Consultant Services Agreement
BACKGROUND

On October 22, 1984, the City Council was asked to
participate in financing the activities of tic &ird:= laiate!► and
the committee which coordinate 's response to
offshore leasing activities.
The Council expressed certain concerns regarding the
request, and those conerns were communicated in a letter, dated
August 15, 1984, to Gary Patton, the Santa Cruz County Supervisor
who submitted the original request. Mr. Patton, in a letter
dated September 14, 1984, answered some, but not all, of the
Council's concerns. Mr. Charter, in his letter,` indicates that
13 cities and counties have agreed to participate in funding Mr.
Charter's work. Laguna Beach and San Clemente have each pledged
$1,000.00. According to Mr. Patton, in the event the entire
contract price cannot be funded, he will perform services for
less than the one —year term of the Agreement.
The Council is also concerned that, in the past, a
large percentage of Mr. Charter's time was devoted to OCS
activities that impacted central and northern California. Mr.
Patton, in his letter, asked Mr. Charter to communicate with me
to explain past and future activities that have been important to
City of Newport Beach. As of this date, I have not been
contacted by Mr. Charter. However, Mr. Charter is currently
involved in at least three projects that are of interest to City
of Newport Beach, and two of those will require significant work
during the next 12 months. To date, Mr. Charter has proven to be
effective at organizing political opposition to Federally —
sponsored projects that would adversely impact Newport Beach and
other coastal cities.
RECOMMENDATION
It is recommended that the City Council commit to
participate to the extent of $1,000 in funding the services of
Richard Charter and the Outer Continental Shelf Local Government
Coordination Program and authorize the Mayor and City Clerk to
execute the Consultant Services Agreement once the form and
content of that agreement have been approved by the City
Attorney.
