FOR
COAST HIGHWAY (SR 1) WIDENING
NEWPORT BOULEVARD (SE 55) TO MacARTHUR BOULEVARD (SR 73)
In consideration for a significant alteration in the scope, complexity
and character of work performed which resulted in expenses incurred beyond the
agreed contract fee, it is mutually agreed by and between the parties hereto to
amend Agreement No. 5151 - 1980 -1 as follows:
1. That CITY shall reimburse the ENGINEER for the additional
actual costs (including labor costs, employee benefits,
overhead and other direct costs) incurred by the ENGINEER
as a result of extra tasks required by the CITY in the
amount of $42,594.59 as set forth in Exhibit "C" attached
hereto.
2. That the net fee of $15,695 as set forth in the original
agreement remains unchanged.
3. That all other terms and conditions of Agreement
No. 5151 - 1980 -1 shall remain in full force and effect.
IN WITNESS WHEREOF said parties have executed this Agreement as
of the date and year first written.

SUBJECT: PACIFIC COAST HIGHWAY WIDENING -- SUPPLEMENTAL AGREEMENT FOR
PROFESSIONAL SERVICES
RECOMMENDATION:
Authorize the Mayor and the City Clerk to execute a
supplemental Agreement with ASL Consulting Engineers for ser-
vices rendered in the preparation of the Pacific Coast Highway
Widening Preliminary Plans and Environmental Impact Statement
(EIS).
DISCUSSION:
On October 14, 1980, the City Council authorized the execution of
a Local Agency /Consultant Agreement to provide preliminary engineering
• plans and the preparation of an environmental document for the improvement
of Pacific Coast Highway in the amount of $180,603. The current agreement
is being funded 86% by Federal Aid Urban (FAU) and 14% with City gas tax
monies.
Over the four -year period, significant alterations in the origi-
nal scope of work and the complexity and character of work performed have
resulted in expenses beyond the original contract fee. The preparation of
the environmental document has taken much longer than anticipated in the
original project schedule. Causes for the delay included added alter-
natives initiated during the public hearing process and not considered in
the original scope of work. Tasks such as transportation analysis, air
quality, and noise had to be readdressed to meet revisions in the State EIR
and Federal EIS guidelines.
As a result of the extra work required in complying with updated
State /Federal requirements, ASL Consulting Engineers and sub- consultant,
Larry Seeman Associates have documented the extra cost at $42,594.59, and
have requested reimbursement.
CalTrans has audited the two firms and has determined that the
• extra work was justified and that the costs were proper and are eligible
for reimbursement.
