Authorize the City Clerk to release the bonds 35 days after Notice of Completion has been recorded in accordance with applicable portions of the Civil Code. 4. Assess liquidated damages in the amount of $6,900. DISCUSSION: The contract for the construction of the Balboa Pier Restroom has been completed to the satisfaction of the Public Works Department. The bid price was $142,583.00 Amount of unit price items constructed 142,583.00 Amount of change orders 6,251.06 Total contract cost $148,834.06 Funds were budgeted in the General Fund, Account No. 02- 7797 -331. Six change orders were issued. The first, in the amount of $978.76, provided for the installation of additional conduits for power and /or telephone service to the gazebo and junior lifeguard trailer. The second, in the amount of $2,665.42, provided for deepening the footings as required by the building permit. The third, in the amount of $2,276.80, pro- vided for additional planter wall and removal and replacement of parking lot curb and sidewalk. The fourth, in the amount of $765.68, provided for heavier wire for the extended electrical service. The fifth, in the amount of $339.20, provided for removal and replacement of a portion of the walk to expose the sewer for maintenance by City forces. The sixth, in the credit amount of (- $775.00) provided for the City supplying the topsoil for the planters. The contractor is Gold Bullion Contracting, Inc., of Chatsworth, California. The contract date of completion was December 31, 1985. Initially, the contractor was delayed in obtaining materials by the extra work resulting from the plan check corrections and inclement weather. A revised completion date of March 20 was established. With respect to such insurance as is afforded by the policy for Bodily Injury and Property Damage Liability, the City of Newport Beach, its officers and employees are additional insureds but only with respect to liability for damages arising out of the ownership, maintenance or use of automobiles (or autos) used by or on behalf of the named insured in connection with the contract designated below. The insurance extended by this endorsement to said additional insured does not apply to bodily injury or property damage arising out of automobiles (1) owned by or registered in the name of an additional insured, or (2) leased or rented by an additional insured, or (3) operated by an additional insured. The insurance afforded the additional named insured(s) shall apply as primary insurance and no other insurance maintained by the City of Newport Beach will be called upon to contribute with insurance provided by this policy. 2. The policy includes the following provision: "The insurance afforded by the policy applies separately to each insured who is seeking coverage or against whom a claim is made or suit is brought, except with respect to the limits of the Insurance Company's liability." 3. The limits of liability under this endorsement for the additional insureds named in paragraph 1 of this endorsement shall be the limits indicated below for either Multi- ple Limits or Single Limit, whichever is indicated by the letter X in the appropriate box. The bidding was competitive. There were nine bidders, of whom the second, third, and fourth lowest have previously done contract work for the City. 2. The prices upon which the original appropriation was based were based on prices bid over a year ago when construction costs were lower. 3. The square -foot price was based on buildings of approximately 25% greater floor area. Generally, as size decreases, unit prices increase. 4. The Balboa Pier Restroom project contains exterior site work, including demolition of the existing building, and construction of a ramp to the Balboa Pier for the handicapped, which were not included in the original appropriation. Gold Bullion General Contracting, Inc., is a new firm incorporated in 1984 by Robert L. Gold and Hugh E. Bullion; however, the owners have also operated a structural steel fabrication and erection business, Atlas Steel, Inc., since 1919. Mr. Gold lists 15 years' experience as a construction manager. Gold Bullion Contracting, Inc., is licensed by the State of California as General Engineering Contractor ( "A" license); General Building Contrator ( 118" license); and Structural Steel Contractor (C -51 license). The list of projects completed or under construction by Gold Bullion Contracting, Inc., includes ice cream stores, fast food restaurants, building additions, and tenant improvements. The list also includes small structural steel projects completed by Atlas Steel, Inc. A check with listed references discloses that Gold Bullion's work is acceptable. DISCUSSION: The 1984 -85 budget contains an appropriation of $125,000 from the General Fund for the Restroom Replacement Program. The first restroom to be • replaced is the one at the base of the Balboa Pier. The location is shown on the attached sketch. The project consists of constructing a new restroom building east of the existing restroom. After the new restroom is completed and in sevice, the old restroom will be demolished and a pedestrian ramp constructed between the pier and the new building. The new building will contain nine unisex toilet rooms opening to the outside, including one for the handicapped; plus five changing rooms opening to the outside. The building will be surrounded by a landscaped patio. Three showers will be provided outside facing the beach. The building is basically the same as three unisex restrooms recently completed at the Huntington Beach State Park beach. The architect for the Balboa restroom is Neil S. Fairbanks of Sacramento, the architect who designed the restroom buildings at Huntington Beach State Park. The project budget is as follows: Construction $110,000 • Architecture Fees 8,250 Miscellaneous Costs 1,250 Contingencies (5% x $110,000) 5,500 Total $125,000 The special conditions provide that the Contractor may fence off the westerly 120 feet of the parking lot for his use. This will result in the loss of 25 parking spaces during the construction period.
