CITY OF NEWPORT BEACH JILL 8 1985 APPROVED 1. Rescind the award of Contract No. 2495 to Sunset Oil, Inc. and direct staff to collect the bidder's bond. 2. Rebudget the contract amount in the FY 1985 -86 appropriation for Street and Alley Slurry Seal Program and rebid the work at the end of summer. DISCUSSION: At 11:00 a.m, on May 1, 1985, the City Clerk opened and read the following bids for this project: BIDDER TOTAL PRICE BID Low, Sunset Oil, Inc., Long Beach $60,337.50 2. Doug Martin Contracting Co., La Habra $67,146.00 3. Roy Allan Slurry Seal Inc., Laguna Hills $67,400.00 The contract was awarded to Sunset Oil, Inc. on May 13, 1985. However, in spite of numerous telephone calls from staff, Sunset Oil, Inc. failed to provide proper payment and faithful performance bonds within ten work days as required by the bid documents. Staff sent letters (copies attached) to Sunset Oil, Inc. on June 19, 1985 and June 21, 1985 regarding Sunset's non- compliance with the bid documents. As of June 28, Sunset Oil, Inc. had not sub- mitted the required bond documents. The project provided for slurry sealing and restriping streets, parking lots and alleys in Newport Shores, Cliff Haven, Newport Heights, Spy Glass Hills Road, University Drive, Balboa Peninsula, and Balboa Island (see attached exhibit). The contract specified that work in the beach areas be completed by June 7, 1985 (before the end of school), with all work to be completed by June 28, 1985. Since none of the work has been done, and because of the extreme dif- ficulty in performing acceptable slurry work in beach areas during the summer, staff recommends that (1) the award of contract to Sunset Oil be rescinded, (2) staff be directed to collect the bidder's bond, and (3) the work be readvertised for bidders at the end of summer. A budget amendment has been prepared amount in the F.Y. 1985 -86 budget in the event Benjamin B. Nolan Public Works Director to appropriate the contract the recommendations are approved. Att. Sufficient funds are available in the current annual Street and Alley Slurry Seal Program, Account No. 02- 3384 -014. A former City slurry seal contractor, Ted R. Jenkins Company, is now conducting business under the name of Sunset Oil Inc. Ted R. Jenkins Company was well - qualified and successfully completed slurry seal contracts for the City. A current check of Sunset's experience references and the State Contractor's License Board has indicated that Sunset (1) has successfully completed similiar projects for other public agencies, and (2) is in good standing, with no legal actions detrimental to their contractor's.license, respectively. This project provides for slurry sealing and restriping streets, parking lots and alleys in Newport Shores, Cliff Haven, Newport Heights, Spy Glass Hills Road, University Drive, Balboa Peninsula, and Balboa Island (see attached exhibit). The slurry seal will extend pavement life and delay the need • for major maintenance or reconstruction. The plans and specifications were prepared by the Public Works Department.
