DISCUSSION:
The contract for the subject project has been completed to the
satisfaction of the Public Works Department.
The bid price was $ 55,623.00
Amount of unit price items constructed $ 58,268.00
Amount of change orders None
Total contract cost $ 58,268.00
Funds were budgeted in the General and Tidelands Funds, Account
Nos. 01- 4185 -200, 23- 4197 -022 and 23- 4197 -028. The Newport Pier railing was
slightly longer than estimated resulting in the increase in the amount of
unit price items constucted.
The contractor is Trautwein Brothers of Newport Beach, California.

INSTRUCTIONS TO BIDDERS
The following contract documents shall be completed, executed and received
by the City Clerk in accordance with NOTICE INVITING BIDS.
1. PROPOSAL

4. BIDDER'S BOND (sum not less than 10% of total bid price)
5. NON- COLLUSION AFFIDAVIT
6. TECHNICAL ABILITY AND EXPERIENCE REFERENCES
except that cash, certified check or cashier's check (sum not less that 10% of
the total bid price) may be received in lieu of the Bidder's Bond. The title
of the project and the words SEALED BID shall be clearly marked on the outside
of the envelope containing the bid.
The City of Newport Beach will not permit a substitute format for the
contract documents listed above. Bidders are advised to review their content
with bonding and legal agents prior to submission of bid.
Bids shall not be received from bidders who are not licensed in accordance
with the provisions of Chapter 9, Division III of the Business and Professions'
Code. The low bidder shall also be required to possess a City of Newport Beach
business license prior to execution of contract.
The estimated quantities indicated in the PROPOSAL are approximate, and
are given solely to allow the comparison of bid totals.
Bids are to be computed upon the estimated quantities indicated in the
PROPOSAL multiplied by unit price submitted by the bidder. In the event of dis-
crepancy between wording and figures, bid wording shall prevail over bid figures.
In the event of error in the multiplication of estimated quantity by unit price,
the correct multiplication will be computed and the bids will be compared with
correctly multiplied totals. The City shall not be held responsible for bidder
errors and omissionsin the PROPOSAL.
Contract documents shall bear signatures and titles of persons authorized
to sign on behalf of the bidder. For corporations, the signatures shall be of
the President or Vice President. For partnerships, the signatures shall be of
a general partner. For sole ownership, the signature shall be of the owner.
In accordance with the California Labor Code (Sections 1770 et seq.), the
Director of Industrial Relations has ascertained the general prevailing rate of
per diem wages in the locality in which the work is to be performed for each
craft, classification, or type of workman or mechanic needed to execute the con-
tract. A copy of said determination is available in the office of the City
Clerk. All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -7981 in-
clusive). The Contractor shall be responsible for compliance with Section
1777.5 of the California Labor Code for all apprenticeable occupations.

COMPREHENSIVE GENERAL LIABILITY INSURANCE ENDORSEMENT
It is agreed that:

Liability, the City of Newport Beach, its officers and employees are additional in-
sureds but only with respect to liability arising out of operations performed by or on
behalf of the named insured in connection with the contract designated below or acts
and omissions of the City of Newport Beach in connection with its general supervision
of such operations. The insurance afforded said additional insured shall apply as
primary insurance and no other insurance maintained by the City of Newport Beach will
be called upon to contribute with insurance provided by this policy.

I. SCOPE OF WORK

The work to be done under this contract consists of (1) constructing
handrails on Newport Pier and (2) constructing groins along the South
Bay Front of Balboa Island. All work necessary for the completion of
these improvements shall be done in accordance with (1) these Special
Provisions, (2) the Plans (Drawings No. H- 5104 -S), (3) the City's
Standard Special Provisions and Standard Drawin s for Public Works

Special Provisions and tandard Drawings may be purchased at the
Public Works Department for Five Dollars ($5). Copies of the Standard
Specifications may be purchased at Building News, Inc., 3055 Overland

II. TIME OF COMPLETION
The Contractor shall complete all work on this contract by May 15,
1986. All work at the Newport Pier site shall be completed within
40 consecutive calendar days. Work at the South Bay Front site shall
be completed within 20 consecutive calendar days.
No work shall begin at either site until a schedule of work at that
site has been approved by the Engineer. No work shall be performed
during spring holiday, March 22 -30.
III. PAYMENT
The prices bid for each item of work shown on the proposal shall be
considered as full compensation for all labor, equipment, materials,
and all other things necessary to complete the work in place, and no
additional allowance will be made therefor.
Payment for all items of work not separately provided for in the pro-
posal shall be included in the prices bid for other items of work.

V. UTILITIES
Electrical and water services shall be maintained at all times to the
restaurant and bait shop and to deck lighting on the Newport Pier.
The Contractor shall submit shop drawings showing methods, materials
and sequences of operation for maintaining temporary or permanent
installations of electrical and water services. Electrical splices
shall be made only in pull boxes.
VI. CONSTRUCTION DETAILS
General
Contractor shall verify all dimensions in the field prior to
fabrication.
The Contractor shall remove, secure and replace utility pipes and
conduit, benches, wooden railings, trash containers, sinks,
etc., which may interfere with construction. The Contractor
shall take necessary precautions to prevent such items or
timber, primer, paint, etc., from falling into or being
disposed of, maliciously or otherwise, into the ocean.

C. Railing and Post Materials
New rails and posts shall be constructed from Coast Region Douglas
Fir Grade No. 1, air dried to 20% maximum. All cutting, such as
trimming, surfacing, boring, etc., shall be done prior to treat-
ment with preservatives. All surfaces of timber shall be
incised.
Because of existing P.C.C. deck and curb displacement and stringer
warp, new posts may not fit up vertically to the pier deck
stringers. In such event, the Contractor shall install full
width (6 ") galvanized steel or dual- treated wooden shims such that
new posts are vertical when bolted tight to their stringer.
Malleable galvanized iron washers shall be used between bolt heads
or nuts and timber posts or stringers.
Railing nail holes may be predrilled to no more than 1/ 8 inch
(0.125 ") diameter.
D. Wood Preservatives
New railings and posts shall be pressure treated with at least
0.25 pcf ammoniacal copper arsenate (ACA) or chromated copper
arsenate prior to construction. Timber used for the groins shall
be dual treated with (1) creosote or creosote coal tar solution
and (2) ACA or CCA prior to construction. Preservative treatments
shall be in accordance with the current requirements of the
American Wood - Preservers' Association standards.
All cuts, bore holes (except predrilled nail holes) and injuries
treated surfaces shall be thoroughly saturated with a field -
treating solution of preservative per AWPA Standard M4.
G. Galvanizing
Nails, bolts, nuts, washers, brackets, etc., shall be galvanized
per Section 210 -3 of Standard Specifications, except that the
minimum weight of coating shall be 50% greater than specified.
VIII. HARBOR WORKERS' AND LONGSHOREMEN'S INSURANCE
The Contractor shall provide insurance which complies with the
United States Longshoremen and Harbor Workers' Act, which provides
benefits greater than the standard Workers' Compensation benefits.

The project provides for the completion of approximately 1,040 linear
feet of wooden handrail around Newport Pier and for the construction of three
groins along the South Bay Front of Balboa Island between Marine Avenue and
Grand Canal. The new handrail is pressure treated with a preservative, and will
be left unpainted so as to minimize future maintenance needs. The existing
handrail (on the shoreward end of the pier) is painted, and is not being altered
under this contract. The 45- foot -long groins should help stabilize the beach
and protect the bulkhead in this area.

DISCUSSION:
The current budget contains appropriations of $24,000 for the
completion of 1,040 linear feet of wooden railings around Newport Pier and
$25,000 for the construction of three groins along the South Bay Front of Balboa
Island. Because of the similar nature of the work, and to effect public bidding
• economies, the Public Works Department staff has combined the projects into one
contract. In addition, staff has included in the contract the repainting of the
existing 1,092 linear feet of railing on Newport Pier. (The repainting was
scheduled to be done this year by General Services Department forces.)
The groins are to be constructed on the South Bay Front between Marine
Avenue and Grand Canal. The 45- foot -long groins should help stabilize the beach
and protect the bulkhead in this area.
Permits for groin construction have been obtained from the California
Coastal Commission and the Corps of Engineers. By accepting the Coastal
Commission's permit, the City had to agree to deposit to the Department of Fish
and Game's enhancement fee account funds adequate to restore a 135 - square -foot
area of the Upper Newport Bay Ecological Preserve.
In the future, sand will be dredged up onto the South Bay Front beach
between the groins as allowed by the City's master dredging permit.
The Engineer's estimate is $56,000. Funds will be used from the
Replenishment of Bay Beaches account, in addition to those mentioned above, if
needed to award this amount.
