Suggested Action
Authorize the Mayor and the City Clerk to execute agreements with the
• two consultants for the preparation of an Environmental Impact Report
and a separate Traffic Analysis for the Cannery Village /McFadden
Square Specific Area Plan.
Background
The City Council, at its meeting of August 27, 1984, authorized the
Mayor and the City Clerk to execute an agreement with The Arroyo Group
for the preparation of the Cannery Village /McFadden Square Specific
Area Plan. It is now anticipated that the Draft Specific Area Plan
will be available for review by the Citizens Ad Hoc Cannery Vil-
lage /McFadden Square Specific Area Plan Committee in late August, with
public hearings to be held by the Planning Commission in October.
Traffic, circulation, and parking have been identified as significant
issues needing to be resolved in the Specific Area Plan. In order to
adequately assess existing conditions and potential impacts from
implementation of the Draft Specific Area Plan, staff requested a
budget amendment to provide funds for a comprehensive traffic analysis
of the study area, including recommendations and design improvements
to the street system, as appropriate, to improve circulation and in-
crease public parking. This budget augmentation was approved by the
City Council at its meeting of May 28, 1985.
Because of the complexities of the traffic and circulation issues,
staff is of the opinion that the environmental document and traffic
analysis should be prepared separately.

Consultant Selection Process
• Staff distributed seven Requests for Proposal for the preparation of
the environmental document and five Requests for Proposal for the
traffic analysis (copies attached). In response, staff received
proposals from five planning consultants and two traffic consultants.
The Requests for Proposals distributed to the planning and traffic
consultants included provisions for the consultants to work together
and incorporate information from the traffic analysis into the en-
vironmental document.
Based upon a comprehensive review of the proposals submitted, staff
recommends that the City Council authorize the Mayor and City Clerk to
enter into agreements for professional services with The Butler /Roach
Group for the preparation of all required environmental documentation
for a fee not to exceed $14,880, and with Austin -Faust Associates for
the preparation of a comprehensive traffic analysis of the study area
for a fee not to exceed $18,580. Also attached for City Council
review and consideration are the Scope of Services submitted by The
Butler /Roach Group and Austin -Faust Associates.
The Butler /Roach Group has prepared several environmental impact
reports for the City in the past. Most recently, Butler /Roach was
• responsible for the Housing Element EIR and the EIR for the Allred
Condominium Project. Austin -Faust Associates has prepared similar
traffic analyses for the cities of Tustin, Irvine, and Santa Ana, as
well as the County of orange. In addition, Mr. Joe Faust, a principal
of the firm and the project manager for this study, was responsible
for the Newport Pier Area Traffic Study prepared in conjunction with
Greer and Company for the City in 1982. His experience in this study
provides exceptional background knowledge in the area.
Staff is of the opinion that both recommended firms are capable of
preparing the required environmental document and the traffic analysis
in a timely and professional manner.

CANNERY VILLAGE /MCFADDEN SQUARE
SPECIFIC AREA PLAN
It is the intent of the City of Newport Beach to retain the services
of a consultant for the preparation of an Environmental Impact Report
for the Cannery Village /McFadden Square Specific Area Plan in confor-
mance with the California Environmental Quality Act (CEQA) , the State
CEQA Guidelines, and City Policy.
The purpose of the Environmental. Impact Report is to assess the
environmental impacts of the proposed Specific Area Plan as developed
by the City and The Arroyo Group, the City's planning consultant. At
a minimum, the following areas shall be addressed in the EIR:
Land Use
° Compatibility /consistency, with the City's General Plan and
• Local Coastal Program, Land Use Plan
a Growth inducing impacts
° Cultural /Historical Resources
° Aesthetics
• Noise
• Geology /Soils
• Air Quality /Energy
• Public Services and Utilities
° Fiscal Impact
° Housing Impact
Traffic and Circulation will be addressed separately by a consultant
• retained by the City. This information will be incorporated into the
EIR. The proposal, in response to this RFP, should include costs for
summary and analysis of the traffic reports, as well as costs of
coordination with the traffic consultant, but not include any costs
for preparation of the traffic studies, which will be contracted for
separately by the City.

Scope of Services
• The consultant shall prepare the Environmental Impact Report for the
Cannery Village /McFadden Square Specific Area Plan. The EIR shall be
prepared in conformance with the California Environmental Quality Act
(CEQA), the State CEQA Guidelines, and City Policy. The EIR shall, at
minimum, include the following sections:
1) Executive Summary: a summary of project impacts, mitigation
measures, and level of significance; and a summary of
project alternatives and environmental impacts.
2) Introduction and Project Description.
3) Environmental Analysis consisting of a description of the
setting, impacts, city policies, and proposed mitigation
measures, and level of significance after mitigation.
4) Summary of environmental effects found not to be signifi-
cant.
5) Cumulative Impacts.
• 6) Analysis of alternatives to the proposed project to include
a range of development iAensi&s from current zoning to
proposals as set forth in the Specific Area Plan.
7) Long -term Implications of. the Project including "The Rela-
tionship Between Local Short -term Uses of Man's Environment
and The Maintenance and Environment of Long -term Productiv-
ity", "Significant Irreversible Environmental Changes Which
Would be Involved in the Proposed Action Should .It be
Implemented ", and "Growth Inducing Impacts."
8) Listing of further environmental documents and actions
needed, including amendments to the City's Local Coastal
Program, General Plan and Zoning Code, as needed.
9) Organizations and persons consulted.
10) Preparers and contributors to the report.

FOR THE PREPARATION OF A TRAFFIC
• AND CIRCULATION SYSTEM STUDY
FOR THE
CANNERY VILLAGE/MCFADDEN SQUARE
SPECIFIC AREA PLAN AREA AND IMMEDIATE VICINITY
It is the intent of the City of Newport Beach to retain the services
of a Traffic Engineering consultant for the preparation of an analysis
of the circulation system and traffic patterns within the Cannery
Village /McFadden Square Specific Area Plan Area and immediate vicini-
ty. The report prepared by the consultant will be incorporated into
the Environmental Impact Report being prepared for the Specific Area
Plan under separate contract.
During the process of preparing the Draft Specific Area Plan, traffic
congestion, lack of convenient parking, and traffic circulation in the
study area were identified as major concerns of the business community
and residents. The Draft Specific Area Plan recognizes the importance
of maximizing public parking, creating wider pedestrian walkways, and
improving the Balboa - Newport Boulevard intersection in the McFadden
• Square area, as well as other parking and circulation concerns in the
study area. In addition t0 the services set forth below, data is to
be collected quantifying these problems, and one or more drawings
showing how the parking and circulation concerns can be resolved shall
be prepared.
Scope of Services
Your proposal should include, at a minimum, the following services:
° Based upon physical counts and existing data, determine current
-summer and winter traffic volumes within the study area and
immediate vicinity.
° Review data contained in the City of Newport Beach "Shuttle
Bus /Trolley Train Study ", and evaluate the proposals contained
therein. Determine whether or not a shuttle system is feasible
and would significantly benefit the City.
• Determine potential traffic volumes based upon current zoning
• standards using the City's traffic model (established and main-
tained by Basmaciyan /Darnell, Inc.).
• Determine anticipated traffic volumes based upon recommended
levels of development as set forth in the Draft Specific Area
Plan using the City's traffic model.
° Analyze existing circulation system within the study area and
immediate vicinity. Determine capacity of system and its ability
to accommodate projected traffic volumes, both under current
zoning and recommended levels of development. Identify any
intersection or other element of the circulation system within
the study area and immediate vicinity, including the Newport
• Boulevard Channel Bridge and Arches Bridge, that may be capacity
constraints.
° Compare capacity of circulation under present configuration and
as provided for in the City's Master Plan of Streets and High-
ways.
° Analyze circulation and parking within the McFadden Square
oceanfront parking lots. Determine potential for improving
circulation and /or increasing public parking.
° Based upon analysis of circulation system and projected traffic
volumes, explore feasibility of improving access /egress within
study area and immediate vicinity and providing additional public
parking, both surface and structured, if it is determined that
the potential exists to improve traffic and parking in the study
area and immediate vicinity, prepare preliminary plans for street
improvements which will show geometrics of revisions.
° Coordinate with City staff, the City's Planning Consultant, and
• Environmental Consultant, as necessary, to incorporate the
findings and recommendations of the Traffic Consultant into both
the Specific Area Plan and Environmental Impact Report.

AGREEMENT FOR PROFESSIONAL SERVICES
Preparation of an Environmental Impact Report for the
Cannery Village/McFadden Square Specific Area Plan

This Agreement is made and entered into the `Nday of 4G,
1985, by and between the CITY OF NEWPORT BEACH, a municipal corporation, herein-
after referred to as "CITY" and the BUTLER /ROACH GROUP, INC., hereinafter
referred to as "CONSULTANT ".
WITNESSETH
WHEREAS, the CITY desires to have an Environmental Impact Report
prepared for the Cannery village/McFadden Square Specific Area Plan; and
WHEREAS, the services of a qualified consultant are necessary in order
to prepare said Environmental Impact Report; and
WHEREAS, requests for proposal were prepared and distributed to
qualified consultants; and
WHEREAS, the proposal of CONSULTANT has been reviewed by the CITY and
found to be responsive to the request for proposal; and
WHEREAS, the CITY desires to accept the proposal of CONSULTANT to
provide professional services in preparing the Environmental Impact Report.
NOW THEREFORE, in consideration of the foregoing, the parties hereto
agree as follows:

I. SERVICES TO BE PERFORMED BY CONSULTANT
CONSULTANT agrees to perform all services specified in the Scope
of Work, attached hereto and marked Exhibit "A ", which is incorporated herein as
though set forth in full. Such services shall be adequate to meet requirements
of the City of Newport Beach relative to the preparation of environmental impact
reports.
CONSULTANT will invoice for services performed at the rates
specified in Exhibit "A ".
CONSULTANT shall maintain all records of expenses and profession-
al services rendered, and shall make such records available for the City to
review.
II. DUTIES OF THE CITY
A. Compensation
The CITY, in consideration of the services to be performed by
CONSULTANT pursuant to this contract agrees to pay CONSULTANT for professional
services a fee, not to exceed $14,890.
B. The CITY shall make available to CONSULTANT such information
and materials as are available to the CITY which relate to services to be
performed by CONSULTANT.
C. The CITY will examine all studies, reports, sketches,
drawings, proposal and other documents presented by CONSULTANT and render in
writing decisions pertaining thereto within a reasonable time so as not to delay
the services of CONSULTANT.
D. The CITY will give prompt written notice to CONSULTANT when
the CITY observes or otherwise becomes aware of any defect in the project.

III. AMENDMENT TO WORK
The CITY reserves the right to order changes in the scope of
services to be performed by CONSULTANT hereunder. In the event that the CITY,
by way of modification, requires CONSULTANT to perform services in addition to
those specified herein, the CITY agrees to pay CONSULTANT the hourly rates
specified in Exhibit "A ".
The CITY further agrees to reimburse CONSULTANT for all reason-
able expenses incurred in the performance of the additional services required by
the amendment. Any amendment to the work hereunder shall be authorized in
writing by the CITY, and CONSULTANT shall perform no work in addition to work
set forth in Exhibit "A" unless authorized in writing by the CITY to do so.
IV. TERMINATION
The CITY reserves the right to terminate this agreement, without
cause, upon seven (7) days' written notice to CONSULTANT. In the event of a
termination of this agreement pursuant to this paragraph, the CITY shall pay
CONSULTANT for all tasks performed to the date of termination in accordance with
the itemization of professional services and expenses therefore, at rates
specified in Exhibit "A ".
V. ASSIGNMENT
CONSULTANT has been selected to perform the work herein on the
basis of its expertise and CONSULTANT is not permitted to delegate the duties
and responsibilities hereunder without first having obtained the prior written
consent of the CITY.
VI. OWNERSHIP OF DOCUMENTS
Drawings, reports, notes, maps, and other documents shall become
the property of the CITY and may be reproduced and utilized as deemed necessary
by the CITY.

VII. LITIGATION SERVICES
In the event of any legal challenge to any action involving the
CITY wherein the validity of the Cannery Village /McFadden Square Specific Area
Plan is an issue, CONSULTANT agrees to cooperate with the CITY and its attorneys
in the defense of said litigation, and agrees to give such testimony as may be
reasonably required by the CITY to establish the validity of said Plan. The
CITY agrees to compensate CONSULTANT for the performance of such services at a
rate equal to the then current billing rate and to reimburse CONSULTANT for all
expenses reasonably incurred during the course of the performance of those
services.
VIII. ARBITRATION
If, at any time, any controversy shall arise between the CITY and
CONSULTANT with respect to any matters arising out of or relating to this
agreement or the breach thereof, which the parties do not promptly resolve, said
controversy shall be decided by arbitration administered by and in accordance
with the rules of the American Arbitration Association, unless the parties
mutually agree otherwise. This agreement to arbitrate shall be specifically
enforceable under the prevailing arbitration law. The award rendered by the
arbitrator shall be final and judgement may be entered upon it in any court
having jurisdiction thereof.
IX. LIMIT OF LIABILITY
The CONSULTANT'S liability to the City arising out of any action
related to performance of this contract shall be limited to the total amount
paid to CONSULTANT hereunder.

X. NOTICES
Any notice required to be given pursuant to the terms and con-
ditions of this agreement, shall be deemed to have been given when deposited in
the U.S. mail, first - class, postage pre -paid, and addressed as follows:

SPECIFIC AREA PLAN
INTRODUCTION
The Butler /Roach Group, Inc. is pleased to submit this proposal
for preparation of the EIR for. the proposed Specific Area Plan.
In addition to our familiarity with the planning and environmental
issues in the Cannery Village /McFadden Square area, The Butler/
Roach Group has extensive relevant experience in preparation
of environmental documentation for plan or program level activities
and plan amendments. Furthermore, we are familiar with City
of Newport Beach policies and procedures for preparation of
environmental documents and related services through our past
• experience in preparation of project- specific and General Plan
amendment EIR's for the City. We frequently support public
agency staff with CEQA compliance requirements, including review
of environmental documents, preparation and distribution of
necessary notices, and preparation of statements of appropriate
findings according to Section 15091 and 15093 of the State CEQA
Guidelines. Finally, we have substantial experience with planning
and implementation In compliance with Coastal Act policies and
Coastal Commission review.
This proposal contains a brief description of our proposed
technical approach, a summary of our qualifications and relevant
experience, a description of the key personnel who will work
on the project, our proposed performance shcedule and cost
estimate,_ and the requested assurances section.
PROPOSED TECHNICAL APPROACH
The environmental Impact Report will be prepared in compliance
• with the California' Environmental Quality Act (CEQA), the State
CEQA Guidelines and City Policy for implementation of CEQA.
The Butler /Roach Group will prepare and distribute the Notice
of Preparation /Non- Statutory Advisement to initiate that public
review period as soon as possible. Additional staff support will
be provided with preparation and distribution of the Notice of
Completion to initiate the public review period for the Draft EIR.

Statement of Facts, or Findings as required by Section 15091

CEQA Guidelines, and, as necessary, the Statement
Considerations referenced in Section 15093 of the
It is our understanding that the proposed Specific Area Plan
is to be a comprehensive community development plan for revital-
ization of the Cannery Village /McFadden Square area. Adoption
of the plan will likely require amendments to the City's General
Plan and Local Coastal Program. Our proposed approach to
preparation of the requisite EIR is to ensure that it will
adequately address the issues necessary for its use for all three
plan adoption /amendment purposes. Our recent experience in
preparation of the EIR for the San Diego Convention Center,
prepared for the San Diego Unified Port District, provided for
environmental analysis and certification for the convention center
and hotel complex, as well as approval of the necessary Port
Master Plan amendment and Coastal Commission approval of the
amendment (the Port Master Plan is the certified equivalent to
an LCP).
In view of the City's planning and development goals for the
Specific Area Plan, the necessary EIR best fits the description
for a "Program EIR", as defined in Section 15168 of the State
CEQA Guidelines. This document will address the cumulative
effects of plan implementation and provide for identification of
mitigation measures that can be incorporated into the plan and
implementing ordinances.
The advantages of this approach include elimination of repetitive
subsequent environmental documents for individual activities,
where those activities comply with the adopted plan and ordi-
nances. The Butler /Roach Group has extensive experience with
the preparation and use of program level EIR's, especially through
its ongoing experience with. the Centre City Development Corpora-
tion (CCDC) in downtown San Diego. Ms. Butler was project
manager for preparation of the Master EIR for approval of three
Centre City Redevelopment Projects in 1979. Since then, The
Butler /Roach Group has provided environmental consultation to
CCDC for monitoring consistency of individual implementation
• activities with the existing environmental documentation and
adopted plans. In the past five years, the majority of develop-
ment within the 200 acre redevelopment area have not required
any additional environmental documentation as a result of the
comprehensive data base and certified documentation established
by the Master EIR and the Supplemental EIR for the 13 -block Santa
Fe Properties Development .Plan, prepared by The Butler /Roach
Group in 1982.

In terms of technical approach, we concur with the RFP's descrip-
tion of the areas of environmental concern and outline of topics
to be included in the EIR. Our preliminary assessment of the
potentially significant issues . include land use and development -
related effects in the areas traffic, circulation and parking;
land use planning - related effects in terms of compatibility and
consistency with the City's General Plan, Land Use Plan and
Local Coastal Program, and potential growth including impacts;
and, potential development - related effects associated with housing,
fiscal impacts and public services /utilities. The EIR will also
address the cumulative effects of plan implementation in terms
of air quality /energy, noise, cultural /historic resources, geology/
soils and water quality, and visual or urban design effects
(aesthetics) . A number of these latter categories may be
anticipated to find no significant adverse impact.
With traffic, circulation and parking being a primary environ-
mental influence in the project area, we anticipate the need for
• early coordination with the City's traffic consultant. The Butler/
Roach Group has a significant amount of experience in reviewing
traffic analyses and incorporating such information in a compre-
hensive environmental impact assessment, especially for revitaliza-
tion efforts in urbanized areas with an established street system.

the proposed Specific Area
Plan. Mitigation measures

The early availability of land use inventories developed for the
planning process and locations of planned uses and densities
will also be important. The interrelationship of the proposed
mix of uses, for example retail /service /commercial and recreation/
marine service /commercial will influence the net effects of develop-
ment in terms of possible vehicle trip reductions and other quali-
tative effects. The value of mixing visitor- serving uses or
residential uses with other districts will be addressed in the
• analysis, as well as the effects of the location and compatibility
of marine industrial uses.

She has provided expert witness testimony in environmental litiga-
tion and recently spoke at the annual conference of the Association
of Environmental Professionals on the preparation of legally

This cost estimate reflects the anticipated level of effort needed
to produce a comprehensive and adequate EIR, in coordination
with the City's traffic consultant and Specific Area Plan work,
which will serve as the base environmental document for all plan
implementation activities.
ASSURANCES
The Butler /Roach Group will establish and maintain the necessary
records and files on the work conducted under this contract to
demonstrate compliance with the terms and conditions of the
contract. We will make such records available to City auditors,
as required. We will retain such records for at least three years
beyond the expiration date of the contract performance period.
