Square Specific Area Plan.
Background
The City Council, at its meeting of August 27, 1984, authorized the
Mayor and the City Clerk to execute an agreement with The Arroyo Group
for the preparation of the Cannery Village /McFadden Square Specific
Area Plan. It is now anticipated that the Draft Specific Area Plan
will be available for review by the Citizens Ad Hoc Cannery Vil-
lage /McFadden Square Specific Area Plan Committee in late August, with
public hearings to be held by the Planning Commission in October.
Traffic, circulation, and parking have been identified as significant
issues needing to be resolved in the Specific Area Plan. In order to
adequately assess existing conditions and potential impacts from
implementation of the Draft Specific Area Plan, staff requested a
budget amendment to provide funds for a comprehensive traffic analysis
of the study area, including recommendations and design improvements
to the street system, as appropriate, to improve circulation and in-
crease public parking. This budget augmentation was approved by the
City Council at its meeting of May 28, 1985.
Because of the complexities of the traffic and circulation issues,
staff is of the opinion that the environmental document and traffic
analysis should be prepared separately.

Consultant Selection Process
C Staff distributed seven Requests for Proposal for the preparation of
the environmental document and five Requests for Proposal for the
traffic analysis (copies attached), In response, staff received
proposals from five planning consultants and two traffic consultants.
The Requests for Proposals distributed to the planning and traffic
consultants included provisions for the consultants to work together
and incorporate information from the traffic analysis into the en-
vironmental document.
Based upon a comprehensive review of the proposals submitted, staff
recommends that the City Council authorize the Mayor and City Clerk to
enter into agreements for professional services with The Butler /Roach
Group for the preparation of all required environmental documentation
for a fee not to exceed $14,880, and with Austin -Faust Associates for
the preparation of a comprehensive traffic analysis of the study area
for a fee not to exceed $18,580. Also attached for City Council
review and consideration are the Scope of Services submitted by The
Butler /Roach Group and Austin -Faust Associates.
The Butler /Roach Group has prepared several environmental impact
reports for the City in the past. Most recently, Butler /Roach was
responsible for the Housing Element EIR and the EIR for the Allred
C Condominium Project. Austin -Faust Associates has prepared similar
traffic analyses for the cities of Tustin, Irvine, and Santa Ana, as
well as the County of Orange. In addition, Mr. Joe Faust, a principal
of the firm and the project manager for this study, was responsible
for the Newport Pier Area Traffic Study prepared in conjunction with
Greer and Company for the City in 1982. His experience in this study
provides exceptional background knowledge in the area.
Staff is of the opinion that both recommended firms are capable of
preparing the required environmental document and the traffic analysis
in a timely and professional manner.

C ENVIRONMENTAL IMPACT REPORT
FOR THE
CANNERY VILLAGE /MCFADDEN SQUARE
SPECIFIC AREA PLAN
It is the intent of the City of Newport Beach to retain the services
of a consultant for the preparation of an Environmental Impact Report
for the Cannery Village/McFadden Square Specific Area Plan in confor-
mance with the California Environmental Quality Act (CEQA), the State
CEQA Guidelines, and City Policy.
The purpose of the Environmental Impact Report is to assess the
environmental impacts of the proposed Specific Area Plan as developed
by the City and The Arroyo Group, the City's planning consultant. At
a minimum, the following areas shall be addressed in the EIR:
Land Use
° Compatibility /consistency. with the City's General Plan and
C Local Coastal Program, Land Use Plan
° Growth inducing impacts
° Cultural /Historical Resources
° Aesthetics
° Noise
° Geology /Soils
° Air Quality/Energy
° Public Services and Utilities
° Fiscal Impact
° Housing Impact
Traffic and Circulation will be addressed separately by a consultant
retained by the City. This information will be incorporated into the
EIR. The proposal, in response to this RFP, should include costs for
summary and analysis of the traffic reports, as well as costs of
coordination with the traffic consultant, but not include any costs
for preparation of the traffic studies, which will be contracted for
separately by the City.

Each proposal submitted must include the following:
1) Cover letter and introduction, not to exceed two pages, to
include name, address and telephone number of person or
persons who may be contacted and 'who are authorized to
represent the proposer.
2) Description of the study approach.
3) The estimated date on which your agency could begin provid-
ing the described services, and the length of time required
to complete the various tasks included within the Scope of
services.

4) Names and resumes of staff who would be directly involved in
providing the services, including the designation of a
specific project manager. This requirement includes any
sub- consultants proposed for any portion of the Scope of
Services.
5) Identification of qualifications and previous experience in
providing similar services.
6) Line item budget and budget narrative in sufficient detail
to identify involvement of all members of the project team,
including billing rates for personnel, printing, attendance
at public hearings, etc.
7) Assurances Section - Each proposal must contain assurances
that the consultant will establish and maintain such records
and files as are necessary to demonstrate that the terns and
conditions of the contract have been complied with, make
such records available to City auditors as required, and
retain such records for at least three years beyond the
expiration date of the contract performance period.

FOR THE PREPARATION OF A TRAFFIC
AND CIRCULATION SYSTEM STUDY
FOR THE
C CANNERY VILLAGE /MCFADDEN SQUARE
SPECIFIC AREA PLAN AREA AND IMMEDIATE VICINITY
It is the intent of the City of Newport Beach to retain the services
of a Traffic Engineering consultant for the preparation of an analysis
of the circulation system and traffic patterns within the Cannery
village /McFadden Square Specific Area Plan Area and immediate vicini-
ty. The report prepared by the consultant will be incorporated into
the Environmental Impact Report being prepared for the Specific Area
Plan under separate contract.
During the process of preparing the Draft Specific Area Plan, traffic
congestion, lack of convenient parking, and traffic circulation in the
study area were identified as major concerns of the business community
and residents. The Draft Specific Area Plan recognizes the importance
of maximizing public parking, creating wider pedestrian walkways, and
improving the Balboa - Newport Boulevard intersection in the McFadden
C Square area, as well as other parking and circulation concerns in the
study area. In addition to the services set forth below, data is to
be collected quantifying these problems, and one or more drawings
showing how the parking and circulation concerns can be resolved shall
be prepared.
Scope of Services
Your proposal should include, at a minimum, the following services:
° Based upon physical counts and existing data, determine current
-summer and winter traffic volumes within the study area and
immediate vicinity.
° Review data contained in the City of Newport Beach "Shuttle
Bus /Trolley Train Study ", and evaluate the proposals contained
therein. Determine whether or not a shuttle system is feasible
and would significantly benefit the City.
• Determine potential traffic volumes based upon current zoning
standards using the City's traffic model (established and main-
tained by Basmaciyan /Darnell, Inc.).
• Determine anticipated traffic volumes based upon recommended
levels of development as set forth in the Draft Specific Area
Plan using the City's traffic model.
° Analyze existing circulation system within the study area and
immediate vicinity. Determine capacity of system and its ability
to accommodate projected traffic volumes, both under current
zoning and recommended levels of development. Identify any
intersection or other element of the circulation system within
the study area and immediate vicinity, including the Newport
Boulevard Channel Bridge and Arches Bridge, that may be capacity
constraints.
° Compare capacity of circulation under present configuration and
as provided for in the City's Master Plan of Streets and High-
ways.
° Analyze circulation and parking within the McFadden Square
oceanfront parking lots. Determine potential for improving
circulation and /or increasing public parking.
° Based upon analysis of circulation system and projected traffic
volumes, explore feasibility of improving access /egress within
study area and immediate vicinity and providing additional public
parking, both surface and structured. If it is determined that
the potential exists to improve traffic and parking in the study
area and immediate vicinity, prepare preliminary plans for street
improvements which will show geometrics of revisions.
° Coordinate with City staff, the City's Planning Consultant, and
Environmental Consultant, as necessary, to incorporate the
findings and recommendations of the Traffic Consultant into both
the Specific Area Plan and Environmental Impact Report.

AGREEMENT FOR PROFESSIONAL SERVICES
Preparation of a Traffic Analysis for the
Cannery village/McFadden Square Specific Area Plan
and Surrounding Areas.
This Agreement is made and entered into the / r day of IA us r
1955, by and between the CITY OF NEWPORT BEACH, a municipal corporation, herein-
after referred to as "CITY" and the AUSTIN -FOUST ASSOCIATES, INC., hereinafter
referred to as "CONSULTANT ".
WITNESSETH
WHEREAS, the CITY desires to have a Traffic Analysis prepared for the
Cannery Village /McFadden Square Specific Area Plan and surrounding areas; and
WHEREAS, the services of a qualified consultant are necessary in order
to prepare said Traffic Analysis; and
WHEREAS, requests for proposal were prepared and distributed to
qualified consultants; and
WHEREAS, the proposal of CONSULTANT has been reviewed by the CITY and
found to be responsive to the request for proposal; and
WHEREAS, the CITY desires to accept the proposal of CONSULTANT to
provide professional services in preparing the Traffic Analysis.
NOW THEREFORE, in consideration of the foregoing, the parties hereto
agree as follows:

I. SERVICES TO BE PERFORMED BY CONSULTANT
CONSULTANT agrees to perform all services specified in the Scope
of work, attached hereto and marked Exhibit "A ", which is incorporated herein as
though set forth in full. Such services shall be adequate to meet requirements
of the City of Newport Beach relative to the preparation of traffic analyses.
CONSULTANT shall maintain all records of expenses and profession-
al services rendered, and shall make such records available for the City to
review.
II. DUTIES OF THE CITY
A. Compensation
The CITY, in consideration of the services to be performed by
CONSULTANT pursuant to this contract agrees to pay CONSULTANT for professional
services a fee, not to exceed $18,580.
B. The CITY shall make available to CONSULTANT such information
and materials as are available to the CITY which relate to services to be
performed by CONSULTANT.
C. The CITY will examine all studies, reports, sketches,
drawings, proposal and other documents presented by CONSULTANT and render in
writing decisions pertaining thereto within a reasonable time so as not to delay
the services of CONSULTANT.
D. The CITY will give prompt written notice to CONSULTANT when
the CITY observes or otherwise becomes aware of any defect in the project.
III. AMENDMENT TO WORK
The CITY reserves the right to order changes in the scope of
services to be performed by CONSULTANT hereunder. In the event that the CITY,
by way of modification, requires CONSULTANT to perform services in addition to

those specified herein, the CITY agrees to pay CONSULTANT the hourly rates
specified in Exhibit "A ".
The CITY further agrees to reimburse CONSULTANT for all reason-
able expenses incurred in the performance of the additional services required by
the amendment. Any amendment to the work hereunder shall be authorized in
writing by the CITY, and CONSULTANT shall perform no work in addition to work
set forth in Exhibit "A" unless authorized in writing by the CITY to do so.
IV.
The CITY reserves the right to terminate this agreement, without
cause, upon seven (7) days' written notice to CONSULTANT. In the event of a
termination of this agreement pursuant to this paragraph, the CITY shall pay
CONSULTANT for all tasks performed to the date of termination in accordance with
the itemization of professional services and expenses therefore, at rates
specified in Exhibit "A ".
V. ASSIGNMENT
CONSULTANT has been selected to perform the work herein on the
basis of its expertise and CONSULTANT is not permitted to delegate the duties
and responsibilities hereunder without first having obtained the prior written
consent of the CITY.
VI. OWNERSHIP OF DOCUMENTS
Drawings, reports, notes, maps, and other documents shall become
the property of the CITY and may be reproduced and utilized as deemed necessary
by the CITY.
VII. LITIGATION SERVICES
In the event of any legal challenge to any action involving the
CITY wherein the validity of the Cannery Village /McFadden Square Specific Area
Plan is an issue, CONSULTANT agrees to cooperate with the CITY and its attorneys

in the defense of said litigation, and agrees to give such testimony as may be
reasonably required by the CITY to establish the validity of said Plan. The
CITY agrees to compensate CONSULTANT for the performance of such services at a
rate equal to the then current billing rate and to reimburse CONSULTANT for all
expenses reasonably incurred during the course of the performance of those
services.
VIII. ARBITRATION
If, at any time, any controversy shall arise between the CITY and
CONSULTANT with respect to any matters arising out of or relating to this
agreement or the breach thereof, which the parties do not promptly resolve, said
controversy shall be decided by arbitration administered by and in accordance
with the rules of the American Arbitration Association, unless the parties
mutually agree otherwise. This agreement to arbitrate shall be specifically
enforceable under the prevailing arbitration law. The award rendered by the
arbitrator shall be final and judgement may be entered upon it in any court
having jurisdiction thereof.
IX. LIMIT OF LIABILITY
The CONSULTANT'S liability to the City arising out of any action
related to performance of this contract shall be limited to the total amount
paid to CONSULTANT hereunder.
X. NOTICES
Any notice required to be given pursuant to the terms and con-
ditions of this agreement, shall be deemed to have been given when deposited in
the U.S. mail, first - class, postage pre -paid, and addressed as follows:

We recently examined the feasibility of various TSM strategies to increase Coast
Highway capacity through Corona del Mar, and some of the concepts examined
there may be applicable to the Cannery Village/ McFadden Square area. AFA's
broad range of experience in traffic and transportation includes specific plan
studies, and as an example we are currently completing two such traffic
analysis efforts in the City of Tustin, one of which involves redevelopment in a
presently developed area.

'brainstorm' ideas and alternative concepts. This workshop will build upon
• previous work, collecting ideas from personnel with considerable knowledge and
practical experience in the area.
2. Existing data including both traffic volumes and parking inventory will
be assimilated, reviewed and updated as necessary. It is recognized at the
outset that considerable data is available and an intensive new data collection
effort is not anticipated.
3. The maximum capacity of the existing circulation system will be
determined. Potential improvements to existing capacity will be identified and
evaluated with respect to their feasibility and cost effectiveness.
4. The entire range of TSM strategies will be examined to identify
practical and achievable improvements which can enhance roadway capacity.
These strategies include parking management as well as conventional traffic
engineering improvements. The impact parking management can have toward
reduction or shifting of peak hour trip patterns will be determined.

6. Existing traffic model forecasts! will be reviewed, verified, and updated
as necessary to represent base conditions using a small area traffic analysis
technique. The travel demand created by incremental development scenarios
will then be estimated. The extent to which these increases are balanced by
marginal increases in capacity as identified in Task 3 will then be assessed.
7. Sources for financing circulation improvements will be identified
including any shortfall which may arise between cost of needed capacity
improvements and reasonably available funding.
8. A preliminary plan drawn at 40 scale for the recommended
improvements of the intersection of Newport and Balboa Boulevards. This plan
will show existing conditions and proposed modificatons in sufficient detail to
ensure feasibility and permit an accurate estimate of construction cost and
right -of -way requirements. This plan shall form the basis for future
preparation of PS &E for the project implementation.

10. The feasibility for formation of publicly or privately owned and
operated parking districts to acquire land and build parking facilities will be
investigated, and their appropriateness for the Specific Plan Area determined.
• 11. Off - street parking demand for the various type of land use proposed
in the study area will be determined from actual practice and any influence to
be expected from parking management identified. This data will be used as the
basis for establishing realistic parking requirements appropriate for this
Specific Plan Area.
The final report will be written in suitable format for inclusion into the
EIR for the Specific Area Plan, and will include a 40 -scale preliminary
improvement plan for the intersection of Newport Blvd and Balboa Blvd.
Time Schedule
AFA is available to commence work on this study immediately, and
estimates a period of 10 weeks for preparation of a draft report.

COMPENSATION
AFA will perform the scope of services outlined above on a time and
