3. Authorize the City Clerk to release the bonds 35 days after the
Notice of Completion has been recorded in accordance with
applicable portions of the Civil Code.
DISCUSSION:
The Contract for the construction of West Newport Park has been
completed to the satisfaction of the Public Works Department.
The bid price was $597,165.15
Amount of unit price items constructed 514,219.32
Amount of change orders 49,801.19
Total Contract cost $564,020.61
Seven Change Orders were issued. The first resulted in a cost
reduction of $52,054.76. It provided for deletion of much of the underground
drainage system, mow strips and headers which would be affected by the Coast
Highway noise wall construction and added the grading, irrigation and turf to
the westerly City limit. It also provided for a change in the type of Palm
trees and an upgrading of the irrigation controllers. The second, in the amount
of $10,144.42, provided for construction of the power and telephone conduits and
transformer vault, changing the lighting conduit from 1 -inch to 1 1/4 -inch and
deletion of the concrete encasement of the lighting conduits. The third, in the
amount of $272.00, provided for removal of an abandoned 6 -inch steel water main.
The fourth, in the amount of $1,260.00, provided for a change in the Palm trees
around the restroom from Chamerops Humilis to Trachycarpus Fortunei. The fifth,
in the amount of $3,960.00, provided for a 90 -day plant establishment and
maintenance period for the westerly Park extension. The sixth, in the amount of
$1,631.87, provided for a change in the type of floor drains in the restrooms.
The seventh, in the amount of $4,480.00, provided for hand watering of the
plantings until the Edison power became available for the automatic controllers.

Funds for the project were budgeted in the General Fund, Account Nos.
02- 7797 -331, 02- 3297 -436 and 02- 5697 -435, the Park and Recreation Fund, Account
No. 10- 7797 -002 and the Building Excise Tax, Account No. 27- 7697 -297.
The Contractor is Vally Crest Landscape, Inc. of Santa Ana.
The Contract date of completion was April 30, 1988. Completion was
delayed by the extra work, the Park extension and the Edison Company
undergrounding project. The restrooms and parking lots were opened for public
use on May 25, 1988. The landscape maintenance was complete on June 30, 1988.

GRANT OF EASEMENT TO SOUTHERN CALIFORNIA EDISON COMPANY
RECOMMENDATION:
Authorize the Mayor and City Clerk to execute a Grant of Easement for
a portion of the subject site for the purposes of serving power to the
park.
DISCUSSION:
As part of the West Newport Park construction an Edison Company trans-
is former is required to be installed on site. Because of Company policy and
Public Utilities Commission Regulations the transformer and its appurtenances
must be located upon or within a recorded easement.
The size of the required easement is 12 feet by 12 feet. The electri-
cal conduit and wiring have already been installed as part of the Park construc-
tion contract. The transformer will be installed by the Edison Company once the
easement has been executed.
A sketch showing the easement is attached for reference.

ADDENDUM NO. 1 dated August 27, 1987 is hereby superseded. Bidders shall pro-
pose to complete Contract No. 2537 in accordance with the Plans and
Specifications as modified by this ADDENDUM NO. 2:
A. PROPOSAL
1. All bids shall be submitted on a revised PROPOSAL dated September 3,
1987.
B. SPECIAL CONDITIONS
Section III, IV, V, and XIV of the Special Conditions are amended to read as
follows:
III. LOCATION AND SCOPE OF WORK
Paragraph III.E.l.a is hereby deleted. The City will provide
electrical power from the power company source to the meter loca-
tion. Riser and connection charges charged by the Southern
California Edison Company will be paid by the City.
IV. LOW BID
A. The complete project consists of constructing all items of
work listed the Proposal. Each bidder must include a price
for each and every one of the items listed in the propgsal.
B. The total price bid for all items in the Proposal shall
be used for the purpose of determining the lowest bid.
V. AWARD OF THE CONTRACT
All bidders must submit a price for each one of the items of
work listed on the Proposal; however, the City specifically
reserves the right to delete from the award of the contract
any or all of Items Nos. 4, 31, 33, 34 of the Proposal.
If the City exercises its right to omit one or more of the
items listed, it will so specify at the time the contract if
awarded.
For the purpose of determining the lowest responsible bid, the
total price bid for all of the items on the Proposal will be
used.

XIV. MATERIALS
Add Paragraph C to Section XIV. MATERIALS as follows:
C. The Contractor shall select from the project site six
existing Washingtonia Robusta palm trees, 20' to 30' in
height, for replanting in the project area. City will
remove the remainder of the existing Washingtonia Robusta
trees from the project sites.
The six Washingtonia Robusta palm trees to be replanted in
the project area shall be dug up, transported, and replanted
by .the Contractor.
C. PLANS
1. On irrigation legend, page L -16, Toro pop -up heads shall be changed
from 570 -P to 570 -6P.
2. a. Catch basins in parking lot shall have traffic grates.
b. Catch basins in landscaped areas shall have parkway grates.
c. All catch basin grates shall be black.
3. Channel drains are shown on Sheet L -5.
a. NDS channel drains are indicated by a series of dashes.
b. PVC drains are indicated by a series of dots.
4. a. The partition in the men's room between the urinal and the wash
basin is precast concrete similar in height and construction to the
toilet partitions in the men's room, except that it extends only
2' -0" from the wall.
b. The partitions inthe women's room are precast concrete.
c. The doors on the stalls in the women's room are phenolic resin.
0. LANDSCAPING AND SITE WORK SPECIFICATIONS
1. Section 12.03 SAND shall be changed to read as follows:
Sand for play equipment area shall be beach sand taken
from a site at the mouth of the Santa Ana River. The
Contractor shall be responsible for excavating, transporting,
and spreading the sand. The sand shall be clean and satis-
factory to the City, but the sand need not be washed.

by the City Clerk in accordance with NOTICE INVITING BIDS:

except that cash, certified check or cashier's check (sum not less than 10% of
the total bid price) may be received in lieu of the Bidder's Bond. The title of
the project and the words SEALED BID shall be clearly marked on the outside of
the envelope containing the bid.
The City of Newport Beach will not permit a substitute format for the
contract documents listed above. Bidders are advised to review their content
with bonding and legal agents prior to submission of bid.
Bids shall not be received from bidders who are not licensed in accordance
with the provisions of Chapter 9, Division.III of the Business and Professions'
Code. The low bidder shall also be required to possess a City of Newport Beach
business license prior to execution of contract.
The estimated quantities indicated in the PROPOSAL are approximate, and are
given solely to allow the comparison of bid totals.
Bids are to be computed upon the estimated quantities indicated in the
PROPOSAL multiplied by unit price submitted by the bidder. In the event of
discrepancy between wording and figures, bid wording shall prevail over bid
figures. In the event of error in the multiplication of estimated quantity by
unit price, the correct multiplication will be computed and the bids will be
compared with correctly multiplied totals. The City shall not be held respon-
sible for bidder errors and omissions in the PROPOSAL.
Contract documents shall bear signatures and titles of persons authorized
to sign on behalf of the bidder. For corporations, the signatures shall be of a
corporate officer or an individual authorized by the corporation. For part-
nerships, the signatures shall be of a general partner. For sole ownership, the
signature shall be of the owner.
In accordance with the California Labor Code (Sections 1770 et seq.), the
Director of Industrial Relations has ascertained the general prevailing rate of
per diem wages in the locality in which the work is to be performed for each
craft, classification, or type of workman or mechanic needed to execute the
contract. A copy of said determination is available in the office of the City
Clerk. All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -7981
inclusive). The Contractor shall be responsible for compliance with Section
1777.5 of the California Labor Code for all apprenticeable occupations.

CONTRACT
THIS AGREEMENT, entered into this day of , 19 b /,
by and between the CITY OF NEWPORT BEACH, hereinafter "City,' and
VALLEY CREST LANDSCAPE. INC. hereinafter "Contractor, "is made with
reference to the following facts:
(a) City has heretofore advertised for bids for the following
described public work:

(b) Contractor has been determined by City to be the lowest responsi-
ble bidder on said public work, and Contractor's bid, and the compensation set
forth in this contract, is based upon a careful examination of all plans and
specifications by Contractor,
NOW, THEREFORE, the parties hereto agree as follows:
1. Contractor shall furnish all materials and perform all of the work
for the construction of the following described public work:

shall perform and complete this work in a good and workmanlike manner, and in
accordance with all of the contract documents.
2. As full compensation for the performance and completion of this

NINETY SEVEN THOUSAND ONE HUNDRED SIXTY -FIVE DOLLAR A 15/1 ($ 597,165.15 ).
This compensation includes 1 any loss or damage arising from the nature of the
work; (2) any loss or damage arising from any unforeseen difficulties or obstruc-
tions in the performance of the work; (3) any expense incurred as a result of any
suspension or discontinuance of the work; but excludes any loss resulting from
earthquakes of a magnitude in excess of 3.5 on the Richter Scale and tidal waves,
and which loss or expense occurs prior to acceptance of the work by City.
3. All of the respective rights and obligations of City and Contractor
are set forth in the contract documents. The contract documents are incorporated
herein by reference as though set out in full and include the following:

were not written in words; no price was bid for Item No. 47; and the bid price
for Items 18, 36, & 46 could not be determined with certainty.
Valley Crest Landscape, Inc. is the Contractor for the City's current
Bonita Creek Park construction contract, and has satisfactorily completed other
projects for the City.
The project consists of park improvements, a rest room, three metered
parking lots providing a total of 58 off - street parking spaces, and security
lighting in the parking lots. The location is shown on the attached sketch.
