The public beach restrooms improvement and replacement program recommended by the former
Newport Beautification Citizens Advisory Committee appears to have deteriorated to a very
slow pace since June 1984 when it was initiated.
At the present date only.1 new restroom at Balboa Pier has entered into the construction
stage, the schedule for this badly needed unit was for completion by June 15, 1986.
The start of construction on a new restroom at the 15th Street location and renovation of
the present Washington Street restroom has been delayed for various reasons until the last
quarter of 1986, with hoped for completion prior to the summer of 1987.
The original 5 year program concept appears to be more likely a 10 year program unless the
construction pace is accelerated. On this point the Quality of Life Advisory Committee
feels that every effort should be made to place on top priority the construction of the new
restroom at Newport Pier which is urgently needed. The logical location for this new rest-
room would be across the entrance to the pier in the vacant area just north of the Marine
Department Headquarters. This location would be similar and counter -part to the new unit
nearing completion at the Balboa Pier. After the present old restroom is demolished, a
small landscaped park with a few benches should be developed in its place. This would
open up a greater ocean vista. A landscaped approach to the Dory Fisherman area would then
be possible and appropriate.
At this stage there does not seem to be any valid reason to hold up construction pending
development of the approved McFadden Square program which could be a long time from now.
Actually the restroom facility would not have any close relationship to any future develop- 'I
ment that may occur in McFadden Square.
The Committee also recommends an early review of the Parks, Beaches and Recreation Depart-
ments and the General Services restroom improvement report of July 1984 to establish an up
to date prioritized list of beach restroom replacements, both existing locations and new
locations based on need and volume use factor.
Also the Committee feels a close liaison between the design architect and the city depart-
ments involved would be beneficial.
Members of the Committee are available for any necessary discussions on this essential and
urgently needed program.

RECOMMENDATION:
1. Reject all bids received on March 26, 1986.
2. Direct the staff to carry over the project to Fiscal Year 1986 -87,
including the appropriation of sufficient additional funds to
complete the project.
DISCUSSION:
In a memo to the City Council on April 14, 1986, the staff recommended
that Contract 2550 be awarded to Peter S. Rodgers Home Improvement, the properly -
licensed and bonded low bidder. Shortly before the Council meeting, the staff
received information that caused it to recommend delaying the award until the
low bidder's qualifications could be checked further.
Had the contract been awarded on April 14, the project would have been
scheduled for completion by August 15; however, the delay in awarding the
contract means that the work would extend at least two weeks further into the
heart of the busiest season at the beach.
In addition, construction during the most crowded season at the beach
would increase the City's potential exposure to liability for damages from
construction operations, compared to the potential exposure in the off season
when there are fewer people around the construction sites.
The second and third lowest bids were very close, both being about
$30,000 over the lowest bid. If for any reason the contract was to be awarded
to either the second or third lowest bidder, an additional budget amendment of
$30,000 would be required in addition to the budget amendment of $66,500
approved on April 14, 1986.
The bids received on March 26, 1986, indicate that the restroom
replacement program is underfunded. The program was originally based on
construction prices for restrooms constructed at the Huntington Beach State

Beach Park at a time when construction was slow and bid prices were lower than
at present. The bids for Contract 2550 were opened after the preliminary
1986 -87 budget was printed; however, at the time the City Council reviews the
1986 -87 capital projects, the staff intends to recommend an increase in the
appropriation for the restroom replacement program.

RECOMMENDATION:
Award Contract No. 2550 to Peter S. Rodgers Property Improvement
in the amount of $212,388; and authorize the Mayor and the City
Clerk to execute the contract.
DISCUSSION:
At 11:00 a.m. on March 26, 1986, the City Clerk opened and read four
bids:

The low bid is 10% over the architect's estimate of $193,000.
Peter S. Rodgers is properly licensed; however, he has not worked for
the City previously. His experience appears to be primarily in the field of
single - family residences.
The subject project consists of replacing the existing 15th Street
ocean front restroom with a new building located between the existing building
• and the ocean front sidewalk; and refurbishing the existing Washington Street
restroom. The locations are shown on the attached sketch. Copies of the plans
are available for review at the Public Works Department; and a complete set will
be placed in the Council Conference room for review.

• On February 24, 1986, the staff reported to the Council that there was
a shortage of funds in the appropriation, and that after bids had been received
the staff would process a budget amendment for Council consideration.
The budget for the project is as follows:

Miscellaneous and contingencies (5 %) 10,600
Total Project Budget $232,563
The status of the restroom replacement program appropriation is as
follows:

The estimate above indicates a funding shortage of approximately

Neil S. Fairbanks of Sacramento, who also designed the Balboa Pier restroom.

The 1985 -86 budget contains an appropriation of $325,000 for a
restroom replacement program. Replacement of the Balboa Pier restroom is under
way. The plan is to replace the 15th Street restroom and to refurbish the
Washington Street restroom with the balance of the appropriation. The
locations of the restrooms are shown on the attached sketch.
The subject project consists of replacing the 15th Street restroom
with a new building located between the present building and the ocean front
sidewalk, and refurbishing the existing Washington Street restroom.
The new 15th Street building will be the same as the new building
being completed at the Balboa Pier site. It will contain nine unisex toilet
rooms opening to the outside, including one for the handicapped, plus five
changing rooms opening to the outside. The building will be surrounded by a
landscaped patio and will have three outside showers facing the beach. The old
building will be kept in operation until the new restroom is placed in service.
The Washington Street restroom and surrounding patio will be refur-
bished. Plumbing fixtures will be replaced; new doors will be installed on the
stalls, and the exterior patio area will be rebuilt. The restroom will be out
of service while the interior modifications are being made.
