RECOMMENDATIONS: APPROVED
Approve an entry agreement for construction of a new sewer main
across 116 Kings Place; authorize the Mayor and the City Clerk to execute
the agreement; and.._d..irect.._the City Clerk to have thefagreement recorded
with the Orange County Recorder.` /
DISCUSSION:
Mr. and Mrs. Ward have dedicated a 10 -foot sewer easement along ,zP(
the southerly boundary of Lot 2, Tract 1219 in order to permit relocation
of the existing sewer main crossing their property. This sewer relocation
is necessary as they have constructed an addition to their residence which
encroaches over the existing sewer main.
Along with the dedication, they have also executed an entry
agreement which allows the City to enter onto their property to construct
a new sewer main.
The City and property owner will split the construction cost in
half as the City will benefit from the new sewer connection in Dover Drive.

SUBJECT: ENTRY AGREEMENT FOR SEWER CONSTRUCTION FOR 116 KINGS PLACE
Attached are the following:
1. Original and two copies of an Entry Agreement.
The Public Works Department has reviewed the agreement and has found
it to be in order.
Action requested:

a. -- Approve the agreement as to form.
b. Forward all copies to City Clerk.
2. City Clerk
a. Present agreement to City Council for approval.
b. Have the Mayor execute the agreement.
c. Retain original of agreement for your files and return
all copies to the Public Works Department.

ENTRY AGREEMENT
THIS ENTRY AGREEMENT is made and entered into this c5?��7- day of
1986, by and between DONALD R. WARD AND BARBARA G. WARD,
-'hereinaft r referred to as "OWNERS ", and the "CITY OF NEWPORT BEACH ", a
municipal corporation, hereinafter referred to as "CITY ".
WITNESSETH•
WHEREAS, OWNERS own certain real property located at 115 Kings Place in
the City of Newport Beach, County of Orange, State of California, as shown on
Exhibit "A ", attached hereto and by this reference made a part hereof, and
hereinafter referred to as "premises "; and
WHEREAS, CITY desires to enter upon the premises to construct a new sewer
main and all appurtenances along the southerly boundary of "premises ".
NOW, THEREFORE, in consideration of the foregoing, the parties hereto
agree as follows:
I. Right of Entry
OWNERS hereby grant to CITY, its agents and employees, the right to
enter upon premises for the construction of a new sewer main and appurtenances
in the sewer easement located along the southerly boundary of premises, as
shown on Exhibit "A ".
II. Construction and Maintenance
The construction of the new sewer may require removal of some trees
and landscape, which will be replaced by OWNER.
III. Term
The term of this entry permit shall continue until construction is
complete, but in no event later than January 1, 1995.

IN WITNESS WHEREOF, the parties hereto have executed this Entry Agreement
as of the day and year first above written.
