SUBJECT: REDEVELOPMENT OF SANTA ANA HEIGHTS
ACTION: If desired, approve and authorize Mayor and
City Clerk to execute a Cooperative Agreement
with the County of Orange regarding redevelop-
ment by the County of an area within the terri-
torial limits of the City.
BACKGROUND: This Agreement is a companion to Ordinance
86 -11 and commits the County to prepare a Redevelopment
Plan which is consistent with the City's Ordinance. The
Agreement also commits the City to consider an Ordinance
approving the Redevelopment Plan on July 14, 1986 which
meets a deadline for setting this year as the base year for
tax increment financing.
This Agreement also provides the City's approval for
implementation of the Purchase Assurance and acoustical
insulation programs in the area of the Anniversary Tract
and the Vista Bahia Condominiums.
The Agreement is self - explanatory.

COOPERATIVE AGREEMENT AMONG THE COUNTY OF
ORANGE, THE ORANGE COUNTY DEVELOPMENT AGENCY
AND THE CITY OF NEWPORT BEACH REGARDING
AUTHORIZATION BY THE CITY OF THE REDEVELOP-
MENT OF AN AREA WITHIN ITS TERRITORIAL LIMITS
BY THE COUNTY
This Agreement by and among the County of Orange (the "County "),
the Orange County Development Agency (the "Agency ") and the City of
Newport Beach, a municipal corporation, (the "City ") is dated for
purposes of identification only this a/ - day of
1986, and is made with reference to the following:
RECITALS:
A. The County of Orange and the City of Newport Beach have
entered into a Stipulation for Termination of Litigation relating to
John Wayne Airport and the Annexation agreement relating to the
Bayview Project, which together promote cooperation between the City
and County in the use of California Community Redevelopment Law to
implement the Land Use Compatibility Program for John Wayne Airport in
an area southerly of the Airport commonly known as "Santa Ana
Heights."
B. The easterly portion of Santa Ana Heights is almost
completely surrounded by the territorial limits of the City and is
within the City's recognized Sphere of Influence. The City expects to
annex this area to its territorial limits at some future date.
C. The County of Orange intends to utilize methods available
under Redevelopment Law to finance the Purchase Assurance and
Acoustical Insulation programs and various circulation, recreation and
utility improvements.
D. The City, in accordance with this Cooperative Agreement,
intends to assist the County in implementing the Land Use

Compatibility Program through the use of Redevelopment Law while at
the same time retaining for the City certain revenue generating powers
and land use controls within the territorial limits of the City and '
within areas which may be annexed to the territorial limits of the
City.
E. The Planning Commission of the County of Orange and the
Orange County Development Agency have cooperated in the selection of a
project area pursuant to California Health and Safety Code Sections
33322 and 33323. The project area selected by the Planning Commission
and the Agency includes territory within the territorial limits of the
City of Newport Beach. Such territory is contiguous to the unincor-
porated territory of the County of Orange which is also included
within such project area. The subject project area and the territory
within the City of Newport Beach are designated on the map attached
hereto as Exhibit "A."
F. California Health and Safety Code Section 33213 provides that
by ordinance, the legislative body of a community may authorize the
redevelopment of an area within its territorial limits by another
community if such area is contiguous to such other community.
G. The City Council at its regular meeting of April 28, 1986
introduced an ordinance authorizing redevelopment by the County of an
area within its territorial limits as shown on the map attached hereto
as Exhibit "A" and incorporated herein by this reference.
NOW, THEREFORE, in consideration of the mutual promises set forth
below, the County, the Agency, and the City do hereby agree as
follows:
Section 1. At its regular meeting of May 12, 1986, the
City Council of City shall consider the adoption of an ordinance

authorizing redevelopment by the County of an area within its terri-
torial limits as shown on the map attached hereto as Exhibit "A" and
incorporated herein by this reference.
Section 2. The Board of Supervisors of the County shall
undertake proceedings pursuant to the Community Redevelopment Law
(Health & Saf. Code Sec. 33000 et seq.) and shall consider the intro-
duction of an ordinance approving a redevelopment plan for the project
area described in the Recitals hereof at its regular meeting on July
8, 1986, and shall consider the adoption of such ordinance at a
regular or adjourned regular meeting not later than July 15, 1986.
Such redevelopment plan shall conform to the Land Use Compatibility
Program referred to in the Recitals hereof; and:
(A) The Redevelopment Plan shall be consistent with the
general plan and zoning of the City of Newport Beach; and shall not
conflict with the land use,and building regulatory powers of the City
affecting property now within the territorial limits or hereinafter
annexed to the City of Newport Beach.
(B) The Redevelopment Plan shall contain a provision that
any amendments to the Redevelopment Plan affecting property now within
the territorial limits or hereafter annexed to the City of Newport
Beach and all redevelopment activities to be implemented therein shall
be subject to the prior written approval of the City.
(C) The Redevelopment Plan shall contain a provision that
for those portions of the Project Area which are either within the
territorial limits of the City of Newport Beach or within the Sphere
of Influence of the City of Newport Beach as established by the Local
Agency Formation Commission as of the effective date of this Agreement
only property tax increments may be allocated to the Agency. All

other revenues, taxes, and fees, including without limitation, sales
tax, uniform transient occupancy tax, property development tax, and
fair share traffic contribution fees derived from areas within the
territorial limits or Sphere of Influence of the City shall not be
allocated or paid to the Agency without the prior written consent of
the City.
(D) The Redevelopment Plan shall contain a provision that
property tax or other revenues allocated to the Agency which are
derived from areas now within the territorial limits or hereinafter
annexed to the City shall only be used for redevelopment activities
within the Project Area and southerly of the Corona Del Mar Freeway
and for such activities as conform to the Land Use Compatibility
Program in effect on the date of this Agreement unless otherwise
expressly authorized in writing by the City.
(E) The Redevelopment Plan shall contain a provision that
California Health and Safety Code Section 33214 shall not serve to
limit the provisions set forth in parts (A), (B), (C) and (D) above.
Section 3. At its regular meeting on June 23, 1986, the
City Council of City shall consider the introduction of an ordinance
approving such redevelopment plan, and shall consider the adoption of
such ordinance at a regular or adjourned regular meeting not later
than July 14, 1986. The County shall provide to the City a final
draft of the Redevelopment Plan not later than June 13, 1986.
Section 4. The adoption of the ordinances described above
shall not be construed to abrogate or limit in any way the police
powers of City with respect to the territory within its territorial
limits, which is also within such project area, and the city shall

retain all such police powers, including, without limitation, land use
and building regulatory powers.
Section 5. In the event the City decides to annex those
portions of Santa Ana Heights within the Project Area and within the
City's Sphere of Influence, the County agrees to cooperate with the
City to expedite such annexation.
Section 6. The City hereby provides the prior written
approval for the following redevelopment activities to be undertaken
by the Agency:
(A) The Acoustical Insulation Program as set forth in the
Land Use Compatibility Program.
(B) The Purchase Assurance Program as set forth in the Land
Use Compatibility Program.
IN WITNESS WHEREOF, the County, the Agency and the City have
caused their duly authorized officers to execute this Agreement on the
day and year set forth below.

AN ORDINANCE OF THE CITAUNCIL OF THE CITY OF
NEWPORT BEACH ADDING CfikPTER 15.65 TO THE NEWPORT
BEACH MUNICIPAL CODE AUTHORIZING THE
REDEVELOPMENT OF AN AREA WITHIN ITS TERRITORIAL
LIMITS BY THE COUNTY OF ORANGE.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES
ORDAIN AS FOLLOWS:
SECTION 1: Chapter 15.65 is added to the Newport Beach
Municipal Code to read as follows:
CHAPTER 15.65. Santa Ana Heights Redevelopment.
15.65.010. Intent and Purpose.
The County of Orange and the City of Newport Beach have
entered into a Stipulation for Termination of Litigation relating
to John Wayne Airport, an Annexation Agreement and a Cooperative
Agreement Regarding Redevelopment which together promote
cooperation between the City and County in the use of
Redevelopment Law to implement the Land Use Compatibility Plan
for John Wayne Airport in an area southerly of the Airport
commonly known as "Santa Ana Heights."
The County of Orange intends to finance land use
conversions, sound attenuation, purchase assurance, equestrian
facilities, and traffic improvements using California Community
Redevelopment Law.
The City in accordance with the Cooperative Agreement
intends to assist the County implement the Land Use Compatibility
Plan through the use of Redevelopment Law while at the same time
retaining for the City.certain revenue generating powers and land
use controls within the territorial limits of the City and within
areas which may be annexed to the territorial limits of the City.

California health and Safety Code Section 33213
provides that by ordinance, the legislative body of a community
may authorize the redevelopment of an area within its territorial
limits by another community if.such area is contiguous to such
other community.
15.65.020. Authorization.
Pursuant to California Health and Safety Code Section
33213, the City Council of the City of Newport Beach hereby
authorizes redevelopment by the County of Orange of that portion
of the Project Area which is within the territorial limits of the
City as shown on Exhibit A attached hereto. The County of Orange
is hereby designated to undertake such redevelopment. Pursuant
to California Health and Safety Code Section 33213, any
Redevelopment Plan prepared by the Orange County Development
Agency for that portion of the Project Area within the
territorial limits of the City of Newport Beach shall be subject
to the approval of the City Council of the City by ordinance
prior to the implementation of any of the provisions of such
Redevelopment Plan with respect to such area.
15.65.030. Approval of Redevelopment Plan.
The City Council may consider the adoption of an
ordinance approving a Redevelopment Plan for the area within the
territorial limits of the City only upon determining and finding
that:
(A) The Redevelopment Plan is consistent with the
general plan and zoning of the City of Newport Beach; and does
not conflict with the land use and building regulatory powers of

the City affecting property now within the territorial limits or
hereinafter annexed to the City of Newport Beach.
(B) The Redevelopment Plan contains a provision that
any amendments to the Redevelopment Plan affecting property now
within the territorial limits or hereafter annexed to the City of
Newport Beach and all redevelopment activities to be implemented
therein shall be subject to the prior written approval of the
City.
(C) The Redevelopment Plan contains a provision that
for those portions of the Project Area which are either within
the territorial limits of the City of Newport Beach or within the
Sphere of Influence of the City of Newport Beach as established
by the Orange County Local Agency Formation Commission as of the
effective date of this Ordinance only property tax increments may
be allocated to the Agency. All other revenues, taxes, and fees,
including without limitation, sales tax, uniform transient
occupancy tax, property development tax, and fair share traffic
contribution fees derived from areas within the territorial
limits or Sphere of Influence of the City shall not be allocated
or paid to the Agency without the prior written consent of the
City.
(D) The Redevelopment Plan contains a provision that
property tax or other revenues allocated to the agency which are
derived from areas now within the territorial limits or
hereinafter annexed to the City shall not be used to make capital
improvements to John Wayne Airport without the prior written
consent of the City;
(E) The Redevelopment Plan contains a provision that
California Health and Safety Code Section 33214 shall not serve
to limit the provisions set forth in parts (A), (B), (C) and (D)
above.

SECTION 2. The :Mayor shall sign and the City Clerk
shall attest to the passage of this Ordinance. The City Clerk
shall cause the same to be published once in the official
newspaper within fifteen (15) days after its adoption. The
Ordinance shall become effective thirty (30) days from its
adoption.
This Ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach, held on the
28th day of April , 1986, and
was adopted on the 12th day of May ,

BACKGROUND: As reported at the Study Session of March 24,
1986, the County is using Redevelopment Law to implement
the Land Use Compatibility Plan for John Wayne Airport.
(A copy of the Study Session report is attached.)
The attached ordinance, in effect, enables the County
only to prepare a Redevelopment Plan. Both California law
and this ordinance require City Council approval of the
Redevelopment Plan by ordinance before any redevelopment
actions can occur.
Additionally, this ordinance sets forth provisions which
must be included in the Redevelopment Plan before the City
Council begins to consider approval of the Plan. These pro-
visions will also be the subject of a COOPERATIVE.AGREEMENT
between the City and the County that will be considered by
Council at the time of the second reading of this ordin-
ance. The ordinance is attached and is self - explanatory.

This ordinance, in effect, approves the project
area within the City. The ordinance will be
structured to protect the City against unauthor-
ized actions by the County agency.
A cooperative agreement between the City and
the County is contemplated to precisely set
out the redevelopment arrangements. This
agreement would be placed on the Council
Agenda at the time of the second reading of
the ordinance described above. This agreement
will also address potential annexation by the
City of parts of the project area.
6. A second City ordinance is required to approve
the County's redevelopment plan for the area
within the City. No projects may be under-

SUBJECT: REDEVELOPMENT OF SANTA ANA HEIGHTS
As reported to the Council on February 10, 1986, the
County is proceeding with a redevelopment agency to im-
plement the compromise land use compatibility plan for
Santa Ana Heights and for areas within Newport Beach.
City and County staff have met on several occasions to
coordinate this process.
The various steps are as follows:
1. The Board of Supervisors has designated itself
as a redevelopment agency.
2. The County agency has approved a "Redevelopment
Project.Area" which includes areas of the City.
(See attached map.) Tax increments from the
entire area can be used to fund redevelopment
projects anywhere within the area.
3. The County is formulating a "Redevelopment Plan"
for the project area. A "Project Area Committee"
has been appointed including representatives
from areas within the City. The City is coor-
dinating with the County in the preparation of a
specific plan which will be the basis for the
redevelopment plan.
4. An ordinance of the City is required to authorize
the redevelopment of an area within the City by
the County agency. Such an ordinance will be
placed on the City Council Agenda for April 14th.
