SUBJECT: Agreement between Daniel Freeman Hospital and Newport Beach to
participate in Paramedic Field Training Program
Recommended Action: Adopt Agreement
The attached document is an agreement between Daniel Freeman Hospital and
the City of Newport Beach to participate in Paramedic Field Training.
This is not a new program, Newport Beach has been a participant in this
training since 1977. The purpose of this agreement is to formally
establish the conditions each party must abide by.
The City Attorney has approved this agreement as to form.

AGREEMENT
THIS AGREEMENT, dated for purposes of identification only this
3522E�day of 1986, is made and entered into by and between
the
CITY OF NEWPORT BEACH, a municipal corporation,
hereinafter referred to as "NEWPORT BEACH,"

DANIEL FREEMAN HOSPITAL /ORANGE COUNTY
PARAMEDIC TRAINING DIVISION,
hereinafter referred to as "AGENCY"
WITNESSETH:
WHEREAS, AGENCY provides instruction to students specializing
in its paramedic program;
and
WHEREAS, NEWPORT BEACH provides paramedic services in its area;
WHEREAS, AGENCY desires to obtain, and NEWPORT BEACH desires to
provide, field training in the provision of paramedic services for
AGENCY'S students.
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES,
COVENANTS AND CONDITIONS HEREIN CONTAINED, THE PARTIES HERETO AGREE AS
FOLLOWS:
1. Students receiving field training from NEWPORT BEACH will abide by the
NEWPORT BEACH Fire Department's policies, procedures, rules and
regulations.
2. The number of students permitted to serve as trainees will be at
NEWPORT BEACH'S sole discretion.

3. NEWPORT BEACH shall appropriately assign trainees to a specific
station and shift for an agreed upon number of twenty -four hour
shifts.
4. NEWPORT BEACH shall provide available instructional materials for
student's use. All instructional materials which are damaged or not
returned will be replaced by students at their own expense.
5. AGENCY shall provide appropriate forms to be used by NEWPORT BEACH in
evaluating student trainees, and NEWPORT BEACH shall evaluate students
through such forms when possible.
6. NEWPORT BEACH, its officers, agents and employees shall not be
liable for any injury that may occur to students on NEWPORT BEACH'S
property, or while engaged in the program, while on assignment to
NEWPORT BEACH.
AGENCY agrees to indemnify, defend and hold harmless NEWPORT
BEACH, its officers, agents and employees for damage to property and for
injury to or death of any person and from all claims, demands and actions
arising out of training provided for AGENCY's students pursuant to this
Agreement.
AGENCY shall carry and maintain during the course of this
Agreement liability insurance coverage.
7. This Agreement may be altered or modified by mutual consent of parties
hereto.
8. Either party may terminate this Agreement upon giving one semester's
prior written notice to the other party
9. The effective date of this Agreement shall be the latest date of
execution hereinafter set forth opposite the names of the signators
hereto. In the event AGENCY fails to set forth a date of execution
opposite the name(s) of AGENCY's signator(s), AGENCY hereby authorizes
NEWPORT BEACH, by and through its representative,to insert the date of
execution by AGENCY's signator(s) as the date said Agreement, as
executed by AGENCY, is received by NEWPORT BEACH.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed on the dates hereinafter respectively set forth.
