LOCATION: Lots 1, 2, 3, 7, 8, 9, 10, 11, 12, and a portion of Lot 4, an unnumbered lot, and a portion of a public alley proposed to be vacated, all in Block 3 of the Balboa Bayside Tract; lots 22 and 23, Block A of the Bayside Tract; and a portion of vacated Edge- water Place, located at 309 Palm Street, on the northerly side of East Bay Avenue between Palm Street and Adams Street, in Central Balboa. ZONE: C -1 APPLICANT: Edgewater Place, Balboa OWNERS: Mark Howard, Don Franklin, Roland Vallely - Newport Beach Application This application is a request to accept an off -site parking agreement so as to permit the construction of a combined retail commercial and restaurant develop- ment on property located in the C -1 District. In accordance with Section 20.63.045B of the Municipal Code, the Planning Commission shall not recommend, and the City Council shall not approve, off - street parking on a separate lot from the building site or sites unless; 1. Such lot is so located as to be useful in connection with the propos- ed use or uses on the building site or sites. 2. Parking on such lot will not create undue traffic hazards in the surrounding area. 0 TO: City Council - 2. 3. Such lot and the building site are in the same ownership, or the owners of the building sites have a common ownership in such lot, and the owner or owners are entitled to the immediate possession and use thereof (ownership of the off -site lot must be ownership in fee or a leasehold interest of a duration adequate to serve all proposed uses on the building site or sites). 4. The owner or owners and the City, upon the approval of the City Council, .execute a written instrument or instruments, approved as to form and content by the City Attorney, providing for the maintenance of the required off - street parking on such lot for the duration of the proposed use or uses on the building site or sites. Should a change in use or additional use be proposed, the off - street parking regulations applicable at the time shall apply. Such instruments shall be recorded in the Office of the County Recorder and copies thereof filed with the Planning Department. Suggested Action If desired, accept an off -site parking agreement with Vallely Family Trust and Balboa Landing so as to allow the required off - street parking for the develop- ment known as Edgewater Place (Use Permit No. _3122), to be located on separate adjoining lots from the building site, which is located on the northwesterly corner of Palm Street and East Bay Avenue, in Central Balboa. Background At its meeting of May 9, 1985, the Planning Commission unanimously approved Use Permit No. 3122 and related environmental document, which permits the construc- tion of the retail and restaurant development known as Edgewater Place. Said approval also included Resubdivision No. 797 which involved a request to establish a single building site. Attached for the City Council's information is an excerpt of the Planning Commission minutes dated May 9, 1985, which set forth the Findings and Conditions of Approval for both applications. Planning Commission Recommendation At its meeting of May 8,1986, the Planning Commission unanimously approved the waiver of the previously- required parcel map which was to combine the subject property into a single building site, in conjunction with the Edgewater Place development. Inasmuch as the parcel map waiver caused the required off - street parking for the Edgewater Place development to be located on lots separate from the building site, the Planning Commission required that the applicant obtain the City Council's approval of an off -site parking agreement. An excerpt of the Planning Commission minutes dated May 8, 1986, is also attached for the City Council's information. TO: City Council - 3. Analysis In accordance with the approval of Use Permit No. 3122, the Edgewater Place development requires a total of 188 off - street parking spaces for the combined restaurant and retail commercial uses within the project. The applicant intends to provide said parking spaces in a five -level parking structure which he intends to construct on several lots which adjoin the development site. There have been no changes in the physical design of the proposed development from those previously approved by the Planning Commission on May 9, 1985.
