RECOMMENDATION:
Authorize the Mayor and the City Clerk to execute a
Supplemental Agreement with the engineering firm of ASL
Consulting Engineers in the amount of $64,600 for the
preparation of final design plans, specifications and
cost estimate (PS &E) for the Coast Highway Widening
Project.
DISCUSSION:
On March 11, 1985, the City Council authorized the Mayor
and City Clerk to execute a professional engineering services
agreement with ASL Consulting Engineers in the amount of (not -to-
exceed) $181,000 for PS &E for the subject project.
During the preparation of the PS &E, the scope of services
was altered by the City and Caltrans which resulted in design
expenditures, by the consultant far beyond the upon agreed price.
Major items not included in the original contract were the
following:
1. Design of a Mechanically Stabilized Earth (MSE)
retaining wall. Due to soil conditions a MSE wall
was recommended instead a reinforced concrete wall.
Caltrans required that the MSE wall be designed to
State standards so as not to preclude contractors
from submitting patented walls.
2. Design modifications to De Anza Mobile Home Park.
These included a drainage channel, reinforced
concrete box storm drain, and on -site alternative
circulation plans.
3. Salary increases. The original contract called
for the design to be completed in 9 months. The
actual length was almost 48 months. This resulted
in salary increases to the consultant.
4. Drainage design. Caltrans required a major storm
drain redesign resulting in additional catch basins
and thus requiring added plans.

Miscellaneous items. These include increased
reproduction costs, preparation of construction
easements, and a design for emergency vehicle
actuation of traffic signals.
The consultant has provided documentation showing his
actual cost to be $64,600.
Caltrans has reviewed the Supplemental Agreement and
authorized expenditures of additional Federal funds. The current
Federal Aid Urban (FAU) program participates for 86% of the
financing. The remaining 14% will be funded with local gas tax
monies. Sufficient funds are budgeted in Account No's. 02- 3381 -002
and 25- 3381 -002.

SUPPLEMENTAL AGREEMENT NO. 2
TO

FOR

NEWPORT BOULEVARD (SE 55) TO MACARTHUR BOULEVARD (SR 73)
In consideration for a significant alteration in the scope,
time of completion, complexity and character of work performed which
resulted in expenses incurred beyond the agreed contract fee, it is
mutually agreed by and between the parties hereto to amend Agreement
No. 5151 -8504 as follows:
1. That CITY shall reimburse the ENGINEER for the
additional actual costs (including labor costs,
employee benefits, overhead and other direct costs)
incurred by the ENGINEER as a result of extra tasks
required by the CITY in the amount of $64,600 as set
forth in Exhibit "D" attached hereto.
2. That the net fee of $16,450 as set forth in the
original agreement remains unchanged.
3. That all other terms and conditions of Agreement No.
5151 -85 -4 shall remain in full force and effect.
IN WITNESS WHEREOF the said parties hereto have entered into

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by Caltrans at regular intervals or as required for
efficient operation of the completed improvements.
The City of Newport Beach will advertise, award and
administer this project. The City will obtain State's
concurrence prior to either award or rejection of contract.
3. In awarding, or agreeing to award the contract, the Local
Agency agrees the payment of Federal funds will be limited to
the detail estimate amount approved by the Federal Highway
Administration in the Federal -Aid Project Agreement (PR -2),
or its modification PR -2A, and accepts any increases in Local
Agency funds.
4. The availability of Federal Funds will be subject to meeting
deadlines and /or other conditions as may be imposed by the
Director upon the recommendation of the FAU Advisory
Committee.
5. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal -Aid Program.

Tom Orlando, 15 Balboa Coves,
West Newport,
representing the West Newport Beach
4th of July
Community Association, addressed the
Council regarding incidents which
occurred over the 4th of July weekend in
West Newport. He stated that many of
the residents were intimidated,
assaulted, hassled, etc. In addition
to the noise, there were fire hazards
from firecrackers, etc. He stated that
there were not enough police officers to
handle enforcement properly. He stated
that they are not finding fault with the
Police Department, but that more help
was needed to control the problems. He
stated that they met with the Police
Chief to discuss what can be done to
prevent similar occurrences next year.
He stated that many of the problems are
as a result of "party" houses, which
seem to be the same houses repeatedly.
He requested that the City Council look
into what the City can do legally in
regard to the property owners of these
party houses.
Mayor Maurer advised Mr. Orlando that
the Police Department will be discussing
with the City Council in October what
preventative measures can be taken with
regard to his concerns and that he will
make sure he is invited to those
meetings for input.
The City Attorney advised that there is
a section in the Penal Code that their
office has used in prior occasions, that
allows the City Attorney's office to
send a letter to the property owner of a
house or apartment that is being used as
a "party" house. The property owner is
notified to abate the nuisance, and if
there is a repeat of the problem, it is
a misdemeanor violation and can be filed
in the Harbor Municipal. Court.
Jerry Bernheimer, 208 36th Street,
addressed the Council, and stated that
the problems mentioned by Mr. Orlando
occur regularly in the West Newport
area, not just on the 4th of July, and
feels it's the same "party" houses
repeatedly that are causing the trouble.
With regard to the 4th of .July, he
suggested the Police Department limit
pedestrian access to the Peninsula, as
well as vehicular access.

SUBJECT: COAST HIGHWAY WIDENING FROM BAYSIDE DRIVE TO MacARTHUR BOULEVARD- -
LOCAL AGENCY /STATE AGREEMENT
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to execute
Program Supplement No. 4 Rev. 1 to the Local Agency -State Agreement
No. 07 -5151, covering the improvement of Pacific Coast Highway from
Bayside Drive to MacArthur Boulevard.
DISCUSSION:
The Federal Highway Administration (FHWA), through Caltrans; has
recently notified the City that Federal Aid Urban (FAU) monies are now
available for the Coast Highway Improvement Project between Bayside Drive and
MacArthur Boulevard.
To qualify for matching Federal Funds (86% Federal, 14% City), the
City must execute a Supplement Agreement to the Local Agency -State Master
Agreement previously approved by the City Council on August 8, 1977. Supplement
Agreement No. 4 Rev. 1 to the Local Agency -State Agreement No. 07 -5151 autho-
rizes the release of $3,518,296 Federal funds to be matched with $561,704 City
funds for a total of $4,080,000. The City has currently budgeted sufficient gas
tax funds to cover its share.
A copy of Program Supplement No. 4 Rev. 1 is attached for the
Council's review.
A previous agreement committed expenditures of $400,000 matching funds
for the preparation of preliminary engineering and the environmental document.
The amount of money programmed under this agreement is solely for the purpose of
right -of -way acquisition in the De Anza Bayside Village, relocation assistance
to mobile home owners and the retention of consultants to provide the necessary
design and right -of -way functions as required by Federal and State law. Funding
to construct Coast Highway will be programmed in a separate agreement.
The current milestone schedule calls for the construction of Coast
Highway between Jamboree Road and MacArthur Boulevard (Phase 1) some time this
fiscal year. Staff has submitted all necessary applications to construct Phase
in anticipation of receiving Federal funds to construct shortly. Construction
of Coast Highway between Jamboree Road and Bayside Drive is scheduled following
the acquisition of the necessary right -of -way in De Anza Bayside Village. Due
to the complexity of acquiring right -Df -way, completion of acquiring the right -
of -way could take up to two years.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE PROGRAM SUPPLEMENT
NO. 4 REV.1 TO LOCAL AGENCY /STATE AGREEMENT
NO. 07 -5151 COVERING THE FAU FUNDING FOR THE
COAST HIGHWAY IMPROVEMENT PROJECT FROM BAYSIDE
DRIVE TO MacARTHUR BOULEVARD
WHEREAS, there has been presented to the City council of the City of
Newport Beach a certain Program Supplement No. 4 Rev. 1 to Local Agency /State
Agreement No. 07 -5151 covering the FAU funding for the Coast Highway improvement
project; and
WHEREAS, the City Council has reviewed the terms and conditions of said
Program Supplement No. 4 Rev. 1 to Local Agency /State Agreement No. 07 -5151
covering the FAU funding for the Coast Highway improvement project, and finds
them to be satisfactory and that it would be in the best interest of the City to
authorize the Mayor and the City Clerk to execute said Program Supplement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that said Program Supplement above described is approved, and the
Mayor and the City Clerk are hereby authorized and directed to execute the same
on behalf of the City of Newport Beach.
