SUBJECT: TRAINING AGREEMENT RESOLUTION
The Council resolution authorizing training agreements between the City of
Newport Beach Police Department and the State of California Department of
Highway Patrol has lapsed.
A new resolution is required before NBPD personnel will be permitted to
attend any POST reimbursed CHP training.
Two officers are scheduled to attend the CHP Commercial Enforcement course
on 9- 22 -86.
A sample resolution has been provided by the California Department of
Highway Patrol, accounting section, contracts unit. The contracts unit
advised the format provided would allow for an open -ended agreement, and
it was recommended that the Chief of Police be the authorized individual
to provide continuity of training agreements.

them to this office at the above address with a resolution
providing authorization for the individual signing the
agreement. A sample resolution is attached for your infor-
mation. When the agreement has been approved, a copy will
be returned to you. Under no circumstances will a participant
from your department be accepted if there is not a signed
agreement on file in this office.

A resolution of the City Council of the City of
authorizing agreements between the Police Department of the City
of and the State of California Department of
California Highway Patrol.
WHEREAS the State of California, Department of California Highway
Patrol requires written training agreements from any agency
participating in training programs at the Academy; and
WHEREAS the Police Department of the City of

NOW THEREFORE, be it resolved by the
City Council

OF NEWPORT BEACH AUTHORIZING AND DIRECTING THE
CITY MANAGER TO EXECUTE TRAINING AGREEMENTS
BETWEEN THE CITY OF NEWPORT BEACH AND THE
STATE OF CALIFORNIA, DEPARTMENT OF CALIFORNIA
HIGHWAY PATROL.
WHEREAS, the State of California, Department of Highway
Patrol, requires written training agreements from any agency
participating in the training programs sponsored and administered
by the Department of California Highway Patrol; and
WHEREAS, a resolution of the City Council of the City of
Newport Beach is required to authorize certain officers of the
Newport Beach Police Department to participate in said training
agreements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the City Manager be and hereby is
authorized and directed to sign said training agreements when
required as long as the amounts to be paid by the City of Newport
Beach are within the Police Department budget.

Enclosed please find three copies of the Basic Commercial Vehicle
Enforcement Training Agreement, between the City of Newport Beach
and Department of California Highway Patrol, and Resolution No.
86 -83 providing authorization of said agreement, which was approved
by the City Council at its September 8, 1986 meeting.
Following approval, please return one fully executed copy to this
office for our files.

TRAINING AGREEMENT
THIS AGREEMENT, made and entered into this 15th day of August,
1986, by and between the State of California, Department of
California Highway Patrol, hereinafter called CHP, and the
City of Newport Beach, hereinafter called CITY.
WITNESSETH: By and in consideration of the covenants and
conditions herein contained, the CHP and the CITY do hereby
agree as follows:
1. CHP agrees to allow one (1) CITY trainee to attend the
Basic Commercial Vehicle Enforcement class to be held September 22
through October 3, 1986, Monday through Friday, at the Ranch House
Inn, 27413 No. Tourney Road, Valencia, California.
2. CHP agrees to provide all training facilities required.
3. This agreement may be amended by mutual consent of the
parties hereto.
4. CITY shall be responsible for paying any cost incurred
by CHP for facility damage caused by the willful or malicious
misconduct of CITY trainees.
5. CITY agrees to indemnify, defend, and save harmless
the State of California, the CHP, its officers, agents and
employees from any and all claims and losses accruing or result-
ing to any person, firm or corporation, who may be injured or
damaged by the negligence of CITY or by the combined active
or passive fault or negligence of the State of California, the
CHP, its officers, agents or employees and the CITY in the
performance of this agreement.
6. In consideration for facility use and training, CITY
agrees to pay CHP upon receipt of an invoice $596.00 per trainee.
The total amount of this agreement shall not exceed Five Hundred
Ninety -six Dollars ($596.00.
7. This agreement shall become effective when signed by
both parties. Training shall not be allowed unless a resolution
or acceptable document of authorization is on file with CHP.
