Raggio City Clerk WER:pm Attachment 3300 Newport Boulevard, Newport Beach • 0 c -2Z-W AGREEMENT FOR PARALEGAL SERVICES This Agreement is made this day of September, 1986 by and between the City of Newport Beach, a municipal corporation (hereinafter referred to as "City ") and Deanna Mallicoat whose address is 112 Tangerine, Irvine, CA 92720 (hereinafter referred to as "Contractor ") is made with reference to the following: RECITALS: A. The City is a municipal corporation duly organized and validly existing under the laws of the State of California with the power to carry on its business as it is now being conducted under the statutes of the State of California and the Charter of the City. B. The City and Contractor desire to enter into an Agreement for paralegal services upon the terms and conditions herein. NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as follows: 1. Term. The term of this Agreement shall commence upon the 22nd day of September, 1986 and shall terminate on the 30th day of June, 1987, unless terminated earlier as set forth herein. 2. Services to be Performed by Contractor. Contractor shall perform the following services: Conducting administrative hearings for municipal code violations; assisting in the review of legal documents to determine their compliance with the City's Municipal Code; performing preliminary analysis of ordinances, opinions, testimony, depositions, documentary material; organizing trial documents and exhibits; researching legislative histories; gathering factual information and performing routine legal research to assist an attorney in determining appropriate action; up keep of law library; assisting in the preparation of roughs of complaints and pleadings; conducting small claims court collection proceedings; assisting in preparing drafts of documents such as resolutions, ordinances, land use agreements, judgments, decisions, notice of hearings and writs of execution; preparing correspondence and reports; assisting in preparing drafts of answers to inquiries regarding legal requirements and procedure relative to the City Municipal Code and exchanging legal and factual information with other City departments. These duties will all be performed under supervision by an attorney. -1- A normal work day shall consist of eight (8) hours and a normal work week shall be from Monday through Friday consisting of forty (40) hours. These hours of work shall generally be 8:00 A.M. to 5:00 P.M. Overtime work shall be undertaken with the advance approval of the City Attorney, and shall be paid at time and one -half. Overtime is defined as hours worked in excess of forty (40) hours a week commencing at 12:01 A.M. Saturday and terminating at 12:00 P.M. Friday. 3. Compensation to Contractor. In consideration of the performance of specified services under this Agreement, Contractor shall be compensated as follows: A. Base pay of $13.50 per hour for hours worked pursuant to this Agreement, payable on a bi- weekly basis. Set hourly rate shall be considered just compensation including all fringe benefits except for the compensation for health insurance. City agrees to additionally compensate Contractor for the cost of securing her own health insurance in an amount not to exceed $100.00 per month. No additional benefits will be provided under this Agreement. B. Compensation to Contractor during the term of this Agreement shall not exceed the total sum of $25,000.00. C. Contractor shall maintain and submit complete records of time expended pursuant to this Agreement corresponding to City's payroll schedule. 4. Independent Parties. The parties to this Agreement intend that the relationship between them created by this Agreement is out of employer- independent contractor. No civil service status or other right of employment will be acquired by virtue of the Contractor's services. 5. Termination. This Agreement may be terminated by either party by giving thirty (30) days written notice prior to such termination. Upon termination of this Agreement, the City shall pay to Contractor that portion of compensation specified in this Agreement that is earned and unpaid prior to the effective date of termination. 6. Integrated Contract. This Agreement represents the full and complete understanding of every kind or nature whatsoever between the parties hereto and all preliminary negotiations and agreements whatsoever kind or nature are merged herein. Any modification of this Agreement will be effective only by written execution signed by both City and Contractor. -2- IN WITNESS WHEREOF the parties have caused this Agreement to be executed on the day and year first above written.
