RECITALS A. Based on existing and anticipated future traffic volumes and emerging development patterns, the cities of Newport Beach, Santa Ana, Irvine, and Costa Mesa and the County of Orange recognize the need for a coordinated arterial highway improvement program as an integral part of the total circulation system in the area outlined in attached Exhibit A. B. The parties seek hereby to set out an arterial program by means of which the vehicular traffic impacts, resulting from implementation of said development, may be dealt with in such a manner as to make manageable, to the greatest extent possible, the need for public street improvement that will be created thereby. (The "Program "). C. Each of the parties has heretofore participated in a cooperative technical analysis of the nature, extent, and approximate cost of the public street improvements that will be made necessary by reason of the increased vehicular traffic loads, that will be generated within the first five years hereafter by new development within said Primary Study Area. D. Each of the CITIES has heretofore collected development fees within its portion of the Primary Study Area for the cost of the public street improvements that will be made necessary by reason of the increased vehicular traffic loads. E. ORANGE COUNTY intends to utilize Orange County Development Agency funds for public street improvements which are necessitated by or benefit the Santa Ana Heights. F. The arterial highway improvements which are to be funded by this Program are shown on Exhibit B attached hereto. The total cost of said street improvements in current (1986) dollars is presently estimated to be approximately Ten Million Dollars ($10 million), allocated as shown on Exhibit B, attached hereto. b _ 7 521- 303/ #4 -1- • • UNDERSTANDING 1. Each of the parties will participate in the Program for a period of five (5) years. 2. Each of the CITIES will commit funds to this Program in an amount based on the schedule set forth in Exhibit C, attached hereto, as applied to building permits issued by such City for development occurring within its portion of the Primary Study Area. Each of the parties may raise the funds by imposition of a fee schedule conforming to Exhibit C or in any manner deemed appropriate by said party. 3. Orange County will fully fund improvements in County of Orange area as described in Exhibit B including all inflationary costs and other costs not anticipated in the estimated improvement costs. 4. Funds committed by the parties will be used to pay for those improvements identified in Exhibit B, as within the jurisdiction of that party. Each party can rearrange schedules for projects on Exhibit B, but changes will be reported pursuant to paragraph 7. 5. The parties will monitor development and improvement needs included in this Agreement on an annual basis in order to determine timing, priority and feasibility of the projects, and revise the attached Exhibits B and C, if necessary, on an annual basis in accordance with the provisions set forth below in paragraph 9. 6. Each of the CITIES will deposit any and all monies collected by said party under paragraph 2 into a special fund, and cause such monies to be invested prudently until required for purposes of construction of the public improvements contemplated hereby, in order that the present worth of such monies, when collected, shall be reduced as little as possible by the effects of inflation. 7. Each of the CITIES will report to the other parties any and all sums of money committed to the special fund by such party, pursuant to paragraph 2 of this Agreement. Beginning December 31, 1986, and each six months period during the term of the Agreement, each of the CITIES will report to each of the other parties, within fifteen (15) days, the balance(s) of the deposits in the foregoing special fund. 8. Each of the parties will diligently pursue the execution of the projects within their jurisdiction according to the implementation schedule included in Exhibit B, and report to each of the other parties progress made on the projects and any delays encountered in the scheduled execution time of the projects. 9. Each of the parties will designate and appoint a City Council member or County Supervisor to the Intercity Liaison Committee (ICLC) whose purpose shall be to review the program project progress, and make revisions in the Five -Year Capital Improvement Program subject to the provisions of this MOU. 10. It is mutually understood that this MOU does not bind any party to undertake any particular action, does not contain the necessary elements of a contract, and cannot be the basis for any claim of justifiable reliance, but is intended simply to identify the actions and current understanding of the parties with respect to the subject matter of this Memorandum. 521- 303/ #4 -2- 6 /0-6 0 • DATED on the day and year first above written. F -3(a) FROM: Public Works Department /Traffic Engineering GAY Tick CITY COUNCIL CITY OF NEWPORT REACH SEP 2 2 1980 APPROVED SUBJECT: INTERCITY LIAISON COMMITTEE HIGHWAY IMPROVEMENT PROGRAM RECOMMENDATION Authorize the Mayor and City Clerk to execute the attached agreement among the Cities of Newport Reach, Costa Mesa, Irvine and Santa Ana, as well as the County of Orange. DISCUSSION The Intercity Liaison Committee (ICLC) has been working for several years to identify highway improvements that will be needed over the next five years within the study area. The study area is shown on page 6 of the agreement (Exhibit I) and includes the portion of Newport Beach northerly of Mesa Drive. The culmination of this effort is the attached Memorandum of Understanding, stating that each agency agrees to perform the identified arterial highway improvements within its jurisdiction. It does not address freeway improvements, nor does it propose the pooling of agency funds. Exhibit II is the Executive Summary of the Transportation Study which identified the recommended improvements. The estimated cost of all improvements is $8,969,000, of which $332,000 would be required for those in Newport Beach. Five improvements have been identified within the City. They include the installation of a median at certain locations on Campus Drive; a new traffic signal at the intersection of Campus Drive and Dove Street; parking restrictions on Dove and Quail Streets to provide two westbound lanes approaching Campus Drive; and the addition of a second eastbound left -turn lane from Campus Drive to MacArthur Boulevard. The last improvement has previously been conditioned on two developments under the City's Traffic Phasing Ordinance. Iof2 )s) C 2 a CITY COUNCIL 9 -22 -86 Intercity Liaison Committee Highway Improvement Program is The agreement provides that each agency is free to raise the necessary funds in any manner they choose. Staff has worked under the assumption that no separate fee program would be established in the study area but rather that Fair Share fees would be utilized for the improvements. The current Fair Share fee is $84.85 per daily trip generated. The level of development anticipated in the ICLC study results in a fee of approximately $58 per daily trip to fund the identified improvement program. The agreement is the culmination of considerable effort on the part of the four cities and, more recently, the County. It represents a cooperative approach to dealing with anticipated traffic problems on a sub - regional basis. The ICLC has reviewed the agreement and recommends its adoption by the participating agencies. Richard M. In June of 1985 the four cities undertook another reevaluation of the ICLC study, specifically to assess the desirability of inviting the county to participate in the fee program. John Wayne Airport EIR 508: The Board on February 26, 1985 adopted the JWA Master Plan and Land Use Compatibility. Plan (LUCP). In certifying EIR 508 the Board adopted a number of ground transportation mitigation measures ranging from intersection improvements to a freeway access system providing direct freeway connections to the new terminal. Implementation of these mitigation measures over the next 10 to 15 years will require approval of the affected local state and federal agencies. All of the county required improvements identified in the ICLC transportation improvement program which are planned for implementation by 1990, are also required as mitigation measures for EIR 508 or are required to be constructed as part of airport master plan or Santa Ana Heights development. In addition, one project listed under the city of Newport Beach is also identified as an EIR 508 mitigation measure. FINANCIAL IMPLICATIONS The ICLC five year transportation improvement program identifies a cost of $21,164,200 for arterial and freeway improvements between now and 1990. This 21 million dollars would be raised through various funding mechanisms within each jurisdiction which amounts to a fee equivalent to $58 per trip end generated by new development. Each member city of ICLC collects revenues by a different mechanism; for example, Santa Ana collects fees based on 1% of the building permit value, Irvine collects $4.75 per square foot for new development in the Irvine Business Complex. The county's contribution to the improvements (based on an increase in trip end growth in SAH) would be $1,374,600 of which $570,000 would be required for arterial highway improvements with the balance ($804,600) for freeway improvements, (Page IV -4 of ICLC Transportation Study). It was estimated that fees would only be collected from future development in Santa Ana Heights area since John Wayne Airport Master Plan implementation will offset circulation deficiencies identified in the airport area. IMPLEMENTATION In all cases implementation of the arterial highway improvements could be implemented by each participating agency through an agreement Memorandum of Understanding (MOU); however, since some participating agencies are capital donor cities for regional freeway improvements at the MacArthur and Jamboree interchanges at I -405, a more legally binding Joint Powers Agreement (JPA) has been suggested. EXHIBIT II 13 JOINT POWERS AGREEMENT Table 1 identifies the ICLC improvements and Figure 1 the location of the improvements that would be required of the county, in addition, Table 1 contains a cross reference to EIR 508 traffic mitigation measures or improvements of the Master Plan. These EIR 508 mitigation measures are shown in entirety in Table 2. As can be seen from the ICLC improvement list all items are attributable to EIR 508 mitigation measures or to the actual improvements contemplated as part of the Airport master Plan or Santa Ana Heights Land Use Compatibility Plan (LUCP). Table 1 also identified funding responsibility by either John Wayne Airport or the Santa Ana Heights Development Agency. In summary, the county's contribution to ICLC would require a commitment to spend an estimated $570,000 (income from a redevelopment agency) for arterial highway improvements for Santa Ana Heights development. The remainder of $804,600 (Page IV -4 of ICLC Study) that would be required for regional freeway improvements could be financed out of airport funding programs since there was a commitment to make improvements to the MacArthur /I -405 interchange (EIR 508 mitigation measure #'s 7 and 8). John Wayne Airport would be also responsible for implementing $795,00 worth of additional transportation improvements to arterial highways that will be implemented as part of development of the Master Plan. The total commitment by the county would be $1,599,600 by John Wayne Airport and $570,000 by the Santa Ana Heights Development Agency. A peak hour limit of 12 scheduled departures per hour will be imposed as discussed in Section 4.15.7.7. Phase II Mitigation. In order to reduce or eliminate the tra is impacts from implementation of the JWA Master Plan and LUCP, and also improve traffic access to the airport, a group of mitigation measures is proposed to be implemented. The objective of these mitigation measures is to do one of the following: o Reduce the V/C ratio to 0.90 or less o reduce the V/C ratio (with project) to at least the "no project" level, if without the project the V/C ratio is already above 0.90. Transportation /circulation improvements required to fully mitigate the traffic impacts from the project are described below: Freeway Access Ramp Additions. The John Wayne Airport Freeway Access Study prepared for the Orange County Environmental Management Agency by PRC Engineering in May, 1984 included preliminary plans and profiles for alternative ramp improvements and recommended five new access ramps to /from the airport site (illustrated in Figure 4.10 -8). Each of the proposed ramps would have appropriate signing to'direct motorists to the Airport. o Ramp A - -A direct entrance ramp linking eastbound (I) SR73 to the airport on the south. o Ramp E - -An airport exit ramp to westbound SR73. (2) o Ramp Fl--An entrance ramp from southbound SR55 to (3) the airport terminal building. o Ramp B - -An entrance ramp from northbound I -405 to (4) the airport terminal building. o Ramp D1 - -An exit ramp from the airport to south- (5) bound I -405. (I)(A) a ZO Ramps B, F1 and Airport Way South shall be operational prior to or concurrent with Phase II implementation. Detailed terminal design shall provide for all ramp connections as identified in Figure 4.10 -6. Ramps A, B and D1 shall be operational as target year need is identified through the annual traffic monitoring program. Annually, the EMA /Transportation -Flood Program Office shall evaluate existing conditions on the road system and recommend to the Board appropriate phasing of transportation mitigation measures which JWA shall be required to implement. The Annual evaluation shall ensure that mitigation is being and will be achieved. The annual evaluation shall also be prepared in coordination with interested agencies as discussed below. The County (John Wayne Airport) shall participate in a joint (29) local agency transportation improvement district in order to effectively and efficiently construct arterial and intersection improvements. Such inter - agency coordination could be accomplished through the Inter -City Liaison Committee (ICLC), composed of the cities of Irvine, Costa Mesa, Santa Ana, and Newport Beach. The traffic monitoring program should also in conjunction with the Inter -City Liaison Committee. Improvement costs would be assigned on a pro rata share based on contributions of new traffic generated by the JWA -LUCP project. Other mitigation measures include the following: 1. Irvine Avenue, from Bristol Street to Del Mar Avenue, (30) shall be upgraded from a primary to a major arterial highway on the Master Plan of Arterial Highways. (II) (A) 2. Improved public transportation services to John Wayne (31) Airport shall be promoted as an alternative to private vehicle access by providing terminal area and frontage dedicated to buses, limousines aIndicates intersections affected by the City of Irvine IBC Project where mutual circulation improvements will be coordinated through ICLC. 22 and taxis as part of the project's airport layout plan and retaining the option of accommodating light rail or other HOV approaches as proposed by OCTD. The Orange County Transit District will be consulted as to the design and location.of terminal transit facilities. (I,III)(B) 3. The list of recommended freeway access and surface (32) street improvements can be amended by interagency agreement so long as the objectives of the mitigation program are maintained (page 4.1047), and improvement costs are assigned on a pro -rata share based on contributions of new traffic generated by the combined John Wayne Airport expansion and LUCP project. 4. Initial development within the LUCP project area shall (33) be limited to a trip generation rate that does not exceed the 58,300 daily trips forecast for the currently adopted general plans for the County and City of Newport Beach. Continued development within the LUCP project area will be permitted only after the traffic /circulation mitigation measures recommended above are constructed or when sufficient capacity exists in the local arterial network as identified through the annual traffic monitoring program.
