LOCATION: Lots 3 and 4, Block 23, Newport Beach Tract (restaurant site), located at 2306 West Ocean Front; and Lots 19, 20, and 21, Block 22, Newport Beach Tract (off -site parking site), located at 111, 113 and 115 - 22nd Street, in Central Newport. ZONE: SP -6 APPLICANT: Zeppa, Inc., Newport Beach OWNER: Piero Serra,,Corona del Mar Application This is a request to approve an off -site parking agreement for a portion of the required parking spaces in conjunction with the establishment of a restaurant with on -sale beer and wine. As outlined in Section 20.63.045B of the Municipal Code, the Planning Commis- sion shall not recommend and the City Council shall not approve off - street parking on a separate lot from the building site or sites unless: 1. Such lot is so located as to be useful in connection with the pro- posed use or uses on the building site or sites. 2. Parking on such lot will not create undue traffic hazards in the surrounding area. 3. Such lot and the building site are in the same ownership, or the owners of the building sites have a common ownership in such lot, and the owner or owners are entitled to the immediate possession and use thereof (ownership of the off -site lot must be ownership in fee or a leasehold interest of a duration adequate to serve all proposed uses on the building site or sites). 4. Suggested Action If desired, authorize the Mayor and City Clerk to execute an off -site parking agreement with the Zeppa Corporation (restaurant site) and The Hill Partnership (off -site parking site). Background At its meeting of June 5, 1986, the Planning Commission voted unanimously to approve Use Permit No. 3200 to establish a restaurant with on -sale beer and wine on the subject property. The approval also included a modification to the Zoning Code so as to allow the use of a valet parking service and tandem parking spaces on the approved off -site parking lot. The Commission also approved Variance No. 1130 that permitted the installation of mechanical equipment on the roof of the restaurant building that exceeded the basic height limit in the 26/35 Foot Height Limitation District. Condition of Approval No. 18 of Use Permit No. 3200 provides that the City Council approve an off -site parking agreement inasmuch as eleven of the required parking spaces are located on the off -site parking lot. Details of the proposed restaurant operation and valet parking service on said off -site parking lot are contained in the attached Planning Commission staff report for City Council review.
