LOCATION: A portion of Lot H, Tract No. 919, located at 2801 West Coast Highway (restaurant site); and 2751 West Coast Highway (off -site parking site) , on the southerly side of West Coast Highway at the intersection of Riverside Avenue, in the Mariners' Mile Specific Plan Area. ZONE: SP -5 APPLICANT: Gordon S. Barienbrock, Newport Beach OWNER: Same as applicant Application This is a request to approve an off -site parking agreement for a portion of the required parking spaces during the daytime on weekends in conjunction with an approved restaurant with on -sale alcoholic beverages. As outlined in Section 20.63.045B of the Municipal Code, the Planning Commis- sion shall not recommend and the City Council shall not approve off - street parking on a separate lot from the building site or sites unless: 1. Such lot is so located as to be useful in connection with the pro- posed use or uses on the building site or sites. 2. Parking on such lot will not create undue traffic hazards in the surrounding area. 3. Such lot and the building site are in the same ownership, or the owners of the building sites have a common ownership in such lot, and the owner or owners are entitled to the immediate possession and use thereof (ownership of the off -site lot must be ownership in fee or a leasehold interest of a duration adequate to serve all proposed uses on the building site or sites). q TO: City Council - 2. 4. The owner or owners and the City, upon the approval of the City Council, execute a written instrument or instruments, approved as to form and content by the City Attorney, providing for the maintenance of the required off- street parking on such lot for the duration of the proposed use or uses on the building site or sites. Should a change in use or additional use be proposed, the off- street parking regulations applicable at the time shall apply. Such instruments shall be recorded in the Office of the County Recorder and copies thereof filed with the Planning Department. Suggested Action If desired, authorize the Mayor and City -Clerk to execute an off -site parking agreement with Gordon Barienbrock (restaurant site) and James A. Carter, Pacifica Marine (off -site parking site). Background At its meeting of September 4, 1986, the Planning Commission voted unanimously to approve Use Permit No. 2051 (Amended) that permitted the daytime use on weekends of an approved restaurant on the subject property. The original Use Permit No. 2051 that permitted the restaurant facility in 1982, provided that the restaurant use shall not be open for business prior to 5:00 p.m. on any day. The amended off -site parking agreement provides for a portion of the required restaurant parking to be located on the adjoining property for daytime use on Saturdays, Sundays and recognized holidays. Condition of Approval No. 2 of Use Permit No. 2051 (Amended) provides that the City Council approve said off -site parking agreement for seven parking spaces partially on the adjoining property, and twenty -five parking spaces entirely on the adjoining site. Details of the proposed restaurant operation and said off -site parking lot are contained in the attached Planning Commission staff report for City Council review.
