Authorize the Mayor and City Clerk to execute an Agreement approving the dis-
tribution of Adult Sports Team Standings to team managers on stationery supplied
by Sgt. Pepperoni's Pizza Store, Inc. The Agreement also includes a $500 fee
to partially offset annual sports awards expenditures.
Background:
Recently the Parks, Beaches and Recreation Department was contacted by Dave
Patterson, President and Owner of Sgt. Pepperoni's Pizza, Inc., regarding
advertising to adult sports participants for the restaurant located on Bristol
Street between Campus and Jamboree in Santa Ana Heights. In discussing alterna-
tives, Department staff and Mr. Patterson agreed that use of restaurant stationery
for printing and distributing weekly standings of adult sports teams would
significantly reduce expenditures on paper supplies for that purpose. Department
staff will distribute the standings directly to managers at regularly scheduled
league games of adult teams competing in softball and basketball. In addition,
the $500 fee partially offsets City expenditures for team awards.
The use of advertising in connection with self- supporting recreation program costs
is not without precedence. The City's four seasonal recreation program brochures,
individual community events and neighborhood celebrations are all enhanced by direct
or in -kind advertising. The selection of Sgt. Pepperoni's Pizza Store, Inc., for
this purpose is convenient for most teams since competition is scheduled within close
proximity to the restaurant's location.
The attachments include a reduced photocopy of the legal size stationery on which
the standings will be printed. The Parks, Beaches and Recreation Commission
approved the stationery's design at their meeting of May 5, 1987. The design has
been specifically incorporated into the attached Agreement.

INDEPENDENT CONTRACTOR AGREEMENT

The following constitutes an Agreement between the City of Newport Beach
(hereinafter, "City ") and Sgt. Pepperoni's Pizza Store, Inc., owners and
operators of a restaurant located at 2300 S.E. Bristol, Santa Ana Heights,
CA. 92707 (hereinafter, "Restaurant "), for services which are hereby
agreed upon as set forth herein.
City and Restaurant enter into this Agreement in reliance on Restaurant
acting as an independent contractor with sole legal responsibility to remit
Federal and State taxes to provide for his /her Worker's Compensation,
Unemployment Insurance, Social Security, and comply with all other legal
duties of an independent contractor.
The term of this Agreement shall commence on the 1st day of June, 1987 and
shall terminate on the 31st day of May, 1988, unless terminated earlier as
set forth herein.
City agrees to publish and distribute Adult Sports League Standings on the
stationery provided by the Restaurant as set forth on Exhibit A, attached
hereto and incorporated herein.
Restaurant agrees to provide stationery as necessary and in a timely manner
in order to permit City to publish and distribute Adult Sports Standings on
a weekly basis during seasonal league competition. Restaurant further agrees
to pay City $500.00 to offset annual sports awards costs on or before June 10,
1987.
Restaurant agrees to defend, indemnify and hold City and its employees and
agents harmless from and against any and all loss, damage, injury, claim,
demand, liability and cause of action which City may be subject to arising out
of the performance of services hereunder.
This Agreement may be terminated by either party hereto upon 30 days' written
notice. Either party may terminate this Agreement for breach of any term of
this Agreement upon 30 days' written notice of the breach.
The undersigned have read, understand, and agree to be bound by all of the
terms as set forth herein and as set forth in Exhibit A.
