RECOMMENDATIONS:

1. Find that the Orange County Environmental Management Agency's
plans for the construction of improvements to the Santa Ana -Delhi
Channel between Mesa Drive and Irvine Avenue are consistent with
the City's General Plan.
2. Approve the County's prepared plans and specifications for the
portion of the work within the City of Newport Beach.
3. Authorize the Mayor and the City Clerk to execute a cooperative
• agreement with the County of Orange, the Orange County Flood
Control District and the Orange County Development Agency (for
Santa Ana Heights) to provide for funding of a portion of the
channel improvements which will allow for the future widening of
Irvine Avenue northerly of Mesa Drive.
DISCUSSION:
The Orange County Flood Control District plans to construct improve-
ments to the Santa Ana -Delhi Channel from downstream of Mesa Drive to upstream
of Irvine Avenue. These improvements include a concrete rectangular channel and
new culvert crossings at both Mesa Drive and Irvine Avenue. Portions of the
project are in the City of Newport Beach and the County has requested that the
City find that the project is in conformance with the General Plan and approve
plans and specifications for those portions in the City.
The flood control facilities are in conformance with the City's
General Plan. They provide for the widening of Irvine Avenue to six lanes in
the future. The need to widen Irvine Avenue was established by the County in
their EIR 508 for the expansion of John Wayne Airport.
• The County has a long- standing policy concerning the Flood Control
District funding of flood control facilities that provides for future widening
of roadways. The District will pay for the replacement of only those portions
of bridges and culverts that exist at the time the drainage facility is
constructed. The cost of extra length or width of culverts and bridges that are
needed for future widening is the responsibility of the agency that controls
the roadway.

•Three facilities need to be lengthened to provide for the future
widening of Irvine Avenue:
A. The Irvine Avenue culvert -- Lengthen culvert from 79 feet to 110
feet = 42 feet ($175,000)
B. The Mesa Drive Culvert -- Lengthen culvert from 54.7 feet to 62 feet
= 7.3 feet ($25,000).
C. Single - barrel extension upstream of Mesa Drive approximately 350
feet (allows for the widening where the channel parallels Irvine
Avenue)($389,000).
All of the proposed facilities to provide for future widening are
within the boundaries of Newport Beach. On March 23, 1987, the City Council
adopted a resolution requesting the County to provide $175,000 from their Major
Bridge Program to fund the increased length of the Irvine Avenue culvert. The
County has provided these funds.
The lengthening of the Mesa Drive culvert primarily serves the Santa
•Ana Heights area, and the Santa Ana Heights Redevelopment Agency has agreed to
fund the $25,000 for this portion of the project.
County traffic studies predict that the future growth in traffic on
Irvine Avenue will be as follows:
Santa Ana Heights Development Agency 52.1%
Airport Expansion 17.5%
City 30.4 %*
*Includes regional growth which will occur in Costa Mesa,
Irvine, and County areas.
The County has asked the City to pay for 30.4% of the cost of
extending the single - barrel culvert (estimated to be $120,000). The Development
Agency will advance the money to the City until such time as the City par-
ticipates in a road widening project for Irvine Avenue in three to four years.
At that time, the City's share would come from the Circulation and
Transportation fund, the Gas Tax fund and possibly the Arterial Highway
Financing Program (AHFP).
• As a part of the proposed Santa Ana Heights annexation, the staff will
request that the rather unusual City boundary along the Santa Ana -Delhi Channel
between Mesa Drive and Irvine Avenue be adjusted as shown on the attached
sketch. If this adjustment occurs, the culverts and channel work will no longer
be in the City and there will be no obligation for the City to pay for the
single - barrel culvert extension if the de- annexation occurs prior to the road
widening.

COOPERATIVE AGREEMENT NO. D87 -093 WITH.THE CITY OF NEWPORT BEACH FOR SANTA
(FLOOD): Environmental Management Agency, on behalf of the Orange County
P oo-TTontrol District, requests approval of Cooperative Agreement No. D87 -093
providing for reimbursements from the Orange County Development Agency, City
of Newport Beach and the County Airport and Road funds, for the construction
of road betterments to Irvine Avenue and Mesa Drive.
MOTION: On motion by Supervisor Vasquez, seconded by Supervisor Riley, the

THIS AGREEMENT, for purposes of identification, hereby dated the

California, hereinafter referred to as
"DISTRICT,"
THE COUNTY OF ORANGE, a political subdivision of
the State of California, hereinafter referred to
as "COUNTY,"
THE CITY OF NEWPORT BEACH, a municipal
corporation, hereinafter referred to as "CITY,"
THE ORANGE COUNTY DEVELOPMENT AGENCY, a body
corporate and politic in the State of
California, hereinafter referred to as
"DEVELOPMENT AGENCY."
W I T N E S S E T H
WHEREAS, DISTRICT proposes to improve the Santa Ana -Delhi Channel in the
vicinity of Irvine Avenue and Mesa Drive by constructing a concrete rectangular
channel and culvert crossings hereinafter referred to as PROJECT; and
WHEREAS, the Irvine Avenue bridge over said channel does not comply with
current design loading requirements; and
WHEREAS, DISTRICT in implementing PROJECT proposes to remove existing
bridges over the Santa Ana Delhi Channel at Irvine Avenue and at Mesa Drive and
replace the two bridges with triple barrel culverts; and
WHEREAS, the Irvine Avenue and Mesa Drive culverts are within present CITY
limits and will benefit CITY and COUNTY in accomplishing future road improvements if
culverts are lengthened to accommodate future road improvements; and

WHEREAS, COUNTY EIR 508 and 508A on the John Wayne Airport expansion and
Santa Ana Heights redevelopment determined a need to implement traffic mitigation
measures and widen Irvine Avenue, and proposed that CITY, DEVELOPMENT AGENCY and
COUNTY Airport fund their pro rata shares of cost; and
WHEREAS, the lengthening of the culverts at Irvine Avenue and Mesa Drive
is in addition to what is needed for flood control purposes but is necessary to
implement future traffic mitigations on Irvine Avenue and Mesa Drive that are
described in EIR 508 and 508A; and
WHEREAS, CITY is considering a request to the Local Agency Formation
Commission (LAFCO) to de -annex those portions of the Santa Ana -Delhi Channel
northerly of the south right -of -way line of Mesa Drive which would remove most of
PROJECT from CITY jurisdiction; and
WHEREAS, DISTRICT funding policy for replacement of bridges and culverts
crossing DISTRICT facilities was set forth in Board of Supervisors Resolution
No. 68 -458; and
WHEREAS, Irvine Avenue is designated a Modified Major (6 -lane divided)
highway on COUNTY's Master Plan of Arterial Highways and on the Santa Ana Heights
Specific Plan, but is still shown a lesser width on CITY's master plan of highways;
and
WHEREAS, DEVELOPMENT AGENCY, COUNTY Airport and CITY desire to fund each's
pro rata share of improvements associated with Irvine Avenue (except bridge
replacement), based upon generation of additional traffic from each entity as
forecasted by COUNTY's analysis as follows:

WHEREAS, DEVELOPMENT AGENCY is willing to pay for the cost of lengthening
the Mesa Drive culvert to span the 60 -foot street right of way; and
WHEREAS, DEVELOPMENT AGENCY is willing to contribute CITY's share of cost
for Irvine Avenue until such time as CITY participates in the widening of Irvine
Avenue to six (6) travel lanes; and
WHEREAS, DISTRICT will include the lengthening of the culverts in its
construction contract provided it is reimbursed for the additional cost; and
WHEREAS, COUNTY budgets and administers both the John Wayne Airport
Enterprise Trust Fund, hereinafter called "Airport Trust," and a Major Bridge
Program, hereinafter referred to as "Bridge Fund "; and
WHEREAS, COUNTY has programmed $175,000 in its Bridge Fund to pay for
lengthening the culvert at Irvine Avenue beyond what is DISTRICT responsibility; and
WHEREAS, DISTRICT staff requested CITY, by letter dated August 25, 1986,
to determine PROJECT's conformance to CITY's General Plan pursuant to Government
Code Section 65402; and
WHEREAS, DISTRICT's Board of Supervisors Resolution No. F87 -8, dated
May 12, 1987, requests CITY approval of PROJECT plans and specifications pursuant to
the Orange County Flood Control Act.
NON, THEREFORE, IT IS AGREED by and between the parties hereto as follows:
I. DISTRICT SHALL:
A. Be and is hereby designated as Lead Agency for PROJECT and shall
prepare and process all necessary environmental documents required by the California
Environmental Quality Act of 1970 (CEQA) as amended.
B. Be and is hereby designated as Project Engineer, Contracting and

Construction Agent for the parties to do and perform all things necessary in order
to design and construct PROJECT and to execute and deliver all documents required in
connection with the construction and completion of PROJECT including its Notice of
Completion and final accounting report.
C. Prepare contract plans and specifications for PROJECT based on
criteria set forth in the current Design Manual of the Orange County Flood Control
District as approved by Director, County of Orange Environmental Management Agency,
hereinafter referred to as DIRECTOR EMA.
D. Design culvert crossings for ultimate right of way widths of
60 feet for Mesa Drive and 108 feet for Irvine Avenue, as compatible with the Santa
Ana Heights Specific Plan.
E. Submit PROJECT plans and specifications for approval by CITY's
City Engineer or his designee, hereinafter referred to as "CITY ENGINEER," prior to
advertising PROJECT for construction bids, and obtain approval of PROJECT plans by
CITY prior to contract award.
F. During the period of construction, have jurisdiction over the
entire construction area including the portion of PROJECT within CITY limits.
G. Be financially responsible for all PROJECT cost except those costs
identified in this Agreement as the responsibility of the other Parties hereto; and
shall advance all funds required for award of contract.
For purposes of this Agreement, four portions of PROJECT are identified as
not being DISTRICT's cost responsibility, defined as follows:
1. "Mesa RCB Extension ": The cost to lengthen the replacement triple -box
culvert at the Mesa Drive crossing 7.3 feet more than existing (62 -foot -wide road
structure minus 54.7 -foot -wide existing bridge); plus the share of cost of any
contract change order concurred by DEVELOPMENT AGENCY's Executive Director for the
purpose of facilitating anticipated future improvements to Mesa Drive;
2. "Irvine RCB Extension ": The cost to provide an extra 42.4 feet of

length of the replacement triple -box culvert at the Irvine Avenue crossing (110 -
foot -wide road structure minus 79 -foot -wide existing bridge, plus adjustment for
skew);
3. "Single Barrel Extension ": The cost to extend one barrel of the
triple -box culvert approximately 350 feet upstream of Mesa Drive to allow for future
widening of the east side of Irvine Avenue, including incremental RCB length for
ultimate curb return areas at Mesa Drive;
4. "Orchard Signal ": The cost, including value of COUNTY- furnished
signal equipment, to install a new traffic signal on Irvine Avenue at Orchard Drive
as identified in the Santa Ana Heights Specific Plan.
5. Each of items 1, 2, 3, and 4 above will include prorated shares of
certain other generalized contract items plus engineering and administrative costs,
and will be determined using final dimensions and final contract prices, on the
basis shown on Exhibit "A" which is attached and made part of this Agreement. The
cost of any contract change orders for the purpose of facilitating future road
betterments will be considered to be a part of said items 1, 2, 3 or 4, whichever
applies.
II. CITY SHALL:
A. Hereby determine that PROJECT is compatible with CITY's General
Plan.
B. Hereby approve the PROJECT plans and specifications as to the
contemplated flood control improvements within CITY boundaries, pursuant to the
Orange County Flood Control Act.
C. Be financially responsible for a thirty and 4/10 percent (30.48)
share of Single Barrel Extension, as defined in Section I.G, although said share may
be advanced by DEVELOPMENT AGENCY. Said share is estimated to be approximately One
Hundred Twenty Thousand Dollars ($120,000), as shown on Exhibit "A," and shall not
exceed One Hundred Fifty Thousand Dollars ($150,000) unless approved in writing

by CITY.

D. Reimburse DEVELOPMENT AGENCY for any funds advanced by it on
CITY's behalf for PROJECT, payable upon the widening or restriping of Irvine Avenue
to provide six (6) travel lanes adjacent to PROJECT, provided the Single Barrel
Extension remains within CITY boundaries at the time of contract award for Irvine
Avenue widening, and provided the Single Barrel Extension is not an ineligible item
for State gas tax expenditure.
E. Upon completion and acceptance of PROJECT by DISTRICT, accept
maintenance responsibility of roads rebuilt by PROJECT within CITY limits.
III. COUNTY SHALL:
A. Reimburse DISTRICT using its Airport Trust, for seventeen and 5/10
percent (17.58) share of Single Barrel Extension, as defined in Section I.G. Said
share is estimated to cost approximately Seventy Thousand Dollars ($70,000), as
shown on Exhibit "A," and shall not exceed One Hundred Thousand Dollars ($100,000)
unless approved in writing by COUNTY.
B. Reimburse DISTRICT using its Bridge Fund, the entire share of cost
for Irvine RCB Extension, as defined in Section I.G. Said share is estimated to be
One Hundred Sixty -five Thousand Dollars ($165,000), as shown on Exhibit "A."
C. Reimburse DEVELOPMENT AGENCY for funds it advances on behalf of
CITY pursuant to Paragraph IV.B herein, in the event CITY de- annexes Irvine Avenue
adjacent to PROJECT prior to the contract award for widening Irvine Avenue adjacent
to PROJECT; such reimbursement by COUNTY shall be made after de-annexation, as soon
as COUNTY road funds for such reimbursement are approved in COUNTY's budget.
IV. DEVELOPMENT AGENCY SHALL:
A. Reimburse DISTRICT for the cost of Mesa RCB Extension plus a
fifty -two and 1 /10 percent (52.18) share of Single Barrel Extension, both as defined
in Section I.G herein. Said share of cost is estimated as $25,000 for Mesa RCB
based on 7.3 -foot extension, plus $200,000 for the share of the Single Barrel

Extension, plus $90,000 for the Orchard Signal. Such reimbursement for the Mesa RCB
Extension, the Single Barrel Extension and the Orchard Signal shall not exceed the
aggregate sum of Three Hundred Ninety Thousand Dollars ($390,000) unless approved by
AGENCY.
B. Reimburse DISTRICT for CITY's share of PROJECT cost set forth in
Paragraph II.C, as an advance on behalf of CITY in the event that the final
accounting report for PROJECT is approved prior to the award of contract for the
widening of Irvine Avenue adjacent to PROJECT to provide six (6) travel lanes. Such
advance on CITY'S behalf shall not exceed the sum of One Hundred Fifty Thousand
Dollars ($150,000) unless approved by DEVELOPMENT AGENCY.
V. PAYMENT AND FINAL ACCOUNTING:
Within four months after acceptance of PROJECT improvements by
DISTRICT, DISTRICT shall prepare a Final Accounting Report for PROJECT construction
for review and approval by CITY ENGINEER and by authorized representatives of the
other Parties hereto. Within thirty days (30 days) after approval of the Final
Accounting Report by the authorized representatives, the Parties hereto shall
reimburse DISTRICT for each Party's own respective share of PROJECT cost subject to
each's cost limitation, if any, and other conditions as provided in this Agreement.
VI. IT IS MUTUALLY UNDERSTOOD AND AGREED:
A. This agreement will automatically terminate in the event DISTRICT
does not award a contract for PROJECT construction prior to July 1, 1988, unless
extended by mutual agreement.
B. Nothing herein shall limit DISTRICT'S right, at its sole discre-
tion, to reject any or all bids for PROJECT construction, for reasonable cause.
C. That neither CITY nor any officer or employee thereof shall be
responsible for any damage or liability occurring by reason of anything done or
omitted to be done by DISTRICT under or in connection with any work, authority or
jurisdiction delegated to DISTRICT under this agreement. It is also understood and

agreed that, pursuant to Government Code Section 895.4, DISTRICT shall fully
indemnify, defend, and hold CITY harmless from any liability imposed for injury (as
defined by Government Code Section 810.8), occurring by reason of anything done or
omitted to be done by DISTRICT under or in connection with any work, authority or
jurisdiction delegated to DISTRICT under this agreement.
D. That neither DISTRICT nor any officer or employee thereof shall be
responsible for any damage or liability occurring by reason of anything done or
omitted to be done by CITY under or in connection with any work, authority or
jurisdiction not delegated to DISTRICT under this agreement. It is also understood
and agreed that, pursuant to Government Code Section 895.4, CITY shall fully
indemnify, defend, and hold DISTRICT harmless from any liability imposed for injury
(as defined by Government Code Section 810.8), occurring by reason of anything done
or omitted to be done by CITY under or in connection with any work, authority or
jurisdiction not delegated to DISTRICT under this agreement.
