WATER DISTRICT SERVICE CONNECTION (CM -13) AT BONITA CREEK PARK
(C- 2697 -B)
RECOMMENDATIONS:
1. Accept the work.
2. Authorize the City Clerk to file a Notice of Completion.
3. Authorize the City Clerk to release the bonds 35 days
after the Notice of Completion has been recorded in
accordance with applicable portions of the Civil Code.
DISCUSSION:
The contract for the construction of the subject project has
been completed to the satisfaction of the Public Works Department.
The Bid Price was $379,800.00
• Amount of Unit Price Items constructed 379,800.00
Amount of Change Orders 31.838.00
Total Contract Cost $411,638.00
Four Change Orders were issued. The first, in the amount of
$5,603.00, provided for a stainless steel control panel in lieu of that
specified. The second, in the amount of $22,000.00, provided for a
change in the site grading to accommodate the existing MWD pipeline, a
change in the electrical feed and modifications to the pipe railing
around the structures. The third, in the amount of $2,335.00, provided
for a change in the pressure sensor and gage and associated telemetry.
The fourth, in the amount of $1,900.00, provided for additional changes
in the telemetry and start -up services.
Funds for the project were budgeted in the Water Fund, Account
No. 50- 9297 -161.
The contractor is Pascal & Ludwig Engineers of Ontario.
The contract date of completion was December 20, 1989. During
excavation the MWD main was found to be at a higher elevation than shown
on the record drawings. The contractor was delayed while the structures
and site work were redesigned. The telemetry and automatic controls
were obtained from a "sole source" manufacturer. This company changed
ownership twice during the contract time, each change resulting in
aAditional delays. The work was completed by May 31, 1991.

RECOMMENDATIONS:
1. Find that lowest bidder, Pascal & Ludwig Engineers, can meet the
requirements for completing the proposed contract work and
declare him the "low bidder".
2. Award Contract No. 2697 -B to Pascal & Ludwig Engineers in the
amount of $ 379,800.
3. Authorize the Mayor and the City Clerk to execute the contract on
behalf of the City.
DISCUSSION:
At 10:00 a.m., on March 16th, 1989, the City Clerk opened and read the
following bids for the subject project:

The low bid was 11% below the Engineer's Estimate of $ 427,000.
The low bidder, Pascal & Ludwig Engineers, is a well qualified general
contractor who has satisfactorily performed similar construction for other reputable
agencies.

It is recommended that the Council authorize award of the project
contract as described.
The project provides for the construction of a planned component of
the Newport Beach Water Master Plan which calls for the installation of a
supplemental water supply connection to the Metropolitan Water District (MWD) of
Southern California's Orange County Feeder No. 1 pipeline. The connection site is
within the Newport North development in the 12 -acre, Bonita Creek Park.
The proposed connection is sized for an ultimate capacity of 15 (cubic
feet per second) cfs, but will initially be equipped to provide a 7.5 cfs flow. Principal
components of the project construction include the following City and MWD owned
facilities: (1.) A tapping valve turn-out vault made of reinforced concrete. This vault
will be entirely below- grade. (2.) A run of approximately 200 feet of 18 -inch steel pipe
from the turnout vault to (3J a 36 foot long by 12 foot wide, jointly owned, vault
structure for metering and control piping. The joint vault will be partially below -
grade adjacent to the existing bike trail beneath the grass covered berm adjacent to
the park's softball diamond. The structure will not be visible from park locations
other than the bike trail, with the exception of several appurtenant electric panels
and ventilation stacks, which will be painted red to match the theme of the park's
existing architecture.
The plans and specifications were prepared under contract to
the City by ASL Consulting Engineers.
Construction is scheduled to commence immediately upon award of
contract to meet MWD's 1988 -89 "shut -down window'. MWD does not allow service
connection construction requiring shut -downs to occur other than during the low -
demand, winter months. The end of the "shut -down window' is April 15, 1989. This
will require the contractor to perform the portion of the work pertaining to the tap
into MWD's pipeline first. Constructed as planned, the proposed work could be
completed by mid- August 1989.

CONTRACT
THIS AGREEMENT, entered into this 27th day of March , 19 89 ,
by and between the CITY OF NEWPORT BEACH, hereinafter "City," and Pascal &
Ludwig Engineers , hereinafter "Contractor, "is made with
reference to the following facts:
(a) City has heretofore advertised for bids for the following
described public work:

ble bidder on said public work, and Contractor's bid, and the compensation set
forth in this contract, is based upon a careful examination of all plans and

NOW, THEREFORE, the parties hereto agree as follows:
1. Contractor shall furnish all materials and perform all of the v. -Irk
for the construction of the following described public work:

This compensation includes 1) any loss or damage arising from the nature cf the
work; (2) any loss or damage arising from any unforeseen difficulties or obstruc-
tions in the performance of the work; (3) any expense incurred as a result c' ary
suspension or discontinuance of the work; but excludes any loss resulting from
earthquakes of a magnitude in excess of 3.5 on the Richter Scale and tidal 'naves,
and which loss or expense occurs prior to acceptance of the work by City.
3. All of the respective rights and oblidations of City and Contractor
are set forth in the contract documents. The contract documents are incorporated
herein by reference as though set out in full and include the following:

4. Contractor shall assume the defense of, and indemnify and hold
harmless, City and its officers, employees and representatives from all claims,
loss or damage, except such loss or damage proximiately caused by the sole

DISCUSSION:
The Newport Beach Water Master Plan calls for the
installation of a supplemental water supply connection to the
Metropolitan Water District (MWD) of Southern California's Orange
County Feeder No. 1 pipeline at such time as development and water
supply demand dictates. In 1986 the Newport North development
added approximately 900 housing units and a 12 -acre park. These
have both increased demand and provided a site for the subject
connection, as the project is to be constructed in Bonita Creek Park,
(Refer to Exhibit 'B" for project location), near the University Drive
Bridge.
The City Council, on May 22, 1988, awarded a contract to
ASL Consulting Engineers for design of the Project. Beginning in July of
1988, plans and specifications were put through an extensive design
review process at MWD which was completed February 9th, 1989, eight
months after the initial design was submitted.

The proposed connection as designed has an ultimate
capacity of 15 cubic feet per second (cfs), but will initially be equipped
to provide a 7.5 cfs flow. The subject project for which bids will be
advertised, will be a joint City, MWD effort. The City, using a private
contractor will provide the majority of the labor and installation of the
facilities. MWD will furnish a large portion of the fabricated materials
for contractor installation and will perform the shutdown and tap
connection to the Orange County Feeder Pipeline. MWD will also field
fabricate and install some of the connection's metering equipment.
The Engineers' Estimate for the Project is $687,000.
The costs are distributed as indicated below. The City will reimburse
MWD for its expenses. Funds for the work are included in the
approved 1988 -89 budgeted water capital projects. The estimated
time of completion is 190 calendar days.

The City must complete the design and be ready to award
the contract for construction during MWD's 1988 -89 "shut -down
window ". MWD does not allow service connection construction
requiring shut -downs to occur other than during the low- demand,
winter months. Due to the rapidly approaching deadline for MWD
shutdowns, the successful bidder must commence work immediately
upon award of the contract. The resulting completion date will be
early September 1989. If the Contractor is unable to meet this
scheduled "window ", construction of the service connection could
commence, but activation of the connection would have to be delayed
until the winter of 1989 -90.

The project is a Metropolitan Water District (MWD) service connection for
the delivery of treated water from the Orange County Feeder Pipeline to the
City of Newport Beach. The connection will be capable of delivering an
ultimate capacity of 15 cfs, but is to be initially equipped to deliver 7.5 cfs.
The project construction for the service connection will consist of a turnout
valve and its vault; a run of 18 -inch connecting piping; a jointly owned, City -
MWD metering vault; and the City's 20 -inch discharge piping connecting to
the City distribution piping system. All of the facilities will be underground
save for a few vault vent stacks, access openings and railings.
The project site is located in the City of Newport Beach approximately 800 ft.
easterly of the intersection of LaVida Street and University Drive (between
jamboree Road and MacArthur Boulevard). The facilities will be installed in
the northeast corner of a 12 -acre, City of Newport Beach park site.
The site is accessible from University Drive, immediately at the west end of the
Bonita Creek Bridge; or can be accessed from LaSalud Street by entering through
the entrance to "Bonita Creek Park" and traversing the park's parking lot.
The site can be found in the 1988 version of the "Thomas Bros. Map Book" on
page 32, in the southeasterly corner of block "B-l". Note that this area is
newly developed and will not appear in the older map books.
The majority of the proposed project's piping lies within a newly constructed
City of Newport Beach park, known as "Bonita Creek Park ". There is a small
portion of the piping and facilities which will be situated in an adjacent
drainage course, called "Bonita Creek ". The creek right -of -way is under the
jurisdiction of the County of Orange, Flood Control District, but MWD has
easement rights for the "Orange County Feeder" pipeline and for construction
and maintenance of appurtenant facilities.

1 b. The proposed project will require excavation for construction
which will result in displacement, fill and remmpaction of the
backfilled materials. No impacts to the environment are expected
since the City of Newport Beach has required and obtained a
detailed soils report and requires the issuance of a grading permit
prior to commencement of construction of the project. This will
insure that the project meets the standards of the current building
codes, erosion control and geotechnical engineering standards.
1 e. The project has the potential to increase wind and water erosion in
and around the construction site. Wind erosion may occur on site
during certain construction operations. Localized watering during
excavation will reduce the adverse affect to a level of insignificance.
Water erosion could also occur as a result of the new construction
by being in proximity to a drainage course. This result will also be
reduced to a level of insignificance by specific provisions of an
erosion and siltation control plan which will be required as a part of
the grading permit. All construction shall be in accordance with the
requirements of the design specifications of the City of Newport
Beach, which also detail specific erosion control measures.
1 f. If soils erosion occurs, the resultant siltation could affect the stream
courses of Bonita Creek, San Diego Creek and Upper Newport Bay.
This effect will be reduced to a level of insignificance by specific
provisions of an erosion and siltation control plan which will be
required as a part of the grading permit.
1 g. During the construction activities grading and trenching operations
for underground utilities may temporarily pose a potential hazard
to construction personnel. This temporary potential hazard will be
mitigated by following the construction specifications which require
the contractor to follow O.S.H.A. safety guidelines for shoring and
trench safety and for securing the site from trespass by persons other
than the contractor's employees.
2 a &b. The construction of the project and its excavation will produce two types
of air contaminants: exhaust emissions from construction equipment
and fugitive dust generated as a result of soil movement.
Exhaust emissions from construction equipment: Exhaust emissions
from construction activities include those associated with the transport
of workers and machinery to the site as well as those produced on site
as the equipment is used.

2 a &b. Fugitive dust emissions: Construction activities are a source of fugitive
dust emissions that may have a substantial temporary impact on local air
quality. Emissions are associated with land clearing, ground excavation,
grading operations and construction of structures. Dust emissions vary
substantially from day to day, depending on the level of activity, the
specific operations and the prevailing weather. Based upon field
measurements of suspended dust emissions from apartment and
shopping center construction operations is 1.2 tons of fugitive dust per
acre of construction per month of activity (USEPA., AP-42, 1977).
The emissions produced during grading and construction activities,
although of short -term duration, could be troublesome to workers and
to a lesser extent the adjacent, but remote developments, even though
prescribed wetting procedures are followed. These emissions are not,
however, expected to cause ambient air quality standards to be exceeded
on site.
3 a. The construction of the proposed project will result in short -term
impacts on the course of the drainage of Bonita Creek as a result of
following the erosion control and siltation mitigation requirements of
the grading permit. No increase in quantity or degradation of quality
is expected and the drainage course will be restored to its original
preconstruction condition. The temporary effects are considered
insignificant with the grading permit conditions imposed for siltation
and erosion control.
3 e. The proposed construction will include trenching and underground
excavations below the natural groundwater table. Construction
dewatering will be necessary to temporarily remove these from the site.
Potential water quality degradation and siltation impacts will be mitigated
to a level of insignificance by permit provisions imposed by permit from
the Regional Water Quality Control Board for construction dewatering.
3 f. The proposed construction will include underground excavations below
the natural groundwater table. Construction dewatering will be necessary
to temporarily remove these from the site. The result will be the removal
of a small local quantity of subsurface water. The proposed scenario for
permitted removal of the nuisance groundwater shall include pumping,
collection into a manifold of piping and discharge into a siltation vessel
prior to release downstream in Bonita creek. The potential impacts will be
mitigated to a level of insignificance by permit provisions imposed by
permit from the Regional Water Quality Control Board for construction
dewatering; by the fact that the pumping will be highly localized and
temporary in nature and that the water will be released into the same
drainage course from which it is withdrawn.

6b. The proposed construction and appurtenant operations will result in
short -term construction noise impacts. Operation of construction
equipment will be necessary to complete the project, although
moderately sized, versus heavy equipment is all that will be required
to complete the work. Noise from construction equipment will be
confined to the vicinity of the construction site. There are no
dwelling units or business establishments within 1000 feet of the site.
Impacts will be confined to the vicinity of the construction site and
will be mitigated to a level of insignificance by provisions imposed by
the City construction specifications which require adherence to
O.S.H.A. safety regulations pertaining to noise emissions and ear
protection for construction workers.
14 a. The proposed project, when completed will significantly enhance the
fire protection capability of the public water system in the vicinity of
the project.
14 e. The proposed project being the installation of a public water supply
facility will result in an additional maintenance responsibility for the
Newport Beach Utilities Department. However, the facility proposed
will be relatively low- maintenance and the City has the ability to serve
this project with existing staff.
16 c. The proposed project is a substantial addition to the City's water
system and will improve utility service and fire protection for
the City.

Mitigation Measures:
Construction of the project shall be subject to a grading permit to be
approved by the Building Department.
2. The grading shall be done in accord with the grading permit and the
construction plans which include a complete inventory of temporary and
permanent drainage facilities, to minimize impacts from silt, debris and
other water pollutants.
I The grading permit shall include a description of haul routes, access
points to the site, watering and sweeping program designated to
minimize the impact of haul operations.
4. An erosion , siltation and dust control plan shall be submitted and be
subject to the approval of the Building Department and a copy forwarded to
the California Regional Water Quality Control Board, Santa Ana Region.
5. The grading, excavation and recompaction of the site and utility trenches
shall be conducted in accord with the plans and specifications prepared by a
licensed civil engineer and based on the recommendations of a geotechnical
engineer or an engineering geologist subsequent to the completion of the
project. Permanent reproducible copies of the "Approved As- Built'
construction plans on standard size sheets shall be furnished to the City
Public Works and Utilities Departments upon completion of the project.
Mitigation Monitoring;
Mitigation measures 1 thru 4 shall be verified for compliance prior to
issuance of the grading permit by the City of Newport Beach. Mitigation
measure 5 shall be verified by the City Utilities Department staff in
conjunction with the Building Department during actual construction.
