SUBJECT: CARNATION COVES BEACH REPLENISHMENT - COOPERATIVE
AGREEMENT WITH COUNTY OF ORANG7HPAMlOR, BEACHES AND PARRS

RECOMMENDATION:
Authorize the 4layor and City Clerk to execute Cooperative
Agreement No. D89 -076 with the County of Orange to dredge
sand onto Carnation Coves beach.
DISCUSSION:
On October 24, 1988, the City Council approved a report
from the Tidelands Affairs Committee and directed City staff to
pursue a cooperative project to dredge sand onto Carnation Coves
beach. A copy of that report is attached.
Since that time, City staff has worked with Pacific Bell
to encase the phone cable on the beach; Carnation Coves Homeowners
Association to obtain Right -of -Entry agreements for construction;
and the County of Orange /Harbor, Beaches and Parks to obtain
necessary permits for the project and a cooperative agreement to
dredge sand onto the beach. Pacific Bell completed the concrete
encasement in March 1991 and Right-of-Entry-agreements have now
been received from each property owner of Carnation Coves.
This agreement with Orange County provides the�'&nding
and administration necessary to dredge sandy material from'.County
tidelands adjacent to the Newport Harbormaster Facility onto the
beach in Carnation Coves. Terms of the agreement are as follows:
COUNTY agrees:
1. To provide engineering services necessary to
complete the maintenance dredging project.
2. To prepare plans and special provisions for project
and to advertise and administer construction of
project.
3. To obtain Corps of Engineers Permit and other
regulatory agency permits necessary to accomplish
project.
4. To have City named as an additional insured in the
contract liability insurance.

CITY agrees:
1. To provide County with plan for placement of
material in Carnation Coves.
2. To provide County with Right -of -Entry Permits from
Carnation Coves residents.
3. To fund 25% of construction cost not to exceed
$10,000.00.
The County is working to complete the plans and
specifications for the project and plans to award a construction
contract late this summer or during the fall. The City will
construct a street end railing and stairway improvements, when the
dredgeing project is completed.
The City share of the funding for the project is
available in the current budget Account No. 02- 4197 -491.

a. Provide $45,000 ($11,250.00 City and $33,750.00 Carnation
Coves Association) in the 1989 -90 Budget.
b. Direct the staff to prepare a cooperative agreement with the
Carnation Coves Association and /or property owners to
implement the project.
c. Direct staff to pursue preparation of plans and specifications
for project.
d. Direct staff to obtain permits for the project.
e. City participation in this project is not to be considered a
precedent for any potential future projects.
f. City participation in this project does not imply any City
responsibility for the existing private bulkheads.
INTRODUCTION:
On May 9, 1988, the City Council reviewed a letter from the
reactivated Carnation Cove Property Owners Association which expressed concern
about the beach and storm drain conditions in Carnation Cove. The Council
directed the Tideland Affairs Committee to consider the matter and report back
to the Council. Since that time the Committee and City staff have reviewed
the 1980 Carnation Cove report prepared by the coastal engineering firm of
Moffatt and Nichols, have met with many Carnation Cove property owners and held
a meeting before the Tideland Affairs Committee where representatives from
Moffatt and Nichols and the Carnation Cove Property Owners Association discussed
the Association's concerns and possible solutions.

• The concerns expressed by property owners, with regard to the
_ conditions of the beach and storm drains, are more specifically:
1. Concrete debris and rocks are a hazard along the base of the
bulkhead wall. Some debris from an abandoned boat ramp, many
rocks and phone cables are exposed. From photos taken in 1980
there has been very little change in the last 8 years.
2. There is no barrier along the bulkhead wall at the City street
end.
3. Lack of sand along the bulkhead wall in Carnation Cove. There is
sand in the northern portion of the Cove but there is no sand in
the central or southern sections. From photographs taken in 1980
there has been very little change in the last 8 years.
4. Sand has filled in under many of the slips. Periodic dredging of
the slips stopped in the late 1970's. Many of the residents
indicate that dredging is needed now to fully utilize their slip
areas.
• 5. During storms, which have occurred since the sand was eroded from
in front of the bulkhead wall, waves have splashed over the
bulkhead wall. The property owners are concerned that this is
happening more frequently and has caused some damage to patio and
deck areas.
DISCUSSION:
At the meeting with the Tideland Affairs Committee the problems as
stated above were made more clear and some possible solutions were discussed
with Dr. Craig Everts, from Moffatt and Nichol engineers. Dr. Everts made the
following points:
1. Beach erosion and slip shoaling are likely related and as sand is
placed against the wall an increase in shoaling rate could be
expected.
2. Dredging, however, still appears to be the most likely solution to
the shoaling problem unless the piers are extended into deeper
• water.
3. Structural solutions to reduce shoaling will be costly, may not
work, and may be environmentally and esthetically undesirable.
4. A 350 foot extension of the storm drain combined with sand
replenishment was considered in the 1980 report. The 1980 rough
cost estimate of $531,700 would probably be increased to
approximately $900,000 in today's dollars.

• Discussions concluded with a request for Moffatt and Nichols to
prepare a proposal to:
1. Provide sediment sampling, soil analysis, soundings and storm
reoccurrence evaluation, which could be used to propose a beach
replenishing project and estimate expected reoccurrence to
maintain the restored beach.
2. Analyze and estimate cost for structural solution which would
provide rock structures perpendicular to the bulkhead wall.
3. Analyze and estimate cost for a structural solution which would
provide a rock structure or wall parallel to existing bulkhead
similar to wall and beach in the area of the Coast Guard
headquarters.
The proposal from Moffatt and Nichols was received and proposed to do
the work as described above for a fee not to exceed $26,700. $14,000 would be
for soil sampling and testing by a geotechnical firm; and the remaining $12,700
for professional and technical service from Moffatt and Nichols.
COMMENTS AND OBSERVATIONS:
After reviewing this proposal, the 1980 Moffatt and Nichols Report,
the updated report from Dr. Everts and the comments from the property owners
assocation, the City staff has offered the following comments and observations:
1. The underlying fee title to the area in question is held by the
adjacent private property owners. It is not a public beach, there
is no public parking and public access is limited.
2. Both the 1980 Moffatt & Nichols Report and the update Report,
prepared by Dr. Everts, cc.iclude that the beach erosion and
shoaling in Carnation Cove are not, to a significant extent,
caused by water and sediment discharged from the storm drain.
3. Concern for storm waves splashing over the bulkheads was mentioned
by some of the property owners during the meetings. Wave data
collected by the U.S. Army Corps of Engineers since 1900 reveals
that prior to 1980 major storm wave events were measured on only 3
• or 4 occasions in 1939, 1958, 1968 and 1978. Since 1980 8 major
storm wave events have occurred. The whole Southern California
coast is experiencing sand erosion and wave damage to some extent.
New private developments near the entrance to Newport Bay have
taken this into account and are designing to minimize possible
wave damage. When homes are built very near the water, no design
can guarantee 100% protection from wave damage, it can only serve
to minimize damage.

4. Staff has reviewed the street end, and additional efforts will be
undertaken to remove some of the debris from below the wall at the
street end. In addition a railing could be installed across the
street end.
5. Comments from Dr. Everts indicate that the design for possible
structural solutions to retain sand against the bulkhead needs
careful study. Carnation Cove is impacted by currents from both
incoming and outgoing tides, storm waves and reflected waves which
individually or in combination can erode sand from different
directions. In addition to the complexity of design, obtaining
permits to construct structures in this area is questionable due
to environmental constraints associated with esthetics and the
filling in of tidal areas.
Staff is concerned that the high cost for structural solutions
(one half million to over one million dollars), the complexities
of design, and the anticipated difficulty in obtaining permits do
not warrant pursuing these structural solutions.
6. Dredging appears to be the most likely solution to the shoaling
problem under the slips. In addition, the dredging can be used to
restore sand adjacent to the bulkhead and at intervals, depending
on the severity and frequency of storms (perhaps every 2 to 6
years) maintenance dredging required under the slips would act to
nourish the sand adjacent to the wall.
The estimated cost for a dredging project to provide a 4 foot fill
against the bulkhead is as follows:
a. 4500 C.Y. @ $8.00 = $36,000
b. Contingencies 10% = 3,600
c. Permits, Engineering & Admin. = 5 400
Total . $*LO, -6
The County dock property beach at the north end of Carnation Coves
traps sand. City staff will work with the County to determine if
future maintenance dredging of the County dock property might help
to restore Carnation Coves beach.
8. While the proposed Carnation Coves dredging involves work on
private property, county tidelands, and private slip areas it also
involves the City owned street end. Because the City owned street
end is within the Carnation Cove area impacted by the loss of sand,
and because storm flows from the storm drain do impact some sand
erosion adjacent to the street end, City staff concludes that
there is justification for the City to participate financially in
a dredging project with the property owners in the . amount of 25%
of the project cost. Future participation in maintenance dredging
should be considered at the time a request is made by the
Association.

• CONCLUSIONS:
After reviewing the request from the Carnation Coves Association,
the Moffat and Nichol reports and City staff comments, the Tideland Affairs
Committee makes the recommendations set forth at the beginning of this report.

REPLENISH SAND BEACH

CARNATION COVE
The undersigned owner of real property located at
Newport Beach, California,
hereinafter referred to as "OWNER" in return for consideration by
the City of Newport Beach, and the County of Orange, their
contractors and agents, hereinafter referred to as "CITY", hereby
grants to CITY the Right Of Entry to place dredged material on
the beach at Carnation Cove upon the following terms and
conditions:
1. OWNER hereby grants CITY an irrevocable right to enter
upon the property named above at any time within a
period of 12 months from the date of this instrument to
• perform work necessary to place dredged material from
the Newport Harbormaster area onto the beach at
Carnation Cove.
2. All tools and equipment placed upon the property by the
CITY shall remain the CITY'S and shall be removed
within .a reasonable period after placement of dredging
material.
3. The CITY shall have the right to patrol and inspect
work on the property during the construction period.

A. Upon completion of project the CITY is not responsible
• for maintenance of the dredged material at Carnation
Cove.

Agency requests approval of an agreement to provide for dredging at the
Newport Harbor Patrol Docks and Interceptor Beach with beach sand
replenishment at Carnation Cove.
MOTION: On motion by Supervisor Riley, seconded by Supervisor Stanton,
the Board authorized execution of Agreement No. D89 -076 with the City of

2 This Agreement is made and entered into this 10 1ff day of
3 1991 by and between the City of Newport Beach, a municipal corporation,
4 hereinafter referred to as CITY and the County of Orange hereinafter referred•to
5 as COUNTY for the mutual benefits and premises contained herein:
6 RECITALS
7 WHEREAS, Newport Harbor is an authorized navigational project of
8 County's Harbors, Beaches and Parks; and
9 WHEREAS, much of the land and water area of Newport Harbor consists of
10 Public Tidelands under administrative jurisdiction of the COUNTY and CITY; and
11 WHEREAS, COUNTY and CITY share an interest in the maintenance and
12 operations of said Public Tidelands area for public use and enjoyment pursuant to
13 the terms and conditions of appropriate Tidelands Trust legislation; and
•
14 WHEREAS, one of the operational aspects of said harbor is the
15 maintenance dredging of navigational areas within Public Tidelands under the
16 administrative jurisdiction of COUNTY or CITY; and
17 WHEREAS, another operational aspect of said harbor is the periodic sand
18 replenishment of recreation beaches within Public Tidelands under the
19 administrative jurisdiction of COUNTY or CITY; and

20 WHEREAS, the most cost - effective means of accomplishing both operational
21 aspects of harbor maintenance is to participate in a joint project of dredging
22 material from County Tidelands adjacent to the Newport Harbormaster Facility and
23 depositing said material on City Tidelands adjacent to Carnation Cove; and
24 WHEREAS, COUNTY is capable of providing the necessary engineering
25 services to accomplish said joint project; and
•26 WHEREAS, COUNTY is capable of providing the necessary regulatory agency
27 permits to accomplish said joint project; and

WHEREAS, CITY will by this agreement provide funding of 25% of the cost
of the project not to exceed $10,000; and
NOW, THEREFORE, it is agreed by and between the parties hereto as
follows:
I.
COUNTY agrees to provide the engineering services necessary to perform
the maintenance dredging at the Newport Harbormaster Public Tidelands Facility
and transfer the material to Carnation Cove.
II.
CITY agrees to provide plan drawings of Carnation Cove delineating area
for material discharge, existing and ultimate cross - sections and special
provisions necessary to accomplish project in Carnation Cove.
III.
COUNTY agrees to prepare plans and special provisions based on input
from I. and II. above; advertise for bids; award contract; provide survey
services; provide construction inspection and contract administration.
IV.
COUNTY agrees to obtain a Corps of Engineers Permit and other regulatory
agency permits which may be necessary to accomplish said joint project.
V.
CITY agrees to provide COUNTY with rights of entry permits from
Carnation Cove residents necessary to accomplish said project.
VI.
COUNTY shall submit billing to CITY for 25% of the construction cost of
said project provided the total cost does not exceed $10,000.

COUNTY shall cause CITY to be named as additionally insured under
the

project contract liability insurance.

CITY shall indemnify and hold harmless the COUNTY from all claims
for

damages

while conducting said project.

IN WITNESS WHEREOF, COUNTY has caused this agreement to be executed by
the Chairman of the Board of Supervisors, 'acting as the governing board of
COUNTY, and attested by its Clerk, and CITY has caused this agreement to be
