SUBJECT: Automatic Aid Agreement for Emergency Medical Services
RECOMMENDATION:
Authorize the Mayor and the City Council to enter into a Memorandum of
Understanding with the County of Orange for the Exchange of Fire, Rescue and
Emergency Medical Services.
DISCUSSION:
The purpose of this Memorandum of Understanding is to outline the procedures
for implementing an agreement for the exchange of emergency response services to
specified areas. It is a guide for day to day operations and is not intended to replace
or revise the Orange County Fire Services Operational Area Mutual Aid Plan in
which the City also participates. The Memorandum of Understanding will be
evaluated annually by the City and the County to determine its effectiveness.

MEMORANDUM OF UNDERSTANDING FOR
EXCHANGE OF FIRE, RESCUE AND EMERGENCY MEDICAL SERVICES
COUNTY OF ORANGE /CITY OF NEWPORT BEACH
This Memorandum of Understanding is authorized by the City Council
of Newport Beach and the County of Orange Board of Supervisors in
an agreement dated July 1, 1989.
The purpose of this Memorandum of Understanding is to outline the
procedures for implementing an agreement of response between the
City of Newport Beach Fire Department, hereinafter referred to as
the CITY and the County of Orange Fire Department, hereinafter
referred to as the COUNTY. This Memorandum is a guide for day to
day operations and is in no way intended to replace or revise the
Orange County Fire Services Operational Area Mutual Aid Plan. This
Memorandum replaces any previous Memorandum in affect.
AMOUNT AND TYPE OF ASSISTANCE
This agreement is for the exchange of services to the areas
specified. The identified fire department resources will respond
to emergencies as set forth below.
Equipment required beyond the scope of this Memorandum of
Understanding must be requested by the Incident Commander or
dispatch center through normal Mutual Aid channels as outlined in
the Orange County Fire Services Operational Area Mutual Aid Plan.

The specific CITY units to respond will be determined by referring
to the Orange County Fire Department Fire Station Order (FSO) file.
2. THE COUNTY SHALL PROVIDE:
a. One unit from either ORC27 Station or ORC28 Station as
second due engine;
One unit from either ORC28 Station or ORC04 Station as
second due truck; in CITY jurisdiction as shown in
Exhibit F.
b. One unit from either ORC04 Station or ORC28 Station as
second due truck; in CITY jurisdiction as shown in
Exhibit G.
C. One unit from ORC04 as second due or up to fifth due
paramedic to all incorporated area of the CITY.
d. One unit from ORC04 as second due chief officer; in CITY
jurisdiction as shown in Exhibit H.
Requests for CITY or COUNTY units may be made for response to
undeveloped areas adjacent to the agreement area. Adjustments and
releases shall be made by the incident commander as soon as the
actual location of the incident and the best appropriate access has
been identified.
Changes in this Memorandum of Understanding may be made at any time
by mutual agreement of the chiefs of both departments. A signed
amendment to this document will be prepared accordingly and
distributed to all holders.
OPERATIONAL COMMAND
The first arriving officer will assume command until he or she
reassigns command or is relieved by a chief officer of the agency
having jurisdiction. All operations will be conducted in a
coordinated and organized manner.
INCIDENT REPORTS
When units of both agencies have responded to an incident, the unit
of the agency having jurisdiction will be responsible for preparing
the incident report. When no units from the jurisdictional agency
respond to an incident the units from the responding jurisdiction
shall prepare their own incident report on the incident and the
agency shall provide, on request, copies of the incident report to
the jurisdictional agency.

DISPATCH AND COMMUNICATIONS
If the requested unit is out of quarters and located so as to
result in a longer than normal response time, the requesting
dispatch center will be advised of the delay.
TRAINING
Periodic interagency training shall be conducted for the purpose of
improving working relationships and operational coordiantion
between CITY and COUNTY units. This training shall be coordinated
through the CITY'S Operations Officer and the COUNTY'S Battalion
Commander.
RESPONSE MAPS AND PREPLANS
Each jursidiction shall. provide the other with current standard
response maps and preplans and updated versions as changes occur.
EVALUATION
The effectiveness of this Memorandum of Understanding shall be
evaluated at least annually by the CITY'S Operations Officer and
the COUNTY'S Battalion Commander.

SUBJECT: Agreement for Exchange of Fire, Rescue and
Emergency Medical Services.
Recommendation:
Authorize the Mayor to sign an agreement for the exchange of
Fire, Rescue and Emergency Medical Services between the City
of Newport Beach and Orange County.
Fiscal Impact-
No additional cost for the City of Newport Beach.
Discussion:
This agreement will permit the City and County Fire Chief to
develop a standard operational procedure to respond the
closest available fire and /or paramedic crew to an emergency
regardless of jurisdictional boundaries.
This operational procedure will result in:
- A faster response time to the scene of an emergency.
- A greater depth of resources that will provide
additional emergency crews when activity is high.
Either party may terminate the agreement at any time by
giving written notice at least 60 days in advance.

COUNTY OF ORANGE
CITY OF NEWPORT BEACH
THIS AGREEMENT, made and entered into this ASP � day of
9 , which date is enumerated for purposes of
refe nce only, by and between the COUNTY OF ORANGE, a political
subdivision of the State of California, hereinafter referred to as
'COUNTY', and the CITY OF NEWPORT BEACH, a municipal corporation
in the County of Orange, hereinafter referred to as 'CITY'.
WHEREAS, COUNTY and CITY provide fire, rescue and emergency
medical services within their respective jurisdictions; and
WHEREAS, COUNTY and CITY have found it to be of mutual
benefit if the services of each fire department are in some
circumstances extended outside of the limits of each jurisdiction
into the boundaries of the other; and
WHEREAS, the parties hereto desire to enter into a mutual
response pact, wherein, in some circumstances, one party will
respond to a fire, rescue or emergency medical incident occurring
within the limits of the other party;
NOW, THEREFORE, for and in consideration of the covenants
contained herein, the parties hereby agree as follows:
1. As used herein, the term "paramedic service" means the
delivery of emergency medical care to sick and injured persons at

the scene of an emergency by Emergency Medical Technician
Paramedics (EMT -P) who have been certified pursuant to the Health
and Safety Code Section 1797 -84. Such term does not include the
transportation of such sick and /or injured persons to a hospital
or other medical care facility.
2. The specific details of the service to be provided under
this agreement and the general operational policies, including, but
not limited to, response areas, communications, types of equipment,
procedures, personnel, written reports, and response patterns shall
be determined by the COUNTY Director of Fire Services and the CITY
Fire Chief in a Memorandum of Understanding.
3. Each party shall, at its own expense, develop and provide
for the necessary cross connections of its communication system
with the communication system of the other.
4. Each party shall, at its own expense, provide to the other
party a predetermined grid mapping system designating the response
area for its areas included in this agreement.
5. Requests for ambulance service shall continue to rest with
the fire agency of the jurisdiction in which the emergency occurs.
6. The services provided by each party pursuant to this
agreement shall be provided at no cost to the other party.
7. The Fire Chief of each jurisdiction or their designated
representatives shall determine and agree upon the capabilities of
each party to respond to incidents requiring special equipment.
8. For purposes of liaison and the administration of this
agreement, the COUNTY Director of Fire Services and the CITY Fire

Chief are designated as the representatives of the respective
parties to this agreement, and they shall be jointly responsible
for administration of this agreement.
9. This agreement shall become operational and effective on
execution by both parties. The agreement shall remain in effect
until participation is terminated by either party. It is further
agreed that either party may terminate the agreement at any time
by giving written notice to the other party at least sixty days
(60) prior to the date of termination.
10. Each party shall indemnify and save harmless the other
party, and its officers, agents and employees from any and all
losses, liability, damages, claims, suits, actions and
administrative proceedings, and demands relating to acts or
omissions of the indemnitor, its officers, agents or employees
arising out of or incidental to the performance of any of the
provisions of this Agreement or any other acts or omissions of the
indemnitor, its officers, agents or employees. Neither party
assumes liability for the acts or omissions of persons other than
each party's respective officers, agents or employees. In the
event judgment is entered against both parties because of joint or
concurrent negligence of both parties, or their officers, agents
or employees, an apportionment of liability to pay such judgment
shall be made by a court of competent jurisdiction and neither

party shall be entitled to a jury apportionment.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement on the day and year first above written.
