HomeMy WebLinkAboutC-2847 - Recycling of Inert Materials (brown, green waste)�2 Zy, AGREEMENT THIS AGREEMENT made and entered into this 23 day of June 1997, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY" and Western USA Waste, hereinafter referred to as the Contractor. W I T N E S S E T H WHEREAS, CITY has determined that it is in the public interest to provide for regular recycling of green solid waste, and brown solid waste in the City of Newport Beach; and WHEREAS, Contractor has submitted a proposal to transport the brown solid waste collected by CITY to a recycling facility and WHEREAS, CITY desires to accept the proposal presented by Contractor. NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: 1. CITY hereby agrees as follows: A. To permit Contractor to collect from it all green solid waste, and brown solid waste which the CITY collects. B. To pay to Contractor per load for each load of green solid waste, and brown solid waste collected from the CITY as follows: Brown Waste $ 100.00 Brown Waste (Contaminated) $ 200.00 Green Waste $ 100.00 Green Waste (Contaminated) $ 200.00 C. In the event of the discovery by Contractor of a contaminated load of brown solid waste, Contractor will collect such waste and dispose of it at County landfills at the expense of the CITY as noted above. In the event of the discovery by Contractor of a contaminated load of green solid waste, Contractor will be responsible for the disposal costs. 2. Contractor hereby agrees as follows: A. To provide at least four roll -off type containers with an approximate capacity of forty (40) cubic yards for green and brown waste collection at the City Yard (592 Superior Avenue, Newport Beach, CA). C. To remove in a timely fashion full bins and provide for empty bins on a schedule which will insure available bin space for all green solid waste, and brown solid waste collected by the CITY. D. To submit to the CITY within fifteen (15) days following the end of each month a monthly report stating the number of tons of green solid waste, and brown solid waste together with the weight certificates from a certified public scale or the equivalent in addition to any other information necessary for analysis and evaluation purposes as determined by the CITY. E. To submit to the CITY, before the fifteenth (15) of each month an invoice for the green solid waste, and brown solid waste collected the previous month in accordance with the agreed price per load. Each invoice will bill separately the City division responsible for a particular type of waste. (i.e. green waste - Parks /Street Tree Division) F. To obtain and maintain in effect Worker's Compensation insurance coverage, in the following minimum amount of $1,000,000, and public liability insurance coverage in the following minimum amount $1,000,000. G. To hold the CITY, its agents and employees harmless from any and all liability incurred for injuries resulting from the activities of Contractor, its agents or employees in the performance of this agreement. 3. Each party shall have the option, at its sole discretion and without cause of terminating this Agreement by giving thirty (30) days' prior written notice to the other party. Upon termination of this Agreement, the CITY shall pay to Contractor that portion of compensation specified in this Agreement that is earned and unpaid prior to the effective date of termination. 4. It is mutually agreed by the parties hereto that this contract shall be in effect for three (3) years from the date of its execution. It is further agreed that this contract may be renewed for an additional three (3) year period by agreement of all parties hereto. The amount of material, which eventually became a suitable ground cover, far exceeded the need in parks or parkways. During October 1990, all compost had to be removed from the Santa Ana River site in preparation of the sale of the property. No other compost site could subsequently be located in the City. In preparing the City recycling plan, the possibility of using the newspaper unloading docks at City Yard (the newspaper program ended December 28, 1990) for the consolidation of other materials for recycling was considered. Specifications for contractors to haul inert materials, which include not only green waste but brown waste (lumber, etc.), asphalt, and concrete as well, were prepared. Six private haulers and three composting companies were contacted to bid on the specifications which basically require that the hauler provide 4 large roll off containers (2 at City Yard for green and brown solid waste, 1 at City Yard for asphalt and concrete, and 1 at the Utilities Yard for asphalt and concrete) that upon call will be hauled away to either a commercial composting operation (green or brown waste) or to a paving company (asphalt and concrete). The range of bids extended from $65.00 to $187.50 per load of asphalt and concrete. The low bidder, Western Waste Industries of Gardena, operates refuse operations in 6 western states and as well as being licensed by the City to conduct commercial refuse operations. Their bids to haul a variety of green and brown solid waste were also the lowest in that category. Accordingly, the attached contract was prepared for review by the City Attorney and Western Waste Industries. In summary, the approval of this contract will provide for an efficient, economical, and environmently appropriate means of recycling inert materials. It will be another major step in meeting the recycling goals. Further, it will reduce operating expenses for heavy equipment and eliminate a significant amount of landfill fees. Western Waste Industries hereby agrees as follows: A. To provide at least two roll -off type containers with an s � • approximate capacity of forty (40) cubic vards each with overall dimensions which can be accommodated at the City Yard loading docks. B. To provide at least one roll -off container with an approximate capacity of ten (10) cubic yards at each of two locations, City Yard (592 Superior Avenue, Newport Beach, CA) and the Utilities Yard (949 W. 16th, Newport Beach, CA). C. To provide backhaul services from a mulching facility to City Yard for mulching materials for City landscape use at no additional charge. Purchase of mulching materials will be directly billed to the City by an independent mulching facility. D. To remove in a timely fashion full bins and provide for empty bins on a schedule which will insure available bin space for all asphalt, concrete, and green and brown solid waste collected by the CITY. E. To submit to the CITY within fifteen (15) days following the end of each month a monthly report stating the number of tons of each commodity (asphalt, concrete, and green and brown solid waste), together with the weight certificates from a certified public scale in addition to any other information necessary for analysis and evaluation purposes as determined by the CITY. F. To submit to the CITY, before the fifteenth (15th) of each month an invoice for the asphalt, concrete, and green and brown solid waste collected the previous month in accordance with the agreed price per load. Each invoice will bill separately the City department responsible for a particular type of waste. G.
