Raggio City Clerk WER:pm Attachment 3300 Newport Boulevard, Newport Beach 0 0 C' - X871 CHP #0023 -91/92 FI STATE OF CALIFORNIA DEPARTMENT OF CALIFORNIA HIGHWAY PATROL LETTER OF AGREEMENT THIS AGREEMENT, made and entered into this 4th day of July, 1991, by and between the State of California, acting by and through the Department of California Highway Patrol, hereinafter called CHP, and City of Newport Beach, Newport Beach Police Department, hereinafter called CITY. WITNESSETH: By and in consideration of the covenants.and conditions herein contained, the CITY and the CHP do hereby agree as follows: 1. CHP agrees to provide uniformed personnel with vehicles and motorcycles for traffic control in the city of Newport Beach during the Fourth of July holiday. It.is anticipated the -t the CHP will provide one motorcycle sergeant, one vehicle sergeant, twelve motorcycle officers and ten vehicle officers. 2. The CHP Coordinator shall be Sgt. John Steel, telephone number (714) 547 -8311 and the Newport Beach Police Department Coordinator shall be Lieutenant Jackson, telephone number (714) 644 -3742. 3. The services will be for July 4, 1991 only. 4. In the event of disaster or unforeseen emergency, this agreement may be cancelled by the CHP without prior notice. 5. This agreement may be amended by mutual consent of the parties hereto. 6. In consideration for the above services and upon receipt of an invoice, CITY agrees to pay CHP in accordance with the attached Exhibit A - COSTS SCHEDULE. The total amount payable under this agreement is estimated to be Ten Thousand One Hundred Twenty One Dollars and Forty Five Cents ($10,121.45). 7. The rates indicated in this agreement are for estimate Purposes only. In the event, CHP is granted a rate increase, CITY agrees to pay the increased rates. cv City of Newport Beach, CHP #0023 -91/92 Page 2 E 8. CITY agrees that additional charges may be assessed for CHP supplies, additional equipment utilized, damage to uniforms or property repaired or replaced at State expense, etc. which are directly related to the services provided. 9. Should additional charges and /or rate increases be assessed, CITY agrees to pay such charges within fifteen (15) days upon receipt of an itemized invoice from CHP. 10. COUNTY agrees that any cancellation of this request for service later than 4:00 p.m. on the day preceding the requested service may result in a charge of four (4) hours overtime for each officer assigned. 11. No additional gifts, donations, or gratuities may be accepted by the California Highway Patrol employees in their behalf or in behalf of the Department, informal squad fund or other local funds. Ten Vehicle officers 9 hours each @ $42.67 per hour = $ 3,840.30 VEHICLE COSTS- 300 miles @ $.37 per mile MOTORCYCLE COSTS: 1,300 miles @ $.32 per mile TOTAL ESTIMATED COST = $ 111.00 $ 416.00 $ 10,121.45
