SUBJECT: COAST OF CALIFORNIA STORM AND TIDAL WAVE STUDY SOUTH
COAST REGION - COST SHARING AGREEMENT WITH COUNTY OF
ORANGE /HARBORS, BEACHES AND PARKS
RECOMMENDATIONS:
Approve the Cost Sharing Agreement with County of
Orange /Harbors, Beaches and Parks and authorize the
Mayor and City Clerk to execute the agreement.
DISCUSSION:
The U.S. Army Corps of Engineers has been authorized to
conduct a study of the Coast of California from the Mexican
• border to the Oregon border. The first phase of the study
extended from the Mexican border to Dana Point and was just
completed. On September 9, 1991, the Corps of Engineers entered
into an agreement with Orange County /Harbors, Beaches and Parks
to continue the study along the Orange County coast. The results
of the study will provide important information for planning and
engineering purposes along the Orange County coast. Elements of
the study include:
1. Collection and evaluation of existing coastal
studies.
2. Installation of wave gages and collection of data.
3. Tabulation of sand profiles and current data.
4. Wave height analysis.
5. Evaluation of potential beach erosion associated
with storm waves and sea level rise.
6. Sediment budget analysis for Orange County
beaches.
Cost sharing for the proposed 5 year study is as
follows:
• Corps of Engineers 50%
County of Orange 25%
Laguna Beach 6;%

The estimated cost of the study is $2,250,000 with the
City's share of $25,000 the first year increasing to $31,500 in
the fourth year. Funds are included in the current budget in
Account No. 02- 2997 -561 for the City's share.
The County of Orange is the local lead agency and has
entered into agreements with the Corps of Engineers and the
cities of Laguna Beach, Huntington Beach, and Seal Beach. This
agreement provides for the City of Newport Beach's share of the
cost. Terms of the agreement are as follows:
A. Orange County agrees to:
1. Act as lead agency.
2. Provide 25% funding for study.
B. City of Newport Beach agrees to:
1. Provide 6;$ funding for study.
2. Appoint one member to Executive Committee for
overall study management.
C. It is mutually agreed:
1. City and County participation shall be subject to
availability of funds and limited by annual budget
approval of each agency.
2. Final Report by June 30, 1996.

STUDY: Environmental Management Agency requests approval of agreements
Tor the Coast of California Storm and Tidal Wave Study, performed in
cooperation with the U. S. Army Corps of Engineers.
MOTION: On motion by Supervisor Vasquez, seconded by Supervisor Roth,
the Board moved to: 1. Find that the recommended action is not a
project as defined by California Environmental Quality Act Guidelines
Section 15378. 2. Authorize execution of the Coast Sharing Agreements
with the Cities of Huntington Beach, Newport Beach, and Laguna Beach.

COST SHARING AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH
AND
THE COUNTY OF ORANGE
FOR THE COAST OF CALIFORNIA STORM AND TIDAL WAVE STUDY
SOUTH COAST REGION
This Agreement is made and entered into this oday of ,
1991 by and between the City of Newport Beach, a municipal corporation,
hereinafter referred to as CITY and the County of Orange /Harbors, Beaches and
Parks, hereinafter referred to as COUNTY for the mutual benefits and premises
contained herein:
RECITALS
1. WHEREAS, the Corps of Engineers is authorized to conduct a study of
the Coast of California from the Mexican Border to the Oregon Border through
Section 208 of the Flood Control Act of 1965; and
2. WHEREAS, the Corps of Engineers has prepared a Consolidated Plan of
Study dated March, 1987 for the entire coast (Appendix A), and has determined
that further studies are necessary to complete the objectives of data collection
and analysis for the California coastline; and
3. WHEREAS, the term "Study" shall mean that work to be done in
accordance with Appendix A and culminating in a report to be made available to
the COUNTY and CITY; and
4. WHEREAS, work in the South Coast Region will proceed according to
the appropriate Scope of Study (Appendix B), upon appropriation of funds, and;
5. WHEREAS, the emphasis of Coast of California Storm and Tidal Wave
Study is on data collection and analysis to assist in coastal planning and
design, and this agreement in no way provides for the implementation of any
projects; and
6. WHEREAS, pursuant to Harbors and Navigation Code, Section 65, the

1 COUNTY either independently or in cooperation with any person or any city,
2 county, state, federal or other agency to the extent that funds are available
3 therefore, shall study and report upon problems of beach erosion and means for
4 stabilization of beaches at shoreline areas;
5 7. WHEREAS, the COUNTY has the authority and capability to furnish the
6 cooperation hereinafter set forth and is willing to participate in study cost
7 sharing and financing in accordance with the terms set forth in a Cost Shared
8 Agreement (Appendix C) between the United States of America (Corps of Engineers)
9 and the County of Orange and the County of Los Angeles, and;
10 8. WHEREAS, the CITY has the authority and capability to furnish the
11 cooperation hereinafter set forth and is willing to participate in study cost
12 sharing and financing in accordance with the terms set forth in this agreement
13 and Appendices A, B and C, and;
14 9. WHEREAS, the South Coast Region of the Coast of California Storm
15 and Tidal Wave Study consists of the section of the Coast between Dana Point
16 headlands and Sequit Point headlands within the Counties of Orange and Los
17 Angeles, and;
18 10. WHEREAS, each County and its cooperating local agencies are
19 required by the terms of the Cost Shared Agreement (Appendix C) to fund fifty
20 (50%) percent of the Non - Federal cost of the project, and;
21 11. WHEREAS, the results of the study will provide important
22 information for planning and engineering purposes to Orange County, the Cities
23 of Laguna Beach, Newport Beach, Huntington Beach and Seal Beach and other local
24 agencies, the County of Orange as primary local sponsor is enlisting the support
25 and cost sharing commitment from as many local agencies as possible, and;
26 NOW THEREFORE, it is agreed by and between the parties hereto as

I.
COUNTY agrees to provide cost - sharing and financing of fifty (50 %)
percent of the Non - Federal funding required of Orange County and local
supporting agencies. Consistent with applicable federal statutes and
regulations, fifty (50 %) percent of this cost sharing may be acceptable in -kind
services.
II.
CITY agrees to provide cost - sharing and financing of twelve and
one -half (12.5 %,) percent, not to exceed $31,250 of the annual non- federal
funding required of Orange County and local supporting agencies. Consistent
with applicable federal statutes and regulations, fifty (50 %) percent of this
cost- sharing may be acceptable in -kind services.
III.
CITY and COUNTY agree that although the scope of work and plan of
action (Appendix B) describe a five year study program, CITY and COUNTY
participation shall be limited by the annual budget approval of the appropriate
Council or Board of Supervisors for each fiscal year.
IV.
According to the funding schedule in Appendix B (Figure 6) the highest
CITY cost sharing of $31,250 would be in year 4 provided City Council approved
participation in the study for that fiscal year. For the first study fiscal
year, starting July 1, 1991, the CITY cost - sharing and financing of the study
shall not exceed $25,000.
V.
The CITY and COUNTY agree that either party may terminate participation
in the Study if it is determined that it is not in accord with its current
policies and budget priorities. When such a case exists, the study shall be

terminated according to Article XII of Appendix C and all data and information
shall be made available to both parties.
VI.
If funds are not available from any cooperating local agency during the
Study period, the Executive Committee, as established in Article V of Appendix
C, shall amend the scope of work and plan of action to continue within the
limits of the revised funding schedule.
VII.
In accordance with Article V of Appendix C, the COUNTY and each
participating CITY shall have equal opportunity for overall Study management by
the appointment of one member to the Executive Committee.
VIII.
The final report documenting the results of the Study shall be
completed by June 30, 1996.

IN WITNESS WHEREOF, COUNTY has caused this agreement to be executed by
the Chairman of the Board of Supervisors, acting as the governing board of
COUNTY, and attested by its Clerk, and CITY has caused this agreement to be
executed by its Mayor, and attested by its Clerk, all thereunto duly authorized
on the dates set forth opposite their respective signatures.
