This memo is a follow -up to the inquiry about the status of the Agreement approved
by the City Council for the sale of water outside the City. The reason there is no fully
executed agreement in the file is because the applicant, after Council approval,
decided to obtain construction water from the Irvine Ranch Water District instead of
from the City of Newport Beach.
The Agreement was never fully executed or acted on by The Irvine Company.

SUBJECT: AGREEMENT FOR SALE OF WATER OUTSIDE THE CITY
WATER FOR GRADING & CONSTRUCTION
THE IRVINE COMPANY AND PELICAN HILL GOLF COURSE
RECOMMENDATIONS:
If desired, approve the sale of water outside the City
for a limited duration to TIC for the Pelican Hill Golf
Course construction.
2. Authorize the Mayor and the City Clerk to execute an
Agreement for the sale of water on behalf of the City.
DISCUSSION:
A contract for rough grading, earthmoving and road construction
northerly of Cameo Highlands, outside the City limits, has been awarded by
The Irvine Company (TIC). TIC has asked to temporarily purchase water from
the City for rough grading, dust control and soil compaction work.
The contractor performing work for TIC has no other source of
water for this area at the present time. After rough grading is completed, the
Irvine Ranch Water District (IRWD) will construct reclaimed water pipelines
and provide reclaimed water to this area. IRWD has agreed to allow the City to
provide water to this area.
TIC proposes to purchase water from the City of Newport Beach
under an Agreement with the understanding that water from the City's
connection will be used temporarily until IRWD's reclaimed water system can
be built and activated.
TIC has consented to the proposed terms for the City to
temporarily provide water service. Staff has reviewed the proposed water
consumption demand and believes that the proposed operation will in no way
adversely affect the City's water system or supply. As such, staff recommends
approval of the Agreement.
A summary of the principal terms of the Agreement follows:
1. City agrees to sell water through a new metered
connection, near the intersection of Surrey Drive and
Rockford Road.
2. TIC will purchase water through the connection at a
rate of $3.00 per hundred cubic feet of water.

3. TIC will install all pipe, valves and fittings necessary to
provide a properly sized, metered connection and agrees
this material shall become the property of the City at the
end of the term of the Agreement.
4. TIC Will use water through the connection only during
non -peak demand hours of the day or night.
5. The term of the Agreement is six months with a clause
allowing extensions of 30 days upon mutual consent.
6. Provisions for unforseen increase in costs for the City to
deliver water to be passed on to TIC.
7. City rights to terminate water deliveries under any
circumstances where continued deliveries would
jeopardize the City's ability to deliver water to its citizens
at an optimum pressure and flow.
The Utilities Committee reviewed this request and the
Agreement terms at its meeting on October 16th. 1992 and recommended
its approval.
