A RESOLUTION OF THE CITY COUNCIL OF TH8 CIT BY THE CITY COUNT
OF NEWPORT BEACH SUPPORTING CONSTRUCTION OF CITY OF NEWPORT BF
TIM IRWD /OCWD GREEN ACRES INTERCONNECT
WHEREAS, The Irvine Ranch Water District (IRWD)
project which, if approved, would result in the daily discharge
during the winter and early spring of approximately 5 million
gallons of reclaimed water into the San Diego Creek, tributary to
Upper Newport Bay, and
WHEREAS, The Orange County Water District (OCWD) currently
processes, on a daily basis, in excess of 5 million gallons of
reclaimed water that is sold to various customers for irrigation
and other purposes and to the County Sanitation District of Orange
County (CSDOC) for equipment cooling and other purposes; and
WHEREAS, OCWD has indicated that they may be willing to accept
excess IRWD reclaimed water during the winter and spring in lieu of
producing reclaimed water at the OCWD treatment plant to satisfy
the needs of CSDOC; and
WHEREAS, OCWD and IRWD have each constructed reclaimed water
pipelines and related facilities in areas neighboring the City of
Newport Beach. The location of existing pipelines and a possible
interconnect are generally depicted on attached Exhibit "All; and

WHEREAS, OCWD may be willing to work with the City and IRWD to
construct a portion of the pipeline and related facilities
necessary to access IRWD reclaimed water when surpluses are
available; and
WHEREAS, The possibility of an interconnect between OCWD and
IRWD facilities could enable IRWD to reduce the extent to which it
relies on CSDOC for disposal of excess wastewater, provide a truly
beneficial use of IRWD reclaimed water during the winter and early
spring, eliminate the need to discharge into San Diego Creek and
avoid any potential impacts of the proposed discharge on flora and
fauna in Upper and Lower Newport Bay.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach that:
1. The Board of Directors of the Irvine Ranch Water
District and the Orange County Water District should actively
pursue the proposed interconnect between OCWD and IRWD reclaimed
water facilities and evaluate the interconnect as an alternative to
the proposed discharge of reclaimed water into San Diego Creek.
2. The City Staff shall work with OCWD and IRWD staff to
facilitate this evaluation and accelerate, to the extent feasible,
any related project that could expedite the interconnect.

SUBJECT: COOPERATIVE AGREEMENT FOR STUDY OF RECLAIMED WATER
SYSTEM INTER -TIE BETWEEN THE ORANGE COUNTY WATER
DISTRICT (OCWD), THE IRVINE RANCH WATER DISTRICT (IRWD)
& THE CITY OF NEWPORT BEACH
RECOMMENDATIONS:
If desired, approve the cooperative agreement to
perform a study of the potential feasibility and benefits
of a reclaimed water system inter -tie between OCWD,
IRWD and the City.
2. Authorize the Mayor and the City Clerk to execute
the Agreement on behalf of the City.
DISCUSSION:
Since 1987, the City and the Irvine Ranch Water District
(IRWD) have been discussing the potential and benefits for an inter -tie
between the existing reclaimed water system that IRWD operates and
the proposed expansion of the Green Acres Project by the Orange
County Water District (OCWD) into Newport Beach.
Discussions between OCWD, IRWD and the City have
centered around the potential for seasonal demand sharing, system
inter - connections, treatment plant capacity, supply reliability, storage
needs and operational cost optimizing. Since the Green Acres Project
Expansion is about to be designed, it makes sense to investigate
whether pipelines might be sized to share capacity and operate the
systems conjunctively. The purpose of the proposed study is to look at
the feasibility, the benefits and the costs of doing so.
The proposed agreement provides for IRWD to take the
lead in administering the study which will be performed by a private
consulting firm. A small group of consulting firms chosen based on
their previous experience with reclaimed water and their technical
qualifications have been asked to provide written proposals for the
study. Under the agreement proposed, the City's share of the costs of
the study will be one -third of the cost, but no greater than $15,000.

The Utilities Committee has reviewed the proposed
concept and its relation to the proposed Green Acres Project on several
occasions in the past. The Committee reviewed this specific request
and the Agreement terms at its meeting on January 13th, 1993, and
recommended its approval.

COOPERATIVE AGREEMENT FOR PREPARATION OF ENGINEERING STUDY

THIS AGREEMENT is made and dated for reference purposes only
as of the 20th day of January 1993, by

RECITALS
A. IRWD operates an irrigation water system which provides
nonpotable water (reclaimed wastewater, subpotable groundwater,
local runoff and untreated imported water) to landscape and
agricultural customers in the Irvine area. IRWD is currently
expanding this system in both terms of geographic area and types of
uses. This expansion has included a recent extension into the
CITY's Irvine Business Complex and may result in additional
extensions of the system into the City of Newport Beach
(hereinafter "CITY "), including the impending extension of
permanent facilities to serve the Coastal Area, and planned future
extensions into the Irvine Business Complex.
B. OCWD operates the Green Acres Project (GAP) which is a
reclaimed water system that provides nonpotable water to landscape

irrigation and industrial users in Fountain Valley, Santa Ana and
Costa Mesa. OCWD is currently planning to expand GAP to serve
users in the City of Huntington Beach and the CITY.
C. The CITY has indicated a strong commitment for using
reclaimed water in the CITY for landscape irrigation purposes. The
CITY has signed an agreement with OCWD confirming their desire to
receive reclaimed water.
D. Over the last few years, IRWD and OCWD have had
discussions regarding the potential for connecting their reclaimed
water systems. The connection could potentially benefit both
districts by increasing supply and operational flexibility. It
could benefit CITY by increasing the area served by reclaimed water
and by providing a more assured reclaimed water supply, fed from
two directions and two suppliers. A review of the existing and
planned locations for the two reclaimed water systems indicates
that they will be in close proximity in Newport Beach. This makes
it possible for a less - costly intertie, if determined to be
beneficial.
E. Staff of IRWD, OCWD, and CITY have met and agreed that it
would be mutually beneficial to have an engineering study performed
that investigates the feasibility and benefits of a reclaimed water
system intertie in Newport Beach. It is the purpose of this
agreement to provide for the preparation of this engineering study
and the sharing of costs for that study.

NOW, THEREFORE, the parties hereto agree as follows:
Section 1: Joint Scope of Work and Selection of Consultant.
The three parties shall jointly develop and review a Scope of
Work for the engineering study and jointly select a consultant to
complete the study. IRWD shall contract with the consultant for
the completion of the study pursuant to such Scope of Work. The
Scope of Work may be modified or amended by IRWD with the
concurrence of all parties as the study evolves. The contract
shall include a not -to- exceed amount of $45,000 for the
consultant's services.
Section 2: Use of Staff.
The three parties will provide staff help and information to
the consultant in their areas of expertise at the sole expense of
the contributing party. Periodic joint meetings will be scheduled
by the parties to review progress and results.
Section 3: Project Management.
Day -to -day project management shall be performed by IRWD; IRWD
agrees to carry out such management in consultation with CITY and
OCWD. The consultant will be legally responsible to IRWD.
Section 4: Cost Sharing.
Unless otherwise agreed in writing, each party shall
contribute equally up to a maximum of $15,000. The not -to- exceed
amount of $45,000 for the engineering study may be increased by
IRWD only with the written approval of all parties, including
agreement as to the sharing of the additional cost. All
contributions shall be paid to IRWD within 45 days of IRWD's
written requests to OCWD and CITY, as needed to pay invoices

submitted by the consultant. IRWD shall deposit the contributed
amounts into its treasury and shall pay the consultant.
Section 5: Sharing of Information.
All three parties shall have full access to all information
developed during the preparation and completion of the engineering
study. All three parties shall be provided with copies of all
reports submitted by the consultant.
IN WITNESS WHEREOF, the parties hereto have executed this
