Box 1768 Newport Beach, CA 92658 -8915 Subject: Cooperative Agreement No. C -7 -0559 Dear Mr. Murphy: The Orange County Transportation Authority (OCTA) and the City of Newport Beach entered into the subject Agreement on January 26, 1998, to conduct the Santa Ana River Crossing Cooperative (SARX) Study. The SARX Study is being conducted as a collaborative effort involving the City of Costa Mesa, City of Newport Beach, City of Huntington Beach, City of Fountain Valley and OCTA. Under the subject Agreement, OCTA is to contract with a vendor to conduct the study. However, the OCTA's Operations and Planning Committee, along with each of the Cities involved, have decided that it is in the best interest of the SARX Study for the City of Costa Mesa to contract with a vendor to conduct the study, while OCTA remains the lead agency for this project. Therefore. OCTA and the City of Costa Mesa have decided to terminate the subject Agreement and enter into a separate Agreement under which the City of Costa Mesa will contract with a vendor to conduct the SARX Study. RECITALS: WHEREAS, OCTA is responsible for maintaining the integrity of the Master Plan of Arterial Highways (hereinafter referred to as the "MPAH "), through its coordination with cities and the County of Orange and ultimately determines the cities' and County's consistency with the MPAH System; and WHEREAS, the MPAH designates Garfield Avenue /Gisler Avenue and 19th Street/Banning Avenue as two (2) bridges overcrossing the Santa Ana River; and WHEREAS, the CITY would be affected by a proposal, by others, to delete one or both of these bridges form the MPAH; and WHEREAS, the CITY desires a study to determine the best solution to regional traffic flow in the area of the proposed bridges (hereinafter referred to as "STUDY "); and WHEREAS, the other parties affected by the traffic from the proposed bridges, cities of Costa Mesa, Fountain Valley, Huntington Beach, and the County of Orange, have agreed to consider a plan of alternative highway improvements that may allow deletion of the bridges from the MPAH; and Page 1 of 5 1 2 3 4 5 6 7 S 9 10 11 12 13 14 15 16 17 1s 19 20 21 22 23 24 25 26 E • AGREEMENT NO. C -7 -0559 WHEREAS, all of the affected parties propose that the "STUDY" identify the potential environmental impacts and subsequent mitigations associated with the above proposed MPAH amendment through a program level Environmental Impact Report (EIR); and WHEREAS, the EIR will be conducted in accordance with Attachment A, Scope of Work Outline, prepared by OCTA and approved by the Santa Ana River Crossing (SARX) Technical Advisory group, and will be used to evaluate all impacts of additional proposed alternatives and to determine the operational and financial feasibility of subsequent mitigations; and WHEREAS, No MPAH amendment will be entertained until the California Environmental Quality Act (CEQA) requirements are satisfied; and WHEREAS, STUDY will be prepared in cooperation with the cities of Costa Mesa, Newport Beach, Fountain Valley, Huntington Beach and the County of Orange; and WHEREAS, STUDY will be conducted in accordance with the recommendations included in the Guidance for the Administration of the Master Plan of Arterial Highways issued by OCTA in November 1995, and will follow the Scope of Work Outline included as part of this Agreement; and WHEREAS, CITY and OCTA wish to herein specify their respective responsibilities for performance of the STUDY; and WHEREAS, CITY and OCTA possess full authority to enter into this Agreement; NOW, THEREFORE, IT IS AGREED by the parties hereto as follows: ARTICLE 1. RESPONSIBILITIES OF OCTA OCTA agrees to the following responsibilities: A. To serve as lead agency for EIR. B. To retain through its procurement process all Consultant (s) necessary to conduct the STUDY. C. To be responsible for review and input to the Consultant on the preparation and processing of all necessary documentation related to the STUDY. D. To provide all OCTA support services identified in Scope of Work for the STUDY. 3 G. To conduct public workshops either with staff or through a Consultant. 4 ARTICLE 2. RESPONSIBILITIES OF CITY 5 CITY agrees to the following responsibilities: 6 A. To be responsible for all CITY staff costs associated with the STUDY. 7 B. To be responsible for $35,000.00 of all consultant costs for the program level EIR. 8 C. To be responsible for review and input to OCTA for the preparation and processing 9 of all necessary documentation related to EIR. 10 D. To provide all CITY support services identified in the Scope of Work for the STUDY. 11 E. To provide all required public notices, convene and assist in public workshops, 12 coordinate citizen input, and other related duties. 13 ARTICLE 3. MUTUAL AGREEMENTS 14 It is mutually understood by the parties hereto that: 15 A. Unless otherwise agreed upon by CITY and OCTA, the STUDY will be completed by 16 November 31, 1998, in accordance with Attachment A, Scope of Work. 17 B. This Agreement does not prohibit the CITY from conducting its own public hearings, 18 community workshops, or otherwise take input from its constituents concerning the EIR, separate 19 from OCTA conducted public workshops. 20 C. Every notice, demand, request or other document or instrument delivered pursuant 21 to this Agreement shall be in writing and shall be either personally delivered, sent by Federal 22 Express or other reputable overnight courier, sent by facsimile transmission with the original 23 subsequently delivered by other means in accordance with this section, or sent by certified United 24 States Mail to the address set forth below, or to such other address as a party may designate from 25 time to time: 26 / Page 3 of 5 • • AGREEMENT NO. C -7 -0559 SCOPE OF WORK OUTLINE FOR THE SANTA ANA RIVER CROSSINGS COOPERATIVE STUDY PROGRAM LEVEL EIR Background: The Santa Ana River Crossing (SARX) Phase II Study is a coordinated effort between the County of Orange, Caltrans, the Orange County Transporation Authority (OCTA) and the cities of Costa Mesa, Fountain Valley, Newport Beach and Huntington Beach. The purpose of this effort is to develop a plan of alternative roadway improvements that may allow the deletion of the proposed Banning Avenue /19th Street and Garfield Avenue /Gisler Street bridge crossings over the Santa Ana River from the OCTA Master Plan of Arterial Highways (MPAH). The SARX study area is bounded by Warner Avenue to the north, Bristol Street and Upper Newport Bay to the east, Beach Boulevard to the west and Pacific Coast Highway to the south. The potential. bridge crossings are located between the 1 -405 and Pacific Coast Highway. Project: The "Project" scenario will examine the deletion of the Garfi -Id Avenue /Gisler Street and Banning Avenue/19th Street bridge crossings over the Santa Ana river from the Master Plan of Arterial Highways (Exhibit A). No Project: The "No Project' scenario will examine the construction of the Garfield Avenue /Gisler Street and Banning Avenue /19th Street bridge crossings in accordance with the existing Master Plan of Arterial Highways (Exhibit B). , Alternative: The "Alternative" scenario will examine the construction of the following alternative bridge crossings: 1) connecting Garfield Avenue to SR -57 and /or 1- 405 instead of Gisler Street and 2)connecting 17th street to Brookhurst Street (north of Banning Street) via Bluff Road instead of the Banning Avenue /19th Street bridge crossing (Exhibit C). General Requirements: The consultant shall prepare a complete program Environmental Impact Report (EIR) to analyze and evaluate the potential environmental impacts of the project ATTACHMENT A TO • 0REEMENT NO. C -7 -0559 at a program level of analysis. The Project, No Project and Alternative scenarios will be evaluated at an equal level of detail. The impact analysis will include Transportation, Land Use, Noise, Air Quality, Aesthetic, Hazards, Recreation, Public Services and Utilities, Population and Housing, Cultural Resources, Soils /Geology /Seismicity, Energy, Hydrology, Biological Resources, Cumulative Impacts and Unavoidable E:dverse Impacts. OCTA will supply and develop, if necessary, all traffic data for consultant analysis of transportation impacts. OCTA will act as the lead agency for preparation of the EIR. Specifications: 1. The consultant will prepare a single standard size sheet informational flyer to explain the project alternatives and the EIR process to the public. This flyer will encourage their participation in the process and will provide a schedule of upcoming meetings. The content of the flyer shall be reviewed and approved by the Technical Advisory Group (TAG) and agency staffs prior to distribution. 2. The consultant will prepare a draft "Notice of Preparation" (NOP) as required for implementation of the California Environmental Quality Act (CEQA). The draft NOP shall be reviewed by the TAG and agency staffs. The Lead Agency shall issue the final Notice of Preparation. 3. The consultant will arrange four scoping meetings with all cooperating agencies and others affected by this project to identify significant issues to be analyzed in the environmental document. 4. The consultant will hold two focus workshops to address resolution of possible issues during this project. 5. The consultant shall submit 100 copies of the first screencheck draft EIR to be reviewed by the participating agencies and the TAG. The consultant shall incorporate collective comments from the participating agencies and the TAG and submit 100 copies of the second screencheck for review. 6. Upon completion of the second screencheck review, the consultant will prepare and submit 100 copies of the Draft EIR (DEIR) to the lead agency. 7. The lead agency shall prepare a Notice of Completion and shall be responsible for distributing the Notice. The consultant shall distribute the DEIR to the State Clearinghouse and other agencies. N t ATTACHMENT A TO • 0GREEMENT NO. C -7 -0559 8. The consultant will coordinate the review of the DER and will hold a review meeting. Furthermore, consultant will prepare response to comments to be included in the final EIR (FEIR). 9. The consultant will hold four open house meetings, one in each of the four participating cities. 10. Upon completion of the draft EIR, consultant will prepare 100 copies of the screencheck findings and 100 copies of the draft findings. 11. The consultant will prepare a screencheck Mitigation Monitoring Plan (MMP) and a final MMP. This plan will report the mitigation measures and costs of mitigation measures for the project and the alternatives. The lead agency will adopt the MMP that matches the approved project. 12.The consultant will finalize the DER and will print and distribute the Final EIR (FEIR) and notices. 13.The consultant will attend and present materials at a minimum of four SARX Technical Advisory Group meetings to be held during Cie conduct of the project. Agency Support Services: Participating cities will provide the consultant with the following. 1. Updated land use data of the circulation plan. 2. Existing SARX model and data 3. Intersection peak traffic counts for all impacted intersections. 4. Mailing list and labels for documents to be distributed, including the informational flyer, Notice of Preparation, workshop /meeting announcements, Draft EIR and Final EIR. 5. Authorize the Mayor and City Clerk to execute a Cooperative Agreement with the Orange County Transportation Authority for the Santa Ana River Crossing Study (SARX) Environmental Impact Report. 2. Approve a Budget Amendment in the amount of $2,000 for the study. DISCUSSION: The Cities of Costa Mesa, Fountain Valley, Huntington Beach, Newport Beach, the County of Orange and OCTA have discussed a cooperative study to identify the environmental impacts of modifying the Master Plan of Arterial Hidhways (MPAH) as it addresses additional crossings of the Santa Ana River. The current MPAH includes future crossings at Garfield - Gisler and at Banning -19th Street. Costa Mesa has proposed deleting both bridges from the MPAH. The study would evaluate the impacts of building the bridges as currently shown on the MPAH, the impacts of deleting both bridges (the Project) and the impacts of an alternative crossing in the vicinity of the two locations. Newport Beach's primary interest is in the impacts of deleting the bridge connecting Banning with 19th Street or the alternative of connecting 17th Street across the river to Brookhurst Street. Past analysis of deleting this bridge showed significant increases in traffic volumes on Coast Highway between the river and the Balboa/Superior intersection. The proposed study will produce a program level Environmental Impact Report that identifies required mitigations for any changes to the MPAH. A "program level" EIR will look at system -wide general impacts of the proposals but will not provide an EIR for any specific project impacts such as site impacts for widening Coast Highway to 8 lanes. Additional EIR work will be needed before any plan that contemplates construction can be implemented. The Scope of Work requires the consultant to hold a variety of meetings in the various cities including scoping meetings, open houses and issues 0 SUBJECT: SARX COOP&TIVE AGREEMENT • January 26, 1997 Page 2 workshops. Thus there will be opportunities for community input at all phases of the study. A copy of the Agreement, including the Scope of Work, is attached as Exhibit 1. It is anticipated the study will be completed by November 30, 1998. The City's share of the cost of the study is $35,000. The current budget includes $33,000 of Gas Tax funds in Account 7181- C5100398 for this study. A Budget Amendment for the additional $2000 is attached as Exhibit 2. When the County was working with the cities of Irvine and Newport Beach on the extension of Newport Coast Drive, funds were needed from our GMA group. Then Mayor Hedges and then Mayor Erickson of Costa Mesa agreed to jointly support the SARX EIR and the GMA actions on Newport Coast D rive. C -7 -0559 SCOPE OF WORK OUTLINE FOR THE SANTA ANA RIVER CROSSINGS COOPERATIVE STUDY PROGRAM LEVEL EIR Background: The Santa Ana River Crossing (SARX) Phase II Study is a coordinated effort between the County of Orange, Caltrans, the Orange County Transporation Authority (OCTA) and the cities of Costa Mesa, Fountain Valley, Newport Beach and Huntington Beach. The purpose of this effort is to develop a plan of alternative roadway improvements that may allow the deletion of the proposed Banning Avenue /19th Street and Garfield Avenue /Gisler Street bridge crossings over the Santa Ana River from the OCTA Master Plan of Arterial Highways (MPAH). The SARX study area is bounded by Warner Avenue to the worth, Bristol Street and Upper Newport Bay to the east, Beach Boulevard to the west and Pacific Coast Highway to the south. The potential bridge crossings are located between the 1 -405 and Pacific Coast Highway. Project: The "Project' scenario will examine the deletion of the Garfield Avenue /Gisler Street and Banning Avenue /19th Street bridge crossings over the Santa Ana river from the Master Plan of Arterial Highways (Exhibit A). No Project: The "No Project' scenario will examine the construction of the Garfield Avenue /Gisler Street and Banning Avenue /19th Street bridge crossings in accordance with the existing Master Plan of Arterial Highways (Exhibit B). . Alternative: The "Alternative" scenario will examine the construction of the following alternative bridge crossings: 1) connecting Garfield Avenue to SR -57 and/or 1- 405 instead of Gisler Street and 2)connecting 17th street to Brookhurst Street (north of Banning Street) via Bluff Road instead of the Banning Avenue /19th Street bridge crossing (Exhibit C). The impact analysis will include Transportation, Land Use, Noise, Air Quality, Aesthetic, Hazards, Recreation, Public Services and Utilities, Population and Housing, Cultural Resources, Soils /Geology /Seismicity, Energy, Hydrology, Biological Resources, Cumulative Impacts and Unavoidable 4Averse Impacts. OCTA will supply and develop, if necessary, all traffic fiat@ for consultant analysis of transportation impacts. OCTA will act as the lead agency for preparation of the EIR. Specifications: 1. The consultant will prepare a single standard size sheet informational flyer to explain the project alternatives and the EIR process to the public. This flyer will encourage their participation in the process and will provide a schedule of upcoming meetings. The content of the flyer shall be reviewed and approved by the Technical Advisory Group (TAG) and agency staffs prior to distribution. 2. The consultant will prepare a draft "Notice of Preparation" (NOP) as required for implementation of the California Environmental Quality Act (CEQA). The draft NOP shall be reviewed by the TAG and agency staffs. The Lead Agency shall issue the final Notice of Preparation. 3. The consultant will arrange four scoping meetings with all cooperating agencies and others affected by this project to identify significant issues to be analyzed in the environmental document. 4. The consultant will hold two focus workshops to address resolution of possible issues during this project. 5. The consultant shall submit 100 copies of the first screencheck draft EIR to be reviewed by the participating agencies and the TAG. The consultant shall incorporate collective comments from the participating agencies and the TAG and submit 100 copies of the second screencheck for review. 6. Upon completion of the second screencheck review, the consultant will prepare and submit 100 copies of the Draft EIR (DEIR) to the lead agency. 7. The lead agency shall prepare a Notice of Completion and shall be responsible for distributing the Notice. The consultant shall distribute the . DEIR to the State Clearinghouse and other agencies. Furthermore, consultant will prepare response to comments to be included in the final EIR (FEIR). 9. The consultant will hold four open house meetings, one in each of the four participating cities. 10. Upon completion of the draft EIR, consultant will prepare 100 copies of the screencheck findings and 100 copies of the draft findings. 11. The consultant will prepare a screencheck Mitigation Monitoring Plan (MMP) and a final MMP. This plan will report the mitigation measures and costs of mitigation measures for the project and the alternatives. The lead agency will adopt the MMP that matches the approved project. 12.The consultant will finalize the DER and will print and distribute the Final EIR (FEIR) and notices. 13. The consultant will attend and present materials at a minirnum of four SARX Technical Advisory Group meetings to be held during f!!e conduct of the project. Intersection peak traffic counts for all impacted intersections. 4. DISCUSSION: Representatives from the County and the cities of Costa Mesa, Fountain Valley, Huntington Beach and Newport Beach met on November 10, 1993 to discuss the Santa Ana River Crossings. The County stated that, if an amendment to the County Master Plan of Arterial Highways (MPAH) and the respective city circulation elements is to be made, an environmental impact report (EIR) must be prepared. The four cities agreed that the County would be the most appropriate agency to be the lead agency in the preparation of the EIR. It was felt that a MOU from the four cities on this matter would show that the cities are willing to work together to come up with an acceptable plan. Attached is a copy of the MOU that has been reviewed and recommended by the staffs of the four cities. The MOU provides for the following: 1. An EIR will be prepared to evaluate both the construction of the two bridge crossings and the deletion of the bridge crossings. The impacts to the transportation network will be determined for each alternative 2. The EIR will be in sufficient detail to allow the County and City Master plans to be amended. 3. The Cities will fund their fair share, along • with the County, realizing the County would need to prepare an EIR to construct the bridges. 5. On December 7, 1993 the County Board of Supervisors will hold a public hearing and then consider the action to be taken on the Santa Ana River Crossings. The CTIIES wish further analysis of the said bridges, in conjunction with OCEMA, in a form of an Environmental Impact Report (EIR). This Memorandum of Understanding (MOU) identifies the objectives of the EIR and the responsibilities of each involved agency. Therefore, the following understandings are agreed upon: 1. The EIR will include evaluation of the viability of the said bridges in three alternatives: A- Delete the said bridges and evaluate the impacts on the transportation network system and the environment. B. Construct the bridges and evaluate the impacts of the transportation network system and the environment. C. Construct one bridge, delete the other, and evaluate the impacts on the transportation network system and the environment (this will reauire analysis of two additional alternatives). 2. The EIR will provide sufficient information, based upon its findings and, as the findings permit, to allow for modification of the County and City Master Plans of Highways. 3. Realizing the multi-jurisdictional'. ffhpScis of the subject EIR, the CITIES desire to have OCEMA be the lead agency for the EIR with full cooperation, input, and review by the CITIES and Caltrans. 4. A funding formula should be developed for the EIR, taking into consideration that OCEMA would have been the responsible agency to fund the entire cost of a future EIR necessary to build the subject bridges. 5 - The CITIES are committed to working with QCEMA as a first order of business to provide a further agreement Said agreement will include OCEMA and the CITIES, and will identify precise cost allocations/percentages for funding of the EIR. 6. It is the intent of the CITIES to have the EIR completed in the shortest possible time frame. This resolution expresses the City's response to the SARX study, and to the proposal to remove the 19th Street /Banning Avenue and Gisler Avenue /Garfield Avenue Santa Ana River bridges from the Master Plan of Arterial Highways (MPAH). The proposal to remove the bridges from the MPAH is premature without a complete analysis of the impacts of the removals, and of the alternative improvements needed to mitigate the impacts. Just one example of an impact which can be identified at this time is the need to further widen Pacific Coast Highway in West Newport. There are other significant impacts in Newport Beach, and elsewhere in the four city study area. Newport Beach believes that a complete alternative plan of arterial highway improvements must be prepared and evaluated before concurrence in the proposal to remove the bridges from the MPAH can be considered. The plan and evaluation must include: 1. Identification of necessary right -of -way acquisition. 2. The scope of widening improvements needed on existing streets, bridges, and intersections. 3. Evaluation of the environmental impacts of the above widening improvements, and the mitigations needed. 4. A cost estimate for the right -of -way, improvement construction, and environmental mitigations. S. While the above list is extensive, we are greatly concerned that those who have proposed removal of the Santa Ana River bridges from the MPAH have not identified the consequences of the action so that the public may be adequately informed, and a rational decision made. We are also concerned with the lack of good faith being displayed regarding the action Newport Beach took to support the Costa Mesa request to extend the Costa Mesa Freeway southerly a number of years ago. Newport Beach support of that request was predicated on development of an adequate circulation system parallel to the coast to enable dissemination of traffic volumes at the southerly terminus of the freeway, including the westerly extension of 19th Street and construction of the Santa Ana River bridge. The need for such traffic dissemination parallel to the coast has been conclusively demonstrated by the SARX study. The dramatic change to many years of regional highway planning being proposed must not be enacted unless satisfactory alternatives are identified and committed to by the affected parties. WHEREAS, the City of Newport Beach has participated in a cooperative study with the County of Orange, Costa Mesa, Fountain Valley and Huntington Beach to evaluate the Santa Ana River Crossings (SARX) southerly of State Route 405 (the San Diego Freeway); and WHEREAS, the SARX Study shows that the river crossings at 19th Street/Banning Avenue and Gisler Avenue/Garfield Avenue, if constructed, would carry significant traffic and if not constructed, cause increased traffic on various links in the MPAH; and WHEREAS, the County and the Cities have received significant input from citizens near, the previously mentioned crossings objecting to the construction of any new bridge crossings of the Santa Ana River southerly of the San Diego Freeway; and WHEREAS, this public input raises concern for the viability, financial feasibility and constructability of a number of elements of the County's MPAH and the circulation elements of the four cities; and WHEREAS, the City of Newport Beach is uncertain that an adequate transportation circulation network that is politically and environmentally acceptable can be provided through the construction of the additional intersection, existing bridge, and roadway improvements required if the 19th Street/Banning Avenue and Gisler Avenue/Garfield Avenue bridges over the Santa Ana River are not constructed; and WHEREAS, the environmental impacts and potential mitigation measures to those impacts have not been fully identified for either the bridge deletions or the required added capacity at intersections, existing bridges and on roadway links. The City of Newport Beach believes that there may be significant impacts involved with providing the added intersection, bridge, and roadway link capacity required if the new bridges are not constructed and that there may be significant public input and concern related to these impacts; and WHEREAS, the City of Newport Beach is willing to consider a cooperative agreement with Orange County, Caltrans (if appropriate) and the cities of Costa Mesa, Fountain Valley, and Huntington Beach, to prepare an acceptable alternate plan of arterial highway improvements which would provide for a balanced land use/circulation sysiom among the four cities by providing a satisfactory level of alternate highway improvements in lieu of the 19th StreetBanning Avenue and Gisler Avenue/Garfeld Avenue bridges over the Santa Ana River. Such a plan for highway improvements would need to identify: 1) necessary right -of -way acquisitions, 2) scope of roadway, existingtfidge, and intersection widening improvements, 3) environmental assessment of proposed roadway improvements and an envirortmental assessment of constructing the bridges, so that a true comparison can be made, 4) methods of construction financing, and 5) time frame for construction. NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach finds that it is premature to support the "no bridge scenario" until it can be demonstrated that an acceptable alternate plan of arterial highway improvements, including a funding program, which would provide for a balanced land use/circulation system among the four cities can be provided, environmentally cleared, and accepted by the four cities. BE IT FURTHER RESOLVED that the City of Newport Beach also finds that it is premature to enter into a cooperative agreement with Orange County, Costa Mesa, Fountain Valley and Huntington Beach and Caltrans (if appropriate) to fund and construct an alternative highway system that has not yet been established or proven to be a better alternative to the 19th Street/Banning Avenue and Gisler Avenue/Garfield Avenue bridges over the Santa Ana River. BE IT FURTHER RESOLVED that the City of Newport Beach will participate in a program to prepare and evaluate an alternate plan of arterial highway improvements which would provide for a balanced land use/circulation system among the four cities and the County by providing a satisfactory level of alternate highway improvements in lieu of the 19th Street/Banning Avenue and Gisler Avenue/Garfield Avenue bridges over the Santa Ana River.
