for

Combined Project Study Report /Project Report
THIS AGREEMENT, entered into this o?, day of

,1994, by and between the CITY OF NEWPORT BEACH,
a municipal orporation, (hereinafter referred to as "CITY ") and
Willdan Associates, whose address is 888 S. West Street, Suite 300,
Anaheim, CA 92802 -1845 (hereinafter referred to as "CONSULTANT ")
is made with reference to the following:
R E C I T A L S:
A. CITY is a municipal corporation duly organized and
validly existing under the laws of the State of California with the
power to carry on its business as it is now being conducted under
the Statues of the State of California and the Charter of the City.
B. CITY and CONSULTANT desire to enter into an
agreement for Professional Civil Engineering services to prepare
and process the combined Project Study Report (PSR) /Project Report
(PR) for Birch Street Bridge Widening Project over State Route 73
Freeway.
NOW, THEREFORE, it is mutually agreed by and between the
undersigned parties as follows:
SECTION 1. TERM
The term of this agreement shall commence on the 1st day
of February, 1994 and shall terminate on the 31st day of January,
1995, unless terminated earlier as set forth herein. Term of
agreement may be extended by mutual consent of both parties.
SECTION 2. SERVICES TO BE PERFORMED BY THE CONSULTANT
Consultant Services shall include professional and
technical services necessary to:
A. Prepare and process the combined PSR /PR Report in
accordance with current Caltrans Guidelines for the
Preparation of Combined PSR /PR Reports for State
Highway Projects Funded by others.
B. Prepare Fact Sheet and /or Exception to Advisory
Standards as required, based on final Caltrans

approved geometrics.
C. Obtain preliminary title reports, prepare right -of-
way maps, and prepare legal descriptions for the 7
properties north of Bristol Street.
D. Prepare environmental documentation for the
project.
Consultant shall provide services noted above and as
attached hereto set forth in Exhibit "A ", the proposal dated
January 27, 1994.
SECTION 3: COMPENSATION TO CONSULTANT
CONSULTANT shall be compensated for services performed
pursuant to this Agreement by submitting an invoice for services
rendered on a monthly basis. The fee shall be on a time and
materials basis based on standard hourly rates set forth in Exhibit
"A "., the Proposal, which is attached hereto and incorporated
herein by this reference. The maximum fee shall not exceed
$59,674.00. In the event of unforseen changes or required
additions to the work which are not outlined by this agreement, the
Public Works Director may authorize additional compensation up to
15% of the original contract amount. Such work shall be performed
on a time and materials basis at the rates shown in Exhibit "A ".
SECTION 4: STANDARD OF CARE
CONSULTANT agrees to perform all services hereunder in a
manner commensurate with the community professional standards and
agrees that all services shall be performed by qualified and
experienced personnel who are not employed by the CITY nor have any
contractual relationship with CITY.
SECTION 5: INDEPENDENT PARTIES
CITY and CONSULTANT intend that the relation between them
created by this Agreement is that of employer- independent
contractor. The manner and means of conducting the work are under
the control of CONSULTANT, except to the extent they are limited by
statute, rule or regulation and the express terms of this
Agreement.
SECTION 6: HOLD HARMLESS
j CONSULTANT shall indemnify and hold harmless CITY, its

CITY Council, boards and commissions, officers and employees from
and against any and all loss, damages, liability, claims, suits,
costs and expenses whatsoever, including reasonable attorneys'
fees, regardless of the merit or outcome of any such claim or suit
arising from or in any manner connected to CONSULTANT'S negligent
performance of services or work conducted or performed pursuant to
this Agreement.
SECTION 7. INSURANCE
Without limiting the consultant's indemnification of
City, Consultant shall obtain and provide and maintain at its own
expense during the term of this Agreement, policy or policies of
liability insurance of the type and amounts described below and
satisfactory to the City. Such policies shall be signed by a
person authorized by that insurer to bind coverage on its behalf
and must filed with the City prior to exercising any right or
performing any work pursuant to this Agreement. All insurance
policies shall add as insured the City, its elected officials,
officers and employees for all liability arising from Consultant's
services as described herein.
Prior to the commencement of any services hereunder,
Consultant shall provide to City, certificates of insurance from an
insurance company certified to do business in the State of
California, with original endorsements, and copies of policies, if
requested by City, of the following insurance, with Best's Class B
or better carriers:
A. Worker's compensation insurance covering all employees
and principals of the Consultant, per the laws of the
State of California;
B. Commercial general liability insurance covering third
party liability risks, including without limitation,
contractual liability, in a minimum amount of $1 million
combined single limit per occurrence for bodily injury,
personal injury and property damage. If commercial
general liability insurance or other form with a general
aggregate is used, either the general aggregate shall
apply separately to this project, or the general

aggregate limit shall be twice the occurrence limit;
C. Commercial auto liability and property insurance covering
any owned and rented vehicles of Consultant in a minimum
amount of $1 million combined single limit per accident
for bodily injury and property damage.
D. Professional errors and omission insurance which covers
the services to be performed in connection with this
agreement in the minimum amount of 1 Million Dollars
($1,000,000).
Said policy or policies shall be endorsed to state that
coverage shall not be suspended, voided or canceled by either
party, or reduced in coverage or in limits except after thirty (30)
days' prior notice has been given in writing to City. Consultant
shall give to City prompt timely notice of claim made or suit
instituted arising out of Consultant's operation hereunder.
Consultant shall also procure and maintain, at its own cost and
expense, any additional kinds of insurance, which in its own
judgement may be necessary for its proper protection and
prosecution of the work.
Consultant agrees that in the event of loss due to any of
the perils for which it has agreed to provide comprehensive general
and automotive liability insurance, that Consultant shall look
solely to its insurance for recovery. Consultant hereby grants to
City, on behalf of any insurer providing comprehensive general and
automotive liability insurance to either Consultant or City with
respect to the services of Consultant herein, a waiver of any right
of subrogation which any such insurer of said Consultant may
acquire against City by virtue of the payment of any loss under
such insurance.
SECTION S. PROHIBITION AGAINST TRANSFER
CONSULTANT shall not assign, sublease, hypothecate, or
transfer this Agreement or any interest therein directly or
indirectly, by operation of law or otherwise without the prior
written consent of CITY. Any attempt to do so without said consent
shall be null and void, and any assignee, sublessee, hypothecate or
transferee shall acquire no right or interest by reason of such

attempted assignment, hypothecation or transfer.
The sale, assignment, transfer or other disposition of
any of the issued and outstanding capital stock of CONSULTANT, or
of the interest of any general partner or joint venturer or
syndicate member or cotenant if CONSULTANT is a partnership or
joint venture or syndicate or cotenancy, which shall result in
changing the control of CONSULTANT, shall be construed as an
assignment of this Agreement. Control means fifty percent (50 %) or
more of the voting power of the corporation.
SECTION 9: PERMITS AND LICENSES
CONSULTANT, at its sole expense, shall obtain and
maintain during the term of this Agreement, all appropriate
permits, licenses and certificates that may be required in
connection with the performance of services hereunder.
SECTION 10: REPORTS
Each and every report, draft, work - product, map, record
and other document reproduced, prepared or caused to be prepared by
CONSULTANT pursuant to or in connection with this Agreement shall
be the exclusive property of CITY upon final payment to the
CONSULTANT.
CITY shall make no use of materials prepared by
CONSULTANT pursuant to this Agreement, except for construction,
maintenance and repair of the Project. Any use of such documents
for other projects, and any use of uncompleted documents, shall be
at the sole risk of the CITY and without liability or legal
exposure of the CONSULTANT.
No report, information or other data given to or prepared
or assembled by the CONSULTANT pursuant to this Agreement shall be
made available to any individual or organization by the CONSULTANT
without prior approval by CITY.
CONSULTANT shall, at such time and in such form as CITY
may require, furnish reports concerning the status of services
required under this Agreement.
SECTION 11: RECORDS
CONSULTANT shall maintain complete and accurate records
with respect to costs, expenses, receipts and other such

information required by CITY that relate to the performance of
services required under this Agreement.
CONSULTANT shall maintain adequate records of services
provided in sufficient detail to permit an evaluation of services.
All such records shall be maintained in accordance with generally
accepted accounting principles and shall be clearly identified and
readily accessible. CONSULTANT shall provide free access to the
representatives of CITY or its designees at all proper times to
such books and records, and gives CITY the right to examine and
audit same, and to make transcripts therefrom as necessary, and to
allow inspection of all work, data, documents, proceedings and
activities related to this Agreement. Such records, together with
supporting documents, shall be kept separate from other documents
and records and shall be maintained for a period of three (3) years
after receipt of final payment.
SECTION 12: NOTICES
All notices, demands, requests or approvals to be given
under this Agreement shall be given in writing and conclusively
shall be deemed served when delivered personally or on the second
business day after the deposit thereof in the United States mail,
postage prepaid, registered or certified, addressed as hereinafter
approved.
All notices, demands, requests, or approvals from
CONSULTANT to CITY shall be addressed to CITY at:

SECTION 13: TERMINATION
Either party may terminate this Agreement at any time and
for any reason by giving the other party seven (7) days' prior
written notice; notice shall be deemed served upon deposit in the

United States Mail, postage prepared, addressed to the other
party's business office. In the event of termination due to the
fault of CONSULTANT, CITY shall be obligated to compensate
CONSULTANT for only those authorized services which have been
completed and accepted by CITY. If this Agreement is terminated
for any reason other than fault of CONSULTANT, CITY agrees to
compensate CONSULTANT for the actual services performed up to the
effective date of the Notice of Termination, on the basis of fee
schedule contained above, subject to any maximum amount to be
received for any specific service.
SECTION 14: COST OF LITIGATION
If any legal action is necessary to enforce any provision
hereof or for damages by reason of an alleged breach of any
provisions of this Agreement, the prevailing party shall be
entitled to receive from the losing party all costs and expenses in
such amount as the court may adjudge to be reasonable attorneys'
fees.
SECTION 15:
CONSULTANT shall comply with all laws, state or federal,
and all ordinances, rules and regulations enacted or issued by
CITY.
SECTION 16: WAIVER
A waiver by CITY or CONSULTANT of any breach of any term,
covenant, or condition contained herein shall not be deemed to be
a waiver of any subsequent breach of the same or any other term,
covenant, or condition contained herein whether of the same or a
different character.
SECTION 17: INTEGRATED CONTRACT
This Agreement represents the full and complete
understanding of every kind of nature whatsoever between the
parties hereto and all preliminary negotiations and agreements of
whatsoever kind or nature are merged herein. No verbal agreement

or implied covenant shall be held to vary the provisions hereof.
Any modification of this Agreement will be effective only by
written execution signed by both CITY and CONSULTANT.
IN WITNESS WHEREOF, the parties have caused this Agreement to
be executed on the day and year first above written.

(ENGINEERING SERVICES AGREEMENT)
RECOMMENDATIONS:
Authorize the Mayor and City Clerk to execute an Engineering Services
Agreement for preparation of the Birch Street Bridge Widening PSR/PR Report
with Wildan Associates.
ENVIRONMENTAL SIGNIFICANCE:
The project has been reviewed, and it has been determined that it is categorically
exempt under the requirements of the California Environmental Quality Act.
DISCUSSION:
The proposed bridge widening project is required to accommodate future traffic
demands upon the completion of the Birch/Mesa arterial. The widening will provide adequate
bridge width to accommodate two through travel lanes and dual left turns on north and
southbound Birch Street at Bristol Street North and South. The project will also require
additional right -of -way to accommodate the transitions approaching the bridge. The project is a
Growth Management Area project and will be partially funded under that program.
Wildan Associates prepared a feasibility study for the proposed bridge project in
the 1992/93 fiscal year. The study pointed out that there would be problems with clearances
below bridge shoring and false work if construction would occur after the additional lanes are
constructed on the Route 73 Freeway. The widening on the 73 Freeway is planned to be
completed in 1996/97 in conjunction with completion of the San Joaquin Hills Transportation
Corridor. City staff has been working with Caltrans and Orange County to move this project
forward in order to avoid the potential construction conflicts. Because the bridge is within State
right -of -way over the 73 Freeway, the project must follow Caltrans planning and design process
and receive Caltrans approval. Caltrans has agreed to allow the City to combine the required
Project Study Report (PSR) and the Project Report (PR) into one report in order to save time.
City has agreed to act as lead agency to prepare the required reports. Staff is also
working with Orange County to accomplish design and construction of the bridge in a
cooperative project with the County.

In selecting a consultant firm to prepare the PSR/PR reports for Caltrans, City
staff determined to request a proposal from Wildan Associates, Wildan Associates prepared the
feasibility report and staff was pleased with this work. During the consultant selection process for
the MacArthur Boulevard widening project, City staff received 34 letters of interest and
qualifications. Wildan Associates was one of the firms selected to interview with the Selection
Committee comprised of Caltrans representative and City staff. Wildan Associates did very well
in the interview and was highly recommended by the Caltrans representative who had worked
with Wildan Associates on another project. Based on favorable Caltrans and City experience with
Wildan Associates, City staff determined to request the proposal for this work from Wildan
Associates.
Wildan Associates January 27, 1994 proposal proposes to prepare the necessary
PSR/PR reports to be approved by Caltrans for a fee of $59,679.00. The fee is based on
standard hourly rates which are comparable to other civil engineering firms providing similar
services in Orange County. An Engineering Services Agreement has been prepared which
generally provides for the following:

Report/Project Report (PSR /PR)
Dear Mr. Wolter:
As discussed in our meeting with Mr. Steve Badurn on January 13, 1994, we are
submitting the following proposal for the above - mentioned project.
We are dividing our proposal into four major tasks. This allows the City the option
to retain Willdan for some or all of the work. Also, we have detailed the items of
work to be completed for each task. If the City wishes to delete some of those items
and renegotiate the fee for that task, we will be happy to discuss this with you.
Task 1 - Combined PSR /PR
Willdan will prepare and process the combined PSR /PR in accordance with Caltrans
Guidelines for the Preparation of Combined Project Study Reports /Project Reports
(PSR /PR) for State Highway Projects Funded by Others, dated June 1993.
The following items will be completed for this task:
Attend meetings with Caltrans and the City. We anticipate a
maximum of four meetings with Caltrans and three with the City for
a total of seven meetings.
The report format will be in accordance with Attachment B of the
Guidelines.
Revise geometric layout in the feasibility study to include Caltrans
design standards

Review the feasibility study exhibit showing the proposed right -of -way for this
project.
Attend a meeting with the City, appraiser, and right -of -way acquisition agent.
Review the preliminary title reports provided by title company with supporting
documents referenced therein.
Compute the right -of -way take parcels and prepare a hardline calculation
map.
Prepare the deed documents for each parcel to be acquired (if required by the
City).
Prepare a final right -of -way map per industry standards showing:
project title naming client, city, county, and state;
existing street and parcels;
proposed right -of -way take parcels fully dimensioned and identified by

Provide a reasonable number of prints, copies, transparencies of legal
descriptions, deed forms, exhibits, and right -of -way maps.
If the project is to be financed by State or federal funds, the scope of services for the
right -of -way map may vary.
Task 4 - Environmental
Willdan Associates will prepare the Initial Study /Negative Declaration for the
proposed project. The document will be based on information contained in the EIR
for the City's General Plan, the EIR for the other improvements done to Birch Street,
and information developed by Willdan as part of the preparation of the Project Study
Report. The document will include the following sections, as required by CEQA:
Section I - Project Background, including the name of the proponent and the
project location;
Section II - Project Description, including site photographs, a map showing the
project's regional and local location, the site plan for the project, and project
elevations or architectural renderings of the project, if available;
Section III - The CEQA Environmental Impacts Study Checklist;
Section IV - The Discussion of the Environmental Evaluation, including a
detailed explanation of the reasoning behind each of the Yes, No, and Maybe
judgements on the Environmental Impacts Study Checklist and specification
of mitigations to reduce significant impacts to a level which is less than
significant;
Section V - The Determination required by CEQA as to whether an EIR for
the project is required;

Willdan will submit the draft Initial Study /Negative Declaration to the City for review.
Willdan will make any changes requested by the City and submit a second draft to the
City for approval. We will then provide the City with one reproducible original of the
Negative Declaration for processing. This scope assumes that no special studies, such
as hazardous materials, biology, etc., are required as part of the Negative Declaration.
If, after review of the existing EIR's in the project vicinity, the need for special studies
is identified, the City will be notified and the appropriate course of action determined
in consultation with City staff.
If the Negative Declaration identifies the need for mitigations to reduce impacts to less
than significant, Willdan Associates would be available to prepare the Mitigation
Monitoring Program for the proposed project for a fee of $750.00. The Mitigation
Monitoring Program would include, for each mitigation, the party responsible for
mitigation monitoring, the party responsible for implementing the mitigation, and the
phase(s) of the project at which monitoring shall occur.
Following City review and approval of the Initial Study /Negative declaration, Willdan
Associates will prepare and mail up to 25 copies of the document for public /agency
review using the City's mailing list.
We understand the City will file the Notice of Determination.

Background: In July, 1988, and as reinforced by memorandum from
Headquarters' Office of Project Planning and Design
(OPPD) in November 1988 and June 1989, approval for
exceptions to advisory design standards was
delegated to the District Directors. Contingent
with this delegation was the District responsibility
to develop its own procedures for documentation,
approval, and retention of the exceptions to the
advisory standards. Delegation did not eliminate
the need to discuss the proposed exceptions with
Headquarters' Geometricians. In addition to
documenting the decision for making the exceptions,
retention of the documentation in a readily
accessible medium is necessary to alleviate future
tort liability problems. Headquarters' OPPD
requested to be advised of the District's documenta-
tion and retention procedures.
Discussion: Procedures have been developed and implemented for
exceptions to mandatory design standards through the
"Fagt Sheet" procedure. District procedures for
exceptions from advisory design standards should
borrow from the Fact Sheet procedure. Tort
liability is a driving agent for the District to
document and have readily accessible the decision
to deviate from advisory standards far after the
project is constructed and the project file is no
longer available. This requires that the documenta-
tion be retained in the District's Centralized
Records Management System. Documentation needs to
be formalized to the extent that the exceptions
decision is factually complete as to the decision

makers' identification and rationale for the
exceptions along with any review /approval action.
- Action: The following procedure and format (Attachment A)
will be used by the Project Manager /Engineer in
District 12 to deviate from advisory standards.
1. Upon identification of need to deviate from an
advisory design standard in the Department's
Highway Design Manual, a document shall be
prepared containing the elements of the
Attachment A format entitled, "District 12,
Advisory Design Standard Exception." The
project manager shall require the submission
of the same document by the design consultant
(including signature and seal) engaged in
design of a project on the state system.
2. Following completion of a draft of the
aforementioned document, it should be reviewed
and discussed with the Headquarters' Geometric-
ian /coordinator. If the exception continues
to be deemed appropriate, then the document
should be made final accordingly and obtain
the concurrence of the responsible deputy for
Project Management. The responsible engineer
shall sign and stamp his Registered ,Engineer
seal upon the document.
3. The original of the executed document shall be
retained in the project file and a copy
transmitted to the District's Centralized Files
in Records Management (Attention: Records
Officer). Retention in the centralized files
will be indefinitely in accordance with
Retention Schedule Std. 2 - Item 25. Each
document will be retrievable through iden-
tification of the District - CO. Route Post

Subject: Mandatory Design Exception Procedures /Fact Sheet Outline
PURPOSE
This memorandum is to reissue the instructions and documentation
requirements pertaining to the approval process for exceptions to the=
mandatory design standards of the FHWA and Caltrans.
This is also to clarify FHWA requirements pertaining to guardrail
installations which deviate from Standard Plan length and flare
dimensions. Such designs shall be documented in an abbreviated Fact
Sheet approval process. Detailed instructions are provided under
"Guardrail ".
Each District should consider updating its procedures for the
documentation and approval of exceptions to advisory design standards
in accordance with the instructions contained herein.
The procedures for the approval of mandatory design standard
exceptions were previously transmitted by OPPD memorandum dated"June
12, 1989 signed by W. P. Smith, and OPPD memorandum dated November 4,
1988 signed by 'Dean Larson, Acting Chief. This memorandum, when
used in conjunction with Topic 82 - Application of Standards of the
HIGHWAY DESIGN MANUAL, supersedes all previously- issued instructions.
FHWA approval of "non- standard plan" guardrail installations has
been required since May of 1988; however, detailed instructions on
requesting such approval have never been issued.
PHILOSOPHY
One of the most important OPPD responsibilities is to establish
and ensure the consistent application of highway design standards to
insure safe highways for the traveling public. A key part of this
responsibility is assuring that adequate records are preserved to
resolve any question about the engineering decisions leading to
approval of exceptions from design standards. The purpose of the

Design Exception process then is to create a written record (Fact
Sheet) which documents the steps leading to each design exception
approval.
GENERAL. PROCEDURES
All requests for approval of exceptions from mandatory design
standards must be submitted to the OPPD Project Development
Coordinator (PDC) in the form of a Fact Sheet which conforms with the
outline attached to this memorandum.
Approval of exceptions from mandatory design standards must be
sought as early as possible in the project development process,
particularly where the project concept and /or cost estimate depend on
the proposed design exceptions. Therefore, design exception approval
shall be obtained prior tithe completion of the Project Study Report
(PSR) /Initial Project Report (IPR) or the. Project Scope Summary Report
(PSSR). These reports shall include a brief description of the
nonstandard feature(s) and shall make reference to the approved Fact
Sheet(s) in the report section which discusses the project proposal, or
under a separate section.
When the need for a mandatory design exception is identified
after the PSR /IPR or PSSR, Fact Sheet preparation and approval should
precede the next project milestone and should be referenced in the
associated engineering document (e.g., PR, PAR, etc.) .
When design exceptions are proposed by encroachment permit
applicants, the Fact Sheet shall be prepared by the Caltrans'
functional unit (Traffic or Project Development) responsible for PEER
preparation; or, if a PEER is not required, the functional unit
concurring with the nonstandard feature.
When design exceptions are proposed on State Highway projects
coordinated by Local Streets and Roads' staff, the Fact Sheet shall be
prepared by the involved local agency or their engineering consultant.
During the construction phase of a project, Fact Sheets must be
prepared to document the decision to build a nonstandard feature
resulting from a contract change order. The appropriate Project
Development staff should be consulted prior to making such a decision
as they are responsible for preparing the Fact Sheet.
Normally, the design exception process begins with a discussion
of prospective nonstandard design features (as soon as they are
identified) with the PDC or Geometric Reviewer and the FM Area
Engineer. This first step is usually the responsibility of the

Also, FHWA approval is not required when either of the following
- conditions apply:
1. The project for which the Fact Sheet is being prepared is
included in the Combined Road Plan (CRP). CRP projects are:
those projects funded with Federal Urban, Secondary, Bridge
Replacement and Minimum Allocation funds and located on
the Federal -aid Urban or Secondary Systems; and Bridge
Replacement Projects not on the Primary system.
To help identify these projects, the cover sheet of the Fact
Sheet outline has been revised to require that both the
Federal -aid system and funding program be listed with the
project identification (see upper right corner) .
2. The project is nol, on an interstate Highway and the project
cost estimate is less than $100,000. However, the Districts
should give careful consideration to how the proposed
nonstandard feature might affect Federal participation on
future projects within the same highway limits.
Requests should be by letter addressed to Roger Borg, FHWA
Division Administrator; should be signed by a Deputy District Director
or the District Director; and shall be accompanied by a copy of the
OPPD- approved Fact Sheet.

FHWA approval is required for proposed guardrail installations
which deviate from the Standard Plan minimum length (62.51) and /or end
flare dimension of 41. FHWA approval is also required for existing
guardrail within a project's work limits which does not meet the above
Standard Plan criteria.
These Standard Plan deviations shall be documented through a
modified "Fact Sheet" process where approval authority rests with the
HQ Division of Traffic Operations. An abbreviated Fact Sheet must be
prepared by the District and approved by the appropriate "HQ Traffic
Operations Liaison Engineer" before requesting FHWA approval.
The attached Fact Sheet outline contains additional instructions;
however, the content of the abbreviated Fact Sheet must be discussed
with the appropriate Traffic Operations Liaison Engineer.

widening, resurfacing, rehabilitation, reconstruction, etc. Give

Item No. 11 of this outline lists the attachments which need to
be included with the Fact Sheet to help describe the project.
Nonstandard Feature(s): Describe proposed nonstandard feature
including "non- Standard Plan" guardrail installations; are they
an improvement over the existing highway standards? How?
Safety Improvements: Describe any proposed improvements that
would qualify as safety enhancements, such as median barrier,
guardrail upgrade, flattening slopes, correcting superelevation,
eliminating roadside obstacles, etc.
Total Project Cost: Include a good estimate of project cost
segregated by major elements, including: roadway, structures,
rights of way, utility relocation, etc., as needed.
2. EXISTING HIGHWAY
Description: Include general highway characteristics, focusing on
those features relevant to the proposed design exception, such as
widths of lanes, shoulders, median, roadbed, bridges, etc.;
horizontal and vertical clearances, design speed, sight distance,
grades; horizontal and vertical curves, pavement cross slope,
superelevation, etc. Highlight all existing nonstandard features
within or adjacent to the project limits.
Provide similar description of adjacent highway segments when
relevant to discussion of the proposed exception.
Structures: Note bridge roadbed /lane /shoulder width; does the
bridge roadbed match the approach roadbed width? Give type of
bridge rail; does it meet current standards for structural
adequacy? Request this information from the Structure Liaison
Engineer assigned to your District.

4. REASON FOR REQUESTING EXCEPTION
Be thorough, but brief; justification must be as complete and
convincing as possible. Reasons exceptions have been granted in
the past include excessive cost, right of way and /or environmen-
tal impacts, defer bridge widening or replacement to scheduled
future project, etc. Supportive factors have included low acci-
dent frequency, need to avoid project delay, local opposition,
consistency with adjacent highway segments, etc.
5. ADDED COST TO MARE STANDARD
Show an estimate of the added cost above the proposed project
cost which would be required to meet the design standard for
which the exception is requested. The estimate does not have to
be highly developed, but must be realistic.
6. TRAFFIC DATA
Include both AADT's and design (peak period) hourly volumes. For
3R projects, use current year traffic. For all others, use
design year traffic, usually 20 years after construction. For
interim projects that are to be replaced by programmed future
construction, use the ultimate programmed construction year.
7. ACCIDENT ANALYSIS
Traffic safety is of primary importance to both OPPD and FHWA in
considering approval or rejection of design exceptions. To
strengthen the evaluation of design exceptions, the fact sheet
should include analysis of accident data to identify prevalent
accident types and causes and evaluate the effect of the
requested design exception(s) on accident types and frequencies.
The Fact Sheet should summarize an analysis of how the proposed
RRR or other project will help alleviate identified safety
problems; or, as a minimum, how it will not contribute to any
increase. This analysis shall be based on evaluation of TASAS
Table B statistical data on the number and severity of accidents
and actual vs. statewide average accident rates, plus Table C
data for high accident frequency spot locations, if any, within
the proposed project limits.
TASAS data analysis should be supplemented by review of District
accident diagrams covering the project area for a heightened
understanding of prevalent accident types and how they relate to
existing and proposed highway design features. Merely stating
the Table B Actual vs. Expected numbers is insufficient.

In determining accident causes, keep in mind that, though the
terms "excessive speed ", "inattention ", "failure to yield right
of way ", "under the influence ", etc., are perfectly valid for the
Highway Patrol, they have meaning for the highway engineer only
as they relate to the underlying highway characteristics. Hence,
the engineer must instead look for other reasons, such as: tight
radius curves with inadequate superelevation, high - volume turning
movements without separate turn lanes, a concentration of rear
end /sideswipe accidents in a particular lane, etc. In general,
the accident concentrations detected in this manner are too small
for a Table C printout, but collectively they are the key to
understanding the vehicle - highway interactions that are the basic
causes of accident problems.
8. INCREMENTAL IMPROVEMENTS
Discuss other practical alternatives intermediate in scope and
cost between the proposed project requiring design exception and
the full standard solution. Include enough information on costs
vs. benefits, right of way and /or environmental impacts, etc., to
explain why none of the alternatives is recommended.
9. FUTURE CONSTRUCTION
Describe any planned future project that will correct the
proposed nonstandard feature and discuss programming. Is the
future work programmed in the STIP, Highway Systems Operation and
Protection Plan (HSOPP), or Traffic System Management plan (TSM)?
If not, is the future work identified in the PSTIP or RTIP?
Or is it covered by a listed measure project? Is it high on the
Candidate Project Priority List? 'How long before the highway is
expected to be brought up to full design standards? Include a
discussion of the Route Concept.
10. PROJECT REVIEWS, CONCURRENCE
Note project reviews by the HQ OPPD Project Development Coordinator
and Geometric Reviewer, HQ Traffic Operations Liaison Engineer,
FHWA Area Engineer, etc. Give dates, discuss comments, and
describe what changes were incorporated in the project in
response to their comments.
11. ATTACHMENTS
Attach plan drawings, cross sections, special details, photos,
etc., as needed to show the problem and justify the exception.
These materials shall be provided for each location that does not
meet the mandatory standard for horizontal /vertical clearance and
lane or shoulder width.
For approval requests pertaining to "non- Standard Plan" structure
approach rail installations, plan drawings shall provide
topographic and right -of -way information within at least 100' of
each end of the structure.

The above schedule is tor: straight time. Overtime will be charged at 1.25 times the standard
j hourly rates. Sundays and holidays Will be charged at 1.70 times the standard hourly rates.
It should be noted that the foregoing wage rates are effective through June 3D, 1994. The rotes
maybe adjusted afterthat date to compensate for labor adjustments and other increases in costs.
