Burnham SUBJ: Resolution Authorizing City Manager to Execute contracts Supplemental Law Enforcement Services July 4, 1994 Holiday On June 24, 1994 the California Highway Patrol advised the Police Chief that they would provide supplemental law enforcement services during the Fourth of July holiday only if presented with a resolution authorizing the City Manager to execute appropriate agreements on behalf of the City. The Highway Patrol advised the City subsequent to the preparation and posting of the agenda. The Brown Act authorizes the City Council to take action on off- agenda items when the matter arose after posting of the agenda. Accordingly, the City Council may, by a vote of 5 members if all are present, or the unanimous vote of the Council if one or more members are absent, take action on the proposed resolution authorizing the City Manager to execute contracts on behalf of the City. RECOMMENDATION• Determine that the need to adopt a resolution authorizing the City Manager to execute contracts on behalf of the City arose after the posting of the agenda for the regular meeting of June 27, 1994 and approve the resolution attached �tq/ this report. BACKGROUND: Each year the City is required to execute a contract with the State of California to provide supplementary law enforcement services by the Highway Patrol during the July 4th deployment period. The attached resolution authorizes the City Manager to execute such contracts on behalf of the City. The resolution is required by the Legal Department of the State of California. Obtain a resolution from the governing body stating (1) who is authorized to sign on behalf of the City and (2) giving authorization to enter into an agreement with the California Highway Patrol. CONTRACT MANAGEMENT UNIT Attachments CHP #0066 -94/95 FI STATE OF CALIFORNIA DEPARTMENT OF CALIFORNIA HIGHWAY PATROL LETTER OF AGREEMENT TRAFFIC CONTROL THIS AGREEMENT, made and entered into this 4th day of July, 1994, by and between the State of California, acting by and through the Department of California Highway Patrol, hereinafter called CHP, and City of Newport Beach, Newport Beach Police Department, hereinafter called CITY. WITNESSETH: By and in consideration of the covenants and conditions herein contained, the CITY and the CHP do hereby agree as follows: 1. CHP agrees to provide uniformed personnel with vehicles and motorcycles for traffic control in the city of Huntington Beach during the Fourth of July holiday. It is anticipated that the CHP will provide one Motorcycle Sergeant, one Vehicle Sergeant, twelve Motorcycle Officers and twenty -six Vehicle Officers. 2. The CHP Coordinator shall be Sgt. Michael A. Fassnacht, telephone number (714) 547 -8311. 3. The services will be for July 4, 1994 only. 4. In the event of disaster or unforeseen emergency, this agreement may be cancelled by the CHP without prior notice. 5. This agreement may be amended by mutual written consent of the parties hereto. 6. In consideration for the above services and upon receipt of an invoice, CITY agrees to pay CHP in accordance with the following: a. One M/C Sergeant 12 hrs. ea. @ $51.67/hr. _ $ 620.04 b. One Veh. Sergeant 12 hrs. ea. @ $49.75/hr. _ $ 597.00 C. Twelve M/C Officers 12 hrs. ea. @ $42.74/hr. _ $ 6,154.56 d. Twenty -six Veh. Officers 12 hrs. ea. @ $40.89/hr. _ $12,757.08 e. Vehicle Miles 1,328 miles @ $ .37 /mi. _ $ 491.36 f. M/C Miles 1,732 miles @ $ .50 /mi. _ $ 866.00 The total amount payable under this agreement is estimated to be Twenty -one Thousand Four Hundred Eighty -Six Dollars and Four Cents ($21,486.04). CITY agrees that additional charges may be assessed for CHP supplies, additional equipment utilized, damage to uniforms or property repaired or replaced at State expense, etc. which are directly related to the services provided. 9. Should additional charges and /or rate increases be assessed, CITY agrees to pay such charges within fifteen (IS) days upon receipt of an itemized invoice from CHP. 10. No additional gifts, donations, or gratuities may be accepted by the California Highway Patrol employees in their behalf or in behalf of the Department, informal squad fund or other local funds. FROM q RESOLUTION NO. 94-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS FOR PROFESSIONAL SERVICES INCLUDING SUPPLEMENTAL LAW ENFORCEMENT SERVICES. WHEREAS, the Newport Beach City Charter, the Newport Beach Municipal Code and the policies adopted by the City Council provide that the City Manager is the chief administrative officer of the City and is responsible for the administration of the annual budget and the preparation of rules relative to the contracting for goods, equipment and services; WHEREAS, effective administration of City government requires the City Manager to have the authority to execute contracts for the acquisition of goods, equipment and services; and WHEREAS, the City has routinely contracted for supplemental law enforcement services during the Fourth of July holiday and various agencies require the City Manager have specific authority to execute appropriate agreements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: SECTION 1• The City Manager is hereby authorized to execute all contracts on behalf of the City involving the purchase of goods or equipment, the retention of consultants to provide special services and the retention of services to supplement City services, including, without limitation, police, fire, general services and utilities provided the contract price does not exceed #30,000; SECTION 2• The City Manager is specifically authorized to execute, on behalf of the City, any agreement with the California Highway Patrol, or any police department in the State of California, for supplemental law enforcement services during the Fourth of July holiday or any other occasion; and 1 0 10 SECTION 3• The terms and conditions of this resolution are deemed supplemental to any other authority, power or right granted to the City Manager pursuant to the City Charter, or any ordinance, rule, resolution or policy adopted by the Newport Beach City Council.
