SUBJECT: MEMORANDUM OF UNDERSTANDING (MOU) FOR IMPROVEMENTS TO
ROUTE 73 FREEWAY AND THE 1 -405 FREEWAY.
RECOMMENDATION:
Approve the multi- agency MOU and authorize the Public Works
Director to sign on behalf of the City.
DISCUSSION:
The San Joaquin Hills Transportation Corridor (SJHTC) EIR includes a
mitigation measure that requires the Transportation Corridor Agencies (TCA) to
participate with Caltrans and other agencies to find a practical solution to
accommodate increased traffic flows on the Route 73 freeway north of Birch Street
• which are anticipated with the development of the toll road.
The attached MOU is the result of an extended series of meetings and
discussions between agencies to provide improvements to the confluence of the
Route 73 Freeway /1 -405 Freeway /Route 55 Freeway in conjunction with the
planned opening of the SJHTC. Parties to the MOU are Caltrans, the Orange
County Transportation Authority (OCTA), the Transportation Corridor Agency
(TCA), the National Transportation Authority (NTA) (a private entity who has
received a franchise from Caltrans to design and build an extension of the 55
Freeway to the 405 Freeway) and the Cities of Costa Mesa and Newport Beach. To
date, planning and design has been completed for one of the missing 73/55
connecting ramps (Connector D). The Connector D Ramp provides for North
Bound 55 Freeway to Eastbound 73 traffic and is ready for construction bids.
Costa Mesa, Newport Beach, TCA and OCTA are participating in this project.
Costa Mesa will provide construction management with funding from OCTA and
TCA. The other missing ramp for the 73/55 Interchange (Ramp B) is currently
unfunded and included in the project being evaluated as part of this MOU.
• Approval of the MOU sets the framework for a continuing cooperative
effort among Costa Mesa, Newport Beach, OCTA, NTA and Caltrans to plan, design
and develop funding for a set of improvements to the 73/405/55 confluence. It is
understood and agreed that future agreements will be required to address final
design, right -of -way, project management approvals and funding for the following
project components:
1. Widen Route 73 by adding one mixed flow lane and one High
Occupancy Vehicle (HOV) lane in each direction.

2. Construction new connector from NB73 to SB55 (Connector B).

consider the ultimate improvements on 1 -405.
4. Provide three lanes on each mixed flow connector along the Route
73/1 -405 Interchange.
5. Construct Harbor /Fairview braided ramps on northbound 1 -405.
6. Widen NB 1 -405 to seven lanes from Route 73 gore to the Harbor
Boulevard off ramp (by utilizing the space under Fairview Road).
7. Widen NB 1 -405 to six lanes from Harbor Boulevard off ramp to Harbor
Boulevard direct on ramp (by widening the Harbor Boulevard bridge).
8. Extend the additional (auxiliary) lane in Number 7 above to Euclid •
Street (by widening the bridge over the Santa Ana River).
9. Widen southbound 1 -405 from Harbor Boulevard off ramp to Harbor
Boulevard on ramp.
10. Widen southbound 1 -405 from Harbor Boulevard on ramp to Fairview
Road off ramp.
The attached map graphically represents the project and its
components.
All parties to this MOU have worked diligently to resolve a multitude
of conflicts. It represents a significant effort to form partnerships among both
public and private interests. Funding for the MOU is from the TCA, the City of
Costa Mesa will begin acting as lead agency in implementing the proposed
73/405/55 improvements.
The MOU is set -up to be executed by the Public Works Director •
and their counter parts in the various other agencies.

The California Department of Transportation (Caltrans), in cooperation with the
Orange County Transportation Authority (OCTA ), the Transportation Corridor Agencies
(TCA), and the Cities of Costa Mesa and Newport Beach, hereinafter referred to as
Project Sponsors are proposing operational improvement modifications to Route 73
between Birch Street and Interstate 405 (1 -405) and to the 1 -405 from Bear Street to
Euclid Street herein referred to as PROJECT.
Project Components for the Route 73 /Interstate 405 Improvements:
1. Widen Route 73 by adding one mixed flow lane and one High Occupancy
Vehicle (HOV) lane in each direction.
2. Construct new connector from NB73 to SB55 (Connector B).
3. Provide for Direct HOV Connectors from NB Route 73 to NB 1 -405 and consider
the ultimate improvements on 1 -405.

The attached map graphically represent the PROJECT and its components.
In addition, Caltrans has granted a franchise agreement to the National Transportation
Authority (NTA) to develop and construct the Route 57 Santa Ana Viaduct
Expressway (SAVE) project from SR 57 to 1 -405 inclusive of direct connections
between Route 57 and Route 73. A portion of the SAVE project parallels 1 -405
between the Santa Ana River and Route 73.
OCTA is in the process of completing the Environmental Documents and the Project
Report for the 1 -405 and Route 73 improvements which need to be closely
coordinated with the SAVE project. This memorandum of understanding (MOU)
establishes general agreement for the development of the Environmental Documents
and the Project Report for the PROJECT in coordination with the SAVE project.
Therefore, the following understandings for the development and oversight of the
environmental documents and the project report for the PROJECT are agreed to as
follows:
A. A design concept plan will be developed to include the PROJECT and the
SAVE project to meet all state and federal requirements, policies, and
procedures. Caltrans will assume the lead in the effort, and all parties
will work cooperatively with Caltrans to finalize the plan. Input will be
obtained from all parties throughout the design concept process, with
monthly progress meetings scheduled and conducted by Caltrans. The
draft design concept plan is expected to be circulated to all parties for
approval in May, 1995, and the final will be submitted for approval in
August, 1995.
B. All parties will continue their present approach for finalizing the Project
Report and the Environmental Documents for the PROJECT, and will
include the federal major investment study to secure approvals of the
PROJECT under the California Environmental Quality Act and National
Environmental Policy Act. The documents will include all PROJECT
components and coordination with the SAVE project.
C. The Environmental Documents (ED) for PROJECT are expected to be
circulated for review and comment by October 1995, and approved by
February 1996.
D. The approval of PROJECT documents will be coordinated with the SAVE
project. Items affecting the development of the PROJECT or the SAVE
project will be resolved by the parties of this agreement.

E. All parties agree that the PROJECT and the SAVE project will be
developed to be compatible. The parties will continue their good faith
efforts towards the development of two project. Any future changes to
the projects beyond the design concept plan will be funded as described
in the following table:
F. It is understood by all parties that Caltrans is the responsible agency in
overseeing the design and construction of the PROJECT and the SAVE
project. As such, it is also understood that changes, conditions,
requirements, and directives that are made by Caltrans as part of their
normal governance of the PROJECT and the SAVE project will exempt
Caltrans from the requirements of the above table. Changes requested
by Caltrans which are not a part of the normal oversight of the PROJECT
or the SAVE project, shall be paid for by Caltrans in accordance with the
above table of Section E.
G. To date, OCTA has spent $343,000, and Costa Mesa has spent
$76,000 on the development of the Project Report and Environmental
Documents for the PROJECT. In addition, an amount not to exceed
$300,000 will be required to finalize the documents. TCA will provide
the additional funds to the OCTA to complete the project report and
environmental documents.
H. A series of future agreements among the parties will be developed to
address final design, right of way support and acquisition, utility
relocation, construction, and construction management of the PROJECT.
All parties agree to work together to seek additional funding for
completion of the PROJECT.
