RECOMMENDATION:
Authorize Weeks Marine, Inc. to complete sand haul operations within the City of
Newport Beach in accordance with the U. S. Army Corps of Engineers Construction
Solicitation and Specifications for the Beach Renourishment, Stage 10, San Gabriel
River to Newport Bay.
is DISCUSSION:
On August 8, 1995, Council approved an agreement between the City and the County
of Orange providing for City participation in Stage 10 of the Federal Cooperative Beach
Erosion Control Project, and on June 24, 1996, authorized a right -of -entry agreement
with the Corps of Engineers to allow access to the West Newport beaches to conduct
an excavation, sand haul, and beach fill operation.
The Corps has awarded a contract to Weeks Marine, Inc. of Cranford, New Jersey for
the construction of the Beach Renourishment Project. The total contract amount is
$7,732,000. The City's contribution to the project is $189,740.
The limits of the project are shown on the attached location map. Work to be
completed within the City consists of moving 140,000 cubic yards of sand from the area
south of the Santa Ana River to the groin fields. Sand haul operations will be allowed
on weekdays between the hours of 7:30 a.m. and 4:30 p.m., and the contractor plans to
work approximately six hours a day during low tide. The work will be accomplished with
14 large scrapers operating on the beach, with the fill work proceeding from south to

north. The contractor will be posting signs closing the beach during working hours, and
will continuously operate two patrol vehicles during working hours while the operation is
underway.
The Corps has issued a Notice to Proceed to the contractor, and work is scheduled to
begin on Tuesday, October 29, 1996, pending Council authorization. Work is
scheduled to continue for 24 working days, through December 2, 1996. Ocean front
residents have been made aware of the project through an informational brochure, and
a neighborhood meeting has been held to discuss the project with affected residents.
The Corps will manage and inspect the project.

RECOMMENDATION:
Authorize the Mayor to execute a right -of -entry agreement with the Corps of Engineers to
allow access to the West Newport beaches to conduct an excavation, sand haul and
beach -fill operation.
DISCUSSION:
• The Corps of Engineers has included beach fill in the West Newport groin field with their
Surfside /Sunset sand replenishment project. There will be 140,000 cubic yards of sand
moved from the area south of the Santa Ana River to the groin fields. The contract is
scheduled to be advertised for bids on June 25, 1996, with bids to be opened on August
20, 1996.
The Corps of Engineers has asked the City to execute a right -of -entry to the beach area
for the construction period, which will begin after September 15, 1996. The length of the
larger project is seven months and it is estimated that the work in Newport Beach will take
4 to 6 weeks.
In 1995, the City furnished the Corps with a set of conditions that would be placed on the
Government's contractor. The attached May 5, 1995 letter lists those conditions.
Condition No. 7 requires the contractor to provide personnel and signs necessary to close
the beaches in the excavation and fill areas. Signs, personnel and possibly fencing will
also be required to manage beachgoers within the limits of the sand -haul operation. The
contractor's equipment will make between 6,000 and 10,000 round trips to haul 140,000
cubic yards of sand.
The Corps' contract documents require the contractor to obtain a right -of -entry permit
from the City Council of Newport Beach before work can begin in West Newport.
. Conditions in the permit will require that the Corps' contractor coordinate project
operations with City staff and the residents, similar to the permit conditions used with the

contractor on the Santa Ana River Project in 1991. When bids are received and a project
schedule is made firm, staff will report back to the Council and begin to notify ocean -front
residents of the project. The City's share of the $10,500,000 project cost is $190,000 and
has been provided through a cooperative agreement with the County of Orange.

Dear Mr. Mesa,
The City is pleased with the decision to include beach fill in the West Newport Groin
field with the Stage 10 beach erosion project. The City Council is scheduled to approve
• a cooperative agreement with Orange County, which provides for the City's share of the
project funding, on May S. 1995.
As we discussed, the City will require the contractor to apply for and obtain a right of
entry permit for the sand haul operations from the City. The permit process will be
similar to the process that the contractors for the Corps of Engineers Santa Ana River
Project and Orange County's Talbert Channel outlet project undertook to place dredged
sand on the beach in West Newport. The contractor will be required to submit a detailed
description and schedule of the proposed sand haul operations. In addition the Corps of
Engineers project specifications should reflect the following conditions which will be
required by the City's permit.
1. The right -of -entry is for the purpose of excavating sand from near the
Santa Ana River, transporting the sand along the beach and placing the
sand within the West Newport groin field and beach near the Newport
Pier.
2. Sand haul operations will be allowed on week days between the hours of
7:30 a.m. and 4:30 p.m. No work will be allowed at night, on weekends or
on holidays.
• 3. All operations shall conform with the City's noise control requirements as
set forth in the municipal code section 10.28.040.
4. Contractor shall provide and operate a water truck during sand haul
operations in order to control dust.

5. Contractor shall provide equipment necessary to shape and dress the
beach during sand haul operations.
6. Contractor shall make arrangements with Orange County EMA to use
open space adjacent to east side of Santa Ana River for equipment
storage.
7. Contractor shall provide personnel and signs as necessary to close
beaches in the excavation and filling areas. Signs and personnel will also
be required to manage beachgoers within the entire limits of the sand haul
operations.
8. The contractor will be required to have a valid City business license.
9. Contractor shall provide a contact person who can be reached by phc-e
must be available at the job site or job trailer at all times during the sa-:d
replacement.
10. Contractor will be required to facilitate a preconstruction meeting K .h
representatives of City and Corps of Engineers inspectors, and contractor
must be held one week prior to beginning the sand placement operatiors.
11. Contractor shall notify City 48 hours prior to changes in operations or
schedule of work.
12. Contractor shall provide for City to be named as additional insured for the
West Newport Beach sand haul portion of the Stage 10 project.
13. Government shall manage and inspect sand placement operations, install
warning signs and maintain the work areas in a clean and safe condition.
14. Contractor agrees to hold CITY harmless from and indemnify CITY for
damages arising from the activity of the GOVERNMENT, its employers
and /or contractors on said lands, in the exercise of rights under the richt-
of -entry permit.

DISCUSSION:
The U.S. Army Corps of Engineers is preparing to undertake Stage 10 of
the Federal Cooperative Beach Erosion Control Project (FCBECP) and has requested
parties to the Cooperative Project (State of California, County of Orange, City of
Huntington Beach, City of Newport Beach and the Surfside Colony Storm Water
Protection District) to enter into agreements necessary for implementation of the Stage
10 project. This agreement with Orange County provides for the City's participation in
the project which will place 1,500,000 cubic yards of beach sand at the Surfside /Sunset
"Feeder Beach" near Anaheim Bay and 150,000 cubic yards of beach sand in West
Newport between the Newport Pier and the 56th Street groin. The $10,600,000 project
will be funded 67% Federal /33% local with the City's share of $189,740.00 equal to
1.79% of the total project cost.
This is the project which, in earlier stages, constructed the groin field and provided
beach fill in West Newport. Beach erosion studies were authorized by the Federal
government in the 1940's and by the State in the 1950's. The FCBECP was initiated in
1963 when severe beach erosion threatened homes in West Newport Beach and
Surfside /Sunset Beach adjacent to the Anaheim Bay Entrance Jetty. Limits of the
cooperative project extend from the Newport Harbor entrance 17 miles westerly to the
Anaheim Bay Entrance Jetty. Since construction of the groin field and beach fill in West
Newport in 1973, three stages of the project have dredged a total of 6,600,000 cubic
yards of sand from offshore onto the "feeder beach" at the Surfside Colony adjacent to
the Anaheim Bay Jetty. The dredging has been programmed to occur on a six -year
cycle with the sand placed on the "feeder beach" migrating by natural forces Easterly to
the groin field in West Newport.

Beach surveys show that even with the regularly placed beach fill at
Surfside Colony, there has been an annual net loss in beach width from the Newport
Pier to 56th Street. Information gathered from City participation in the Federal Coast of
California Study and the Balboa Peninsula sand surveys conducted by City consultant
Dr. Craig Everts of Moffat and Nichols Engineers, and the City Marine Department
lifeguards and dive team, have demonstrated this annual loss of sand. The U.S. Army
Corps of Engineers has reviewed the survey information and has now agreed to modify
the FCBECP. The Stage 10 project will include placement of 150,000 c.y. of beach
sand in the West Newport Groin Field and ensuing FCBECP projects will analyze and
place sand in the West Newport Groin Field, if needed. The beach in West Newport
near 36th Street and the Surfside Colony beach near the Anaheim Jetty are currently
very narrow and during the recent winter storms, berms were constructed to reduce the
potential for waves over - topping the narrow beach.
The Corps of Engineers' plan calls for bottom loading scrapers to pick -up
sand from the wide beach between the Santa Ana River and 60th Street, drive down
the beach and place the sand on the narrow beach between the Newport Pier parking
lot and the 56th Street groin. The Corps of Engineers Santa Ana River project placed
approximately 1,500,000 c.y. of excess material, excavated during the river
construction, into the near shore area of West Newport between 60th Street and the
river jetty. Our surveys have shown that wave energy is separating out the silty
material and clean sand is moving onto the beach. The offshore stockpile will continue
to provide clean sand to build back the beach after this excavation is completed
providing a source of clean sand for future sand hauls to the groin field area. Staff is
working with the Corps of Engineers to finalize their plan for the work. The project
specifications will provide for the Corps of Engineers' contractor to obtain a Right -of-
Entry Permit approved by the City Council prior to the start of work. This process
worked well with the County's Talbert Channel project and the Corps of Engineers
Santa Ana River project which both dredged sandy material into the near shore area in
West Newport.
The Stage 10 work is presently planned for this fall and it is estimated that
the sand haul operation will require approximately three months. The work will be
limited to normal daytime working hours with no work at nights, weekends or holidays.
The actual construction date has not been set but it is planned to accomplish the sand
haul during the fall or winter months when beach use is at a minimum. Even in the off-
season, some assistance from the City lifeguards and beach maintenance crews will be
needed to assist the contractor in managing beach users and enforcing beach closures
in the excavation areas and fill placement zones on the beach. When plans are
finalized and the construction schedule is confirmed, information will be provided to
ocean front homeowners and the West Newport Association.

Orange County, Huntington Beach and Surfside Colony have all indicated
that their share of the funding is available for the project. The State's share is currently
in the proposed FY 95 -96 budget, the $1,200,000 Federal share is available in the
current fiscal year, and the remaining $6,000,000 of the Federal share has been
requested to be in the proposed FY 95 -96 Federal budget which, if approved, will be
available in October 1995. The City's share of $189,740 is available in the current year
budget in Account No. 7231 P301051A.
Attached for reference and background information is a copy of a Stage
10 project description and summary of previous project stages and costs.

The FY 94 -95 budget includes $190,000 for the City's share of the $10,600,000 Stage
10 Federal Cooperative Beach Erosion Control Project (FCBECP). This is the project
which, in earlier stages, constructed the groin field and placed beach fill in West
Newport. The current project proposes to place over 1,750,000 c.y. of dredge sand on
the beach in Surfside /Sunset Beach, with the Federal government bearing 67% of the
cost, the State of California 16.5% of the cost and local agencies 16.5 %. The City's
share of $190,000 represents approximately 1.8% of the total cost.
Beach erosion continues in West Newport and placement of beach fill will be required
sometime in the future. Through participation in the Coast of California Storm and Tidal
Wave Study, the Balboa Peninsula Littoral Sand Movement Study and continued
participation in FCBECP, Public Works Department staff plan to demonstrate the need
for a large scale West Newport Beach fill project as a future stage of the FCBECP.

Approve an amended Agreement between the City and the County of
Orange providing for City participation in Stage 10 of the Federal
Cooperative Beach Erosion Control Project; and authorize the Mayor and
the City Council to execute the Agreement.
DISCUSSION:
On May 8, 1995, the City Council approved an Agreement between the
City and the County of Orange which provided for City participation in Stage 10 of the
Federal Cooperative Beach Erosion Control Project. The $10,6000,000 cooperative
project, to be managed by the U.S. Army Corps of Engineers, was to include the
placement of 150,000 c.y. of beach sand in the West Newport Groin Field and
1,700,000 c.y. of sand dredged from offshore on to the "feeder beach" at the Surfside
Colony adjacent to the Anaheim Bay Jetty. A copy of the May 8, 1995 Council memo,
which describes the project in detail, is attached.
The State of California has notified Orange County and the local agencies
that their share of the funding for the project has been reduced in the recent budget
negotiations. The Governor's budget includes $2,100,000 for the project, a $300,000
reduction in the State's share. Terms of the Federal Legislation authorizing the
Cooperative Project, require 67% Federal /33% Local matching funds for the project.
This Local matching requirement reduces the Federal funds available to the project,
resulting in approximately a $900,000 reduction in the total project funds available for
the project.
State and Federal engineers have determined that a modified project can
still be implemented and they have recommended that the amount of offshore dredged
material, to be placed at the Surfside Colony beach, be reduced to meet the available
funding. This is good news for West Newport as the modified project will still include
the original plans to place 150,000 c.y. of beach sand in the Groin Field.

County has now requested the ocal parties to execute a new agreement which reflects
the reduced State and Federa neling resulting in a $9,739,636 cooperative project.

remain unchanged and City staff recommends approval.

river jetty. Our surveys have shown that wave energy is separating out the silty
material and clean sand is moving onto the beach. The offshore stockpile will continue
to provide clean sand to build back the beach after this excavation is completed
providing a source of clean sand for future sand hauls to the groin field area. Staff is
working with the Corps of Engineers to finalize their plan for the work. The project
specifications will provide for the Corps of Engineers' contractor to obtain a Right -of-
Entry Permit approved by the City Council prior to the start of work. This process
worked well with the County's Talbert Channel project and the Corps of Engineers
Santa Ana River project which both dredged sandy material into the near shore area in
West Newport.
The Stage 10 work is presently planned for this fall and it is estimated that
the sand haul operation will require approximately three months. The work will be •
limited to normal daytime working hours with no work at nights, weekends or holidays.
The actual construction date has not been set but it is planned to accomplish the sand
haul during the fall or winter months when beach use is at a minimum. Even in the off-
season, some assistance from the City lifeguards and beach maintenance crews will be
needed to assist the contractor in managing beach users and enforcing beach closures
in the excavation areas and fill placement zones on the beach. When plans are
finalized and the construction schedule is confirmed, information will be provided to
ocean front homeowners and the West Newport Association.

Orange County, Huntington Beach and Surfside Colony have all indicated
that their share of the funding is available for the project. The State's share is currently
in the proposed FY 95 -96 budget, the $1,200,000 Federal share is available in the
current fiscal year, and the remaining $6,000,000 of the Federal share has been
requested to be in the proposed FY 95 -96 Federal budget which, if approved, will be
available in October 1995. The City's share of $189,740 is available in the current year
budget in Account No. 7231 P301051A.
Attached for reference and background information is a copy of a Stage
10 project description and summary of previous project stages and costs.

FEDERAL COOPERATIVE BEACH EROSION CONTROL PROJECT
STAGE 10
The FY 94 -95 budget includes $190,000 for the City's share of the $10,600,000 Stage
10 Federal Cooperative Beach Erosion Control Project (FCBECP). This is the project
which, in earlier stages, constructed the groin field and placed beach fill in West
Newport. The current project proposes to place over 1,750,000 c.y. of dredge sand on
the beach in Surfside /Sunset Beach, with the Federal government bearing 67% of the
cost, the State of California 16.5% of the cost and local agencies 16.5 %. The City's
share of $190,000 represents approximately 1.8% of the total cost.
Beach erosion continues in West Newport and placement of beach fill will be required
sometime in the future. Through participation in the Coast of California Storm and Tidal
Wave Study, the Balboa Peninsula Littoral Sand Movement Study and continued
participation in FCBECP, Public Works Department staff plan to demonstrate the need
for a large scale West Newport Beach fill project as a future stage of the FCBECP.

11 WHEREAS, Congress has, by the enactment of Public Law 874,
12 87th Congress, adopted and authorized a beach erosion control
�3 project, to be accomplished in stages, which extends from Anaheim
14 Bay Harbor to the west jetty of Newport Beach Harbor in Orange
15 County, and
16 WHEREAS, the implementation of said Federal beach erosion
17 project is of direct benefit to the beaches owned and operated by
18 CITY and COUNTY in providing a source of beach sand for
19 replenishment of natural erosion of said beaches, and
20 WHEREAS, the United States Army Corps of Engineers is
21 prepared to undertake Stage 10 of said project at an estimated
22 cost of $9,739,636 to be financed on the following basis:

5 $814,080 cost for Stage 10 is based upon a formula depicting the
6 percentage of the 80,000 linear feet of beach frontage property
7 owned by each public entity which is within the Federal project
8 area. The balance of funds required is identified as a subsidy
9 from Orange County Harbors, Beaches and Parks. The total cost
10 breakdown is as follows:

4 CITY agrees to pay COUNTY on or before September 1, 1995, or

6 hereto, CITY's portion of the cost of Stage 10 of the aforesaid
7 beach erosion control project, said portion being the amount of
8 $189,740.

10 COUNTY agrees to coordinate said project with CITY and other
11 local shoreline owners, and the State of California, to the
12 mutual benefit of all parties concerned.

14 COUNTY shall, on or before September 1, 1995, or immediately
15 after approval of this agreement and similar agreements by all of
16 the aforementioned local shoreline owners and receipt of billing
17 from the State of California, pay the local shoreline owners'
18 portion of the Stage 10 Federal beach erosion control project in
19 the amount of $814,080 to the State of California to facilitate
20 implementation of said Stage 10 project.

22 COUNTY will obtain from the State of California Department
23 of Boating and Waterways, the agency coordinating the Stage 10
04 project with the United States Army Corps of Engineers, an
25 accounting of all expenditures of all funds received for Stage 10
26 of the aforementioned project and shall pursue refund of any
27
funds which are in excess of ultimate project cost of a

1 proportionate basis to COUNTY and shall, in turn, refund to CITY
2 its prorated share of any refunds received within 30 days after
3 receipt thereof by COUNTY in a ratio equal to that stated in the
4 recitals of page 2 of this agreement.

6 To the extent permitted by law, CITY shall indemnify and
7 save harmless COUNTY, its officers, agents, and employees from
8 and against all claims, demands, loss or liability of any kind or
9 nature which CITY, its officers, agents, and employees may
10 sustain or incur or which may be imposed upon them or any of them
11 for injury to or death of persons, or damage to property as a
12 result of the negligence or wrongful act or omission by COUNTY,
13 its officers, agents, employees, or invitees in carrying out the
14 terms of this agreement or exercising the rights herein granted.
