Approve subject agreement and scope of services for the
Balboa Peninsula Planning Study.
BACKGROUND
At the February 26th City Council meeting staff was directed to return with
• an agreement for consultant services for the Balboa Peninsula Planning
Study recommended to the City Council by the Balboa Peninsula Planning
Advisory Committee (BPPAC). Staff has met with Mr. Tim Collins of the
Committee, and, based upon committee recommendations, has met with
Mr. Jack Camp of the firm Urban Design Camp to finalize a scope of services.
It should be noted that the committee received and reviewed three other
proposals (from The Planning Center, Forma, and Phillips, Brandt, Reddick).
DISCUSSION
Attached is a consultant agreement and scope of services for the Balboa
Peninsula Planning Study. It outlines a three phase scope, including Research
and Data Collection, Planning Workshops, and Concept Alternatives. This
work is to be done for a contract amount of $30,000. The scope of services
also outlines a fourth Implementation phase, which is not proposed for
authorization or funding at this time. Also attached is the October 11, 1995
statement of the revised Balboa Peninsula Planning Policy
Recommendations of the BPPAC.
The Assistant to the City Manager has reviewed the funds available for
Professional and Technical Services in this year's budget, and believes that
. the funds for this program can be made available through delaying or

reducing other programs anticipated for this budget. Therefore, this project •
will be funded through the Professional and Technical Services account of
the City Manager's Office.
RECOMMENDATION
Authorize the City Manager to enter into a Consultant Agreement with the
firm of Urban Design Camp for the Balboa Peninsula Planning Study.

Thank you for providing Urban Design Camp an opportunity to work with the the City and the
Planning Advisory Committee in the formulation of the planning objectives and concepts.
• The City is in need of not only a vision and development concepts for the entire peninsula but in
need of short term objectives and a critique of the development activities of each district. The level of
detailed studies for the Central Balboa area can serve as a model for the remaining districts of the
peninsula, Although this study will not be able to go into as much detail as the Central Balboa studies,
the same approach and methodologies will be employed.
At the conclusion of the study the City will have an idea of what type of projects and design could
make economic, functional and aesthetic sense, on both a short and long term basis.

Advisory Committee on this project.

PROJECT APPROACH
Balboa Peninsula
Planning Study
Urban Design Camp has been invited to work with City staff and the Planning Advisory
Committee to develop an understanding and appreciation for what can be done to enhance
the Balboa Peninsula.
Our approach will be to work closely with City staff and representatives of the Balboa
Peninsula Planning Advisory Committee to develop both short term and long term
recommendations.
The project will start with the typical data collection of all previous reports and studies. The
next task will take a more unique approach to information gathering. With the authorization
of the City Council, we propose to conduct a series of planning workshops with
representatives from the four planning districts which comprise the Balboa Peninsula (Lido -
Civic Center, McFadden Square, Cannery Village and Central Balboa). Concurrently the .
Consultant Team will conduct a site analysis to discover planning opportunities and constraints
unique to each District.
The study will review not only the City's past studies and plans but also review and compare
the existing design standards and zoning regulations. The intent is to discover what it will take
to bring about change in the Peninsula's various Districts. We need to review in detail the
regulations for signing, parking, landscaping, floor area ratios, setbacks, etc, We need to find
out what past recommendations have not been implemented. This question needs to be
addressed before we create yet another plan which for whatever reason is not implementable.
Once these questions are answered then the graphic ideas and recommendations can be
prepared and new regulations proposed.
This Peninsula wide planning effort is a great opportunity to discover the unique components
of each District and create a vision which reinforces the positive features and mitigates the
negative aspects. This vision once approved can be implemented with new design standards
and zoning regulations unique to each District. Unique components of the public
improvements should also be explored, including street widths, sidewalk size, parkway and
median treatments. Public Improvement projects can then be designed to establish District
themes which are reinforced with new private development.

These conceptual development plans with alternatives will be presented to the City staff and
other committes and interested individuals. A summary report will include a complete
analysis of issues affecting the various Districts and the alternative concepts prepared for each
District; with both short term and longterm recommendations identified. The report will also
include suggested catalyst projects and their related impacts from the City's other commercial
areas such as Mariner's Mile, Newport Center and Corona del Mar.
We feel these changes to our proposal are responsive to the Peninsula's needs and will
provide the City and the Planning Advisory Committee with a clear understanding of their role
as overall coordinators. This study is intended to be a professional critique of all planning
efforts conducted to date and conclude with clear direction for guiding and establishing future
commercial development projects.

SCOPE Of SERVICES
The following Scope of Services outlines the purpose, methodology, and products involved in
several major task areas, as we understand them at this time.
PHASE 1 RESEARCH / DATA COLLECTION / ANALYSIS
Task 1.1 Project Coordination Meeting with Balboa Peninsula Planning Advisory
Committee
Objective: To finalize the scope of work and study schedule. To establish District
boundaries. Also define residential and commercial boundaries.
Activity: Attend committee meeting to outline the objectives and establish a final scope
of work and schedule. Identify individuals to be recommended to the City
Council in each selected District of the Peninsuia as project advisors.
Product: Memorandum of meeting with final outline of the consultants' scope of work.
Time Frame: Week one, 4 hours, team members two.
Task 1.2 Research
Objective: To gather all the information available in order to identify issues, opportunities
and constraints.
Activity: Identify policies and goals of the City's General Plan and Zoning Ordinance as
they relate to the study. Review existing documentation such as but not
limited to (Regional Urban Design Assistance Team studies, marketing, traffic
circulation studies, financial reports, etc.).
Product: Memorandum summarizing findings.
Time Frame: Week .two, 8 hours, team members one.
Task 1.3 Data Collection
Activity: Conduct site reconnaissance and take photographs on -site and off -site for
reference and presentations. Prepare a preliminary site evaluation including a
visual resource analysis of site.

Activity: Inventory and analyze information reviewed in Task 1.2 and address findings.

Product: Memorandum summarizing findings with report and maps.
Time Frame: Week four, 8 hours, team members two.
PHASE 2 PLANNING WORKSHOPS
Task 2.1 District Workshops
Objective: To work with small District groups of concerned and informed community
leaders and stakeholders to determine community issues and develop possible
strategies.
Activity: Conduct creative planning sessions to explore options and to brainstorm
creative concepts for each District. Meet with District representatives to
identify issues, objectives, and opportunities. Four meetings total - one for
each District. The workshop participants will be recommended by the Balboa
Peninsula Planning Advisory Committee and approved by the City Council.
Product: Report summarizing each District meeting
Time Frame: Week four - eight, 30 hours, team members two.
PHASE3 CONCEPT ALTERNATIVES
Task 3.1 Develop Conceptual Plan Alternatives
Objective: Consultant Tearn will identify alternative development programs based on the
information gathered.
Activity: Preparation of one conceptual development plan with sketch alternatives for
each District and an overall Peninsula concept plan based on the

opportunities and constraints, identified in Task 1.3, researched in Task 1.2
and recognized in the planning workshops of Task 2.1.
Test the viability of the various options with respect to implementation
feasibility by analyzing the concepts with respect to marketability, financial
feasibility, access, traffic, neighborhood compatibility, etc.
Product: One conceptual plan per District and one overall peninsula concept plan;
with support materials and exhibits.
Time Frame: Week eight -twelve, 32 hours, team members two.
Task 3.2 Conceptual Plan Presentation
Objective: To review conceptual plans and alternatives for each District and the overall
Peninsula plan with City staff and the Planning Advisory Committee.
Activity: Conduct a meeting with the Balboa Peninsula Planning Advisory Committee,
City officials, staff and interested parties to present the District Plan •
Alternatives.
Product: Memorandum summarizing meeting.
Time Frame: Week Thirteen, 12 hours, team members two.
Task 3.3 Summary Report
Objective: To identify and document the issues, opportunities and objectives for the four
Districts of the Balboa Peninsula.
Activity: To recommend short and long term actions for improvements to each District
of the Balboa Peninsula. Identify potential projects by District where
warranted. Propose changes to the City's existing regulations (zoning codes
and development standards) in order to facilitate the identified
recommendations.
Product: Written summary with final conceptual plan and graphic presentation
materials.
Time Frame: Week Fifteen, 20 hours, team members two.

PHASE 4 PLAN IMPLEMENTATION
Task 4.1 Prepare Final Documentation with Master Plan
Objective: To make specific recommendations for the Balboa Penninsula which can
make positive changes for the betterment of the entire City.
Activity: Prepare a final documentation along with a master plan identifying
conclusions and recommendations for implementation strategy.
Product: Final report with final 'Balboa Peninsula Concept Development Plan ".

COST •
Urban Design Camp proposes the Scope of Services be provided on a time and materials
basis with the fees not to exceed the following figures unless authorized by the Client.
Reimbursable expenses are additional and shall be billed at 1.1 times the cost to Urban
Design Camp. If requested and authorized by Client, additional services shall be on a
contract by contract basis.
This is an estimated breakdown of the costs:

PLANNING POLICY RECOMMENDATIONS

DESIGNATE BALBOA PENINSULA AS A SPECIAL PLANNING DISTRICT.
DEVELOP A PLAN FOR COMMERCIAL PLANNING AND RESIDENTIAL
POLICY ELEMENTS THAT MEETS BOTH TRANSITIONAL AND LONG-
TERM OBJECTIVES.
POLICY CONSIDERATIONS NECESSARY TO ESTABLISH POSITIVE
CHANGES.
1. Balboa Peninsula - Sense of Place: Provide specific plans that will
create a mission and sense of place to differentiate unique roles
of the four principal commercial areas:
• Lido - Civic Center
• McFadden Square
• Cannery Village
• Central Balboa
2. Mission Statement: Adhere to mission statement for a quality
community which would include:
• Enhance and expand residential element.
• Consolidate and redevelop concentrated quality commercial
elements.
• Enhance landscape and streetscape for residential and
commercial elements.

• Consider Redevelopment Agency and comprehensive
Redevelopment Area plans.
• Revise planning and zoning ordinances to provide incentives
for both transitional and long term plan objectives.

Parking Management Plan that:

businesses and which provide little or no economic benefit
to City.

• Prohibits credit for remote parking facilities in entitlement
process without appropriate mitigation (i.e., provision for

visiting yacht facilities to provide access by bay and bring
tourists to area by water.

stated objectives.

and establish a maintenance ordinance to address deferred and

10. New Sign Ordinance: Establish a comprehensive sign ordinance
for the Peninsula Villages.
11. Traffic Circulation: Develop a new traffic circulation plan which
recognizes:
• The necessity for a new circulation plan at McFadden
Square.

• Peninsula capacity limitations and residents' necessity for
reasonable ingress, egress and compatible commercial - retail
elements.
12. O000rtunities: Maximize opportunities and existing economic
strengths. Key examples:
• The Bay as an amenity.
• Marine sales and service industry.
• Visiting yachting and regatta participants.
• 15th Street Marina, hospitality, lodging and yachting center
potential.
13. Transfer Traffic and Parking Impacts: Transfer high traffic and
parking impact uses off Peninsula.
14. Community Issues Management: Institute a community issues
management strategy to clearly understand the community issues
and develop support for key elements of the plan. Prioritize the
key catalysts that stand for quality change. Coordinate planning
program with Economic Development Program.
15, Transitional Interim Measures: City Council must be willing to
invoke urgent transitional ordinances and zoning controls designed
to:
• Prevent addition of commercial uses that are inconsistent
with stated objectives.
• Control expansion or transfer of existing undesirable uses.
• Proactively seek desirable uses for strategic sites.
• Control existing enforcement costs.
• Demonstrate to community at large that City is committed
to change.

1996, by and between CITY OF NEWPORT BEACH a Municipal
Corporation (hereinafter referred to as "City "), and Urban Design
Camp, Jack Camp, President, 1401 Quail Street, Suite 100, Newport
Beach, California, 92660 (hereinafter referred to as "Consultant "),
is made with reference to the following:
RECITALS
A. City is a Municipal Corporation duly organized and
validly existing under the laws of the State of California
with the power to carry on its business as it is now being
conducted under the statutes of the State of California and
the Charter of the City.
B. The principal member of Consultant is Jack Camp.
C. City desires to engage Consultant to perform
services described in attached scope of work to assist City
and the Balboa Peninsula Planning Advisory Committee in the
formulation of planning objectives and concept plans.
NOW, THEREFORE, it is mutually agreed by and between the
undersigned parties as follows:
1. TERM
The Term of this Agreement shall commence on the day written
above and shall terminate upon completion of the scope of work set
forth in the May 15, 1996 Project Outline attached hereto as
Exhibit "A.
2. SERVICES TO BE PERFORMED
Consultant shall perform the tasks set forth in Exhibit "A"

3. COMPENSATION TO CONSULTANT
Consultant shall be compensated at the rates set forth in
Exhibit A. Billings for services performed pursuant to this
Agreement shall not exceed $30,000.00, including expenses. All
work shall be done by Consultant and shall not be subcontracted to
others without the Ctiy's written authorization. Total costs,
including any authorized sub - consultants shall not exceed $30,000
without an amendment to this Agreement.
4. INDEPENDENT PARTIES
City retains Consultant on an independent contractor basis and
Consultant is not an employee of the City. The manner and means of
conducting the work are under the control of Consultant, except to
the extent they are limited by statute, rule or regulation and the
express terms of this Agreement.
5. COOPERATION
Consultant agrees to work closely and cooperate fully with
City's designated Project Administrator, and any other agencies
which may have jurisdiction or interest in the work to be
performed. City agrees to cooperate with the Consultant on the
project.
6. TIME OF PERFORMANCE
The task to be performed by Consultant under and pursuant to
this Agreement shall be completed within the time periods provided
in Exhibit "A."
7. CITY POLICY
Consultant will discuss and review all matters relating to
policy and project direction with the Project Administrator, who
shall be the City's Planning Director in advance of all critical
decision points in order to ensure that the project proceeds in a
manner consistent with City goals and policies.
8. To the extent any provisions of this Agreement conflict
with Exhibit A, the provisions of this Agreement shall prevail.

(Six weeks)
• Conduct the first district planning workshop. The consultant will
briefly explain the workshop process to each district group
individually. Each district group will then proceed on their own
to identify and document both positive and negative community
issues along with improvement recommendations on a Peninsula
wide and specific district basis. The issues identified in this
workshop will be the basis for the second workshop. Anticipated
four hour meeting minimum. Meeting to be scheduled by each
district group individually.
Meeting 2 - May 16 - 29 - Date to be set
Conduct the second district planning workshop with each district
group along with the consultant and City staff to review and clarify
all the community issues developed in the First planning workshop.
The intent is to develop a district group consensus of each issue
and possible improvement recommendations. Anticipated six
hour meeting minimum. Meeting to be scheduled by each district
group individually.
Meeting 3 - May 30 - June 13 - Date to be set
• Consultant to summarize the findings from the workshops.
June 30 - Aug. 5 Phase Three - Concept Alternatives
(Five weeks)
• Analyze and compare the reports developed for the individual
districts with the research on opportunities and constraints.
• Prepare a preliminary plan with a series of recommendations and
strategies to accommodate the mutually agreed upon objectives
and solutions.
• Second round of group district meetings. T ^.is will allow each
district to separately explore options and Erainstorm creative
concepts unique to each district, developed by the consultant.
Meeting 4 - July 15 - July 22 - Date to be set
• Prepare summary reports for each district that identify the issues,
define the objectives and recommend solutions and opportunities.
• Format the issues and areas of potential comlicts within the
districts and the Peninsula. Develop strategies for resolving these
conflicts.
• Prepare conceptual strategy for the implernentation of
specific tasks and projects in each district.
• General meeting of review for the conceptual plan with all district
participants.

City's designated Project Administrator, and any other agencies
which may have jurisdiction or interest in the work to be
performed. City agrees to cooperate with the Consultant on the
project.
6. TIME OF PERFORMANCE
The task to be performed by Consultant under and pursuant to
this Agreement shall be completed within the time periods provided
in Exhibit "A."
7. CITY POLICY
Consultant will discuss and review all matters relating to
policy and project direction with the Project Administrator, who
shall be the City's Acting Planning Director in advance of all
critical decision points in order to ensure that the project
proceeds in a manner consistent with City goals and policies.
8. To the extent any provisions of this Agreement conflict
with Exhibit A, the provisions of this Agreement shall prevail.
IN WITNESS WHEREOF, the parties have caused this Agreement to
