The following constitutes an Agreement between the CITY OF NEWPORT
BEACH, hereinafter "City", and JOE CLEARY, a skilled self employed film production
coordinator, hereinafter "Contractor", to provide the coordination of film production
within City limits.
The City and the Contractor agree that the Contractor is to act as a film liaison
officer and designee of the City Manager to assist in the administration, implementation
and coordination of film production within the City of Newport Beach. Contractor's
efforts will include, but are not limited to, advertising and marketing the City of Newport
Beach as a desirable location for film production, processing permit applications,
coordinating film production with other involved City departments, providing onsite
services by interacting, overseeing and monitoring film production within City limits and
the collection of all appropriate and required fees and costs. Contractor will work
directly with the Revenue Manager.
The City and the Contractor are entering into this Agreement in reliance on the
Contractor acting as an independent contractor with sole legal responsibility to pay all
federal and state income and social security taxes, to provide for his/her own workers
compensation and unemployment insurance, if necessary, and, to provide liability
insurance, if any, in amounts as required by the City.
The Contractor agrees to carry out this Agreement in the manner which
maintains the highest degree of production safety.
The City may, at its sole discretion and without cause, terminate this Agreement
at any time by giving thirty (30) days prior written notice to the Contractor.
The Contractor certifies that he/she is qualified to perform the services described
in this Agreement.
The undersigned has read, understands and agrees to be bound by all the terms
as set forth herein.
