HomeMy WebLinkAboutC-3952 - Professional Services for the Preparation of a Draft EIR Associated with a Use Permit Application Proposed by Hoag Healthcare Center at 500 Superior AvenueAMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT WITH KEETON KREITZER CONSULTING FOR ENVIRONMENTAL CONSULTING SERVICES FOR THE HOAG HEALTH CENTER USE PERMIT THIS AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT, is entered into as of this 18th day of June 2007, by and between the CITY OF NEWPORT BEACH, a Municipal Corporation ( "CITY"), and Keeton Kreitzer Consulting (KKC), a sole proprietorship, whose address is 17291 Irvine Boulevard, Suite 305, Tustin, California, 92780 ( ".CONSULTANT "), and is made with reference to the following: RECITALS: A. On the 20`h day of February 2007, CITY and CONSULTANT entered into a Professional Services Agreement,. hereinafter referred to as "AGREEMENT ", for environmental consulting services for the Hoag Healthcare Center Use Permit, hereinafter referred to as "PROJECT ". B. CITY desires to enter into this AMENDMENT NO. 1 to reflect additional services not included in the AGREEMENT. C. CITY desires to compensate CONSULTANT for additional professional services needed for PROJECT. D. CITY and CONSULTANT mutually desire to amend AGREEMENT, hereinafter referred to as "AMENDMENT NO. 1, as provided here below. NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as follows: In addition to the services to be provided pursuant to thee AGREEMENT, CONSULTANT shall diligently perform all the services described in AMENDMENT NO. 1 including, but not limited to, all work set forth in the Scope of Services attached hereto as Exhibit A and incorporated herein by reference. The City may elect to delete certain tasks of the Scope of Services at its sole discretion. 2. City shall pay Consultant for the services on a time and expense not -to- exceed basis in accordance with the provisions.of this Section and the Schedule of Billing Rates attached to the AGREEMENT. Consultant's compensation for all work performed in accordance with this AMENDMENT NO. 1, including all reimbursable items and subconsultant fees, shall not exceed Seven Thousand Seven Hundred Dollars and no /100 ($7,700) without prior written authorization from City. 0 3. Based on our conversations regarding the project, the scope of work for the Hoag Healthcare Center Draft EIR will be expanded to include an additional analysis, which is intended to evaluate potential public health and safety impacts and related issues identified. by the California Department of Toxic Substances Control (DTSC) in the comment letter dated April 19, 2007 submitted to the City of Newport Beach in response to the Notice of Preparation (NOP) issued for the proposed project. As a result, KKC will add Section 4.6 (Public Health and Safety) to Chapter 4 (Environmental Analysis) of the Draft EIR in order to evaluate the issued identified by DTSC. The esti mated. budget to complete this additional analysis would not exceed $2,500.00, which would result in a revised budget for Task 4 of $21,700.00. In addition; the scope and budget of the traffic analysis must also be expanded to address comments received from the City of Costa Mesa and Caltrans during the NOP comment period. Based on the NOP comments received from those agencies, the estimated budget for the traffic analysis must also be augmented by $5,200.00, resulting in a total budget for the traffic analysis of $43,000.00. RECOMMENDATION Receive and File. DISCUSSION This report is intended to provide notice to the City Council of a contract for professional services between the City of Newport Beach and Keeton Kreitzer Consulting for the preparation of a Draft Environmental Impact Report (EIR) associated with a Use Permit application for the proposed Hoag Healthcare Center project located at 500 Superior Avenue. The original contract amount was $98,520, which was paid for by the project applicant (Newport Beach Healthcare Center, LLC). However, the scope of work has been expanded to include additional analysis required to address various preliminary comments received on the project. The estimated budget to complete this additional analysis is $7,700, resulting in a total contract amount of $106,220.00. The applicant has been notified of the amended contract amount and has agreed to fund the amount. • • July 10, 2007 Page 2 The project involves amending Use Permit No. 2006 -010 to allow the full conversion of the existing site, currently entitled for a mix of general office, medical office and research & development use, solely to medical office use. The request also includes the construction of an additional 20,586 square feet of floor area, for a total of 350,000 square feet of medical gross floor area. Additionally, approval of a Traffic Study is being requested pursuant to the City of Newport Beach Traffic Phasing Ordinance (TPO). The Draft EIR is currently under preparation for the project and will analyze any potential significant effects resulting from project implementation and will identify any mitigation measures and reasonable alternatives to avoid such significant effects. The Draft EIR is anticipated to be circulated for public review in September and a Planning Commission hearing is anticipated to be held in November to review and consider the final EIR document, prior to project approval.
