Andersen City Clerk WEA:lr attach. 3300 Newport Boulevard, Newport Beach ORIGINAL 0 AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR CONSTRUCTION OF TEMPORARY BYPASS WATER MAINS AT CAMPUS DRIVE AND AT JAMBOREE ROAD AND THE CONSTRUCTION OF WATER MAIN CROSSINGS THROUGH THE CAMPUS DRIVE BRIDGE AND THE JAMBOREE ROAD BRIDGE IN CONJUNCTION WITH THE STATE ROUTE 73 EXTENSION THIS AGREEMENT is made and entered into this .._ day of �.i 1983, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY ", and the firm of ASL CONSULTING CIVIL ENGINEERS, hereinafter referred to as "ENGINEER ". W I T N E S S E T H WHEREAS, CITY intends to construct 16 -inch water bypass lines in Campus Drive and Jamboree Road and 18 -inch water lines in the Campus Drive Bridge and the Jamboree Road Bridge, hereinafter referred to as "PROJECT "; and WHEREAS, CITY intends construction of PROJECT to be included in the CALTRANS contract to construct new bridges in conjunction with the Corona del Mar Freeway extension (Route 73); and WHEREAS, ENGINEER has submitted a proposal to CITY (dated February 18, 1983) to perform engineering services in connection with the design of PROJECT; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be performed by ENGINEER ENGINEER hereby agrees to perform the following services: A. Prepare detailed plans for the construction of temporary 16 -inch bypass water mains at Campus Drive and Bristol Street 1 of 6 • • and at Jamboree Road and Bristol Street, as well as detailed plans for the construction of permanent 18 -inch water mains through the bridges located at Campus Drive and Bristol Street and at Jamboree Road at Bristol Street. Plans will be prepared on standard size CALTRANS sheets for inclusion in the CALTRANS Route 73 plans. B. Prepare necessary special provisions and bid proposals to be included in the CALTRANS bid package. C. Prepare a final engineer's estimate based on the quantities used in the bid proposal. D. Prepare a final engineer's estimate for construction of a 12 -inch water main through the Campus Drive Bridge in lieu of the 18- inch - diameter water main. E. Prepare a final engineer's estimate for construction of a 14 -inch water main through the Jamboree Road Bridge in lieu of the 18 -inch- diameter water main. F. Provide coordination as required with Metropolitan Water District. G. Provide coordination with Mesa Consolidated Water District. N. Provide coordination as required with CALTRANS. I. Be available for attendance at meetings. J. Complete an investigation of underground utilities affecting PROJECT. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following in- formation and materials: A. Available records pertaining to existing street improvements and CITY -owned utilities. B. CITY crews to pothole underground facilities that might inter- fere with the construction. C. Any other additional available information which the parties hereto agree may be beneficial to the design of the PROJECT IV. Time of Completion Final design, including all plans and other documents for the PROJECT shall be submitted to the Public Works Director of the 2of6 0 Ll CITY for final review by March 23, 1983. The preliminary investigation and the design of the temporary bypasses shall be completed prior to March 15, 1983. V. Ownership of PROJECT Documents Original drawings, reports, notes, maps, and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. VI. Engineer in Charge Roy N. Lamar, REC No. 15920, shall be the Engineer in Charge of PROJECT design. VII. Right of Termination CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER`s business office at 1201 East Warner Avenue, Santa Ana, California 92262. In the event of termination due to errors, omissions, or negligence of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VIII. Fee Schedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Sixteen Thousand Five Hundred Dollars ($16,500) except as otherwise provided herein. A. Reproduction performed in- house: Xerox Copies $0.20 /each Gestetner $0.20 /each Blueprint $0.25/sq. ft. Vehicle mileage, between engineer's office and project site and/ or CITY offices, will be billed at $0.25 per mile. B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety -five percent (95 %) of the maximum fee; 2. Balance of the total amount earned to be paid upon comple- tion of work specified in Section II (Services to be per- formed by ENGINEER). 4of6 IX. Additional Work Should ENGINEER complete any additional work not outlined in this Agreement, but authorized by CITY, the extra work shall be per- formed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VIII (Fee Schedule and Payment) above. X. PROJECT Scooe Revisions The scope of the PROJECT may be changed and the maximum fee re- vised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed One Thousand Six Hundred Dollars ($1,600). If the revisions to the scope of the PROJECT would result in an increase in the maximum fee ex- ceeding One Thousand Six Hundred Dollars ($1,600), an amendment providing for such revisions shall be processed and executed by the parties hereto. XI. Insurance A. Professional Liability Insurance ENGINEER shall provide Professional Liability (errors and omissions) Insurance in the minimum amount of $250,000. B. General Liabilitv Insurance ENGINEER shall maintain in full force and effect during the term of this Agreement the following insurance in the minimum amounts specified below: Bodily Injury or Death. . . . . $ 300,000 each person $1,000,000 each occurrenct Property and Product Damage $ 500,000 each occurrence $1,000,000 aggregate The policy or policies shall contain the following endorse- ment: "The City of Newport Beach and the State of California, their officers, employees and agents are hereby declared to be additional insureds under the terms of this policy, as to activities of both the City and the State in re- spect to PROJECT, and this policy shall not be cancelled without Thirty (30) days' prior written notice to the City and the State." .m E r� u IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date first above written. (3L) February 28, 1983 CITY COUNCIL AGENDA ITEM NO. F-3(c) SUBJECT: CORONA-OEL.MAR FREEWAY EXTENSION WATER MAIN RELOCATION RECOMMENDATION: Authorize the Mayor and the City Clerk to execute a local agency consultant agreement with ASL Consulting Engineers for the prepara- tion of plans, specifications and _cost estimates for the relocation of water mains at Jamboree Road and at Campus Drive in conjunction with the extension of the Corona del Mar Freeway.. DISCUSSION: The California Department of Transportation is extending the Corona del Mar Freeway from Redhill to MacArthur Boulevard, with bridges to be con- structed at Campus Street, Birch Street and Jamboree Road. The City presently has water facilities.crossing the proposed Corona del Mar Freeway at Campus Drive and Jamboree Road. The relocation of these facilities is to be completed as a part of the Corona del Mar Freeway contract. The design, plans, specifications, and cost estimates must be completed and submitted to the California Department of Transportation by April 1, 1983. The Public Works Department has received several proposals from engineering consultants for the proposed work, and upon reviewing their quali- fications, has decided to choose ASL Consulting Engineers as the most qualified consultant for the project. A local agency /consultant agreement has been executed by the Civil Engineering firm, ASL Consulting Engineers, to provide design, plans, specifi- cations, and cost estimates for by -pass water mains and permanent 18 -inch water mains to be constructed through the bridges at Campus Drive and at Jamboree Road. The lump sum fee for the engineering work is $16,000. The major parts of the scope of service provided in the agreement are as outlined below: A. Campus Drive at Bristol Street 1. Provide plans, specifications, and cost estimate for tem- porary by -pass 16 -inch water main and permanent 18 -inch water main through bridge. 2. Provide cost estimate for construction of 12 -inch water main through bridge in lieu of 18 -inch water main. 0 0 February 28, 1983 Subject: Corona del Mar Freeway Extension Water Main Relocations Page 2 B. Jamboree Road at Bristol Street 1. Provide plans, specifications, and cost estimate for tem- porary by -pass 16 -inch water main and permanent 18 -inch water main through bridge. 2. Provide cost estimate for construction of 14 -inch water main through bridge in lieu of 18 -inch water main. The agreement will be funded from the water fund and reimbursed by the State after a cooperative agreement has been executed. The consultant is prepared to commence work immediately upon the City's written notification to proceed. All plans, specifications, and cost estimates are to be completed by April 1,1983. This project is being performed cooperatively with the Mesa Consoli- dated Water District, as the District also has water facilities at the Campus - Bristol location.
