Design of the Reservoir was authorized by the City Council on April 26, 1971. The construction was accepted by the Council on January 28, 1974. A picture and location map of the Reservoir site is attached. Eighty -eight percent of the construction cost ($259,964.78) was advanced by the developer, John D. Lusk and Son. The balance ($35,449.75) was advanced from the City's Water Fund. All funds advanced are reimbursed from the Water Acreage Fee assessed by the City on undeveloped land. The contract for the construction of the Spyglass Hill Reservoir has been completed to the satisfaction of the Public Works Department. The bid price was $294,100.00 Amount of unit price items constructed 294,100.00 Amount of change orders 1,314.53 Total contract cost 295,414.53 Amount budgeted in the Water Fund 304,100.00 (Account No. 50- 9297 -087) Two change orders were issued. The first, in the amount of $335.48, provided for a change in the reinforcing steel to clear the waterstop in the reservoir footing. The second, in the amount of $979.05, provided for a change in the type of bearing pads between the reservoir wall and footing. The funds for construction of the reservoir were advanced by both the City Water Fund and the developer of Upper Harbor View Hills -- Sector IV (John D. Lusk and Son). All funds advanced are eligible for reinbursement from the water acreage changes deposited in the Water System Development Fund. The construction and reimbursement agreement provided that the developer ad- vance 88% of the cost of the reservoir and that the City advance the balance of 12 %. The design engineering was performed by Shuirman- Simpson of Newport Beach, California. The contractor is E. L. Yeager Construction Company of Riverside, California. The contract date of completion was May 10, 1972. The contractor was delayed 47 days as a result of rain and mud preventing access to the site. i January 28, 1974 Subject: Acceptance of Construction of Spyglass Hill Reservoir (C -1351) Page 2 Upon filling the reservoir, it was found that the leakage exceeded the allow- able limits. The tank was drained, repairs were made, and the tank refilled three times with the leakage reduced each time. The final repairs resulted in a rate of leakage far below the allowable. The contractor diligently pur- sued the repair work. However, it was a very time - consuming process. The reservoir was placed in service on December 10, 1972. Because of the repairs, the landscaping was delayed until the cooler weather, thus requiring a much longer germination time. All work was completed and a final inspection made on January 18, 1973. Since the contractor made every effort to complete the work as soon as possible, the assessment of liquidated damages is not recom- mended. 1. }Joseph . Reject the bid (second low) of the Rhein Corporation due to irregularities in their proposal. 2. Adopt a resolution awarding contract No. 1351 to E. L. Yeager Construction Company, Inc. for $294,100.00 and authorizing the Mayor and the City Clerk to execute the contract. DISCUSSION: Six bids for contract 1351 were received and opened in the office of the City Clerk at 10:00 A.M. on October 10, 1972. Bidder Bid E. L. Putman Henck, a Corp., San Bernardino $324,625.00 The proposal submitted by the Rhein Corporation failed to state the price bid, both in words and numerals, for items No. 1 and 2 and the total. The total bid price was only shown on the title sheet of the contract documents. The low bid is 7% less than the engineer's estimate of $315,000. This contract provides for the construction of a 1.5 million gallon water storage reservoir for water pressure zone IV and V areas of the Spyglass Hill Development. The estimated date of completion is April 30, 1973. The plans were prepared by Shuirman- Simpson, Civil Engineers and Lang and Wood, Landscape Architects. E. L. Yeager Construction Company has not previously done work for the City of Newport Beach; a check of the references supplied indicates that the firm is qualified to perform the work required by this contract. October 24, 1972 Page Two Subject: Spyglass Hill Reservoir, C -1351 It should be pointed out that an environmental statement has not been prepared for this project. This reservoir is an integral part of the Spyglass Hill development, which is well advanced in construction; and the grading for the reservoir has already been completed as a part of the overall grading for the development. It is therefore felt that the reservoir construction taken by itself will not have a significant effect on the environment. An amount of $282,000 was provided in the 1972 -73 budget. A budget amendment of $22,100 has been prepared for Council consideration if the subject contract is awarded. The amount includes an allowance of $10,000 for materials testing and contingencies. An existing cooperative financing and reimbursement agreement with John D. Lusk and Son requires that they advance 88% of the construction cost of the reservoir project. The remainder is to be advanced by the Water Fund. All monies advanced are eligible for reimbursement from water acreage charges deposited in the Water System Development Fund. Approve the plans and specifications for Spyglass Hill Reservoir (Contract 1351). 2. Authorize the City Clerk to advertise for bids for Contract 1351 to be opened at 10:00 A.M. on October 10, 1972. DISCUSSION: // -C? The subject contract will provide for the construction of a buried, prestressed 1.5 million gallon concrete storage reservoir for water pressure zone IV and for landscaping of the reservoir site. The plans and specifica- tions for the reservoir were prepared by Shuirman- Simpson, Civil Engineers. The landscaping plans and specifications were prepared by Lang and Wood, Landscape Architects. The funds for construction of the reservoir will be advanced by both the city Water Fund and the developer of Upper Harbor View Hills - Sector IV (John D. Lusk and Son). All funds advanced would be eligible for reimbursement from the water acreage charges deposited in the Water System Development Fund. The existing construction and reimbursement agreement provides that the developer advance funds for 88% of the cost of the reservoir and that the city advance the balance of 12 %. The engineer's estimate for the contract is $315,500. Included in the current budget are the sums of $33,800 for the total city chare and $248,200 for the developer's share of the cost. The increase over.the previous cost estimate is due primarily to the addition of a drainage system underneath the reservoir at an estimated cost of $12,000, and to the inclusion of additional seismic reinforcement. A budget amendment will be presented for Council consideration when bids have been received and the actual price determined. Sufficient unappro- priated funds are available in the Water Fund to finance the increase in the amount to be advanced by the city. DISCUSSION: On April 26, 1971, the Council authorized design and preparation of Plans and Specifications for the Master Plan Water Supply Facilities required to provide domestic water service to Harbor View Hills, Sector IV. The necessary facilities are being constructed in three separate contracts. The contracts for the Zone IV Transmission Main and the Big Canyon Pumping Stations are now in progress and are scheduled for completion in mid - summer. The engineering plans and specifications for the third contract, Spyglass Hill Reservoir, have been essentially completed by the firm of Shuirman- Simpson, Civil Engineers. Spyglass Hill Reservoir is proposed to be of prestressed concrete construction, fully buried with 3 feet of earth over the top. Burial of the reservoir will ensure compatibility with the residential neighborhood within which it is located, and enable the site to be fully landscaped. The proposed landscaping features include a sandy play area directly over the reservoir, walkways, landscape planting and an irrigation system. The estimated con- struction cost is $27,750. A proposal has been obtained from the firm of Lang and Wood, Landscape Architects and Environmental Planners, for design and preparation of Plans and Speci- fications for landscaping of the reservoir site. Compensation will be based on standard hourly rates with the maximum fee not to exceed $3,954000. The reservoir is to be constructed with funds advanced primarily by the the developer, and also by the City Water Fund. All funds advanced will be reimbursed from water connection charges deposited in the Water System Development Fund. Sufficient funds are available in current appropriations to provide for the professional services. THIS AGREEMENT is made and entered into this ;Z %zC, day of 1972, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "City ", and the Firm of Lang & Wood, Landscape Architects and Environment Planners, hereinafter referred to as "Landscape Architect "; RECITALS 1. City proposes to construct a buried concrete reservoir to serve water pressure Zone IV and to utilize the surface of the reservoir site as a park; 2. Landscape architectural services are necessary to prepare plans and specifications for landscaping the reservoir site; 3. Landscape Architect has submitted a proposal to perform preliminary investigations and design, and to prepare plans and specifications for the proposed landscaping. THE PARTIES HERETO AGREE AS FOLLOWS: 1. GENERAL City engages Landscape Architect to furnish the services hereinafter specified, for the compensation herein stipulated, and Landscape Architect agrees to perform such services upon said terms. 2. DUTIES OF LANDSCAPE ARCHITECT The Landscape Architect shall: (a) Attend such conferences with the City and others as may be requisite to an understanding of the Project; (b) Visit the site in order to be familiar with all -1- governing site and construction conditions; (c) Prepare schematic drawings and budgets with material descriptions delineating the basic design of the Project, especially in collaboration with the City's Consulting Engineer's work in progress. Landscape Architect shall make revisions therein or further schematic drawings as may reasonably be requested by City. (d) After written approval of preliminary drawings by City, prepare working drawings on City's standard plan sheets, complete specifications, proposal forms, and other documents in such detail as may be required, on multilith masters, to obtain competitive bidding on the work, such drawings and specifications being an amplification of the approved preliminary drawings. All drawings and specifications shall be in full compliance with applicable building codes, ordinances, and other lawful regulatory authority. (e) In the event the City's contractor's construction price varies more than ten per cent (10°x) from the construction cost budget, Landscape Architect shall, at City's request, make revisions to such drawings and specifications as may be necessary in order to eliminate the variation. No additional fee will be allowed for making such revisions. In the event the City's contractor's construction price varies ten per cent (10 %) or less from the construction cost budget, Landscape Architect shall, at City's request, eliminate such variation or any portion thereof; provided, however, that Landscape Architect's services shall be considered as additional services. (f) Following the City's approval of the plans and specifications and of the latest estimate of construction cost, review all proposals, bids, alternates, or substitutions submitted to City by the contractor and in turn submitted by City -2- 0 0 to Landscape Architect, followed by written recommendations with respect to acceptance or rejection thereof. (g) Make an initial visit to the site as soon as construction has been authorized for the purpose of reviewing the plans and specifications with the Contractor and City. (h) Make periodic visits to the site to check the progress and quality of the landscaping work and to determine in general if the work is proceeding in accordance with the plans and specifications as prepared by Landscape Architect. On the basis of Landscape Architect's observations while at the site, Landscape Architect will keep City informed of the progress of the work, will endeavor to guard City against defects and deficiencies in the work, and may condemn work as failing to conform to the plans and specifications. (i) Make two specific site visits: (1) Operational check of the irrigation system, and acceptance for sixty -day maintenance. (2) Final inspection for 100% acceptance. (j) Based on such observations and the City's Contractor's applications for payment, Landscape Architect will issue approvals for payment in such amounts. These approvals will constitute a representation to City, based on such observations and that data comprising the Application for Payment, that the work has progressed to the point indicated. (k) Check all shop drawings for conformance with the design concept of the Project. (1) Furnish all interpretations, details, or incidental services necessary for the proper execution of the work, including the selection of specimen plant materials (42" box and larger). (m) Issue to the City's Contractor any change orders which substantially alter the function, quality, appearance or cost of the finished work. Such change orders shall have the prior written approval of City before they become effective, and copies -3- • thereof shall be delivered to City at the time of issuance. (n) With the Contractpr, prepare a set of marked blueprints which shall show all basic changes from the original contract requirements and the locations of irrigation lines, valves and electrical routing. This set of marked blueprints or a copy thereof shall be filed with the City. (o) Engage the special services of such irrigation and electrical consultants and soil laboratory services as may be deemed necessary for the Project. 3. DUTIES OF CITY following; City agrees to provide Landscape Architect the (a) Standard plan sheets for preparation of plans; (b) Multilith masters for preparation of special provisions. (c) Copies of available preliminary plans and details relating to reservoir site. (d) Consultation as needed to accomplish the work. 4. COMPLETION OF SERVICES Landscape Architect agrees to complete those services as set forth in Paragraph 2(d) hereinabove on or before May 10, 1972. Landscape Architect further agrees to complete the remaining duties as required, based on the City's Contractor's construction progress. 5. PAYMENT BY CITY City agrees to pay Landscape Architect for all services specified in this agreement, on the basis of the rate schedule set forth below, but not to exceed the total sum of Three Thousand Nine Hundred Fifty - Fourand no /100 ($3,954.00): Principals $25.00 per hour Staff $12.50 per hour Assistant Staff $10.00 per hour Clerical $ 7.50 per hour Travel expenses in excess of 12 trips to job site: $ 0.15 per mile The amount to be paid the Landscape Architect shall be payable as follows: -4- 0 0 (a) Monthly partial payments, each payment to be the am4pnt earned as determined the foregoing fee schedule; said amounts shall be payable upon presentation of statements for work performed to date; the :sum of the total monthly partial payments shall not exceed ninety per cent (90 %) of the above maximum fee. (b) Balance of the total amount to be paid upon acceptance of the construction work by the City Council, but in no event later than twelve (12) months after signing of the plans by the Public Works Director. In addition, City shall reimburse Landscape Architect for actual cost of reproduction of copies of said plans and specifications and related documents and other related cost authorized by Public Works Director and advanced by Landscape Architect. 6. TERMINATION This agreement may be terminated at any time by City upon three (3) days' written notice to Landscape Architect. Notice shall be deemed served upon deposit in the United States mail, postage prepaid, addressed to Landscape Architect's business office. In the event of termination due to the fault of Landscape Architect, City shall be relieved of any obligation to compensate Landscape Architect. If this agreement is terminated for any reason other than the fault of Landscape Architect, City agrees to compensate Landscape Architect for the actual services performed up to the effective date of the notice of termination on the basis of the fee schedule contained in this agreement. 7. AMENDMENT The scope of the services to be furnished by Landscape Architect may be changed and the maximum fee amended upon prior written mutual consent of Landscape Architect and the Public Works Director. -5- 0 • 8. ASSIGNMENT This agreement or any portion thereof shall not be assigned without the written consent of.City. 9. HOLD HARMLESS Landscape Architect shall assume the defense of and indemnify and save harmless the City, and its officers and employees, from all claims,�`'Ioss, damage, injury and liability directly or indirectly arising.from any errors, omissions or negligence in Landscape Architectl:p performance of this agreement, or from the landscaping +nofiNU1RNservices herein provided.
