HomeMy WebLinkAbout868 - Licensing & Vaccination of DogsORDINANCE NO. 868 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 4110 AND 4112 AND ADDING SECTION 4110.5 TO THE NEWPORT BEACH MUNICI- PAL CODE RELATING TO LICENSING AND VACCINA- TION OF DOGS. The City Council of the City of Newport Beach does ordain as follows: SECTION 1: Section 4110 of the Newport Beach Municipal Code is amended to read: 'SECTION 4110. Dogs. Li- censing. Every person who harbors a dog, of whatever sex, over the age of three (3) months, within the City, shall pay to the City a bien- nial license tax of Five Dol. lars ($5.00) for each dog. The City shall deliver to the per. son making such payment a license which shall describe the dog, together with a seal or tag having thereon the number of such license and figures indicatink the years for which the license has been paid, and shall keep a record of the name of the owner and a description of the dog licensed. Duplicates shall be issued for lost tags for fifty cents (50c) upon showing proof of such loss. Such person shall attach the tag to a collar or harness and shall cause such collar or harness with the attached tag to be kept on such dog at all times. The license tax herein mentioned shall be due and payable on the first day of January, 1959, and the first day of January of each sec. ond year thereafter. Where a dog is acquired after the first day of January in the second year of the license term, a license tax of Two Dollars Fifty Cents ($2.50) shall be due on the date of acquisi. ' Aion of such dog for the bal. ance of the term. In the event the license -tax is delinquent on April -first of the year in which it is due, a penalty of One Dol. lar ($1.00) shall be collected in addition to the license tax." SECTION 2: Section 4110.5 is added to the Newport Beach Municipal Code to read: "SECTION 4110.5 D o g s. Vaccination V a c c i n a t i on shall mean the inoculation of a dog with a vaccine ap- proved by the City Health Officer of the City of New- port Beach. 1. Every person who owns or harbors any dog shall have such dog vaccinated against rabies on or prior to the date such dog reaches six (6) months of age and thereafter at intervals of not greater than two (2) years. 2. Every duly licensed veterinary after vaccinating any dog shall sign a certif- icate in triplicate contain- ing the following informa- tion: a. The name and address of the owner or harborer of the vaccinated dog. b. The kind and serial number of vaccine used and the date of vaccina- tion. c. The year, number of dog license tag, and name of city where issued, or, in the event that the dog has not previously been li- censed, a notation to that effect. d. The breed, age, color and sex of the vaccinated dog. Such veterinarian shall immediately present the original certificate to the owner or harborer of the dog, shall deliver the dup- licate copy of the certifi- cate to the City Humane Officer, and shall retain the triplicate copy thereof. 3. A dog may be licensed prior to vaccination, provid- ed, however, that such dog shall be vaccinated as here- in provided. If the dog be not vaccinated as herein provided for, the license theretofore issued shall im. mediately become null and void, unless such dog shall have been vaccinated by vaccine appproved by the PAGE I — ORD. 868 Ll City Health Officer by a duly licensed veterinarian within one year prior to the date of the issuance of the license and the owner or harborer of such dog dis- plays upon demand a certif- icate showing the fact of such vaccination by a li- censed veterinarian, signed by him, and containing the information set forth in subsection 2 hereof. 4. The City Humane Of- ficer shall retain and file the copy of the certificate as a part of the official reg- istry of all dogs licensed. 5. No person who owns or harbors any dog shall fail or refuse to exhibit the cer- tificate required by this sec- tion upon demand of any person charged with its en- forcement. 6. Every owner and har- borer of a dog shall attach the official rabies tag to the collar or harness of a vaccinated dog and shall cause such collar or har- ness to be worn by the dog at all times. The original certificate of vaccination shall be retained by the owner or harborer of the vaccinated dog for inspec- tion by any person charged with the enforcement of this section. 7. No unauthorized person shall remove from any dog any collar or harness or other device to which is at- tached a license tag for the current year or rabies tag or remove such license or rabies tags from any dog. S. Every person who brings a dog into the City of Newport Beach, which has not been vaccinated with the approved vaccine as herein prescribed w i t h i n twelve (12) months prior to the importation, shall have such dog vaccinated within five (5) days from and after its arrival in the said City. '.A certificate of vaccination issued by a duly licensed veterinarian from any other jurisdiction for the specific –d o g establishing vaccina- tion with an approved vac- cine may be accepted by the Humane Officer as evidence of vaccination, providing it be within the interval pre. scribed by this section. 9. No person shall make use of or have in his pos- session or under his control a stolen, counterfeit, or forged vaccination certifi- cate, rabies tag, license, or license tag. 10. In furtherance of the program of the City of New- port Beach for vaccination of dogs against rabies, the City Health Officer is here- by authorized and directed to: a. Approve of such vac- cine or vaccines as he may find suitable for such use, promulgate h i s findings and approval and file a statement of his findings and approval in the office of the City Health Officer as a public record; b. Change such findings and approval when as a result of experience, re- search, practice or tests he finds that a new or differ- ent vaccine or vaccines are suitable for such use, and file a statement of his findings and approval in the office of the City Health Officer as a public record; and the City Humane Of- ficer is hereby authorized and directed to: a. Prescribe the form of certificate to be used by duly licensed veterinarians under the provisions here- of and to distribute such form of certificate to duly l i c e n s e d veterinarians practicing in this County upon request; b. Distribute to every owner or harborer of any dog within the City the names, addresses, and tele- phone numbers of all duly licensed veterinarians who have agreed to vaccinate the dogs of such residents for not more than the sum of Two Dollars ($2.00), which is to be paid to them as hereinafter provided. 11. There shall be added to PAGE 2 — ORD. 868 z� 0 and collected with the li- cense tax provided by other sections of this chapter the sum of Two Dollars ($2.00) for each dog owned or har- bored by such applicant for a license unless applicant exhibits to the City Hu- mane Officer a certificate complying with the require- ments of subsection 2 here- of signed by a duly licensed veterinarian certifying that the dog has been vaccinated with an approved vaccine within the preceding twelve (12) months. Said sum of Two Dollars ($2.00) so col- lected shall be deposited with the Director of Finance at such times and manner as license taxes are so de- posited. 12. The Director of Finance shall draw his warrant on the City in favor of each such veterinarian in pay- ment of the amount of Two Dollars ($2.00) for each such vaccination as he shall have made upon satisfac- tory proof thereof. 13. The vaccination re- quirement above shall not apply to a dog where a cer- tificate has been issued by a duly licensed veterinarian doing business in the Coun- ty of Orange setting forth that the giving of the inocu- lation would endanger the life of the dog. In such an event, said dog shall be confined at all times within the premises of the owner or within a motor vehicle own- ed by or under the super- vision of the owner of such dog." SECTION 3: Section 4112 of the Newport Beach Municipal Code is amended to read: "SECTION 4112. K e n n e l Tax. Every person who har- bors more than three (3) dogs over the age of three (3) months on any premises in the City, except on busi- ness premises on which a licensed business is operat- ed which reasonably in- cludes keeping dogs, shall be deemed to have a dog ken- nel. In lieu of the biennial license tax imposed by Sec- tion 4110, such person shall pay a kennel tax of Five Dol- lars ($5.00) per year for each dog kept at a dog kennel as herein defined." SECTION 4: This Ordinance shall be published once in the Newport Harbor Ensign, a news- paper of general circulation, printed and published in the City of Newport Beach and the same shall be effective 30 days after the date of its adoption. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the Sth day of December, 1955, and was adopted on the 22nd day of December, 1955, by the following vote, to wit: AYES, COUNCILMEN: HART, LORENZ, SOMERS, KINGSLEY, ATKINSON, HIGBIE, STODDARD.
