HomeMy WebLinkAbout1185 - Entertainment EstablishmentsTHS -aem 9/7/66 as follows- ORDINANCE NO, 1185 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 50280010 AND 50280060 OF, AND ADDING SECTION 50280041 TO, THE NEWPORT BEACH MUNICIPAL CODE RELATING TO ENTERTAINMENT ESTABLISHMIENTS The City Council of the City of Newport Beach does ordain SECTION to Section 50280010 of the Newport Beach Munici- pal Code is amended to reads 8050280010 Entertainment Defined. The term 'entertain- ment' as urn this chapter sha I mean any act, play, bur- lesque show, revue, pantomime, fashion or style show, scene, song, song and dance act, or instrumental music participated in by one or more employees, guests, customers or any other person or persons, The presence of any waitress, hostess or other female employee in any place described in Section 50280020, or the allowing of any other female present on the premises to appear in such public place, unclothed or in such attire or costume as to expose to public view any portion of either breast at or below the areola thereof, or any part of the pubic region or anal region or crease of the buttocks of any such person, is included in the term 'entertainment'." SECTION 20 Section 5,28,041 is added to the Newport Beach Municipal Code to read- "5,28,041 Additional Re ulatioaaso The following reg- ulations s apps y to any esta is ent for which an enter- tainment permit has been issued, and it shall be the duty of the permittee both to enforce said regulations and to inform his employees thereof- (a) Female performers, employees, or models shall be so clothed that the breasts shall be completely covered by nontransparent material from the top of the areola to the lowest portion of the breast, and the private parts and the crease of the buttocks will be completely covered by nontransparent material. (b) Stage or entertainment areas shall not be open to view from outside the premises. (c') Actions of performers shall not be lewd, indecent, or simulate a sex acts' SECTION 3, Section 5,280060 of the Newport Beach Munici- pal Code is amended to read- 115.28,060 Revocation of Permit, The City Manager may revoke a perm ti ti issue un er t e provisions of this chapter for any of the following reasons- • (a) The permittee has ceased to meet the requirements for issuance of a permits (b) The establishment has been operated in an illegal or disorderly manner or in violation of any of the regulations set forth in Section 5628,041, 10 (c) Music or noise from the establishment for which the permit was issued interferes with the peace and quiet of the neighborhood. (d) The permittee, or any person associated with him as principal or partner, or in a position or capacity involving total or partial control over the establishment for which the permit was issued, has been convicted of a criminal. offense involving moral turpitude." SECTION 4. This ordinance shall be published once in the official newspaper of the City and the same shall be effective thirty (30) days after, the date of its adoption. This ordinance was introduced at a regular meeting of the City Council of the City of Newport Belch held on the 12th day of September , 1966, and was adopted on the 26th day of September , 1966, by the following vote, to wit, • ATTEST- 0 �u , Acting City C r AYES, COUNCILMEN.
