ORDINANCE N0, 1266
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTIONS 20002.135 AND 20.53.010
OF TITLE 20 OF THE NEWPORT BEACH MUNICIPAL
CODE.RELATING_TO- DRIVE ®IN, TAKE OUT, AND
OUTDOOR-
RESTAURANTS-
The City Council of the City of Newport Beach does
ordain as follows:
SECTION to Section 20.020135 of the Newport Beach
Municipal Code is hereby amended to read:
"20002,135 Drive -In and Take Out Restaurant. The
terms 'drive -in', 'walk -up' and 'take out' restaurants
shall mean a place of business which sells food products
or beverages and which:
to Delivers such food products or beverages to
customers outside of the building in which they
are prepared by means of a service window, counter
or similar method or device, or
2< Delivers such food products or beverages to
customers within a building which is designed in
such a manner that a majority of the customers
will remove such food products or beverages from
the building for consumption either on the premises
or in the immediate vicinity,"
SECTION 2> Section 200530010 of the Newport Beach
Municipal Code is hereby amended to read:
"200530010 Definitions. As used in this chapter
the following terms shall have the meanings indicated:
DRIVE IN AND TAKE OUT RESTAURANT. The terms 'drive-
in', 'walk -up' and 'take out' restaurants shall mean a
place of business which sells food products or beverages
and which:
0 1. Delivers such food products or beverages to
customers outside of the building in which they
are prepared by means of a service window, counter
or similar method or device, or

2. Delivers such food products or beverages to
customers within a building which is designed in
such a manner that a majority of the customers will
remove such food products or beverages from the
building for consumption either on the premises
or in the immediate vicinity.
OUTDOOR RESTAURANT. The term °outdoor restaurant°
shall mean a place of business which sells or serves food
products or beverages for consumption on the premises
where such place of business is located, and which provides
for, or permits consumption of, such food products or
beverages on any portion of such premises not within a
fully enclosed building, consisting of a permanent struc-
ture, having a roof and four walls;"
SECTION 3. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective 30 days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 22nd
day of July , 1968, and was adopted on the 19th day
of August , 1968, by the following vote, to wit:
