Subject to the particular additions, deletions an amen ments herein- after set forth in this Chapter, the rules, regulations, provisions and conditions set forth in that certain Code entitled 'Uniform Plumbing Code, 1967 Edition', which Code is • promulgated and published by the International Association of Plumbing and Mechanical Officials (a private association which has been in existence for a period of more than three years last past), including Chapters 1 through 13 and Appendices A, B, C, F and G, three full printed copies of which, printed as a Code in book form, were by the City Council ordered filed and which have been actually filed in the office of the City Clerk and which, as so on file are hereby referred to, adopted and made a part hereof as fully and for all intents and purposes as though set forth herein at length, shall be and the same are hereby established and adopted as the rules, regulations, pro- visions and conditions to be observed and followed in the installation, alteration or repair of plumbing and drainage systems and the inspection thereof; and subject to said additions, deletions and amendments hereinafter set forth, said Code is hereby established and adopted and the same shall be designated, known and referred to as the 'Plumbing Code' of and for the City of Newport Beach. 15.08.020 Amendment to Section 1.1 of the Plumbing Code Section o t e um�ing Coue, erein�e ore a opteU in Section 15.08.010, is amended to read- 'Sec. I.I. Administrative Authority. Whenever the teT;—Tra—dministrative authority" is used in this Code it shall be construed to mean the Building Director of the City of Newport Beach or his authorized representative.' 15.08.030 Amendment to Section 1.2 of the Plumbing Code Sections the P um ing Code, herein a ore a opte in Section 15.08.010, is amended to read. 'Sec. 1.2. Assistants. Whenever the term "assistants9ris use�in tLis Code it shall be con- strued to mean the duly authorized inspectors of the Building Department.' 15.08.040 Deletion of Section 1.3 of the Plumbing Code. Sectiont 3 rs here 6y e eted rom the Plumbing Code, hereinbefore adopted in Section 15.08.010. 15.08.050 Amendment to Section 1.4 of the Plumbin Code Section the Plumbing Co e, erein a ore adopted in, Section 15.08.010, is amended to read- 'Sec. 1.4. Duties of the Administrative Authority. The Administrative Authority shall maintain public office hours necessary to efficiently administer the provisions of this Code and amendments thereto and shall perform the following duties. (1) Require submission of, examine and check plans and specifications, drawings, descrip- tions, and/or diagrams necessary to show clearly the character, kind and extent of plumbing work covered by applications for a permit and upon approval thereof shall issue the permit applied for. -2 (2) Collect all fees for permits issued as provided by this Code, issue receipts therefor in duplicate, the duplicate copy of which shall be maintained as a record of his office. • (3) Administer and enforce the provisions of this Code in a manner consistent with the intent thereof, and inspect all plumbing and drainage work authorized by any permit to assure compliance with provisions of this Code or amendments thereto, approving or condemning said work in whole or in part as conditions require. (4) Issue upon request a certificate of approval for any work approved by him. (5) Condemn and reject all work done or being done or materials used or being used which do not in all respects comply with the provisions of this Code and amendments thereto. (6) Order changes in workmanship and /or materials essential to obtain compliance with all provisions of this Code. (7) Investigate any construction or work regulated by this Code and issue such notices and orders as provided in Section 1.6. (8) Keep a complete record of all the essential transactions of his office. • (9) Transfer all fees collected by him to the proper authority provided by law to receive such funds. 15 .08.060 Amendment to Section 1.5 of the PlumbinR Code. Section .5 of the Plum ing Co e, herein a ore adopted in Section 15.08.010, is amended to read. 'Sec. 1.5. Right of Entry. (1) The Administrative Authority, or his duly authorized representative, shall have the authority to enter any building or premises for the purpose of investigating the existence of suspected or reported damage or defects which constitute an immediate danger to human life or an immediate hazard to public safety or health. (2) Except in emergency situations as defined in Section 1.5 (1) of this Code, the Administrative Authority, or his authorized representative, shall not enter any building or premises without the consent of the owner or occupant thereof, unless he possesses a reasonable search warrant authorizing entry and search of the premises. (3) No person shall hinder or prevent the • Administrative Authority or his authorized representa- tive, in the performance of the duties hereinbefore described as emergency situations or while in possession of a valid search warrant, from entering upon and into any and all premises under his juris- diction, at all reasonable hours, for the purpose of inspecting the same to determine whether or not the provisions of this Code and all other applicable laws -3® or ordinances pertaining to the protection of persons or property, are observed therein.° 15.08.070 Amendment to Section 1.7 of the Flumbiniz Code. Section 7 of the Plumbing Code, erein efore adopted in tSection 15.08.010, is amended to read- 'Sec. 1.7. Violations and Penalties. Any person, firm or corporation violating any o t e provisions of this Code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed Five Hundred Dollars ($500) or by imprisonment in the County Jail for not to exceed six (6) months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this Code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or on approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction • of errors in plans and specifications or from preventing construction operations being carried on thereunder when in violation of this Code or of any other ordinance or from revoking any Certificate of Approval when issued in error. Every permit issued by the Administrative Authority under the provisions of this Code shall expire by limitation and become null and void if the work authorized by such permit is not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work may be recommenced a new permit shall be first obtained to do so.' 15.08.080 Amendment to Section 1.10 of the Plumbin Code. Section 1.10 of the Plumbing Code, hereinbe ore adopted in Section 15.08.010, is amended to read. 'Sec. 1.10. Issuance of Permits. (a) No permit shall be issued to any person to do or cause to be done any construction or work regulated by this Code unless such person is a duly registered or licensed contractor as required • by this Code except, when and as otherwise provided herein. (b) Any permit required by this Code may be issued to a person to do any plumbing or drainage work regulated by this Code in a single family -4- 0 • .I L dwelling used exclusively for living purposes, including common accessory and minor poultry or agricultural buildings in the event that such person is the bona fide owner of such dwelling and accessory buildings and that the same are occupied and used exclusively by said owner, provided that said owner shall personally perform all labor in connection there- with. (c) A permit may be issued to any responsible person not acting in violation of Chapter 9, Division 3, of the Business and Professions Code of the State of California for the installation, alteration, or repair of water piping, water treatment equipment, and for private sewage disposal systems and house sewers connecting thereto. Permits may be issued for the installation, alteration, or repair of house sewers connecting with the public sewer to owners as described in Subsection (b) of this Section or to other persons properly registered or licensed as required by this Code.' 15.08.090 An Section of t Section 15.08.010, is amended to reads 'Sec. 1.12. Permit Fees. (a) General. Any person applying for a permit shall, at the time the application is made, pay to the Administrative Authority the fees set forth in this Section. Except as provided herein a plumbing permit and a sewer or private sewage disposal permit shall be required for each building or installation. Code. Exceptions Where accessory buildings and /or appurtenances, such as laundry rooms, guest houses, bath houses or swimming pools, are used in conjunction with a single family residence, are located on the same lot and under the same ownership, and are erected at the same time as the main building, all plumbing items may be combined on one plumbing permit. All buildings and appurtenances regardless of type, located on the same lot and under the same ownership may, when being connected at the same time to a common house sewer or to a common or multiple private sewage disposal system, be combined on one sewerage permit. Plumbing permit fees shall be as specified in Table No. I. Sewer and private sewage disposal permit fees shall be as specified in Table No. II. For the purpose of this Section a sanitary plumbing outlet on which or to which a plumbing fixture or appliance may be set or attached shall be construed to be a fixture. Built -in dishwashers shall be construed fixtures whether individually trapped or not. Fees for reconnection and retest of existing plumbing systems in relocated buildings shall be based on the number of plumbing fixtures, gas systems, water heaters, etc., involved. When interceptor traps or house trailer site traps are installed at the same time as a house sewer on any lot no sewer permit shall be required for the connection of any such trap to an appropriate inlet fitting provided in the house sewer by the permittee constructing such sewer. -5- When a permit has been obtained to connect an existing building or existing work to the public sewer, or to connect to a new private disposal facility, backfilling of private sewage disposal facilities abandoned consequent to such connection is included in the house sewer permit. Plans and specifications shall be submitted a®nd approved prior to the commencement of any work described in this section. A plan checking fee shall be paid to the Building Director at the time of submitting the plans and specifications for work described in this Section. Said fee shall be equal to one - fourth (1/4) the required plumbing permit fee as set forth in Table I of this Article. • All plan checking fees shall be based on the aggregate quantities required for the complete project: 1) Building or premises containing over 180 drainage fixture units. -7- 2) Building or premises with a potable water supply 4" or larger. 3) Building or premises with fuel gas piping 4" or larger or containing medium or • high pressure fuel gas. (c) SS eecc1 *! 1,. Whenever any work for which a permit is require ud nder the provisions of this Code has been commenced, constructed or completed without the authorization of such permit, a special investigation may be required before a permit will be issued for such work in order to determine whether the work done complied with Code Requirements. In addition to the regular permit fee, an investigation fee shall be collected as follows, When the Permit Fee is, Investigation Fee $10.00 or less . . . . . . . . . . . . .$ 10.00 More than $10.00 . . . . . . . . . .$ 25.00 No permit shall be issued when an investigation fee is due until such fee has been paid. The payment of the investigation fee shall not exempt any person from compliance with the provisions of this Code nor from any penalty prescribed by law. The permit fee herein specified shall be doubled when work requiring a permit has been started or • carried on prior to obtaining said permit and the applicant had knowledge that a permit was necessary as evidenced by the fact that at the time of doing such work he held a license as required by Section 1.10 of this Code., or had previously applied for a permit as provided in this Code, but payment of such double fee, provided the permit is subsequently issued, shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein. (d) Conversion Inspection Fee. A fee as set forth in Table -B below s all a paid when a con- version inspection is required by the Administrative Authority. Affected Floor Area (Sq. Ft.) A fee of Fifteen Dollars ($15.00) may e c arge y the Administrative Authority for any investigation of a building, structure, work reports, certification or any other related work, requested by an owner or authorized agent of such owner. The provisions of this Section shall not apply to emergency work when it shall be proved to the satis- faction of the Administrative Authority that such work was urgently required and that it was not practical to obtain a permit therefor before commencement of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there is an unreasonable delay in obtaining such permit, an investigation fee as herein provided shall be charged. (f) Reins ection Fee. Five Dollars ($5.00) per inspection may e c arge for additional inspections necessary as a result of faulty workmanship or material or both; or for any inspection requested before the work to be inspected has been completed and made ready for inspection. Notice of completion of the work or of correcting faulty workmanship or material shall be given the Administrative Authority and reinspection requested,' 15.08.100 Addition of Section 1.15 to the Plumbs Co Section . 5 is a e to the Plum ing Code, here n e ore adopted in Section 15.08.010, to read. 'Sec. 1.15. Surrender of Permit. If no portion of the worc or construction covered by a permit issued by the Chief Plumbing Inspector under the provisions of this Code has been commenced the person to whom such permit has been issued may deliver such permit to the Chief Plumbing Inspector with the request that such permit be cancelled. The Chief Plumbing Inspector shall thereupon stamp or write on the face of such permit the words "Cancelled at the request of the permittee ". Thereupon such permit shall be void and of no effect." 15.08.110 Addition of Section 1.16 to the Plumbing Code. Section is added to the Plumbing Co e9 hereinbetore adopted in Section 15.08.010, to read. 'Sec. 1.16. Suspension or Revocation of Permit. The ChlefP uMng Inspector may suspend or revoke any permit issued under the provisions of this Code whenever such permit is issued in error, or is issued on the basis of incorrect information supplied, or has been obtained by falsification or misrepresenta- tion, or when work is being done thereunder in violation of this or any other related ordinance or regulation.' 15.08.120 Ad Section s adopted in Section tion of Section 1.1 15.08.010, to re umb 'Sec. 1.17. Refund. In the event that any person shall have obtained a permit and no portion of the work or construction covered by such permit shall have been commenced and such permit shall have been cancelled without any work having been done as provided for in Section 52 or Section 62, the permittee upon presentation to the Chief Plumbing Inspector of a request therefor in writing, shall be entitled to a refund in an amount equal to 80 per cent • of the fee actually paid for such permit. The Chief Plumbing Inspector will satisfy himself as to the right of such applicant to such refund and each such refund shall be paid as provided by law for the payment of claims against the County. No refund shall be made when a permit has been obtained by falsification or misrepresentation and has been revoked for such cause.' 15.08.130 Addition of Section 1.18 Section is added to the P um ing Co adopted in Section 15.08.0109 to read° 'Sec. 1,18. Plumbers shall be those persons w o a or aat tte trade of plumbing in return for wages or salary but who do not furnish any materials or supplies in the execution or per- formance of any plumbing work. All plumbers shall be classified in one of the following categories: (a) Plumber, Journeyman: A person who labors at the trade of plumbing as an employee of • a plumbing contractor and under the direction of said contractor or master plumber. (b) Plumber, Apprentice: A person who labors at the trade of plumbing as an employee under the direct supervisions and in the im- mediate presence of a plumbing contractor or journeyman plumber. _10- (c) Plumber, Maintenance- A person who is regularly employed to install, alter, maintain or repair plumbing, gas piping or sewage disposal systems in or on buildings or premises owned or occupied by his employer. • 15.08.180 Amendment to Section 406(a) of the Code. Sect 40L-Ca o –the Plumbing Code, erein – aaddopted in Section 15.08.010, is amended to read- Sec. 406. Cleanouts. '(a) Each horizontal drainage pipe and horizontal under floor vent, over five feet (51) in length shall be provided with a cleanout at its upper terminal, except sinks and urinals which shall have Cleanouts at all upper terminals. Cleanouts may be omitted on each horizontal drainage pipe installed on a slope of seventy two deggrees (72*) or less from the vertical (angle of 1/5 bend), but each such run of piping which is more than one hundred feet (1000) in total developed length shall be provided with a cleanout for each one hundred feet (100'), or fraction thereof, in length of such piping; provided, that excepting the building drain and its horizontal branches, a cleanout shall not be required on any pipe or piping which is above the first floor of the building. An approved type of two -way cleanout fitting installed outside of a building at the lower end of a building drain and extended to grade may be substituted for an upper terminal cleanout.' • 15.08.190 Amendment to Section 406(i) of the Plu Code. Section 40 of the Plumbing Co e, herein e o aacpted in Section-15.08.010, is amended to read- Sec. 406. Cleanouts. '(i) Cleanouts shall be provided for pressure drainage systems as classified under Section 409(g).' 15.08.200 Deletion of Subsection c) of Secti of the Plumb in Code. Subsection c o£ Section 50 hereby deleted trom the Plumbing Code, hereinbefore adopted in Section 15.08.010, 15.08.210 Amendment to Section 506 b of the Plumb Code. Section 50 ot the Plumbing Code, hereinbefore Yd—opted in Section 15.08.010, is amended to read- Sec. 506. Vent Termination. '(b) Each vent shall terminate not less than ten feet (10') from or at least three feet (3') above any window, door opening, air intake or vent shaft, nor less than ten feet (10') in any direc- tion from the nearest point on any adjacent lot where openable windows are permitted in a building thereon. (Example- seven feet (7') from lot • line in residential and five feet (5') from lot line in commercial).' -11- • LJ • 15.08.220 Amendment to Section 909(e) of the Plumbin Code. eS tin 909(e) of Me um ing Code, erein a =ore meted in Section 15.08.010, is amended by deleting the words 'having each layer' from the third paragraph as found on page 68 of the published edition of the Uniform Plumbing Code. 15.08.230 Amendment to Section 1008(c) of the Plumbin Code. Sect n 1008(c) o_ the Wing Code.- ereinbefore adopted in Section 15.08.010, is amended to reads Sec. 1008. Installations Inspection and Testing. '(c) Water piping installed within a building and in or under a concrete floor slab resting on the ground shall be installed in accordance with the following requirements (1) N6n- metallic and ferrous piping shall be prohibited; except that ferrous piping four inches (4 ") and larger may be used when protected against corrosion and installed in channels, tubes or in similar protective manner when approved by the Administrative Authority. Cast iron pressure water piping excepted. (2) Copper tubing shall be installed without joints where possible. Where joints are permitted, they shall be brazed and fittings shall be wrought copper.' 15.08.240 Amendment to Section 1009(h) of the Plun Code. Section 1009(h) of the Plumbing Co e, ere n efor adopted in Section 15.08.010, is amended to reads Sec. 1009. Size of Potable Water Piping. '(h) No building supply pipe shall be less than three - quarter inch (3�4 ") in diameter and not less than one inch (1 ") diameter for each single family residential structure. Section 1107 a of'--the Plumbing Code, here adopted in Section 15.08.010, is amended to reads Sec. 1107. Cleanouts. '(a) Cleanouts shall be placed in every building sewer at the junction with the soil pipe at the building, and at intervals not to exceed one hundred feet (100') in straight runs. -12- 15 .08.270 Addition of Subsection (f) of Section added to the Plumbing Code, hereinbefore adopted in Section 15.08.010, to read. 'Sec. 1119. Abandoned Sewers and Sewage Disposal Facilities s (f) No such excavation shall be left unattended at any time unless the permittee shall have first provided a suitable and adequate barricade to assure public safety.® 15.08.280 Amendment to Section 1305 of the Plumbin Code. Section 1305 o the P umbing Code, herein efore adopted in Section 15.08.010, is amended to read- 'Sec. 1305. Gas -Fired Water Heater Approval Requirements. (a) Except as provided in Subsection (c) of this section gas fired water heaters and gas fired hot water boilers shall conform to approved recognized applicable standards or to other standards acceptable to the Administrative Authority. Each such water heater or boiler shall bear the label of an approved testing agency certifying the attesting that such equipment has been tested and inspected and meets the requirements of applicable standards. (b) Except as provided in Subsection (c) of this section or when reconditioned by the manufacturer • or his approved agent in accordance with its original approval requirements and reinstalled at its original location, each reconditioned water heater or hot water boiler shall be tested for safety and con- formity to approved standards and shall bear the label of an approved testing agency certifying and attesting that such equipment has been tested and inspected and meets the requirements of applicable standards. Such label shall also state clearly that the water heater has been reconditioned and shall give the name and address of the reconditioner. Every person applying for a permit to install a used or reconditioned water heater shall clearly state on his application for permit that such equipment is used or reconditioned. (c) Notwithstanding standards for equipment and installations or listings of approved testing agencies, all gas storage -type water heaters and hot water boilers, in addition to the primary temperature control, shall be equipped with a temperature- limiting device which shall consist of either an automatic energy shutoff system, a temperature relief valve or a combination temperature and pressure relief valve. The above required temperature - limiting device shall be installed at the factory or shipped with the appliance, accompanied by complete instructions for its installation. When it is designed to shut off the source of energy, it shall activate a valve or relay which is separate from the valve or relay operated by the primary temperature control ° -13- 15.08.290 Amendment to Section 1306 of the Plumbin Code. Section 1306 o the Plum ing Code, herein a ore aacopted in Section 15.08.010, is amended to reads 'Sec. 1306. Oil Burning and Other Water Heaters. . (a) Except as provided in Subsection (b) of this section, water heaters deriving heat from fuels or types of energy other than gas shall be constructed and installed in accordance with approved standards in a manner satisfactory to the Administrative Authority. Vents for such appliances shall be of approved or listed types and shall be installed in conformity with their conditions of approval. Proper provision shall be made for an adequate supply of air for combustion and for adequate ventilation of heater rooms or compartments. Each such appliance shall be installed in an approved location satisfactory to the Administrative Authority and to local and State fire prevention agencies. (b) Notwithstanding standards for equipment and installations or listings of approved testing agencies, all storage -type water heaters and hot water boilers, regardless of source of energy, in addition to the primary temperature control shall be equipped with a temperature- limiting device which shall consist of either an automatic energy shutoff system, a temperature relief valve or a combination temperature and pressure relief valve. '(a) Water heaters generating a glow, spark or flame capable of igniting inflammable vapors may be installed in a residential garage provided the pilots and burners, or heating elements and switches are at least eighteen inches (18 ") above the floor level.' SECTION 2. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective thirty (30) days after the date of its adoption.
