HomeMy WebLinkAbout1356 - Citations & Warrants:0 .40 0 NO. 2356 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 1.12.010,. 1.12.020.AND. 1.12..030 OF THE NEWPORT BEACH MUNICIPAL.. CODE, AND REPEALING SECTIONS 1.12.040 AND 1.12.0509 RELATING TO CITATIONS AND WARRANTS The City Council of the City of Newport Beach does ordain as follows: SECTION 1. 1.12.010 of the Newport Beach Municipal Code is amended to read: "1.12.010 Chapter 5c of Penal Code Adopted by Reference. Except as provided in this chapter, the, provisions of Chapter 5c, Title 3, Part 2, of the Penal Code of the State of California, as amended, are hereby adopted and made a part of this Chapter as though fully set forth." SECTION 2. 1.12.020 of the Newport Beach Municipal Code is amended to read: "1.12.020 Authority of Public Officers or, Employees to Make Arrests. The following designated public officers and employees shall have the power to arrest persons for misdemeanor violations committed in their presence as hereinafter provided: (1) Humane officers shall have the power to make arrests for any violation of Title 7 of this Code, entitled 'Animals'. (2) Parking control officers shall have the power to make arrests for any violation of Title 12 of this Code, entitled 'Vehicles and Traffic', relating to parking of vehicles. -1- ID 0 (3) The Marine Safety Director and all lifeguards shall have the power to make arrests for any violation of Chapter 5 of Division 3 of the California Harbors & Navigation Code, Title 11 of this Code entitled 'Recreational Activities', and Title 17 of this Code entitled 'Harbor Regulations', and shall have the power to make arrests for violations of the following Sections of this Code, Section 6.04.070 'Improper Garbage Disposal', Section 6.04.200 'Tampering With Beach Receptacles Prohibited' and-Section 6.04.230 'Human Deposits'." SECTION 3. 1.12.030 of the Newport Beach Municipal Code is amended to reads "1.12.030 Violation of Promise to Appear: Any person willfully violating his promise to appear in Court or before a person authorized to receive a deposit of bail is guilty of a misdemeanor regardless of the disposition of the charge upon which he was originally arrested." SECTION 4. Sections 1.12.040 and 1.12.050, of Chapter 1.12 of the Newport Beach Municipal Code are hereby repealed. SECTION 5. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption.
