HomeMy WebLinkAbout1366 - Annexation 71 - Acacia-PalisadesORDINANCE NO. 13 6 6 AN ORDINANCE OF THE CITY OF NEWPORT BEACH APPROVING THE ANNEXATION TO THE CITY OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF NEWPORT BEACH AND KNOWN AS THE ACACIA - PALISADES ANNEXATION - ANNEXATION NO. 71 WHEREAS, on the 27th day of May, 1970, the Local Agency Formation Commission of Orange County adopted a resolution approving the proposed annexation to the City of Newport Beach of certain uninhabited territory, said proceeding to be known as the Acacia - Palisades Annexation - Annexation No. 71; and WHEREAS, a written petition requesting annexation of said territory has been filed with the City Council, signed by the owners of not less than one - fourth of the land in the territory by area, and by assessed value as shown on the last equalized assessment roll of Orange County; and WHEREAS, on the 28th day of September, 1970, the City Council adopted Resolution No. 7291, which resolution gave notice of the proceedings initiated by written.petition for the annexation to the City of Newport Beach of certain unin- habited territory known as the Acacia - Palisades Annexation - Annexation No. 71, and setting the 23rd day of November, 1970, as the date on which the City Council would hold a hearing for for the purpose of considering written protests against said annexation, made by any person owning real property within the territory proposed to be annexed; and WHEREAS, at the time set forth for hearing protests, no written or oral protests were made by the owners of the territory to be annexed as prescribed in the Annexation of Uninhabited Territory Act, and the City Council determined toby resolution that a majority protest had not been made; and -1- s t 1b WHEREAS, it appears that the necessary proceedings relating to annexation have been conducted strictly in accordance with the law; NOW, THEREFORE, the City Council of the City of Newport Beach DOES ORDAIN as follows: SECTION 1. The annexation to the City of Newport Beach of that certain uninhabited territory contiguous to said City, known as THE ACACIA - PALISADES ANNEXATION - ANNEXATION NO. 71, is hereby approved and the same is hereby ordered to be annexed and made a part of the City of Newport Beach, California. Said territory is more particularly described as follows: A parcel of land lying within Tract No. 706 as shown on a map thereof, recorded in book 21, page 25 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows: Beginning at a point in the center line of Campus Drive (formerly Acacia Street) said point being on the north- westerly prolongation of the southwesterly line of Tract No. 3201 as shown on a map thereof, recorded in book 130, pages 25 through 29 of Miscellaneous Maps, records of said Orange County, said point also being an angle.point in the existing boundary of the City of Newport Beach being the most westerly corner of Annexation No. 56, Ordinance No. 1116, adopted by the City Council of the City of Newport Beach, February 8, 1965; thence South 50° 11' 45" East, 330.00 feet along said existing boundary as described in said annexation No. 56 and as described in the Acacia Street Annexation, Ordinance No. 837, adopted by the City Council of the City of Newport Beach, October 28, 1957, thence departing from said existing boundary South 39° 48' 15" West, 1370.00 feet along the north- easterly prolongation of the southeasterly line, the southeasterly line and the southwesterly prolongation of the southeasterly line of Lots 72 through 79 and Lot 81 of said Tract No. 706 to the center line of Orchard Drive; thence North 50° 11' 45" West, 330.00 feet, along said center line, to the center line of Acacia Street, as shown on said Tract No. 706; thence North 390 48' 15" East, 1370.00 feet along said center line of Acacia Street to the Point of Beginning. SECTION 2. The boundaries of the City of Newport Beach are hereby altered to include the territory described herein. -2- SECTION 3. This ordinance shall be published once in the official newspaper, and the same shall be effective 30 days is after the date of its adoption.
