AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING CHAPTER 15.12 OF THE NEWPORT
BEACH MUNICIPAL CODE TO ADOPT THE NATIONAL
ELECTRICAL CODE, 1975 EDITION
The City Council of the City of Newport Beach DOES
ORDAIN as follows:

15.12.010 Adoption of National Electrical Code. Subject
to the particular additions, deletions and amendments hereinafter
set forth in this Chapter, the rules,'regulations, provisions and
conditions set forth in that certain Code entitled "National
Electrical Code, 1975 Edition" (NFPA No. 70 -1975; (ANSI C1 -1975)
published by the National Fire Protection Association, and the
whole thereof, including the appendix thereto, three full printed
copies of which, printed as a Code in book form, were by the City
Council ordered filed and which have been actually filed in the
office of the City. Clerk and which, as so on file are hereby referred
to, adopted and made a part hereof as fully and for all intents
and purposes as though set forth herein at length, shall be and
the.same are hereby established and adopted as the rules, regula-
tions, provisions and conditions to be observed and followed in
the construction, alteration, installation, moving, repair and use
.of any electrical wiring on any premises within the incorporated
area of the City of Newport Beach; providing for issuance of
,permits and collection of fees therefor; and providing penalties
for violation of such code; and subject to said additions, deletions
and amendments hereinafter set forth, said Code is hereby
established and adopted and the same shall be designated, known
and referred to as the "Electrical Code" of and for the City of
Newport Beach.
15.12.020 Exemptions The provisions of this Code
shall not apply to public utilities or to electrical wiring for
street lighting or traffic signals located primarily in a public
way.
15.12.030 Compliance With Electrical Code Required
No person shall erect, construct, alter or repair any electrical

installation or wir.in(,J in the City or cause or permit the same
to be done without, complyi.nd with all provisions of the. Electrical.
Code.

15.12.040 Violations and Penalties Any person, firm
Code
or corporation violating any of the provisions of this shall
be deemed guilty of a misdemeanor and upon conviction thereof shall
be punishable by a fine or not to exceed Five Hundred Dollars
($500.00) or by imprisonment in the County Jail for not to exceed
six (6) months, or by both such fine and imprisonment. Each
separate day or any portion thereof during which any violation of
this Code occurs or continues shall be deemed to constitute a
separate offense, and upon conviction thereof shall be punishable
as herein provided.
The issuance or granting of a permit or approval of
plans and specifications shall not be deemed or construed to be a
permit for, or an approval of, any violation of any of the
provisions of this Code. No permit presuming to give authority
•
to violate or cancel the provisions of this Code shall be valid,
except insofar as the work or use which it authorizes is lawful.
The issuance or granting of a permit or approval of
plans shall not prevent the Electrical Inspector from thereafter
requiring the correction of errors in plans and specifications or
from preventing construction operations being carried on thereunder
when in violation of this Code or of any other ordinance or
from revoking any Certificate of Approval when issued in error.
15.12.050 Amendment to Section 90 -4 Section 90 -4
of the National Electrical Code, hereinbefore adopted in Section
15.12.010 is amended to read:
"90 -4 Enforcement. The Building Official of the
City of Newport Beach shall enforce the provisions of
this Code and shall have the responsibility for making
interpretations of the rules, for deciding upon the

approval of equipment and materials, and granting
the special permission contemplated in a number of the
rules."

• 15.12.070 Addition of Section 90 -8. Section 90 -8 is
added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010, to read:
"90 -8 Electrical Inspector. Electrical Inspector
shall be the Building Official of the City of Newport Beach
and such other person or persons in the Building Department
as are authorized and directed by the Building Official to
carry out under his direction and supervision the powers
and duties set forth in this Code.
Whenever the term "Electrical Inspector" is used in
any section of this ordinance such term shall be construed
to mean the Building official or his authorized representative."
15.12.080 Amendment to Article 100. Article 100 of the
National Electrical Code, entitled "Definitions" hereinbefore
• adopted in Section 15.12.010 is amended to add the definitions of
the following terms only.. All words, phrases or terms not
hereinafter defined shall have the same meaning as set forth in
Article 100 as published.
"Apartment house is any building or portion thereof,
which is designed, built, rented, leased, let or hired out
to be occupied, or which is occupied as the home or
residence of three or more families living independently of
each other and doing their own cooking in the said building,
and shall include flats and apartments.
Building is any structure built for the support of
shelter of persons, animals, chattels or property of any
kind.
Building Official is the officer or other designated
• authority charged with the administration and enforcement
of this Code or his duly authorized representative.
Master Electrician is a person who is engaged in the

business or installing or repairing electrical wiring
or I equipment, or who does, or who holds himself out as
willing to do personally or through his employees any work
• or services in connection with the installation, alteration
or repair of any electrical wiring or equipment or part
thereof.within the incorporated territory of the City of
Newport Beach and who possesses an appropriate contractor's
license pursuant to Chapter 9, Division 3 of the Business
and Professions Code.
Dwelling is any building or any portion thereof which
is not an "Apartment House," Lodging House" or a "Hotel"
as defined in this Code, which contains one or two "Dwelling
Units ", or "Guest Rooms ", used, intended or designated to
be built, used, rented, leased, let, or hired out to be
occupied, or which are occupied for living purposes.
Dwelling Unit is a single unit providing complete
• independent living facilities for one or more persons includ-
ing permanent provisions for living, sleeping, eating,
cooking and sanitation.
Hotel is any building containing six or more rooms
intended or designed to be used, or which are used, rented
or hired out to be occupied, or which are occupied for
sleeping purposes by guests.
Maintenance Electrician is any electrician regularly
employed in accordance with the provisions of Sections 105 -2
and 105 -3 of this ordinance.
Person is an individual human being, a firm, partnership
or corporation, his or their heirs, executors, administrators,
assigns, officers or agents; the City of Newport Beach and
any local agency as defined in Section 53090 of the Govern-
ment Code, or officer thereof.

Sign Electrician is any person holding a valid State
Contractor's License with a classification of C -45 engaged
in the business of installing or maintaining the electrical
wiring of a sign or of a gas tube electrical sign whether
fixed or portable for which a permit is required by this
Code."
15.12.090. Addition of Article 105. The title of
Article 105 of the National Electrical Code, hereinbefore adopted
in Section 15.12.010 is added to read:
"Article 105 ADMINISTRATION."
15.12.100 Addition of Section 105 -1. Section 105 -1 is
added to the National Electrical Code hereinbefore adopted in
Section 15.12.010 to read:
"105 -1 Applications and Permits.
(a) Applications. Applications for electrical permits,
describing the work to be done, shall be made in writing by
a master electrician, maintenance electrician or their
authorized representative. Where a license is required by
the State of California, a permit shall not be issued unless
the applicant has such a license. In the case of an owner,
such application shall be for a special owner's permit.
Applications shall give the location where such work
is to be done, either by street and house number, by lot,
block and tract, or similar description that will readily
identify and definitely locate the proposed work. A separate
application shall be required for each building.
EXCEPTION: Applications for single - family dwellings
may include all accessory buildings such as garages,
sheds, guest houses, and the like that are located
on the same lot, erected at the same time, and
supplied from the same service as the main building.
A separate application shall be required for any
private dock installation.
Each such application shall be accompanied by drawings
or plans as required by the Electrical Inspector.
Application may be made by a firm, partnership or
corporation, any officer or member of which is an
electrician, sign electrician, master electrician in
the event that all construction or work is done
under the direct personal supervision of such officer
or member.

(b) Special Owner's Permit. The Electrical Inspector
may issue.to an individual a special owner's permit'authoriz-
ing said individual to install, alter, change or repair
electrical equipment in, on, or about a single - family
residence of which said individual is owner, and in which
he resides or intends to reside, but not elsewhere; provided
that no electrical work authorized under any.such special
owner's permit shall be done, nor shall the owner holding
any such.permit allow any such work to be done, except
personally by the owner to whom the permit is issued, or by
a member of his immediate family; and, if this or any other
provision hereof shall be violated by the holder of such
special.owner's permit, such permit shall be subject to
immediate cancellation by the Electrical Inspector, and the
holder thereof shall be liable to the penalty hereinafter
provided for violation of this Code.
(c) Permits. No alteration or addition shall be made
to any existing wiring, nor shall any wiring for the placing
or installation of any electric light, power or heating
device, or any apparatus which generates, transmits, trans-
forms or utilizes electricity, operating at a voltage exceed-
ing 25 volts between conductors or capable of supplying more
than 50 watts, be made without first obtaining a permit
therefor from the Electrical Inspector, excepting minor
repair work such as repairing flush and snap switches,
replacing fuses, changing lamp sockets and receptacles,
taping bare joints, repairing drop cords and the like.
The application, plans and specifications filed as
required by this section, shall be checked by the Electrical
Inspector, and if found to be in conformity with the require-
ments of this Code and all other laws or ordinances applicable
thereto, the Electrical Inspector shall, upon receipt of the
required fee, issue a permit therefor. Every permit issued
shall be valid only for the location described on the applica-
tion therefor.

Inspector under the provision of this Code has been commenced,
the person to whom such permit has been issued may deliver
such permit to the Electrical Inspector with a request that
such permit be cancelled. The Electrical Inspector shall
thereupon stamp or write upon the face of such permit the
words, "cancelled at the request of the permittee." Thereupon
such permit shall be null and void and of no effect.
(f) Additional Electrical Work after Final Approval.
After the Electrical Inspector has finally approved electrical
work authorized under an electrical permit, no additional
electrical work shall be done thereunder without first obtain -
ing.a separate electrical permit authorizing such additional
electrical work."
15..12.110 Addition of Section 105 -2. Section 105 -2
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
•11105 -2 Maintenance Electrician. (a) A Maintenance
Electrician shall not install, alter, maintain or repair
electrical wiring or equipment in or on any building owned
or occupied by his employer without first having obtained
a Certificate or Competency as herein provided.

(d) Expiration of Permit. Every permit issued by
the Electrical Inspector under the provisions of this Code
'
shall expire by limitation and become null and void if
the building or work authorized by such permit is not
•
commenced within 120 days from the date of such permit, if
the building or work authorized by such permit be suspended
or abandoned at any time after the work is commenced for a
period of 120 days, or if the electrical work authorized by
such permit is not completed within one year from date of
issuance of such permit. When an electrical permit expires,
no electrical work thereafter shall be done without first
obtaining a separate electrical permit from the Electrical
Inspector in the same manner as is required herein for an
original permit.
(e) Cancellation of Permit. If no portion of the work
or construction covered by a permit issued by the Electrical
Inspector under the provision of this Code has been commenced,
the person to whom such permit has been issued may deliver
such permit to the Electrical Inspector with a request that
such permit be cancelled. The Electrical Inspector shall
thereupon stamp or write upon the face of such permit the
words, "cancelled at the request of the permittee." Thereupon
such permit shall be null and void and of no effect.
(f) Additional Electrical Work after Final Approval.
After the Electrical Inspector has finally approved electrical
work authorized under an electrical permit, no additional
electrical work shall be done thereunder without first obtain -

15..12.110 Addition of Section 105 -2. Section 105 -2
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
•11105 -2 Maintenance Electrician. (a) A Maintenance
Electrician shall not install, alter, maintain or repair
electrical wiring or equipment in or on any building owned
or occupied by his employer without first having obtained
a Certificate or Competency as herein provided.

(b) The Electrical Inspector shall establish
minimum standards of electrical competency to be used in
determining whether any person is qualified for a Certificate
• of Competency as a Maintenance Electrician.
The Electrical Inspector shall issue such Certificate of
Competency to any applicant meeting such standards. If the
Electrical Inspector determines that an applicant is not so
qualified, such applicant may appeal his determination in
accord with such procedures as may be set forth by the City
Council of the City of Newport Beach."
15.12.120 Addition of Section 105 -3 Section 105 -3 is
added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010 to read:
"105 -3 Registration of Maintenance Electricians. (a)
The Electrical Inspector shall register each Maintenance
Electrician to whom a Certificate of Competency is issued.

The business identity of the Maintenance Electrician and
•
his employer, their business addresses, and the location and
description of buildings and premises in or on which the
Maintenance Electrician will be doing electrical work, shall
be included in such registration and the Maintenance
Electrician shall notify the Electrical Inspector of any
changes in.the information required under such registration.
(b) Certificates of Competency shall expire on the
30th day of June following their issuance, and may thereafter
be renewed on an annual basis.
(c) An applicant for such a Certificate of Competency
shall at the time of filing his application pay an examina-
tion fee of Ten Dollars ($10.00), and at the time a
Certificate of Competency is issued pay a registration fee
of Ten Dollars ($10.00). A registration.fee of Ten Dollars
($10.00) shall also be said at the time of each annual

renewal of such certificate.

in Section 15.12.010 to read:
"105 -6 Inspection.
(a) Approval. Upon the completion of the electrical
wiring in.or on any building or structure of any nature,
• or tent, or premises, except as otherwise exempted in this
ordinance, the person, firm or corporation installing the
same shall notify the Electrical Inspector, who shall inspect

in Section 15.12.010 to read:
. "105 -4 Revocation or Suspension of Certificates of
•
Competency. The Electrical Inspector, with the approval
of the City Manager, may suspend or revoke a Certificate
of Competency when the Maintenance Electrician holding.such
certificate has violated any of the provisions of this Code
or has engaged in conduct constituting incompetency in
connection with his electrical work. Any such Maintenance.
Electrician may appeal such suspension or revocation in the
same manner as set forth in Section 15.12.110 of this Code.
No electrical work shall be done by such Maintenance
Electrician pending a decision by such Board without the
approval of the City Manager."
15.12.140 Addition of Section 105 -5. Section 105 -5
is added to the National Electrical, Code, hereinbefore
•
adopted in Section 15.12.010 to read:
"105 -5 Interpretations by Electrical Inspector. The
Electrical Inspector is hereby empowered to make interpreta-
tions of any of the provisions of this Code wherever there
.is a reasonable question as to what is required in the way
of materials or methods or manner in which the materials
shall be installed. Such interpretations shall be in writing
filed in the office of the Electrical Inspector and shall
be final unless an appeal is taken."
15.12.150 Addition of Section 105 -6. Section 105 -6
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010 to read:
"105 -6 Inspection.
(a) Approval. Upon the completion of the electrical
wiring in.or on any building or structure of any nature,
• or tent, or premises, except as otherwise exempted in this
ordinance, the person, firm or corporation installing the
same shall notify the Electrical Inspector, who shall inspect

such installation, and if it is found by him to be
fully in compliance with the provisions of this ordinance,
he shall issue; as provided for herein, the certificate
of inspection or approval tag authorizing connection to
the electrical service and the energizing of the installa-
tion.
(b) Permission to Cover Work. It shall be unlawful for
any person to lath over, seal, cover or conceal any
electrical wiring or other electrical equipment, for the
installation of which a permit is provided herein, until
such electric wiring or other electrical equipment shall
have been inspected and approved by the Electrical Inspector.
Said Electrical Inspector shall have the power to remove,
or to require the removal of any obstruction which prevents
proper inspection of any electrical equipment.
(c) Corrections. All defects shall be corrected within
ten (10) days after inspection and notification or within
such other reasonable time as is permitted by the Electrical
Inspector.
(d) Connection. It shall be unlawful to energize or
cause or permit to be energized any electrical wiring coming
under the provisions of this Code, until such electrical
wiring shall have been inspected and approved by the
Electrical Inspector and the building finalized. Provided,
however, that the Electrical Inspector may give written
temporary permission to furnish electric current to, or the
use of electric current through any electrical wiring for a
length of time not exceeding thirty (30) days, if it appears
to said Electrical Inspector that such electrical wiring
may be used safely for such purpose, and that there exists
an urgent necessity for such use.
• (e) Governmental Agencies. The provisions of this
Code shall cover, govern and control the installation,
alteration or repair of any electrical wiring, connection,

fixtures, sockets, appliances, apparatus, machinery or
other electrical device by or on behalf of the City of
Newport.Beach or any department or officer thereof or by
or on behalf of any school district or any quasi - public
. or political corporation or governmental agency or body,
on any premises not owned by a public school district being
constructed within said incorporated territory. This
paragraph does not apply to such electrical wiring as is
specifically exempt under the provisions of Section 15.12.020."
15.12.160 Addition of Section 105 -7. Section 105 -7
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
10105 -7 Reinspection. The Electrical Inspector is
hereby authorized and empowered to make at such times and
as often as in his discretion it may seem necessary, a
thorough reinspection of the installation in or on any build -
ing, structure or premises of all electrical wiring, electric
• devices and electrical material now installed or that may
hereafter be installed within the incorporated territory of
said city and when the installation of any such wiring
device or material is found to be in a dangerous or unsafe
condition the person, firm, corporation or governmental
agency owning, using or operating the same shall be notified
in writing and shall make the necessary repairs or changes
required to place such wiring, device or material in a safe
condition and to have such work completed within a period of
ten (10) days after such notice, or within such other
reasonable period specified by the Electrical Inspector in
said notice and shall pay such fees as are required by the
provisions of this ordinance.
The Electrical Inspector is hereby empowered to dis-
connect or to order the discontinuance of electrical service
• to wiring, devices or materials found to be defective until
the installation of such wiring device or material has been

made safe as directed by the Electrical Inspector, and
any person, firm, corporation, political subdivision or
governmental agency ordered to discontinue such electrical
service shall do so within 24 hours after the receipt of

such notice and shall not reconnect such service or allow
the same to be reconnected until notified so to do by the
Electrical Inspector."
15.12.170 Addition of Section 105 -8 Section 105 -8
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010 to read:
"105 -8 Right of Entry.
1. The Electrical Inspector, or his duly authorized
representative, shall have the authority to enter any
building or premises for the purpose of investigating the
existence of suspected or reported damage or defects which
constitute an immediate danger to human life or an immediate
hazard to public safety or health.
• 2. Except in emergency situations as defined in Section
105 -8 -1 of this Code, the Electrical Inspector, or his
authorized representative, shall not enter any building or
premises without the consent of the owner or occupant thereof,
unless he possesses an inspection warrant authorizing entry
and search of the premises.
3. No person shall hinder or prevent the Electrical
Inspector or his authorized representative, while in the
performance of the duties hereinbefore described as emergency
situations or while in possession of a valid inspection
warrant from entering upon and into any and all premises under
his jurisdiction, at all reasonable hours, for the purpose of
inspecting the same to determine whether or not the provisions
of this Code and all other applicable laws or ordinances
• pertaining to the protection of persons or property, are
observed therein."

15.12.180 Addition of Section 105 -9 Section 105 -9
is added to the National Electrical Code, hereinbefore adopted

in Section 15.12.010 to read:

-9 Permits. (a) An electrical permit shall be
required whenever any electrical equipment is to be installed
..within or on any building, structure, premises, whether
publicly or privately owned, and shall also be required for
any alteration, addition to or repair of any existing
electrical equipment except as otherwise provided herein.
(b) No electrical permit shall be required for the
following classes of electrical work:
1. Minor repair work, such as the replacement of
lamps or the connection of portable electrical equipment
to suitable permanently installed receptacles.
2. The installation, alteration, addition to or
repair of electrical equipment, installed by or for an
electricity supply agency for the use of such agency in
•.
the generation, transmission, distribution or metering of
electricity.
(c). Submission of any false statement in connection
with the issuance of any electrical permit shall constitute
sufficient cause for a revocation of such electrical permit
by the Electrical Inspector "
15.12.190 Addition of Section 105 -10 Section 105 -10
is added to the National Electrical Code, hereinbefore adopted in
Section 15..12.010, to read:
"105 -10 Monthly Permits for Maintenance Electricians.
(a) In lieu of individual permits for electrical work, a
monthly permit may be issued by the Electrical Inspector
to any person regularly employing one or more Maintenance
Electricians. Such permit shall be issued.on a calendar
•
month basis.
(b) Application for such a monthly permit shall be on
a form provided by the Electrical Inspector and shall

contain the name and registration number of each Mainten-
ance Electrician employed and a description of the
electrical work and the premises on which the electrical
work has been done under such permit
• (c) Each such Maintenance Electrician shall keep a
current detailed and accurate record in duplicate of all
electrical work which has been done by him and such record
shall be available for inspection by the Electrical
Inspector.
(d) Within fifteen (15) days after the end of each
calendar month, the person employing such Maintenance
Electrician shall file his application for such monthly Mainten-
ance Electrician permit with the Electrical Inspector, to which
shall be attached one copy of such Maintenance Electrician's
record of electrical work done during the preceding calendar
month, and shall pay such fees as are required for such
work by this Code. The Electrical Inspector shall then
issue the monthly Maintenance Electrician permit."
• 15.12.200 Addition of Section 105 -11. Section 105 -11
is added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010, to read:
"105 -11 Fees. Payment of Fees. The fees prescribed
herein shall be paid to the Electrical Inspector for the
City of Newport Beach for each electrical installation,
alteration, addition or repair for which an electrical permit
is required. The Electrical Inspector shall not issue an
electrical permit, until all such fees are paid in full."

15.12.230 Addition of Section 105 -14. Section 105 -14 is
added to the National Electrical Code, hereinbefore adopted in Section
15.12.010, to read:
"105 -14 Plan Chocking Fee.
A Flan checking tee shall be paid at the time of submitting
plans as required for all proposed installations where one or more
services or fouders have a disconnecting means with a single or

15.12.240 Addition of Sect_i_on 105 -15. Section 105 -15
is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
"105 -15 Penalty Fee.
Any person who shall commence any electrical work for
which a permit is required by this ordinance without first having
obtained a permit therefor shall, if subsequently permitted to
obtain a permit, pay double the permit fee fixed by this section
for such work provided that this provision shall not apply to
emergency work when it shall be proved to the satisfaction of the
Electrical Inspector that such work was urgently necessary and that
it was not practical to obtain a permit therefor before the
commencement of work. In all such cases, a permit must be obtained
• as soon as it is practical to do so, and if there be an unreason-
able delay in obtaining such a permit, a double fee as herein
provided shall be charged."
15.12.250 Addition of Section 105 -16. Section 105 -16 is
added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010, to read:
"105 -16 Fees - Additional Electrical Work Under Electric
Permit. Whenever additional wiring will result in a deviation
from the electrical work authorized under an electrical permit and
such deviation has been approved by the Electrical Inspector, an
additional fee equal to the difference between the fee paid when
such permit was issued and the fee required for the additional
wiring, plus issuance of permit fee, shall be paid."
15.12.260 Addition of Section 105 -17. Section 105 -17
• is added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010 to read:

105 -17 Pecs for Additional Inspection.
The Electrical Inspector may charge an additional fee
• of $10.00 for each additional inspection that he is required to
make, ,i:: a r(�sult of faulty workmanship or material, or for any
inspection requested before the work inspected has been completed,
made ready for inspection, or before an 'electrical permit has
been obtained."
15.12.270 Addition of Section 105 -18. Section 105 -18
is added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010, to read:
"105 -18 Fees - Temporary Electrical Service.
Whenever the owner or electrical contractor requests
the temporary energizing of a building's electrical system, the
Electrical Inspector when he finds the system safe may authorize
the connection and use of a temporary electrical service for
testing and work with power. A fee of $20 shall be paid to the
• City for one and two family residential buildings and $30 for
all others. When testing is required by the Electrical Inspector
this fee may be waived.
The application for temporary enerai_ zing of the
building's electrical system shall be accompanied by cash, certified
check or cash bond in the amount of $500 for I & J occupancies
and $1000 for all other occupancies. The applicant shall
complete an agreement to be provided by the City agreeing and
guaranteeing that the structure will not be occupied prior to
final inspection and permanent release of utilities. The cash,
certified check or cash bond shall be returned to the applicant
at the time the structure has received final inspection, however,
should the structure be occupied prior to final inspection, said
deposit shall be forfeited and paid to the City to reimburse City
• for its administrative costs in enforcing this code and the
electrical service shall be discontinued until such a time as the
building has rucuved final inspection and authorization for
permanent release of t:7u utilities is granted by the Building
Official.

15.12.280 Addition of Section 1.05 -19. Section 105 -19
is added to the National Electrical Code, hereinbefore adopted in
Section 15.12.010, to read:
"105 -19 Fees - Refunds.
In the event that any person shall have obtained an
electrical permit and no portion of the work or construction covered
by such permit shall have been commenced and such permit shall
have been cancelled as provided for in Section 105 -1(e),
the permittee upon presentation to said Electrical Inspector of a
request therefor, in writing on a special form, shall be entitled
to a refund in an amount equal to 80 per cent of the permit fee
actually paid for such permit.
The Electrical Inspector shall satisfy himself as to
the right of such applicant to such refund and-each such refund
shall be paid as provided by law for the payment of claims against
the City. No refunds shall be made on permits of $6.00 or less
(except permits issued in error) or permits which are more than
one (1) year old.
No portion of the plan checking fee shall be refunded,
unless no checking has been performed on a set of plans, in which
case 90 per cent of the plan checking fee shall be refunded."
15.12.290 Amendment to Section 110 -5. Section 110 -5
of the National Electrical Code, hereinbefore adopted in Section
15.12.010 is amended to read ds follows:
110 -5. Conductors normally used to carry current
shall be of copper ( #6 and larger may be aluminum).
Where the conductor material is not specified, the
sizes given in this code shall apply to copper
conductors. Where other materials are used, the size
shall be changed accordingly.

tables 310 -11; and 310 -15).

15.12.300 Amendment to Section 210 -1. Section 210 -1 of
tic National Electrical Code, hereinbefore adopted in Section
15.12.010 is amended to read:
210 -1. Scope. The provisions of this Article shall
apply to branch circuits supplying lighting or appliance
loads or combinations of such loads. Where motors, or
motor - operated appliances, are connected to any circuit
supplying lighting or other appliance loads, the pro-
visions of both this Article and Article 430 shall apply.
Article 430 shall apply where branch circuit supplies
only motor loads.
(a) Accessory uses or other buildings, signs, etc.,
separately located on the same lot or premises shall
have connecting conductors run underground. (Agricultural
areas excepted.)
(b) Where space circuit protective devices are
provided or space for future circuit protective devices
is provided on the buss in any flush or semi -flush
mounted panel, then raceways of sufficient capacity to
permit utilization of such space or spaces shall be
provided to an approved accessible location. Such
accessible location is defined as follows: Where suf-
ficient attic space is available or underfloor space is
available, a raceway shall terminate conveniently for
future use in each such space. Where this condition
does not exist, then such terminations shall be approved
by the Electrical Inspector.

15.12.310 Amendment to Section 210- 25(b). Section
210 -25(b) of the National Electrical Code, hereinbefore adopted
in Section 15.12.010, is amended to read:

210 -25. Receptacle Outlets Required
(b) At least one receptacle outlet shall be in-
stalled in each basement and garage.
15.12.320 Amendment to Section 210 -25. Section 210 -25
of the National Electrical Code, hereinbefore adopted in Section
15.12.010, is amended by the addition of Exceptions No. 4, No. 5
and (e) to read as follows:
EXCEPTION NO. 4. Garages or carports accessory to
dwelling units shall be wired with a minimum of one
switched light outlet and one receptacle per each two
auto stalls and /or fraction thereof. Said wiring, if
exposed shall be in approved metal raceways. All wiring
to detached accessory buildings shall be run underground.
• EXCEPTION NO. 5. In hotel, motel and multiple
occupancies, receptacle may be omitted.
(e) Minimum Wire Size. For the supply of current
to general appliance and convenience receptacle circuits,
no conductor smaller than No. 12. A.W.G. shall be
installed. No convenience receptacle or appliance
receptacle shall be installed or operated on a general
lighting branch circuit at any time in any occupancy
unless switched.
15.12.330 Amendment to Section 210- 26(a). Section 210 -26(a)
of the National Electrical Code hereinbefore adopted in Section
15.12.010 is amended by the deletion of the word "attached" and now
reads as follows:
(a) Dwelling -Type Occupancies: At least one wall
switch controlled lighting outlet shall be installed in
every habitable room; in hallways, stairways and garages;
and at outdoor entrances. At least one lighting outlet

shall be installed in attic, under floor space, utility
room and basement where used for storage or containing
• equipment requiring servicing.
15.12.340 Amendment to ArLi.cle 215 of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended by adding Section 10 to read as follows:
11215 -10 All feeder conductors shall be installed
in an approved raceway."
15.12.350 Amendment to Section 230 -43 of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
"230 -43 Wiring methods for 600 Volts or less.
Service entrance conductors extending along the
exterior or entering buildings or other structures
shall be enclosed in rigid metal conduit to the
first over current device, or for circuits not
• exceeding 600 Volts in wire ways auxiliary gutters
or as busways.
15.12.360 Amendment to Section 230 -71(a) of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
"230 -71(a) Disconnection from service conductors.
A single fusible switch or automatic circuit breaker
shall be provided to disconnect all underground con-
ductors supplying each separately metered occupancy.
15.12.370 Amendment to Section 250 -83 of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
"250 -83 Made Electrodes. Where electrodes
described in Section 250 -81 and 250 -82 are not
• available, the grounding electrode shall consist of:
(a) Not less than 20 feet of bare copper conductor
not smaller than No. 4; or not less than 20 feet

of No. 4 ;steel reinforcing bar; or not less
than 20 feet of 3/4 inch galvanized steel
conduit; or an approved equal installed as
• follows:
The electrode shall be located in the bottom
of the foundation footing with minimum concrete
encasement of 3 inches. One end of the electrode
shall extend out of the foundation adjacent to the
equipment to be grounded to permit the grounding
conductor to be secured by an approved method.
EXCEPTION: Where the above method is not practical, the
following electrodes may be used upon approval of the
enforcing authority.
(b) Plate Electrodes. Each plate electrode shall present
not less than 2 square feet of surface to exterior
soil. Electrodes of iron or steel plates shall be
• at least 1/4 inch in thickness. Electrodes of
nonferrous metal shall be at least 0.06 inch in
thickness.
(c) Pipe Electrodes. Electrodes of pipe or conduit
shall be not smaller than of the 3/4 inch trade size
and where of iron or steel, shall have the outer
surface galvanized or otherwise metal- coated for
corrosion protection.
(d) Rod Electrodes. Electrodes of rods of steel or iron
shall be at least 5/8 inch in diameter. Approved
rods of nonferrous materials or their approved
equivalent used for electrodes shall be not less
than 1/2 inch in diameter.
15.12.380 Amendment to Section 250 -91(b) of the National
Electri.cal'Code, hereinbefore adopted in Section 15.12.010, is
• amended to read:
EXCEPTION NO. 1: Flexible metal conduit shall be permitted
for grounding if all the following conditions are met.
(a) The circuit conductors contained therein are protected
by over- uurrunt devices riyted at 20 amperes or less.

(b) The conduit is term.i.nated in fittings approved for
the purpose.
15.12.390 Amendment to Section 250 -91(b) of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
250- 91(b`. The conduit is terminated in fittings
approved for the purpose_
EXCEPTION NO. 2: Liquid tight flexible metal conduit
shall be permitted for grounding in the 1 -1/4 inch
and smaller trade sizes if the conduit is terminated
in fittings approved for the purpose.
15.12.400 Amendment to Section 300 -13 (b) of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
"300 -13(b) In all circuits the continuity of con-
ductors shall not be dependent upon device connections,
such as lamp holders, receptacles, etc. where the
removal of such devices would interrupt the continuity."
• 15.12.410 Amendment to Section 334 -6 of the National
Electrical Code, hereinbefore adopted in Section 15.12.010, is
amended to read:
11334 -6 USE. Except where otherwise specified
elsewhere in this Code, and where not subject to
physical damage, metal clad cable may be installed
for branch circuits and feeders in concealed work as
follows:
(a) Type MC. This type of power cable may be used in
partially portected areas, such as in continuous
rigid cable supports and the like in dry locations
and when any of the following conditions are met
it may be used in wet locations:
(1) The metallic covering is impervious to
• moisture.
(2) A lead sheath or moisturo impervious
jacket i:: provided under the metal covering.

(3) The insulated conductors under the
metallic covering are approved for use
in wet locations. (See Section 300 -5).
(b) Type AC. Metal -clad cable of the AC type
may be used in dry locations; for under plaster
extensions as provided in Article 334; and embedded
in plaster finish on brick or other masonry, except
in damp or wet locations. This cable may be run
or fished in the air voids of masonry block or tile
walls; where such walls are exposed or subject to
excessive moisture or dampness or are below grade
line, Type ACL cable shall be used. This cable
shall contain lead covered conductors (Type ADL),
if used where exposed to weather or to continuous
moisture, for underground runs; and embedded in
masonry, concrete or fill in buildings in course
of construction, or where exposed to oil, or other
conditions having a deteriorating effect on the
insulation. Type AC metal -clad cable shall not be
used where prohibited elsewhere in this Code, in-
cluding (1) in theatres, except as provided in
Section 520 -4; (2) in motion pictures studios; (3)
in any hazardous locations; (4) where exposed to
corrosive fumes or vapors or to weather; (5) on
cranes or hoists, except as provided in Section
610 -11 Exception No. 3; (6) in storage battery rooms;
(7) in hoistways or on elevators, except as provided
in Section 620 -21; or (8) commercial garages where
prohibited in Article 511; (9) Type AC or ACL Metal -
clad cable may only be used in single family and
duplex dwellings and their accessory buildings.

not be used for exposed wiring and shall only be used
for concealed wiring on single family or duplex dwell-
ings or in apartment houses of type V construction and
not over three (3) stories in height or 21,000 square
feet in area as follows:
(a) Type NM. This type of non - metallic sheathed
cable may be installed for concealed work in normally
dry locations. It may be installed or fished in air
voids in masonry block or tile walls where such walls
are not exposed or subject to excessive moisture or
dampness. Type NM cable shall not be installed where
exposed to corrosive fumes or vapors; nor shall it be
• embedded in masonry or concrete and covered with plaster.
or similar finish.
(b) Moisture and Corrosion - Resistant Type N.MC.
This type of non - metallic sheathed cable may be installed
for concealed work in dry, moist, damp or corrosive
locations, and in outside and inside walls of masonry
block or tile. Where embedded in plaster or run in
shallow chase in masonry walls and covered with plaster
within two inches of the finished surface, it shall be
protected againstdamage from nails by a cover of corrosion -
resistant coated steel at least 1/16 inch in thickness
and 3/4 inch wide in the chase or under the final
surface finish."
15.12.430 Amendment. to Section 336 -6. Amendment to
Section 336 -6 of the National Electrical Code, hereinbefore
isadopted in Section 15.12.010 is amended to read:

15.12.440 /auendmcnt to Section 348 -1. Amendment to
Section 348 -1 of the National Paectrical Code, hereinbefore adopted
in Section 15.12.010 is amended to read:

"348 -1 USE. Electrical metallic tubing may be used
for both exposed and concealed work inside of structures.
Electrical metallic tubing shall not be installed in
a manner which will cause it to be exposed to the outside
air or weather conditions. Electrical metallic tubing
protected from corrosion solely by enamel shall not be
used. Electrical metallic tubing shall not be used (1)
where during installation or afterwards, it will be
subject to severe physical damage; (2) for installation
underground or in concrete. Where practicable the use
of dissimilar metals throughout the system shall be
avoided to eliminate the possibility of galvanic action.
(See Section 300 -4 for limitation in the use of ferrous
raceways and fittings protected from corrosion solely
by enamel."
Section 15.12.450 Amendment to Section 350 -2. Amend-
ment to Section 350 -2 of the National Electrical Code, hereinbefore
adopted in Section 15.12.010 is amended to read.
"350 -2. USE. Flexible metal conduit shall not be
used (1) in wet locations, unless conductors are of
the lead- covered type or of other type specifically
approved for the conditions; (2) in hoistways, except
as provided in Section 260 -21; (3) in storage battery
rooms; (4) in any hazardous location except as permitted
in Section 501 -4(b), 502 -4 and 503 -3; nor (5) where
rubber - covered conductors are exposed to oil, gasoline,
or other materials having a deteriorating effect on
rubber; (6) for installation underground, exposed to
the water, embedded in masonry, concrete, adobe,
plaster or similar finish; (7) where exposed to physical
damage.
• Section 15.12.460 Amendment to Section 350 -5. Amendment
to Section 350 -5 of the National Electrical Code, hereinbefore

"350 -5 Grounding. 1?lexible metal conduit shall
be permitted as a grounding means where conduit is
terminated in fittings approved for the purpose."
Section 15.12.470 Amendment to Section 410 -8. Amend-
ment to Section 410 -8 of the National Electrical Code, hereinbefore
adopted in Section 15.12.010 is amended by adding the following:
"(c) All lighting outlets shall be operated by a
wall or door switch (no pull chain lighting fixtures
permitted.)"
Section 15.12.480 Amendment to Section 422 -5. Amend-
ment to Section 422 -5 of the National Electrical Code, hereinbefore
adopted in Section 15.12.010 is amended by adding the following:
"(c) In every dwelling unit fixed appliances, such
as food grinders, dishwashers, washing machines, dryers,
• laundry tray locations, built -in heaters, or any other
fixed appliances with 1/4 H.P. or larger shall be on a
separate branch circuit supplied by a minimum No. 12
A.W.G. Wire.. Each dwelling unit shall have installed
therein an individual food waste grinder branch circuit.
Said circuit shall be supplied with.a minimum No. 12
A.W.G. Wire and a 15 ampere indicating type switch.
Said switch shall be located in the wall adjacent to the
sink. Food waste grinder shall be wired with a minimum
of No. 16 A.W.G. 3 wire S.P.T. -3 thereto- plastic hard
finish cord or equal and an approved grounding type,
cord grip cap must be used."
SECTION 2. This Ordinance shall be published once in
the official newspaper of the City, and the same shall be effective
thirty (30) days after the date of its adoption.
