HomeMy WebLinkAbout90-35 - Amending a Portion of Districting Map No. 18 so as to Reclassify One Portion of the Subject Property from the R-1 District to the R-2 District, Another Portion from the R-2 District to the R-1 SPR District and Another Portion from the R-1 DistrictORDINANCE NO. 90 -35 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 18 SO AS TO RECLASSIFY ONE PORTION OF THE SUBJECT PROPERTY FROM THE R -1 DISTRICT TO THE R -2 DISTRICT, ANOTHER PORTION FROM THE R -2 DISTRICT TO THE R -1 SPR DISTRICT AND ANOTHER PORTION FROM THE R -1 DISTRICT TO THE R -1 SPR DISTRICT, AND TO ESTABLISH ON THE DISTRICTING MAP, 10 FOOT FRONT YARD SETBACKS ON BOTH THE IRIS AVENUE AND OCEAN • BOULEVARD FRONTAGES. (AMENDMENT NO. 713) THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN, AS FOLLOWS: SECTION 1. Districting Map No. 18 is hereby amended for the property located at 126 -130 Iris Avenue, on the southeasterly corner of Iris Avenue and Ocean Boulevard, being comprised of Lots 30, 32, and 34, Block A -36, Corona del Mar, and located at 3016 Breakers Drive, on the northerly side of Breakers Drive, easterly of Iris Avenue, being comprised of Lot 1, Tract No. 1026, as follows: 0 a.) Change the zoning designation from the R -1 District to the R -2 District, and establish a 10 foot front yard setback on Ocean Boulevard on the following property: Beginning at the most easterly corner of said Lot 34; thence S 40°0'00" W along the southeasterly lines of said Lots 34, 32 and 30, a distance of 67.09 feet; thence N 21° 55'03" E 61.87 feet to a point on the northeasterly line of said Lot 34; thence southeasterly in a direct line, a distance of 20.69 feet to the Point of Beginning. b.) Change the zoning designation from the R -2 District to the R -1 SPR District on the following property: That portion of Lot 1, Tract No. 1026 in the City of Newport Beach, • County of Orange, State of California, as shown on a map filed in Book 33, Page 38 of Miscellaneous Maps, in the office of the Recorder of said County, said portion being more particularly described as follows: -1- u • Beginning at the most westerly corner of said Lot 1, said corner also being a point on a curve concave to the south and having a radius of 250.00 feet, said curve being in the southerly boundary of said lot; thence southeasterly along said curve and boundary, through a central angle of 4° 5553 ", an arc length of 21.52 feet; thence N 21° 55'03" E 61.63 feet to a point on the northwesterly line of said lot; thence S 40° 00'00" W along said northwesterly line, a distance of 69.23 feet to the Point of Beginning. C.) Change the zoning designation from the R -1 District to the R -1 SPR District, and establish a 10 foot front yard setback on Iris Avenue and Ocean Boulevard on the following property: Commencing at the most easterly corner of said Lot 34; thence N 730 18'21" W along the northeasterly line of said lot a distance of 20.69 feet to the True Point of Beginning; thence continuing N 730 1821" W along said northeasterly line, a distance of 30.18 feet to the beginning of a tangent curve concave to the southeast and having a radius of 64.50 feet; thence southwesterly along said curve, through a central angle of 66° 41'39 ", an arc length of 78.57 feet; thence S 40 °00'00" W 35.10 feet to the southwesterly line of said Lot 30; thence southeasterly in a direct line, a distance of 90.78 feet to the most southerly corner of said Lot 30; thence N 40 °00'00" E along the southeasterly line of said Lot 30, a distance of 18.12 feet; thence N 21° 55'03" E 61.87 feet to the True Point of Beginning. SECTION 2. The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 18 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes described in Section 1 (above), and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the Newport Beach Municipal Code. -2- • • • SECTION 3. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its adoption. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 13th day of August, 1990, and adopted on the 27th day of August, 1990, by the following vote, to wit: ATTEST: - < .:..
