HomeMy WebLinkAbout94-39 - Amending Title 20 of the Newport Beach Municipal Code By Amending Portions of Districting Map No. 48 so as to Reclassify Property at the Westerly Corner of Newport Center Drive and Granville Drive from the U District to the APF(5,000sf) District,ORDINANCE NO. 94 -39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE BY AMENDING PORTIONS OF DISTRICTING MAP NO. 48 SO AS TO RECLASSIFY PROPERTY AT THE WESTERLY CORNER OF NEWPORT CENTER DRIVE AND GRANVILLE DRIVE FROM THE U DISTRICT TO THE APF[S,OOOsfJ DISTRICT, AND TO RECLASSIFY THE REMAINDER OF THE PROPERTY PREVIOUSLY KNOWN AS THE GRANVILLE APARTMENTS FROM • THE U DISTRICT TO THE MFR(69du) DISTRICT, AND ESTABLISH VARIOUS FRONT YARD SETBACKS ON DISTRICTING MAP NO. 48 WHICH PERTAIN TO EACH OF THE PROPERTIES. (PLANNING COMMISSION AMENDMENT NO. 805) WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning designation of Districts and other provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, the Planning Commission has recommended to the City Council the adoption of General Plan Amendment No. 94 -1(A) and Local Coastal Program Amendment No. 34 so as to change the land use designation of the property located at the westerly corner of Newport Center Drive and Granville Drive from "Multi Family Residential" to "Administrative Professional and Financial Commercial" uses; and • WHEREAS, the remainder of the subject property previously known as the Granville Apartments is currently zoned Unclassified; and WHEREAS, land use decisions are legally required to be consistent with the City's General Plan and Zoning; and WHEREAS, in conjunction with the consideration of the above referenced amendments to the General Plan and Local Coastal Program Land Use Plan, the project has been determined to be Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 3 (New Construction or Conversion of Small Structures); and WHEREAS, pursuant to Section 20.84.030 of the Municipal Code, the Planning • Commission and the City Council have held duly noticed public hearings to consider Amendment No. 805 to Title 20 of the Newport Beach Municipal Code amending a portion of Districting Map 48; and WHEREAS, the Planning Commission has recommended that the City Council approve Amendment No. 805 to Title 20 of the Newport Beach Municipal Code amending Districting Map, No. 48. NOW THEREFORE, the City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1. Districting Map No. 48 is hereby amended for the property located at at the westerly corner of Newport Center Drive and Granville Drive, changing •the zoning designation from the "U District" to the "APF[S,OOOsfj District ", and reclassify the remainder of the property remainder of the property previously known as the Granville Apartments from the "U District" to the "MFR(69du) District ", and to establish various front yard setbacks on Districting Map No. 48 for the following described property: That the property located at the westerly corner of Newport Center Drive and Granville Drive, more particularly described as Lot 10, Tract No. 14839 be reclassified from the U District to the APF[S,OOOsfj District; that the remainder of the property previously known as the Granville Apartments and more particularly described as Lots 1 -9 and Lots "A" and 'B" of Tract No. 14839 be reclassified from the U District to the MFR(69du) District. The front yard setbacks to be designated on the Districting Map shall be 3 feet along the westerly side of Lots 1 and 2, adjacent to the golf course; 15 feet along the easterly side of Lots 1 and 2, adjacent to Granville Drive; 10 feet along the westerly side of Lots 3, 4, 7, 8, 9 and 'B ", adjacent to Granville Drive; 20 feet along the westerly side of Lots 5, 6 and 10, adjacent to Granville Drive; 35 feet along the southerly side of Lot 10, adjacent to Granville Drive; and 35 feet along the easterly side of Lot 10, adjacent to • Newport Center Drive. SECTION 2. The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 48 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes described in Section 1 above, and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the Newport Beach Municipal Code. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its • adoption.
