HomeMy WebLinkAbout98-9 - Approving Amendments to Districting Map Number 4 to Reclassify Property Located in the 3300 Block of Via Lido from the RSC District to the MFR District [Amendment 868]ORDINANCE 98 -09 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING AMENDMENTS TO DISTRICTING MAP NUMBER 4 TO RECLASSIFY PROPERTY LOCATED IN THE 3300 BLOCK OF VIA LIDO FROM THE RSC DISTRICT TO THE MFR DISTRICT [AMENDMENT 8681 WHEREAS, an application has been filed proposing the reclassification of the property located at 3312 to 3336 Via Lido from the Retail and Service Commercial (RSC) District to the Multi - Family Residential (MFR) District; and WHEREAS, on February 5, 1998, Planning Commission of the City of Newport Beach held a public hearing this amendment; and WHEREAS, on March 9, 1998 and April 13, 1998, the City Council of the City of Newport Beach held public hearings regarding this amendment; and • WHEREAS, the public was duly noticed of the public hearings; and WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 5, minor alterations in land use limitations. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Districting Map Number 4 shall be amended to read as provided in attached Exhibit "A." SECTION 2: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. A parcel map be recorded prior to issuance of Building Permits unless otherwise approved by the Public Works and Planning Departments. That the parcel map shall be prepared on the California coordinate system (NAD83) and that prior to recordation of the parcel map, the surveyor /engineer preparing the map shall submit to the County Survey and the City of Newport Beach or a digital - graphic file of said map in a manner described in Sections 7 -9 -330 and 7 -9 -337 of the Orange County Subdivision Code and the Orange County Subdivision Manual, Subarticle 18. 2. Prior to recordation of the parcel map, the surveyor /engineer preparing the map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner described in Sections 7 -9 -330 and 7 -9 -337 of the Orange County Subdivision Code and the Orange County Subdivision Manual, Subarticle 18. Monuments (one inch iron pipe with tag) shall be set on each lot corner unless otherwise approved by the Subdivision Engineer. Monuments shall be protected in place if installed prior to completion of the construction project. 3. All improvements be constructed as required by Ordinance and the Public Works Department. • 4. Arrangements be made with the Public Works Department in order to guarantee satisfactory completion of the public improvements, if it is desired to record a parcel map or obtain a building permit prior to completion of the public improvements. 5. Each dwelling unit shall be served with an individual water service and sewer lateral connection to the public water and sewer systems unless otherwise approved by the Public Works Department and the Building Department. 6. The intersection of the private driveways with Via Lido be designed to provide sight distance for a speed of 30 miles per hour unless otherwise approved by the Traffic Engineer. 7. County Sanitation District fees be paid prior to issuance of any building permits. 8. The deteriorated sidewalk be reconstructed along the Via Lido frontage without color additives, that the unused drive aprons be removed and replaced with curb, gutter and sidewalk along the Via Lido frontage and that the parking meters be relocated to the satisfaction of the Traffic Engineer. All work shall be completed under an encroachment permit issued by the Public Works Department. 9. A condition survey of the existing bulkhead along the bay side of the property be . made by a civil or structural engineer, and that the bulkhead be repaired in conformance with the recommendations of the condition survey and to the • • 0 STATE OF CALIFORNIA } COUNTY OF ORANGE } as.
