UP AND ABANDON FOR pE#AI,IC.STREET PURPO A. CERTAIN PORTION OF SMFLTZER AVENUF AND % ERTAIN.ALLEY WITHIN THE SAID CITY. follows: The Boa rd of Trustees of the City of Newport Beach do resolve as SECTION 1. It is the intention of the Board of Trustees to order that portion of a public street and an alley, hereinafter described, within the said City, to be closed up, vacated and abandoned for public street purposes; the said portions of said street and alley to be closed up, vacated and abandoned for public street purposes and described as follows, to —wit: (a) All that portion of Smeltzer Avenue within the said City from the northwesterly prolongation of said Ocean Avenue is laid out and port Heights as recorded in Misce Orange County, California, to the 12th Street is laid out and shown to Newport Heights. the southwesterly line of Ocean Avenue, as shown upon a Map of First Addition to New - 11aneous Maps Book 4, Page 94, Records of southwesterly line of 12th Street, as.-.said upon the aforesaid Map of First Addition (b) All that portion of the alley extending northwesterly and southeasterly through the northerly portion of Block 11 of a Map of First Addition to Newport 'Heights as recorded in Miscellaneous Maps Book 4, Page 94, Records of Orange County, California, from the northwesterly line of 6anta Ana Avenue to the southeasterly line of Smeltzer Avenue, as said Santa. 0 Ana Avenue and Smeltzer Avenue are laid out and shown upon the aforesaid Map' of First Addition to Newport Heights. il. SECTION 2, • That the public work herein provided for is the closing.up of • the portions of the street and alley herein described in Section 1 and it appearing to the Board of Trustees that there are no costs, damages or ex- penses occasioned by or arising out-xif said work and that no assessment is necessary to pay the costs, damages or expenses of said work and that, therefore, no assessment district of lands to be effected or benefited by said work or improvement is necessary. SECTION 3. The Street Superintendent of the City of Newport Beach is hereby directed to cause to be conspicuously posted along the line of said contem- plated improvement, at not more than three hundred feet in distance apart upon said street and not less than three in Lill upon said street, notices cf the passage of this resolution, said notice to be headed, "NOTICE OF PUBLIC FFORR ", in letters not less than one inch in length and stating the fact of the passage of this resolution, its date and briefly the work of Sme /fz er ArP ,Yee and �q//eyy improvement proposed,being that of vacating the portion of Jbmjmd a he-re- in described, and the said notice shall refer to this resolution for fur- ther particulars; the said Street Superintendent shall also cause a simi- lar notice to that herein described, to be published by.four successive insertions in the Newport News, a weekly newspaper, printed, published and circulated in said City of Newport Reach (there being no daily newspaper so printed published and circulated in said City). SECTION 4. The City Clerk shall certify to the passage of this Resolution and cause a minute thereof to be recorded in the minutes of the meeting of the Board of Trustees at which this resolution was passed.
